SUBMISSION ON AN APPLICATION FOR RESOURCE CONSENT UNDER SECTION 96 (1) OF
THE RESOURCE MANAGEMENT ACT 1991

1. This is a submission on an application by GBC Winstone for a Resource Consent for land use. Council Refs:
LU1700100.
2. The application is to place overburden from existing Otaika Quarry onto adjoining land zoned countryside
environment and partially within mineral extraction area, as defined in Operative Whangarei District Plan. The
proposal requires consent as a Discretionary Activity.
The specific parts of the application that this submission relates to are those parts which address air
quality, particularly potential adverse health and amenity effects due to the proposal’s close
proximity (adjacent) to residential area(s), and the adequacy of any proposed conditions of consent in
the event that consent is to be granted.
3. The applicant is specifically put on notice about the following matters:
A. Inappropriate source data – the applicant has used meteorology from locations that our air quality
expert does not consider representative despite the presence of (limited) site-specific meteorology
associated with particulate monitoring.
B. Monitoring data shows occasional exceedance of Ministry for the Environment Good Practice Guide
suggested trigger levels for total suspended particulate (TSP) at a residential site now (i.e. before the
activity commences when existing operations are more than 300 metres distant).1 The applicant
states “the Otaika Quarry appears to be the main source of TSP at the monitoring location”. It is
reasonable to assume that additional activities, in closer proximity, will only increase levels of
particulate at adjacent residences.
C. The applicant has not assessed respirable crystalline silica – an established potential public health
issue for residents adjacent to the applicants’ other quarry in Canterbury.2 These two quarries are
mining the same type of rock (greywacke, which contains silica).
D. The applicant has not assessed particulate matter less than 10 microns in diameter (PM10) against the
national environmental standards for air quality. Elevated PM10 levels are also an established
potential public health issue for residents adjacent to the applicants’ other quarry in Canterbury.3
4. This submitter opposes grant of consent for the application.
5. The reasons for this submission are:
The lack of any separation distance between the proposed activity and adjacent residences;

To avoid potentially significant adverse effects (i.e. potential exceedance of health-based standards
and guidelines for PM10 and respirable crystalline silica) at adjacent residences; and
To promote the reduction of adverse environmental effects on the health of people and communities
and to improve, promote and protect their health pursuant to the New Zealand Public Health and
Disability Act 2000 and the Health Act 1956.
These statutory obligations are the responsibility of the Ministry of Health and NDHB
The Ministry of Health requires this submitter to reduce potential health risks by means including submissions
on resource consents to ensure the public health significance of potential adverse effects are adequately
considered by consent authorities.
6. The decision sought is to refuse consent.
7. This submitter is not a trade competitor of the Applicant for the purposes of s.308B of the Act.
8. This submitter will wish to be heard in support of this submission but will not be prepared to consider

Modern commercialendeavours, moreover, may not be of the kind that people have been taught toassociate with waste minimization. The endeavours involve battles fought withthe most bathetic instruments, two-for-the-price-of-one specials, sticker basedbribes like red and yellow tag bargains, and free stickers of the All Blacks, butthey are battles nevertheless, comparable in their intensity and demands tohunting and gathering through the forests of pre-European-Aotearoa. Therefore,the big question is How can the Whangarei District councillors managebusinesses and households’ consumerism with attaining waste minimization orreduction? Most of the councillors’ effort will focus on keeping the Vision sharp
and distinct at all times. They will be wise to remember that at the heart of wastereduction lies an imperative which is undoubtedly urgent and simple, namelysurvival. They will be preoccupied with the ancient task of trying to stay alive,which simply happens to require, in a consumer economy overwhelmingly basedon the satisfaction of peripheral desires, activities of waste management that areprecise and rule-bound, regular and punctual, and that honour beauty and nature.

