After an illustrious career, Lt Gen Anbu superannuated on Satur- day. Lt Gen Naravane is an alumnus of the National Defence Academy and the Indian Military Academy, Indian Army Spokesperson Col Aman Anand said. He was commissioned into the 7th Battalion, The Sikh Light Infantry Regiment in June 1980. The officer brings with him an enormous amount of experience of serving in the most challeng- ing areas. In a distinguished military career spanning almost four decades, he has the distinction of carrying out key appointments in active Counter Insurgency environ- ments, both in the North East and in Jammu and Kashmir & was a part of the Indian Peace Keeping Force in Sri Lanka dur- ing Operation PAWAN. NEW DELHI, SEPT 1 Union Minister Mukhtar Ab- bas Naqvi on Sunday flagged off a bike rally to Kashmir to celebrate the abrogation of Ar- ticle 370 and spread the mes- sage of 'Ek Vidhan, Ek Samvidhan.' The rally is being led by woman biker Raj Lakshmi, who arrived here with her team from Kanyakumari. The group will cover more than 5,000 km distance. "This bike rally is to send the message of 'Ek Vidhan, Ek Samvidhan' (One Legislative, One Constitution) in all rural and urban areas. After the ab- rogation of Article 370, it is important to create aware- ness among masses about its positive results," said Naqvi. "The bikers will apprise masses that the Indian flag will be hoisted in the region. It is an attempt to generate a feeling of nationalism. It is not politics. It is about the country," added Naqvi, speaking to media persons. "The Kashmiri youths will surely get inspired by the rally. Revocation of Ar ticle 370 is a historic mo- ment for all of us. Naqvi flags off bike rally to Kashmir to spread message of peace AGENCY SANAA, SEP 1 At least 50 prisoners of war were killed when the Saudi- led coalition launched a series of airstrikes overnight on a prison in Yemen's central province of Dhamar, the Houthi-controlled health min- istry said in a statement early Sunday morning. "At least 50 were killed in seven airstrikes by the coali- tion warplanes against the prison and 100 others wound- ed, as rescue teams were still searching for possible sur- vivors under rubble," it said, adding that the death toll could rise as many injured are in critical conditions. Meanwhile, the Houthi- run al-Masirah television re- ported on its website that "the targeted prison is located in- side a complex of the Com- munity College in the center of Dhamar and that the Inter- national Committee for the Red Cross (ICRC) has visited it several times." Saudi-led airstrikes on Yemen prison kills at least 50 Abrogation of Article 370 AGENCY NEW DELHI, SEPT 1 Finance Minister Nirmala Sitharaman on Sunday dismissed fears of job losses fol- lowing the government’s decision to merge 10 public sector banks and insisted that not even a single employee would be removed in the wake of the amalgamation. “Absolutely, ill informed. I want to as- sure every union in everyone of these banks to please recall what I have said last Friday. When we spoke about amalgamation of banks I have very clearly underlined the fact that there shall not be one employee re- moved. Not at all”, she said at a press con- ference. On Friday, Sitharaman had unveiled a mega plan to merge 10 public sector banks into four as part of plans to boost govern- ment’s $5 trillion economy dream. On the same day, Central Statistics Office (CSO) released figures that showed the India’s gross domestic product (GDP) grew at just 5 per cent, the slowest in six years. The All India Bank Employees Union has said the merger would lead to closure of banks and job losses. The Bharatiya Mazdoor Sangh (BMS), labour wing of the RSS has also criticised the bank merger plan saying it was done without any study would only protect inter- ests of corporate houses. Ahead of Sitharaman’s assurance to bank employees, former Prime Minister Manmohan Singh said the state of the econ- omy was deeply worrying and insisted that last quarter’s GDP growth rate of 5% sig- nals that the country is in the midst of a pro- longed slowdown. The old man and his grand children fell on the road and they were run over by a speeding trolley. Two figures released this week, namely GDP growth slip-ping to a six-year low at five per cent against 5.8 per centin the last quarter and 10 public sector banks merging to

form four big banks shows the government has lost its grip onthe economy. It must come as a surprise to Union finance min-ister Nirmala Sitharaman that the slew of measures she an-nounced has not reversed the slowdown which seems to be thehallmark of the Narendra Modi years.

