A Letter from the Minister of Trade, Industry and Tourism

In Colombia, free trade zones have become the first-line of development to face the challenges of the XXI century. They have been effective in attracting investment and generating employment, while being important centers for regional progress.

With 56 years in existence, they have evolved, with a special shift in 1991, when the Minister of Foreign Trade at that time and current President of the Republic, Juan Manuel Santos signed the formation of the Private Free Trade Zones which led to the development of new areas for industry, commerce and services with special custom and tax regulations in Bogota, Rionegro, Palmira, Cartagena and La Tebaida.

With the rise of the national economy, free trade zones grew dynamically throughout the Colombian territory as logistics and business development centers. This is echoed in the 90 that have been approved under the current tax and customs system for a total of 101 free trade zones already established in Colombia.

We currently have the largest number of Free Trade Zones in Latin America. Projects are being developed in almost all regions of Colombia in order to improve trade logistics and directly reach markets benefiting from the free trade system, thus obtaining a greater competitive advantage. A boom that has forced builders to wage on these business centers as new focus for investment and industry growth.

Under the new regime, free trade zones have become an effective tool to attract investment representing a figure of $ 32.3 billion. They have also contributed to the generation of 16,000 new direct jobs and 142,000 new indirect jobs. We believe that this figure will continue to grow driven by investment in infrastructure and the consolidation of free trade zones focused on services which are also known as a source of employment.

Free trade zones are a business model that will undoubtedly transformed the industrial sector through incentives and benefits such as the flat income tax rate of 15%, the exemption in customs duties and the facilitation of importing and exporting. These are all key factors to address the needs of today’s market that is constantly changing in the face of free trade agreements as well as the interests of the different sectors to improve logistics, the need of being present in other countries and the advantages of tariff preferences.

Thanks to these incentives, the country’s strategic location, its excellent connectivity to the Americas, Europe and Asia and the possibility of attracting companies to use Colombia as a platform for the distribution of their products internationally, the free trade zones activity represents a pillar of competitive development of our regions and an excellent opportunity on the road to the nation’s prosperity.

A LETTER FROM THE PRESIDENT

Colombia has been projected as one of the most promising destinations for businesses in the last decade. The government adopted policies that created a dynamic internal market and a growing trade integration with the world. Foreign Direct Investment joins as one of the elements that reflect the country’s momentum: a decade ago, the value of FDI was US$1.720 billion and at the close of 2013, it reached US$16.772 billion, according to the Ministry of Trade, Industry and Tourism.

Major companies decided to invest in our country, and moreover, expand their businesses towards other markets, motivated by the safety and benefits that the Colombian law grants to foreign investors, among other reasons.

In the last ten years, the Gross Domestic Product (GDP) recorded an average growth of 4.7%. Additionally, one of its most attractive points is an internal market of 47 million people, 55% of whom are under 30 years of age and a middle class that grew its GDP per capita from US$1,980 in 2000 to US$8,300 in 2014.

Moreover, the current free trade agreements with Colombia open the doors for current or potential companies in Colombia to obtain the tariff benefits that the nearly 50 markets with 1.5 billion consumers offer, to which these companies have privileged access.

In recent years, the three main credit rating agencies (Standard and Poor’s, Moody’s, and

Fitch Ratings) granted an investment rating to Colombia. Additionally, the World Bank’s Doing Business qualified Colombia as the third friendliest country in the region for doing business and the country that has carried out the most positive reforms to this end.

Development, stability, dynamism, and potential are some of the attributes that the main international financial institutions and multilateral bodies use to refer to Colombia, considering it a trustworthy and attractive partner for foreign investors.

Colombia also has an optimal regulation of Free Trade Zones, strengthened by the enactment of Law 1004 of 2005, with which the country positioned itself in the orbit of global trade and significantly elevated the inflow of foreign investment and foreign exchange, which has also generated new jobs and an increase in the development of our industry.

The current publication offers privileged information about the potential, opportunities, and advantages that the Free Trade Zones in Colombia provide to investors who are interested in entering the country. The mission of the Ministry of Trade, Industry and Tourism is to support entrepreneurial activity, production of goods, services and technology, as well as the management of the country’s tourism areas, with the aim of improving competitiveness, sustainability and encouraging the creation of added value.

PROCOLOMBIA is the state body responsible for the commercial promotion of Colombia as a destination for foreign direct investment, Colombian investment abroad, international tourism, and the export of non-traditional Colombian goods and services.

The Chamber of Free Trade Zone Members is part of the NATIONAL ASSOCIATION OF INDUSTRIALISTS OF COLOMBIA (ANDI), and users and industrial and trade operators of Free Trade Zones can join it, provided that they are affiliated to ANDI and also demonstrate an interest in joint activities that favor the harmonious development of Free Trade Zones in Colombia.

Members of the Chamber must subscribe to, apply and disseminate the ANDI Declaration of Ethical Principles.

The Chamber’s activities are focused on:

• Proposing rules and procedures that promote the development of the Free Trade Zones.