Swag are opposed to the granting of the above Resource Consent application for the Disposal of
Overburden.
SWAG is an action group formed to preserve and and maintain the safety and general
quality of life in our community and to promote a long term vision for Southern
Whangarei and as such find GBC Winstones proposal to dispose of overburden on the
Pegram Block is not in the interest of the nearby residents, the Blue Goose future tourist
developments nor in the interest of the many users of the sport grounds and the proposal is
in conflict with the vision we have for entrance to Whangarei; we would like to see WDC
to showcase the entrance. GBC Winstones Otaika Quarry is close to entrance to
Whangarei, with the quarry access way on a junction with SHl. The Pegram Block is
about 1.4kms from Whangarei Harbour and about 3.6kms from the CBD and because of
this location the conflicts are complex and numerous.
Overburden is an unavoidable product of quarrying. By its very nature quarrying results in
permanent damage to the landscape. It is large scale and intrusive. By seeking to use the
Pegram Block for the disposal of overburden, Winstone’s operations would intrude further
into the neighbouring communities bringing more adverse effects of dust, dirt, noise, and
vibration in close proximity.
Otaika Quarry and the residents both need certainty by managing incompatible land uses.
A 300 metre interface was established legally during the Acacia Park subdivision consents.
(see Russell Mcveagh’s 1995 letter attachment #1). The MEA buffer around the Quarry,
with the 500m setbacks, precisely and absolutely separate conflicting land uses and thus
should remain.
From GBC Winstones website: ’Non-residential ’buffer zones’ protect neighbours from
noise and dust around our quarries’ - see attachment # 2
’Shelter belts of native trees endemic to the area are planted wherever possible’ -
Contrary to this, we note they plan to plant willows, acacias (blackwood) and
poplars on the Pegram Block.
Other reasons:
1. GBC Winstones is socialising their business problems onto the community: visual
amenity, dust, noise, vibration are a major components of the overall negative impact
and locals and residents already put up with dust and noise nuisance, unsocial hours,
vibrations, blasts, and a higher maximum noise limits.
2. The proposed disposal of overburden on the Pegram Block is excessive- 2.4 million
cubic metres on land that is marked as unstable on WDC maps. This proposed weight
and mass could affect surrounding water courses according to Professor Jarg Pettinga. 3. The timeframe is too long. 35+ years is permanent, not temporary and the adverse
effects could be passed to the next generation of owners.
4. Residents should be able to live in peaceful surroundings. 5. We are also concerned because this could potentially have a huge impact on other
bodies such as the environment and the harbour, visitors and tourists, recreational
areas, and the noise and dust nuisance could be a health hazard and it is highly likely
to devalue surrounding property and making them difficult to sell for over 35+ years. 6. Winstone’s Quarry has been operating for over 50 years. Suddenly overburden has
become an urgent problem with only one solution and that solution has a significant
unpropitious impact on their immediate neighbours. 7. A change to MEA would allow a ~ industrial activity adjacent to well-established
Living 1 and 3 environments, which would not be compliant to RMA amenity and
reverse-sensitivity rulings, on land that is designated L1, L3 and countryside. 8. A Mineral Extraction Management Plan, regarding overburden, should exist viz.
64.3.1, v. The Plan should include the proposed location and dimensions of
overburden storage and deposition areas and stockpiles of mineral material.
Landowners and ratepayers should not be the bandaid to poor business management
nor operational problems. 9. Quarry and residents should be separated by a buffer. Environment Court Winstone
Aggregates v Auckland Regional Council A49/2002 - where it was held that effects
such as noise and vibration could not reasonably and economically be contained
within the site and a reverse-sensitivity buffer was imposed. This means that the
area, the entrance to Whangarei, within 4 kIns of the CBD, about 1.2 kilometres from
Whangarei Harbour.
Therefore it is up to Regional Council, WDC and the Environmental Court, with use of
objectives, structure plans, rules and the RMA(1991) to constrain industrial activities and
manage environmental effects for the health, wellbeing and safety for current and future
generations and because of our concerns above, SWAG would request the local authorities
to support the ratepayers and residents to retain a buffer.
In this case it should be people first. Residents, landowners, rate-payers should be entitled
to certainty and should be entitled to a healthy peaceful existence.
We would like WDC to show case the entrance of Whangarei, with tourism and the
Hundertwasser building, becoming ever more important to the district’s economy. This is
an unique diverse area, there are numerous aspects to weigh up against each other. The
Otaika, Raumanga, Toe Toe Structure Plan 2009 recognises this and identifies a number of
opportunities.

