LEGAL FORM OF BUSINESS

To open a bakery, you must first obtain a business license. The business license gives you permission to legally operate your bakery within a specific jurisdiction. According to the Small Business Administration, if the restaurant is involved in activities regulated by a federal agency, such as interstate transport of animal products or plants, you may need a federal business license. State, county or local agencies may require licensing and charge an annual fee or a percentage of your sales to maintain the license. As with any business, a new restaurant must exist as a legal entity at the local, state and federal level. Even when registered as a corporation with both the IRS and a state Department of Revenue, a restaurant must comply with local business licensing guidelines. This sometimes means registering a trade name at city hall, while other situations require more complex licensing.

DESCRIPTION OF INDUSTRY ( SIZE , GROWTH RATE , HISTORY )

There are many players in the bakery industry. The top four companies are estimated to only account for 11.7 percent of the market. The industry is characterized by many small bakeries, but there has been a recent trend towards consolidation and economies of scale. Businesses compete on price, quality, differentiation and relationships with key suppliers. I want a small size business.

TYPE OF ACCOUNTING SYSTEM

Since our business is small we want to start using QuickBooks for ours accounting system. After a while operation the system, and as we progress we want to change our accounting system to something better. Bookkeeping software that combines a variety of accounting processes into one user-friendly system. The software's primary function is to alleviate the use of multiple tables, spreadsheets, and tracking sheets necessary to document and maintain accounting tasks at a company. Accounting figures are also easily reconciled for tax purposes with Quickbooks. The software was developed by Intuit and can be customized based on the needs of the business utilizing the software.I want to use QuickBooks system because since 65% of the smalls business use the system I want to use it too.

LICENSES

Business License Cities and counties normally require a bakery

to have a business license issued by the city or county. These are typically annual licenses, renewed each year for a fee. If the business is in an unincorporated area of the county, the county normally issues the license, while bakeries within the city limits obtain a license through the city. Some states require a business to obtain a fictitious business name, in which the bakery registers its business name according to the rules of the state.

Sales Permit If the state charges sales tax, the bakery

owner typically needs a sales permit. Rules regarding taxable items vary by state, with some states exempting certain types of food from sales tax. Another consideration is if the food is carryout or eaten on the premises like a restaurant. The food sales tax exception normally does not apply to restaurant food.

Health Department Permit The bakery typically needs a permit from the

local health department. The health department might also require certain employees of the bakery to obtain food handler's cards. These are certificates the employee earns after completing a food safety class. The health department will periodically check the bakery to verify the business is complying with health and safety standards set for food establishments.

• Fire Department PermitThe local fire department may require the bakery have a fire department permit. This often involves a routine check of the premises to inspect the installation of the ovens and verify the bakery has adequate fire protection. Some ordinances specify a bakery or restaurant have an overhead sprinkler system that the fire inspector might check.

• Other PermitsAs with any business, the bakery may need additional permits or licenses to comply with local or state ordinances. This might include a sign permit, parking permits or building permits to make necessary alterations to the bakery building.