• Defending legal stability for the companies that make up the Chamber.

• Promoting the ethics and good commercial practices of the Free Trade Zones.

• Carrying out studies on the sectoral behavior of the system.

• Issuing bulletins with statistics on the Free Trade Zones’ operations.

• Creating special committees to review the legal and operational aspects that are relevant to the Free Trade Zones’ activities.

• Advising members on the correct application of legislation.

• Unifying legal opinion. • Defending access to Free Trade Zone

products by countries with whom an international agreement is in place.

• Representing and supporting Chamber members or their respective users before the State authorities.

Additionally, hold monthly meetings with the heads of operation to analyze and seek solutions for the different operations that are undertaken in different regions, and periodically issue a manual of criteria for this purpose.

Support the preparation of programs for business missions to other countries (either public or private).

Coordinate global conferences and seminars abroad to promote Colombia, such as PROCOLOMBIA, to communicate the opportunities that Free Trade Zones offer to foreign investors. Create training courses on different themes and to organize the National Congress, in which national and foreign business people will take part.

Via the main cargo airport of Latin America, situated in Bogota, businesses are able to reach the more than 1.5 billion consumers in countries that have trade agreements with Colombia.

Agro-industryFruits, vegetables and preparations of these, ingredients for the food, cosmetic and pharmaceutical industries, which want to make use of its human resources, and diversity of population for the processes of research, development and innovation.

Petroleum goods and servicesAccording to the investment attraction agency of Bogota, in recent years, it has increasingly positioned itself as a hub for the oil and gas services industry in South America, due to the oil boom and attractive business environment in Colombia. Bogota has the country’s largest concentration of companies providing services to the oil and gas industry.

AutomotiveThe region has established itself as a platform for the manufacture and assembly of commercial and haulage vehicles to supply the national and regional market. The headquarters of 6 of the 8 assembly plants in Colombia are located in the region, and it has more than 50 auto parts companies, large and medium-sized, which supply the domestic and foreign industries.

BPO – Shared servicesBogota, thanks to a wide range of advantages, has become the ideal destination in South America for

providing offshore/nearshore services: Contact centers, digital content, Information and Communications Technologies (ICT).

Santander has become internationally renowned for its vocation in these sectors. Because of this, Tholons’ Top 100 rankings for 2014 listed Bucaramanga as one of the 100 most attractive cities to invest in outsourcing.

Hotel and tourism infrastructureIn 2014, more than one million foreign visitors visited the Andean Region, 55% of the total number of visitors to the country, with tourism being the main reason for their visit. Bogota is increasingly positioning itself as a hub for events and conferences in the region, and according to the ICCA is the top destination for events in the country, and the twelfth city on the continent.

Tourism in Santander is seen as a key development tool, thanks to its contribution to the region’s economic growth. When it comes to medical tourism, the Colombia Cardiovascular Foundation has been awarded registration by Joint Commission International, creating a major opportunity for international advancement in this sector. Santander also has potential for the development of infrastructure for adventure tourism, since the region has developed a considerable offer of this type of product and has become a domestic and world leader.

Previously, Cucuta was a place associated with little more than trade and the town’s location on the frontier with Venezuela. This has changed significantly in recent times: in the city and its metropolitan area, home to 62% of the department’s population - around 800,000 people - production priorities have been identified in line with the area’s key strengths (see strategic sectors). Strategies are being employed to help Cucuta’s industry compete in more sophisticated markets using attractive business models, for example the strategy developed for cluster1 - construction and clay - which is currently being adopted by cities like Bucaramanga and is expected to be rolled out nationwide. WHY INVEST IN CUCUTA?There are many good reasons to invest in North Santander, but we will focus on two in particular: firstly, the special system of Free Trade Zones that exists, and secondly, the significant tax incentives that were granted by Cucuta’s City Council under Agreement 017.

SPECIAL PERMANENT FREE TRADE ZONESElsewhere in the country, multi-million dollar investments ranging from US$3.2 [million] to US$48.6 [million] are required to enter the free trade zone system, depending on the type of company, and the investments must be demonstrated in the first three years of trading. In Cucuta, meanwhile, the investment required by any type of business is just US$1.6 million, to be demonstrated in the same time period. Another requirement is that of job creation. In the rest of the country, companies must provide between 150 to 500 direct or indirect employees, a figure that creates a barrier to entry for new businesses. In Cucuta, companies need only demonstrate 20 employees during the first three years of trading, 20 in the three following years, and then it has through the ninth year to produce an additional 10. This makes a total of 50 employees over 9 years, which represents a real difference when making the decision to invest and the opportunity to join a free trade system that offers a major competitive advantage.

AGREEMENT 017 OF MAY 2014In making this agreement, the Cucuta City Council showed its support for promoting the city by granting special tax advantages to new businesses that are started in the city. These advantages are based on two key axes:

Tax incentives for new construction that generate new property registrations. The tax incentive that benefits the business owner is the waiver of the property tax that applies according to the size of the building, which may last for 2 years if the building covers 32,292 sq.ft. or for 10 years if the construction covers 182,987 sq.ft.

