13 Een kleurmerk is een handelsmerk waarbij n of meer kleuren
worden gebruikt om de waren en diensten van een onderneming te
onderscheiden van die van andere ondernemingen.handelsmerkkleuren
Het Hof van Justitie van de EG heeft in Libertel Groep BV tegen
Benelux Merkenbureau (zaak C-104/01) op 6 mei 2003 uiteengezet waar
een kleurmerk aan moet voldoen om binnen de Europese Unie te kunnen
worden geregistreerd [1]. Hieruit volgt onder meer dat voor kleuren
niet snel wordt aangenomen dat het voldoende onderscheidend
vermogen heeft. Dat is slechts het geval wanneer de kleur echt als
onderscheidend teken voor de onderneming is ingeburgerd. Bovendien
volgt er uit dat rekening dient te worden gehouden met het algemeen
belang dat de beschikbaarheid van kleuren niet teveel wordt beperkt

20 The protection of a trademark can be refused upon two kinds
of grounds: Trademark Instances (Benelux Trademark Office and Ohim)
have the power to refuse a trademark for registration upon its lack
of distinctiveness or other grounds, purely based upon the applied
trademark itself. Holders of older trademark rights have the right
to oppose or react against the application of a trademark upon its
confusing similarity between their older trademark and the
trademark applied for. Official Trademark Instances (Benelux
Trademark Office and Ohim) dont have the power to initiate
themselves a refusal upon relative grounds. Holders of older
trademark rights must oppose first, for the Trademark Instances to
regain their power of refusing a trademark upon relative grounds.

21 Pantone is de naam van een bedrijf dat kleurcoderingen
publiceert. De coderingen, zoals PMS 200 ('Pantone Matching
System'), zijn een eenduidige afspraak tussen alle partijen in een
ontwerp- en productieproces (bijvoorbeeld ontwerper,
textielleverancier en drukker). Het woord 'matching'
('overeenkomen, samenvallen') geeft aan dat het reproduceren van
een bepaalde kleur een belangrijke doelstelling is; dit is geen
vanzelfsprekendheid in ontwerp- en productieomgevingen. De eerste
publicatie, in 1963, was vooral gericht op grafische ontwerpers,
drukkerijen, en hun kleurtechniek CMYK. Op dit moment is de
catalogus uitgebreid met vertalingen naar elektronisch gemaakte
kleuren voor presentatie op beeldscherm.CMYK

22 CMYK CMYK (Cyaan, Magenta, Yellow, Key) is een systeem om
met vier basiskleuren, inclusief zwart, een groot aantal kleuren te
kunnen verkrijgen door subtractieve kleurmenging. Dit systeem wordt
vooral gebruikt bij drukinkten. Ook komt soms het CMY-systeem voor,
waarbij geen zwart wordt gebruikt. Echter in druktechniek leidt dit
doorgaans tot te lichte afbeeldingen, omdat de resultante van pure
cyaan, magenta en geel donkergrijs is.basiskleurensubtractieve
kleurmenging C staat voor Cyaan, (bij additieve kleurmenging een
combiatie van blauw en groen licht);Cyaan M staat voor Magenta, een
combinatie van rood en blauw licht;Magenta Y staat voor Yellow
(geel), een combinatie van rood en groen licht;geel K staat voor
Key, zwart.zwart Bij meerkleurendruk betekent "Key plate" de
drukplaat met de 'artistieke details', dat wil zeggen de lijnen en
effecten (in tegenstelling tot kleur-vlakken). Deze details worden
gewoonlijk in de donkerste kleur gedrukt, dus bij de
vierkleurendruk CMYK in zwart. Bovendien: een 'B' voor Black zou
verwarring kunnen geven met 'Blue' (blauw). De CMYK-code voor een
kleur wordt weergegeven door het dekkingspercentage van de vier
inkten die nodig is om die kleur te verkrijgen. Wanneer we de
basiskleuren langs drie assen uitzetten, krijgen we de