In the case of the PSU (public sector undertaking) banks,mergers are not the answer to problems that besiege them.What is required is for banks to be freed from the strangleholdof the government which is the largest shareholder. PSUs areburdened with funding the give-aways and sops announced bythe government. For instance, banks handled over Rs 1 lakhcrore that came in under the Prime Minister’s Jan Dhan Yojanaand the government has yet to compensate the banks for thisjob. Another reform needed is accountability. For instance,banks are saddled with non-performing assets of around Rs8.08 lakh crores and this is the hard-earned money of the peo-ple that has been frittered away. Large corporates account forthe bulk of the NPAs. Bank frauds account for Rs 71,542crores, an increase of 73.8 per cent over the previous year’s`41,167 crores.

The fact that most of the frauds related to advances showsthat either due diligence was not done by the bank officials con-cerned or that they were complicit with borrowers in cheatingthe bank. Either way there should be accountability. But howmany such offenders have been taken to task? The high-profilecase involving the Punjab National Bank is of a one-off kind inrecent times, involving high-flying individuals. However, ofequal if not greater concern is the steep fall in growth of theeconomy which translates into millions of job losses. WorldBank figures indicate that, for every one per cent rise in GDP,7,50,000 lakh jobs are created; so at seven per cent GDPgrowth 5.25 million jobs should be created. With the unem-ployment rate at a 45-year high, consumer demand which fu-els the economy is lacking.

New investments too are at an ebb as the private sector hasa backlog of inventories and is reluctant to go in for new proj-ects. The debate on whether the slowdown is cyclical or struc-tural is semantics best left to economists. The crying need inthe short term is for government to kick-start investment andundertake infrastructure projects on a large scale and createemployment. It also needs to give a major push to the Nation-al Rural Employment Guarantee Scheme particularly in ruralIndia. It will serve a dual purpose of providing employmentthat will reduce rural distress whilst creating rural infrastruc-ture. In the long term, the government which has a large man-date from the people should undertake land and labour reforms.This will give a further push to ease of doing business, so nec-essary to attract investment, both in domestic and global terms.

Various aspects of Nazirule from 1933 to 1945 havereceived copious amounts ofattention in the form of books,documentaries, films and arange of highly scholasticanalysis. A forgotten feature,however, of that period was thesystematic destruction of an in-dependent judicial system. Be-fore the Nazis first appropriat-ed dominance in 1933, AdolfHitler did not wax eloquentagainst the judiciary. This wasdue to the fact that the Germanlegal system was both federalin character and deeply em-bedded in the classical Westernlegal tradition of an au-tonomous judiciary both at thebase and at its pinnacle.

This ambivalence did notsubterfuge the reality that thelegal system as it stood consti-tuted, especially the independ-ence of the judiciary, was ananathema to the Nazis. Thingscame to a head within threeweeks of Hitler being sworn inas Chancellor in what is knownas the Reichstag Fire case.

Hitler had this unex-pressed expectation that thejudges would find a sinisterand ambitious conspiracy bythe Communists behind theReichstag fire, but the judgesconvicted only a single com-munist. Outraged, Hitler lever-aged the authority conceded tohim in terms of the ReichstagFire Decree to set up his ownjudicial system, outside the hi-erarchical order of the Germancourt system and even outsidethe ambit of German law.These were the Sondergerichteor the Nazi special courts.

The remit of these specialcourts was extensive. Almostany crime that could be de-scribed as political oppositionto the Nazi regime ended upbefore them. The most notori-ous of these monstrosities wasthe Volksgerichtshof, the Peo-ple’s Court, formed in 1934 toconduct the alleged treason tri-

als. These measures spelt thedeath knell of the German le-gal and judicial system.