JOB CREATIONJob creation is, without a doubt, a determining factor in this agreement due to the progressiveness it implies in the payment of Industry and Commerce taxes by waiving said tax, which starts at 0% in the first year, 25% in the second and third years, 50% in the fourth, 75% in the fifth and 100% in the sixth year; however if the new company is a consumer goods company, the payment of this tax will apply to 0% for the first 5 years and 100% from the sixth year onwards. On the other hand, a tariff of 1X1000 is applied to Industry and Commerce payments for 5 years because of the generation of legal employment, and in the event that disabled people are employed, 100% of the payments from the taxable base of the Industry and Commerce tax for the period declared.

The tourism sector is enjoying significant growth in the region, especially around its beaches and historic sites. Barranquilla, Puerto Colombia, El Cisne Lake, Bocas de Ceniza, Tubara, Salgar Castle, Pumarejo Bridge and the thermal springs of Usiacuri are some of the most important destinations of the Atlantico region, which give it high potential for tourism.

It’s important to remember the tourism diversity project of the Magdalena department too, which aims to diversify and improve the tourism product for the domestic and/or foreign market, and consolidate the internationalization of tourism in the Santa Marta district.

• Agro-industry

The region has huge potential in agriculture and livestock thanks to the productivity and richness of its soil and widely-available irrigation for the land. Nationally, Bolivar is one of the major tourist destinations.

This department’s agriculture is based on five products: cassava, sorghum, yam, soy and traditional maize.

In the Magdalena department, the agricultural and livestock sector is exploring horticulture, oil and bio-fuels, beef and dairy cattle farming, marine and freshwater fish farming and fishing, logging, specialty coffees and cacao and its by-products.

• Infrastructure

Thanks to its geographically strategic location, above all for international trade with the United States and Canada on the East Coast and the Gulf of Mexico, Caribbean basin and Europe, the Magdalena department offers huge advantages for developing a strong logistical position that allows a growing volume of import and export cargo to be managed. This has been achieved through the diversification and modernization of infrastructure and logistical and transportation services, and by increasing our export offer in international markets.

The region has optimal biophysical and environmental conditions (thermic floors, agro-ecological conditions, microclimates) generated by the location of the productive and potential areas of the department in a tropical area. This facilitates year-round production, thus maintaining its position in the market.

The Cauca Valley department features investment opportunities in the creation of commercial vehicle (buses) assembly plans and cargo plants to service the local market, and in the installation of auto parts production plants that help meet the needs of assembly plans and aftermarket.

The Cauca Free Trade Zone is a successful example of the implementation of the special tax, customs, and foreign trade regulations established in Law 1004 of 2005. With its establishment in December 2009, qualified employees received investment commitments and job creation, driving the best results in the region and the country at the close of 2014.

Today, the Cauca Free Trade Zone structure is a highly diversified industrial complex where companies belonging to various sectors of the economy operate, such as food and beverages, cosmetics and toiletries, metalworking, agro-industry, art and printing, construction, fashion and apparel, and others.

Opportunity for Investment and JobsThe investment commitments received with the establishment of the Cauca Free Trade Zone increased to $90 billion pesos while investments made at the close of 2014 reached $228 billion pesos, far exceeding the initial commitments. The positive environment for investment, along with one of the best installation and operation costs in the Pacífico region, have encouraged local and foreign investors who have visited the Cauca Free Trade Zone in 2014 and 2015 to be part of a new investment process evaluation.

In terms of employment, the 36 companies established in the Cauca Free Trade Zone reported the creation of 5,303 direct jobs and nearly 9,000 indirect jobs according to calculations

from the National Association of Industrialists of Colombia (ANDI). It is important to highlight that 65% of the direct jobs generated belong to people who live in municipalities of northern Cauca, such as Puerto Tejada, Guachené, Villa Rica, Caloto, and Santander de Quilichao. The remaining 35% of jobs belong to people who live in the city of Cali and other municipalities in the Valley.

Foreign TradeIn 2014, the department of Cauca’s total exports reached US$377.8 million, of which 28%, or US$104.5 million originated from the Cauca Free Trade Zone. Consequently, the Cauca Free Trade Zone positioned itself as the fifth Free Trade Zone in Colombia with most exports and third in imports, with a balance that recorded a surplus of US$44 million FOB. This occurred in the context whereby all of the Free Trade Zones in Colombia recorded a deficit of US$ 663.9 million FOB.

Social responsibilityIn 2014, and thus far in 2015, the Cauca Free Trade Zone has created alliances with public and private entities with the goal of contributing to the improvement of the conditions of the quality of life of the population living in condos and surrounding municipalities. These alliances have allowed bringing social intervention programs to municipalities such as Puerto Tejada with the support of the Department for Social Welfare, strengthening Complementary School Day Programs, bringing sports to more than 450 kids from 6 municipalities in northern Cauca, boosting education programs of higher education institutions in the region with the presence of highly qualified professionals from the companies sharing their experiences and knowledge with students, and more.
