The senior regional magistrate accused of accepting a bribe to infl uence a court case has hit back and sued several parties for unlawful arrest and defamation. One of the respondents is Zoutnet, publisher of the Zoutpansberger and Limpopo Mirror newspaper, whom he sues for R20 million.

Senior Regional Magistrate Ronnie Rambau made the headlines on several occasions over the past year. Along with two other offi cials, he was arrested in a police trap in February 2010. The trap was held within the Musina area, with the aim of catching corrupt offi cials who sabotage the course of justice by predetermining the sentence of vehicle theft cases by means of a plea agreement. The three accused allegedly also received bribe money in murder and rape cases.

The case against Rambau and his co-accused, prosecutor Estene Willemse and attorney T E Lubisi, is set to continue in Musina from 21 to 25 May this year. All three pleaded not guilty to the charges.

Rambau was also accused of compiling a hit list, allegedly conspiring to have some of the witnesses murdered. He was arrested in January 2011, after a warrant for his arrest was issued in the Giyani Magistrate’s Court. This case was withdrawn in the same court in August last year, presumably to give the police more time to investigate the al-legations. Rambau’s legal representative argued that the case had no merits.

In April this year, Rambau’s legal team served papers on no fewer than 11parties, accusing them of, among others, his unlawful arrest and prosecu-tion. In these papers, the arrest is described as ma-licious and without reasonable or probable cause. Rambau’s legal team argues that, through these actions, he had been deprived of the preservation of his status as a senior magistrate and suffered physical and psychological trauma whilst in jail. He claims just over R21 million in damages from the parties, which include the police offi cers who

arrested him and investigated the case, the national director of public prosecutions and the Ministers of Police and Justice.

Almost as an afterthought, Rambau also sues the Zoutpansberger, Limpopo Mirror and Isabel Ven-ter for defamation. Some of the articles focussing on Rambau’s court appearances were written by Venter. In this case, he demands R20 million because his reputation was tarnished.

“The words in the context of the articles are wrongful and defamatory in nature in that they were intended and were understood by readers … to mean that the plaintiff is dishonest and he is a criminal,” the documents state.

The different parties are all expected to fi le pa-pers opposing Rambau’s application in the North Gauteng High Court this week.

Anton van Zyl, managing director of Zoutnet, described the case as yet another example of how people want to go after the messenger instead of focussing on the issues at hand. “We don’t make the news, we report on what is happening in a man-ner that is as unbiased and objective as possible,” he said. “If people appear in court, especially high-profi le citizens, we have a responsibility to report on it. It is actually more than just a responsibility, it is a constitutional obligation,” he said.

Rambau’s defamation case is one of several that the local newspaper group had to fend off in the past years. In 2008, a former municipal manager of the Makhado Municipality, Ms Faith Muthambi, fi led papers in the Gauteng North High Court claiming R150 000 from Zoutnet. She claimed that the South African Municipal Workers Union (SAMWU) and the two newspapers of Zoutnet, the Limpopo Mirror and the Zoutpansberger, had damaged her good reputation. The alleged defama-tion of character stemmed from a protest march held by SAMWU in April 2008. During the protest march, SAMWU accused the municipal manager of corruption and nepotism. Zoutnet’s newspapers reported on the march and the allegations made.

After a period of more than two years, this case eventually made it to court, only to be struck of the roll, because Muthambi’s legal team stated that they were not ready for trial. A cost order was made against Muthambi.

In January 2010, a Musina-based business-man, Azwindini (Juluka) Justice Mamidze, sued Zoutnet for R1,5 million, claiming his reputation had been dented by articles the newspapers car-ried. In June 2009, the Limpopo Mirror carried an article on the arrest of four suspects in Musina for, among others, the smuggling of cigarettes worth R500 000. Mamidze was acquitted on the charge of cigarette smuggling on June 29, 2009.

When the case was scheduled to appear in the North Gauteng High Court in February this year, Mamidze’s legal representatives were at fi rst no-where to be found. The afternoon before the trial date, a new legal representative was appointed and he could only plead that the case be postponed. This case was also struck off the roll and Mamidze was instructed to pay all costs.