1. We act for Wtnstone Aggregates Limited (’Wmstone"). Our client has referred to
us your letter of 11 September 1995 regarding the above subdivision on land
adjacent to Wtnstone’s Otaika quarry.
2. Winstone wishes to place on record its concern regarding residential activity in close proximity to the Otaika quarry. Tbe coropa..l1y’S vieVl! is that r~sidentlal a...’1d
rural residential development and quarries are incompatible in close proximity to one another. New residential developments should be directed away from
mineral resource areas, and particularly from operating quarries (as from other forms of industry).
3. The Otaika quarry contains reserves of very good quality aggregate and is a resource of major district and regional significance. The location of residential
development in close proximity to the quarry will have an adverse effect on
quarry operations in that it will constrain the way Winstone normally operates its quarry.
4. As you are aware, the Resource Management Act 1991 ("RMA") imposes a duty on all landowners and occupiers to avoid adverse effects on the environment
aristng from activities carried on by them. The areas adjacent to quarries are
commonly subject to the effe ts of noise and vibration from blasting. With

residential activity in close proximity to the quarry, Winstone would be restrained
from operating and continuing its long term development of the Otatka quarry in the way it might otherwise do so, particularly in carrying out blasting activities. As the Council is aware, if Winstone’s quarrying activities have an adverse effect
on adjoining residential land, then any owner of that land could bring an action in nuisance or apply for an enforcement order to stop those activities. Permitting residential activities to locate in close proximity to the quarry could therefore
compromise the long term productive use of the mineral resource. This effect on Winstone’s operation of the quarry is a potential effect on the environment which the Council must take into account when considering the application.
5. For a llUmbe.l" of years, Winstone has taken action to ensure that residential
activity does not come too close to the quarry. For example, in the mid-1980’s Winstone requested the Council to include a notation on its planning maps indicating that ground vibration could occur within 1,000 metres of quarry workings. At that time, the need for a buffer area around the quarry was also considered by the Council and it was proposed that this be a matter included in the next review of the district plan. Winstone has also made submissions on the draft strategy documents which have preceded the formulation of a new district
plan. Those submissions stressed the importance of buffering the quarry from
encroaching residential activity.
6. In our view, the potential adverse effects of the subdivision proposal could be
remedied or mitigated by the imposition of a 500 metre buffer area in which no
dwelling units are allowed between the quarry boundary and the subdivision. In its present form, the subdivision plan fails to provide fully for such a buffer area as part of proposed lot 3 and almost half of proposed lot 18 are within 500 metres of the quarry boundary. If the subdivision were permitted as currently
proposed, a dwelling could be erected or a multi-unit development take place anywhere on those lots, bringing residences within 500 metres of the quarry.
7. Winstone therefore seeks an amendment to the subdivision scheme plan so that
no lots for residential purposes are located within 500 metres of the Otatka
quarry boundary. In our view, unless such amendments are ma e to the
subdivision scheme plan, the proposed activity would have adverse effects upon Winstone as the neighbouring occupier of the quarry which are more than minor. In our view, unless the suggested amendments are made, the application w11l have to be publicly notified because it would fail the tests contatned in section
94(2) of the RMA.
8. We also note that there is support for such an amendment to the scheme plan in the subdivision policies contained in the Transitional District Plan. In particular, a subdivision must have regard for the characteristics of adjoining land and the
present and likely future pattern of development of that land.

applicant to redesign the subdivision scheme plan to ensure that no lots for residential purposes are within 500 metres of the quarry boundary. or that other
means are found to exclude dwelling units from this buffer area.

There are many ways we work to be a good neighbour in the community and to achieve positive environmental outcomes:
All management staff at our 26 sites are encouraged to engage in open and active communications with all their neighbours, building strong and positive links with the local
community. In this way, concerns around such issues as environmental management and
operational capability can be discussed and acted upon. At our larger quarries this
process has been formalised through the establishment of Site Liaison Groups. We have public open days and school trips, field trips and excursions on site for students Non-residential ’buffer zones’ protect neighbours from noise and dust around our
quarries Shelter belts of native trees endemic to the area are planted wherever possible We regularly go over and above our council consent requirements to ensure positive environmental and community relations

INTRODUCTION

THE PROPOSAL
In general we support this proposal.
Aggregate is a significant resource for the Northland region. A sustainable supply of
aggregate is essential for continued development to enable people and communities
to provide for their social, economic and cultural well-being. This is not only required
to provide for building, construction and roading projects associated with growth,
but also to maintain and redevelop existing infrastructure.
The Otaika quarry is Northland’s largest supplier of aggregate and is an extremely
important aggregate resource for the region.
The Northland Chamber of Commerce is concerned that if the proposed overburden
disposal area for Otaika Quarry was declined or even restricted, it may result in a
reduced availability of this regionally important aggregate resource for Northland.
The ongoing supply of aggregate is crucial to many current and future projects in the
Northland region. Further without a secure and efficient supply of aggregate, it may
be difficult for many businesses in Northland to commit to further capital investment
in Northland, or continue to operate at all.
We would welcome the opportunity to be heard on this submission.