Even the fig leaf of feignedimpartiality was ripped toshreds when Hitler addressedthe judiciary in a speech in theReichstag on April 26, 1942.Hitler said, “I expect the Ger-man legal profession to under-stand that the nation is not herefor them but they are here forthe nation... From now on, Ishall intervene in these casesand remove from office thosejudges who evidently do notunderstand the demand of thehour.” Judges in Nazi Ger-many were then instructed thatin the event of any conflict be-tween the Nazi Party and thelaw, the Nazi Party should al-ways succeed as their objec-tives surmounted any notionsof fair play. Interestingly,judges were the least persecut-ed class in Nazi Germany.

Hardly anyone ended up in aconcentration camp for theirco-option was voluntary andprostration total. The legitimi-sation of Nazi atrocities usingthe letter of law was the rulerather than the exception.

That is why to restore thefaith of people in the Axis-oc-cupied countries in the rule oflaw, the Allies conducted theNuremberg and Tokyo trials ofwar criminals rather than sum-marily execute them.

The philosophy of natu-ral rights and notions of auton-omy for the courts of law had

no place in their scheme ofthings. Fascist justice was therule of the thug sanctified by asupine judicial class. However,what took the cake was JosephStalin’s abuse of the judicialsystem to purge his rivals atone stroke. The Moscow Trialsfrom 1936 to 1938 were themost gargantuan judicial shamin history. The only object ofthis kangaroo process was toexterminate the Bolshevik oldguard, thereby allowing Stalinto make the state synonymouswith the self. On August 15,1936, the official Soviet newsagency reported that the Russ-ian state prosecutor hadcharged Gregory Zinoviev,Leon Kamenev, I.N. Smirnovand 13 others of conspiringwith the Nazi regime to assas-sinate seven front-ranking So-viet leaders, and the murder ofone S.M. Kirov more than 18months earlier. Nine days lateron August 24, 1936, the presi-dent of the tribunal read theverdict sentencing all the de-fendants to death and forfeitureof all property belonging tothem. Less than 24 hours laterthe press proclaimed that themercy appeal of the con-demned men had been vetoedby the Presidium of the CentralExecutive Committee of theSoviet Union and further re-ported the verdict has been ac-tioned.

In less than a fortnightsince the first revelation of analleged terrorist plot, 16 menwere allegedly tried and merci-

lessly executed after a judicialsham. Among them werenames inextricably linked withthe Russian revolutionarymovement, the October Revo-lution, and the initial period ofthe Third International. Thesentence pronounced includedthe directive to bring before thecourt on the same chargesLeon Trotsky and his son L.L.Sedov. Both “Father and Son”were Stalin’s proverbial night-mare.

Sixty-seven years later inSeptember 2013, the NationalAssociation of Judicial Magis-trates of Chile issued a state-ment, imploring victims of thePinochet dictatorship to pardonthe judiciary’s “wrongfulomissions of its duties”.

The statement candidlyconfessed: “Our courts’ inad-missibility and rejections ofthousands of complaints —many of which were rightlyfiled on behalf of compatriotswhose fate was never deter-mined — the systematic re-fusal to investigate criminalacts perpetrated by stateagents, and reluctance to per-sonally get involved in the ac-tions taking place in detentioncentres and torture, no doubtcontributed to the painful im-balance of human rights duringthis dark period.” Furthermore,while beseeching for absolu-tion, the magistrates catechisedChile’s Supreme Court to re-flect on its own conduct duringPinochet’s 17-year-old dicta-torship.

The famousEnglish barrister GeoffreyRobertson, Q.C., whose serv-ices are in demand internation-ally in cases concerning viola-tion of human rights, has writ-ten a cogent statement of thelaw in his book Crimes AgainstHumanity: The Struggle forGlobal Justice.

