WASHINGTON (AP) —Defense Secretary MarkEsper said Monday thatPresident Donald Trumpordered him to stop a dis-ciplinary review of a NavySEAL accused of battlefieldmisconduct, an interventionthat raised questions aboutAmerica’s commitment tointernational standards forbattlefield ethics.

Esper, who initially fa-vored allowing the Navyto proceed with a peer-re-view board for Chief PettyOfficer Edward Gallagher,which could have resultedin him losing his SEAL sta-tus, said he was obliged tofollow Trump’s order. Buthe also directed the Penta-gon’s legal office to reviewhow service members aretrained on wartime behav-ioral standards.

“I can control what I cancontrol,” Esper told report-ers when asked whetherTrump sent the right mes-sage to U.S. troops by inter-vening to stop the Gallagherreview. “The president isthe commander in chief. Hehas every right, authorityand privilege to do what hewants to do.”

Gallagher was acquittedof murder in the stabbingdeath of an Islamic Statemilitant captive but convict-ed by a military jury of pos-ing with the corpse while in

Iraq in 2017.In another twist, Esper

also made an extraordinaryaccusation against RichardSpencer, whom he fired onSunday as the civilian lead-er of the Navy. Esper saidSpencer had gone behindhis back to propose a secretdeal with the White House inwhich Spencer would fix theoutcome of the Gallagherreview. Spencer, in a resig-nation letter Sunday, said hecould not in good consciencefollow an order that he be-lieved would undermine theprinciple of good order anddiscipline in the military –suggesting that he had beenordered to stop the peer-re-view process for Gallagher.

Some military experts ex-pressed concern that the in-tervention of a president ina matter of military justicecould undermine the cred-ibility of America’s claimsto be a leader in ethical andlawful behavior on the bat-tlefield.

“What concerns me themost is the chilling effectthis will have on specialforces’ willingness to reportwhen they see illegal behav-ior,” said James Stavridis, aretired Navy admiral. “Thatis tragic because in the endwhat separates us from ouropponents on the battlefieldis our willingness to followthe rule of law.”