“Cases like these cost hundreds of thousands of rands in legal costs alone,” says Anton van Zyl. He pointed out that there are a number of other ways through which readers can express their discontent, if any, with newspaper reports. “One such avenue is the Press Ombudsman’s offi ce. There are no legal costs involved when lodging a complaint to the Press Ombudsman and this is still the quickest way to correct biased or inaccurate reporting,” he says.

“We will not be silenced by such litigation and we will continue to report on what is happening in our community,” says Van Zyl. He feels that the free press is one of the remaining pillars of South Africa’s democracy and, even though he respects everyone’s right to litigate, this constitutional right must be protected.

“It is sad that the small independent voices of the community get targeted in this way,” he adds.

The newly appointed mayor of the Makhado Municipality, Cllr David Mutavhatsindi, says that improving fi nancial management at the municipality is his main priority. He wants to see an improvement in terms of governance.

“The municipality has been receiving qualified audit re-ports for years and the situation needs to be improved,” said Mutavhatsindi in an interview on Monday. He added that he would strive to ensure that there was good and clean accountancy at the municipality.

Mutavhatsindi said that he would first try and see to it that the municipal manager and CFO’s posts were fi lled. “The posts will not just be fi lled, but will be fi lled by well-qualifi ed and competent people,” he prom-ised.

He also indicated that ensur-ing better services to the people would be his focus. He said on Monday that he would try and ensure that residents of all areas that fall within the jurisdiction of the Makhado Municipality have basic services such as electric-ity, houses, water and other services.

“Together with the Vhembe Dis trict, we will strive to im-prove the quality of water. We are also moving towards a dy-namic and progressive centre of socio-economic development by 2025,” he said. Mutavhatsindi said that he would also try and ensure that employment relations

at the municipality are improved. “The relationship between em-ployees and the municipality is not good at the municipality and needs to be improved, as it affects service delivery,” he said.

He urged all the residents of Makhado to get involved in the activities of the municipality in terms of planning.

“Everybody must attend our IDP meetings. It is my responsi-bility to improve the involvement of minority groups. Together we can do more,” said Mu-tavhatsindi.

Mutavhatsindi’s qualifica-tions include a master’s degree

in government and political trans formation that he did with the University of Free State in 2004. He also holds a diploma in executive leadership in municipal management, a bachelor of arts degree (cum laude), a bachelor of education degree (cum laude), a diploma in education (cum laude) and a post-graduate diploma in education management (cum laude).

Mutavhatsindi is a former prin cipal of Nandoni Primary School. He served in several ANC structures before. He is a former Speaker of the Makhado Municipality.

Hierdie mylpale is Maandag bekend gemaak in ‘n CoAL bedryfsverslag.

Produksie by Vele is in Desember verlede jaar hervat, nadat die mynreus

The Makhado Municipality’s refusal to approve the building plans of a member of the Soutpansberg Ratepayers Association (SRPA) could be illegal.

“The Chief Financial Offi cer is … in no position to authorise service delivery … until the arrears amount on his account is paid in full or a satisfactory arrangement are (sic) made with the municipality to repay the arrears amount,” the municipal-ity writes in a letter dated 28 February and signed by the former municipal manager, Mr Shadrack Tshikalange.

The SRPA member also with-holds rates and taxes and pays for consumption according to the SRPA’s legal dispute declared with the Makhado Municipality in August 2008. The member, who applied for approval of building plans in 2011, is in ar-rears with rates and taxes to an amount in excess of R42 000, which amount is held in trust by Van Heerden and Rudolph Attorneys.

The municipality told the member to pay the outstanding amount “for the fi nal processing of the approval of your plan”.

The logical question that fol-lows is whether members of the SRPA will ever be able to get building plans authorised. In the case of a member’s selling a house, it is a well-known fact that members have to request their arrears money and pay up

before being able to sell.“The transfer of property is

something else. But to refuse to authorise service delivery in terms of approval of building plans? On face value, that seems to be illegal. You cannot do debt equalising like this. If they want their money, they must take the person to court and address the problem where it lies, but they cannot refuse to authorise service delivery. That amounts to the municipality’s playing court,” said attorney Mr André Naudé.