The imprisonment inBritain of Chile’s dictator Gen-eral Augusto Pinochet and thejudgment in his case by theHouse of Lords signifies abenchmark in the growth of in-ternational law on the trials ofperpetrators of torture and oth-er “crimes against humanity”regardless of the immunity thata former leader or high stateofficial enjoys and regardlessalso of where he is found.

139 militantsneutralized by Armyin J&K till AugustNEW DELHI: As many as 139 militantshave been neutralised by the IndianArmy in Jammu and Kashmir in thefirst eight months of this year, defencesources said on Saturday. The numberincludes terrorists killed in skirmishesalong the Line of Control (LoC), as wellas in various encounters with the Armywithin the hinterland of the state. Thefigures provided by the Army wererecorded from the period January 1 tillAugust 29. During the same period, theArmy has lost as many as 26personnel belonging to various ranks interrorist-initiated incidents across thevalley. The highest number of fatalities(8) suffered by the Army in any singlemonth during the first eight months ofthe calendar year was in February."Five militants have been neutralizedby the Army in the month of Augustwhile one was captured during anoperation. The month of May was themost eventful as far as militaryengagements against terrorists isconcerned," said a senior Army official.

Pak violates ceasefirealong LoC in Poonch

Pakistani troops resorted tomortar shelling and smallarms firing on forward postsand villages along the Line ofControl (LoC) in Poonchdistrict of Jammu andKashmir, officials said. Theceasefire violation by Pakistancomes a day after Army ChiefGeneral Bipin Rawat visitedthe troops on the LoC in thetwin districts of Poonch andRajouri, and reviewed theprevailing situation andoperational readiness of theunits of White Knight Corps."At about 1300 hours,Pakistan initiated ceasefireviolation by firing of smallarms and shelling withmortars in Poonch sector. TheIndian Army is retaliatingbefittingly," Jammu-basedArmy PRO Lt Col DevenderAnand said in a briefstatement. Officials said thefiring from across the borderwas intense and was stillcontinuing when last reports

were received. However, therewas no report of any casualtyin the Pakistani firing, theysaid. Seven people, includingfive soldiers and a 10-day-oldbaby, were killed and severalothers injured in frequentceasefire violations byPakistan along the LoC in thetwo districts since July. Thechief of Army staff (COAS),who was on a two-day visit toJammu and Kashmir, onSaturday visited forward areasalong the LoC in Poonch andRajouri districts, and reviewedthe mission readiness of units,response mechanism toceasefire violations, measuresadopted to deal with Pakistanproxies, counter infiltrationposture and preparation todeal with violent actions onthe Line of Control. Duringhis visit, Gen Rawat interactedwith the soldiers deployed onthe LoC and commendedthem for their unwaveringdedication to duty, selflessdevotion and high standard ofprofessionalism.

All these aspects makehorticulture a significant sector for thefarmers and state government as well.At present, 2.30 lakh hectare area isunder horticulture. Fruit production hasbeen increased to 10.38 lakh MT in2019. Horticulture's contribution inState's annual income is approximatelyRs. 3000 to Rs. 5000 crore and about 9lakh people are involved in horticultureactivities for their livelihood. More than30.37 lakh fruit plants have beendistributed among farmers of the Stateand approximately 8446.93 hectareadditional area was brought underhorticulture in the state during thepresent government. An area of 83,677sq. m. has been covered under green

house and 9,44,215 sq. m. area has beencovered under Anti-Hail Nets underMission for Integrated Development ofHorticulture (MIDH) in the State. Topromote the mechanization ofhorticulture activities, subsidy has beenprovided for 3,049 power operatedequipments and construction of 198water collection tanks for the benefits offarmers in the state during the presentgovernment. To combat incidence ofpests/diseases in fruit crops, 349.90 MTpesticides involving Rs. 5.21 croresubsidy have been supplied to thefarmers of State. To ensure remunerativeprices of produce to growers, 371Procurement centers were opened forapple, mango and citrus fruits and27,348.91 MT fruit worth Rs.2064.74lakh has been bought from farmersunder Market Intervention Scheme and1,33,333 plastic crates were alsoprocured to distribute among thefarmers for categorization andmarketing of fruits during the presentgovernment.

