Annual Complaint Report Calendar Year 2010

ANNUAL COMPLAINT REPORT - EXECUTIVE SUMMARYfor the Calendar Year 2010

The Annual Complaint Report includes information on the types of complaint allegations received, the disposition of those allegations, and the resulting discipline, as well as summary information by rank and division of assignment.

A complaint is the first step in the Department’s disciplinary process. Complaints may be made by members of the public, or may originate within the Department. A complaint may include various allegations against one or more employee, sworn or civilian. Complaint allegations are investigated to determine their validity. Recommended findings are made by an accused employee’s commanding officer. Disciplinary action is taken against employees who are shown to have violated Department policies regarding misconduct or failure to perform the duties of their positions. The type and severity of discipline imposed varies according to the nature of the sustained allegations and the accused employee’s work history and disciplinary record. The Chief of Police makes the final determination of discipline imposed.

Pursuant to LAPD Policy, Internal Affairs Group shall investigate all complaints which allege: unauthorized uses of force; discrimination; improper ethnic remarks; gender bias; unlawful search; unlawful seizure (including false imprisonment and false arrest); dishonesty; domestic violence; improper behavior involving narcotics or drugs; sexual misconduct; theft; and retaliation. All other allegations are investigated by an employee's chain of command supervisors.

Since this section is based on closed complaints during the year, it does not necessarily depict the number of complaints received or the patterns of conduct by employees during that time period. A case originating in one year might be closed in another year and not necessarily with other cases originating from the same period. Some cases may be delayed many months due to pending Board of Rights' findings or criminal filing decisions by the Office of the District Attorney.

Appendix AThis report was originally created to meet the Consent Decree requirements specified in paragraph 130, which read:

The LAPD shall annually report to the Commission, with a copy to the Inspector General, the type of complaint allegations it receives and the disposition (including sustained rate) and discipline or lack of discipline resulting from each type of allegation. This report shall include both the allegations received and any collateral misconduct discovered during the investigation. This report shall list the above information for each type of allegation as well as summarize aggregate information by geographic division(department, bureau, area, and district), officer rank, and type of assignment.

Explanation of Tables

Disposition of Closed Complaint Allegations and Sustained Rate by Allegation: Table A lists the total number of final allegations made and the disposition of allegations for each allegation type. It also lists the number of sustained allegations (those adjudicated as Guilty, Sustained, or Sustained-No Penalty) and the allegation sustained rate. Allegations are counted for each accused employee. The allegation totals are also repeated in Tables B1, C, E, and G.

Sustained Rate by Allegation Type and Distinct Employees Cited in Complaints: Table B1 lists the allegation sustained rate and number of employees (sworn & civilian) cited in complaints. The number of allegations may not be equal to the number of employees, as multiple allegations may be attributed to one employee in a complaint. This may also hold true for the employee count, as an employee may have multiple sustained allegations, and will consequently be listed multiple times (i.e., once for each allegation).

Penalty Imposed By Rank: Table B2 lists discipline imposed by rank. Discipline is imposed based on the totality of the sustained allegations. For example, if an employee is suspended for 10 days for Discourtesy, Dishonesty and Neglect of Duty, it should not be assumed that the employee received 3.3 days for each allegation type.

Source of Complaints Closed and Sustained Rate by Allegation Type:Table C lists the number of complaints closed, the number of sustained complaints, and the

sustained rate for each allegation type. It also lists the number of complaints closed and sustained rate by the source of complaint. A single complaint will be listed for more than one allegation type if it includes allegations of multiple types.

Allegation Summary by Employee Rank:Table D lists the number of sustained allegations and the total number of allegations made for

each rank and allegation type.

Allegation Summary by Employee Assignment Type: Table E lists the number of sustained allegations and the total number of allegations made for each assignment and allegation type. Each employee’s assignment type is derived from division of assignment and rank.

Tables F, G, and H: These tables display information based on the organization of the accused employees at the time of incident, which may not be the same organization at the time the



complaint is closed and may also include some former employees due to retirement, resignation, or removal. The total of the complaints by source category may be greater than the number of total closed complaints since one complaint may have more than one source. A complaint containing multiple accused employees may be assigned to more than one area/division within a bureau, but will be counted only once when totaling the complaints at the bureau level.

Complaint Summary for Closed Complaints by Bureaus and Divisions: Table F lists the complaints closed (in total and by source of complaint), complaints sustained, and sustained rate for each bureau and division. It also shows the number of employees cited in complaints, the number of employees having sustained allegations, the number of employees suspended and the number of employees who received a penalty more severe than a suspension such as a discharge or removal. Table F also lists the most frequently occurring allegation types for each bureau and division along with the number of counts and the counts sustained.

Complaint Summary for Closed Complaints by Employee Rank: Table G lists the same information as Table F, but presents it by rank, rather than by Department, bureau, and division.

Complaint Summary for Closed Complaints by Assignment Type:Table H lists the same information as Tables F and G, but presents it by assignment type.