The member in question brought the matter to the atten-tion of the SRPA. The SRPA wrote a letter to the municipality, explaining that “the money in the trust account is held in trust until such time as the Makhado Municipality decides to resolve the dispute.” The SRPA put on record that the municipality is prohibited by the Municipal Systems Act (Act 32 of 2000) to “implement any of the debt collection and credit control measures … in relation to any arrears on any of the accounts of a person who declared a dispute on the basis of the legislation mentioned above”.

The SRPA chairperson, Ms Inga Gilfi llan, said that her as-sociation “deeply regrets this intimidation and victimisation of a law-abiding, taxpaying resident of Louis Trichardt,” referring to Mr F L Avian of 10 De Vaal Street.

The Makhado Municipality, in turn, referred the SRPA to “the provisions of Section102 (1) and (2) Local Government: Munici-pal Systems Act 102 of 2000”. It took a fi rm position against the existence of a dispute and wrote, “this section specifi cally requires a dispute to be about any specific amount claimed by the municipality from the person. The so-called dispute declared by your Rate Payers Association does not fall within the strict requirements of Sec-tion 102(2) of the Systems Act; and furthermore, no dispute was ever declared by Mr FL and KE Avian about any specifi c amount claimed by the municipality, therefore there is currently no dispute declared in terms of the Systems Act”.

“I would like to know in terms of which act and article the mu-nicipality has the right to refuse service delivery,” Naudé said. This question and questions on an update of the situation were directed to the municipal spokes-person, Mr Louis Bobodi, who said that he was still sourcing the information.

The SRPA manager, Ms Aretha Smith, said that they had received the advice to consider Sections 7 and 8 of the National Building Regulations Act. “You can bring an application to a magistrate to approve the plans if the municipality refuses,” engineer Mr Johan Koekemoer advised Smith.

Municipality’s refusal might be illegal

Minder wild weens ernstige droogte

Two vehicles collided on the corner of Erasmus and Grobler Street in Louis Trichardt on Tuesday morning after both drivers apparently failed to stop at the fourway stop street. The situation in Louis Trichardt borders on the ridiculous as almost nobody stops at a stop sign any more. Following Tuesday’s crash, one bystander remarked that one is more likely to actually cause an accident if one does stop at a stop sign.

Pupils of Ridgeway Independent School have made a valuable contribution towards saving the rhino from becoming extinct. Their rhino project has taken an exciting new turn.

The danger that the rhino faces is very real. Rhinos are slaughtered due to the thriving illegal market in rhino horn. The latest statistics by the Department of Environmental Affairs indicate that, in the four months since the beginning of this year, South Africa has lost 199 rhinos, with the Kruger National Park (KNP) as the poachers’ most targeted area. KNP has lost 119 rhinos in this short period. South Africa is home to 80% of the world’s

rhino population. In 2007, rhino poaching deaths were 83, while in 2011 the deaths rose to 448.

Should the current rate of rhino poaching continue, the rhino population growth rate could officially go into decline during this year.

The Ridgeway rhino project started when the plight of the rhino touched the hearts of two 10-year-olds, Casper-John Venter and Marco Marcos of the school. They initiated a fundraising project which brought in more than R3 000. They transferred the amount to the Endangered Wildlife Trust, who rewarded them with certificates.

“This money has enabled

the Trust to pay for the train-ing and housing of Rico, a German Shepherd. Rico is currently being trained to sniff out rhino horn and other illegal substances.

On completion of his train-ing, he will work at the OR Tambo airport in Johannes-burg. We are very proud of these boys for initiating this project and our pupils who sup-ported it by donating money,” said Ms Elaine Waller, the school’s bursar.

The school unanimously chose Rico to be the official mascot of the school. The good news is that the community of Louis Trichardt can meet Rico at the Cultural Fun Day on Sat-urday, 5 May, at the school.

ATM bombing rocks Levubu communityOnly a couple of weeks after an ABSA ATM and two FNB ATMs had been blown up at the Nzhelele Valley Complex in Nzhelele, another ABSA ATM was blasted open at Levubu last Friday.

The incident happened at about 01:00 at P&L Hardware’s premises in Levubu. More than R100 000 was allegedly taken from the ATM during the bombing. The spokesperson for the Levubu Police, W/O Solly Mukhola, confirmed the

incident. He said that three un-known men had gained entrance after cutting a hole in the fence. “A security guard came running to the police station, and when our police team rushed to the scene of the incident, the crimi-nals had already gone,” he said. According to Mukhola, R55 400 was found scattered all over at the scene.