ROB on Chogitti-Ladhewali railway crossing approved :ChaudharyJALANDHAR: Jalandhar MP Santokh Singh Chaudhary on Sunday informed that the centralgovernment has accepted the demand of a rail over bridge (ROB) on Chogitti-Ladhewali railwaycrossing and has begun the process for approval of an ROB on Dakoha railway crossing. TheCongress MP had raised these demands before Northern Railways General Manager T P Singh, whohad assured him of a prompt action in the matter. In a letter to him, the GM wrote that the proposal forROB on Chogitti-Ladhewali crossing was accepted in 2019-20 budget. For ROB on Dakoha crossing,the Union Government is waiting for a proposal from Punjab government. “I will speak to ChiefMinister Capt Amarinder Singh to expedite the submission of a proposal regarding ROB on Dakohacrossing. The construction of these railway over bridges would benefit the people immensely. In myconstituency, wherever there are railway crossings, over bridges and under bridges will be built for thesafe movement of people,” he said.

Former prime minister DrManmohan Singh on Sun-day lashed out at NarendraModi-led Union govern-ment for the country's eco-nomic situation and saidthat "the state of the econo-my today is deeply worry-ing".

"The last quarter’sGDP growth rate of fivepercent signals that we arein the midst of a prolongedslowdown. India has thepotential to grow at a muchfaster rate but all round mis-management by the Modigovernment has resulted inthis slowdown", Dr Singhsaid a video statement. Theformer PM's criticism cametwo days after the govern-ment stated that the growthin India's gross domesticproduct (GDP) was fivepercent in the first quarterof current financial year,2019-20, compared with5.8 per cent in the previous

financial year. "It is particu-larly distressing that themanufacturing sector'sgrowth is tottering at 0.6percent. This makes it veryclear that our economy hasnot yet recovered from theman-made blunders of de-monetisation and hastilyimplemented GST", DrSingh added. He also urgedthe government to "putaside vendetta politics, andreach out to all sane voicesand thinking minds, to steerour economy out of thisman-made crisis" and

added that "our youth,farmers and farm workers,entrepreneurs and the themarginalised sections de-serve better. India cannotafford to continue downthis path". AnFIR has been registered against a police in-spector in Mumbai for "inaction" in the case of al-legedrape of a 19-year-old woman who later diedat a hospital, police said on Sunday. The woman,who belonged to a Scheduled Caste as per herlawyer, was allegedly raped by four of her friendsin Mumbai in the first week of July. She was lateradmitted to a state-run hospital in Maharashtra'sAurangabad city where she died on August 28.

Based on the complaint by lawyer Nitin Sat-pute, representing the woman's family, an FIR waslodged against Chunabhatti police station's inspec-tor Deepak Surve on Saturday, according to police.In the complaint, Satpute alleged "inaction" by thepolice in handling the case.

He claimed the police also failed to register of-fences against the accused under the SC/ST (Pre-vention of Atrocities) Act, as the victim belongedto a Scheduled Caste. "Prima facie, there is a seri-ous flaw on part of the police, who, inspite of theefforts made by the victim's family to seek actionagainst the gangrape culprits, didn't bother to actagainst the accused," Satpute alleged.

"The First Information Report (FIR) has beenregistered against police inspector Deepak Surveunder the Scheduled Castes/Scheduled Tribes(Prevention of Atrocities) Act for humiliating thevictim," he added. The alleged rape came to lightonly when the woman complained of pain in herprivate parts on July 24 and was admitted to a pri-vate hospital in Aurangabad, located around 325km from here.