“We have opened three cases: that of theft, malicious damage to property and the illegal use of explosives,” said Mukhola. He

added that police investigations were still continuing.

Meanwhile, when contacted for comment on what the police were doing about the alarming spate of ATM bombings in the Vhembe District, SAPS pro vin-cial spokesperson Lt Col Moha-le Ramatseba said that the police were aware of the incidents and that the crime intel ligence unit was busy investigating.

“Hopefully, we will be able to crack down on and arrest the culprits,” he said.

New trauma centre envisaged for victimsA trauma centre for Louis Trichardt and surrounding areas is long overdue and, at present, the local Rotary Club and Rotary Anns are attempting to raise funds for this purpose.

Victims of trauma and physical or sexual assault need a place where they can give statements and be examined under conditions that do not add to their trauma. Currently, victims are examined and have to give statements in a small office behind the police station, where the conditions can be described as cramped and inadequate.

In the nine months from April 2010 to January

2011, some 764 victims of physical assault and 60 of sexual assault were treated and counselled at the Louis Trichardt Memorial Hospital. In the four months from April 2011 to August 2011, there were 265 victims of physical assault and 24 of sexual assault. In most cases, the victims require shelter away from their attackers. Many of these victims are children. The hospital has 52 beds for a population of some 140 000 people and cannot accommodate the victims.

These facts came to light at a meeting between representatives from the Louis Trichardt Rotary Club and Rotary Anns and the CEO of the Louis Trichardt Memorial hospital, Ms PC Raulinga, Dr D Kazaji, the acting clinical manager, Mr MR Magampa of the Department of Health, Mr D. Ndlovu of the SAPS, and Makhado Victim Em-powerment chairperson Ms V Matimulani, NGOs and the Makhado Municipality.

“All have pledged their full co-operation to the project. The Louis Trichardt Memorial Hospital has pledged the services of doctors (they have 10 doc-tors), trauma nurses (3), psychologist, cleaners (5) and security guards (10). The hospital will provide food for the traumatised patient. They will also be responsible for the cleaning, lights and water and security,” said Mr Ian Bannatyne, Rotary’s assist-ant district governor. He was accompanied by Ms Carole Went, president Rotary Ann, and Ms Diane Bannatyne, past president Rotary Ann.

Rotary has undertaken to help raise the funds locally and overseas to purchase a mobile home and install plumbing and electricity, at an estimated cost of R750 000. Rotary is a non-profit organisa-tion (NPO). They are able to issue businesses with a tax exemption certificate that can be used when acquiring BEE status and is tax deductible.

“Please, businesses, use your BEE for Socio-Economic Development contribution, which is 1% of your nett profit after tax (NPAT) for this very important project,” requested Rotary president Mr Godfrey Went. All those interested in this project are welcome to contact Mr Bannatyne via email at [email protected]

The Zoutpansberger’s website (www.zout-pansberger.co.za) offers rea ders a calendar entry service on their Events Page.

Visitors to the website can now list their calendar entries for upcoming events on the Events Page themselves. It is as easy as merely logging in on the Events Page through your existing Google, Facebook or Twitter accounts and uploading your entry. The entry will, however, not appear immediately as it has to go through a moderation process fi rst.

In addition, sport club administrators (and

for that matter church and school administra-tors) can contact us to directly submit events on the Events Page without a moderations process. If an administrator is listed as a user on the site, their calendar entries will show im-mediately. This function allows administrators to update events through the year on a platform used by ten others publications throughout the province as part of both a local and provincial calendar.

For more information, phone Andries van Zyl at Tel 015 516 4996/7.

Thanks to Canadian youngsters and the local Rotarians, school children in Louis Trichardt will be kept warm this winter.

The Rotarians donated brand new school jerseys to those who are in need of jerseys at Louis Trichardt Primary School, Sout-pansberg Primary School and Louis Trichardt High School.

“The Rotarians of Calgary in Canada, as well as in Louis

Trichardt, took the initiative to donate money for the jersey project. We are grateful for the 35 jerseys donated to us and will distribute the jerseys according to need. We appreciate the fact that children in Canada have large community projects in South Africa. They work very hard to contribute to the needs of children in our country, “ said Ms Stienie Fourie, deputy-principal

of Louis Trichardt Primary. The money was raised by 14-

to 18-year-old children of the Canadian Rotarians.

“Last year in September, these Canadian children visited the Tomba Lushaka Day Care Centre in Madombidzha, where they provided funds for a borehole, a water tank and a toilet,” said Mr Ian Bannatyne, assistant district governor of the Rotarians.

School jerseys were donated by the Rotarians to Soutpansberg Primary School on 25 April. In a determined move against smuggling, customs officials from the South African Revenue Service (SARS) last week Tuesday destroyed 796 700 illegal cigarettes that were seized at the Beit Bridge border post.

This was announced by the To bacco Institute of Southern Afri ca (TISA) in a press re-lease.

According to TISA, this fol-lows the destruction of 40 400 000 illegal cigarettes in Gauteng, the Free State and the Western Cape during April this year.

“Around 80% of the illegal cigarettes coming into South Af-rica are from across the border in Zimbabwe. Unscrupulous smug-glers have broadened their routes to be able to smuggle cigarettes illegally onto the market. These products unfortunately often end up in the South African market, contributing to the almost R4 bil-

Crime prevention

Almost 800 000 cigarettes destroyedlion loss in government revenue annually,” says Mr Francois van der Merwe, CEO and chairman of TISA.

Van der Merwe says the de-struction is evidence of the inte-grated effort from law enforce-ment authorities to shut down the supply chain of smugglers.

TISA conducts the destruction of illicit cigarettes on behalf of SARS and All destruction takes place under the supervision of SARS officials. “We believe this partnership is the only way to combat the illicit trade in tobacco products successfully,” says Van der Merwe.

Police successesThe Makhado SAPS had somewhat of a busy long weekend.

The weekend started off with some drama on Saturday when the police were called out to in-vestigate a case of business robbery which took place along the Louis Trichardt/Elim road.

According to the police, employees of the shop were confronted by “thugs with a fi re arm”. Cash was taken during the robbery.

No shots were fi red and nobody was injured during the incident. The police urged people with information that can assist them regarding this robbery to phone the detective line at Tel 082 319 9638.

Although nobody was arrested for the busi-ness robbery, the police did manage nine other arrests in unrelated cases. In the fi rst arrest, three suspects aged 17, 29 and 35 were arrested and charged with single counts of common robbery. The charges brought against them relates to robberies that took place in the central business area of Louis Trichardt. According to police information, the three used force to over power their victims and steal their money.

Another three suspects, aged 23, 27 and 28 respectively, were locked up after dagga was found in their possession. One more suspect was caught for planting dagga.

Two more suspects, both aged 18, were also arrested for theft out of a motor vehicle. Police regard this arrest as a break through, because the suspects can be linked to similar cases in Tshikota during December of last year. All sus-pects were expected to appear before court.

The Way, the Truth and the Life

Christ the joy and reality of life - Philippians 3:16

There is life in Christ. The Old Testa-ment gave the law, when Jesus came

He gave love and life. That is why the Jews were critical of Jesus when He healed on the Sabbath. But Jew or Gentile, Christ changes a person’s life, because there is:

a) Joy in Christ (verse 1)There is no greater privilege than to

rejoice in Christ. David said in Psalm 16:11: “You will show me the path of life. In Your presence is fullness of joy; at Your right hand are pleasures forever.” Godly joy will change your whole life.

Paul had the joy of God in his heart, and all the suffering in jail could not overcome his joy in Christ. Joy in the Lord gives His children security. Verse 1: “But for you it is safe.”

b) The reality in Christ (verse 3)To praise Jesus means to honour Him.

To serve the Lord in Spirit means not to satisfy the flesh. Galatians 5:16: “I say then: Walk in the Spirit and you shall not fulfill the lust of the flesh.”

In Jesus it is possible, because He said: “I am the way, the truth, and the life. No one comes to the Father except through Me.”

The way = the right way. The truth = the right manner. The life = the right joy. Jesus is the Lord and Master and joy of all who serve and worship Him.

bespreek, skakel Stanley by 082 493 3897, Koos by 082 490 6013, Mark by 083 324 8495, Jandré by 083 288 5426 of Paula by 015 516 1228.
