'P;J 6'00 . cUnitPrice PROCLAMATION NO. 311/2003 THE ADDIS ABABA CITY GOVERNMENT REVISED CHARTER PROCLAMATION WHEREAS, it is believed that Addis Ababa must. become a suitable urban space for work and residence measurable by modem standards in view of the fact that it is the capital of the Government of the Federal Democratic Republic of Ethiopia and the seat of the African Union and of a variety of International Organizations as well as it is a reflection of a lar~e and growmg residents representative of Nations, Nationahties and Peoples; . WHEREAS, having based upon the provisions of the Constitution of the Federal Democratic Republic of Ethiopia which stipulates that the residents of Addis Ababa have full power of self-government and that the details thereof shall be set out by law; / WHEREAS, it is necessary to create conditions which enable the city to maximize the achievements of its develop- ment objectives by giving due account to the best wishes and diligence of its resiaents and by relying on its dev~lopment potentials; WHEREAS, in order that the competitiveness and developmental countinuity become real and being aware that the city can by attracting investment have substantial con- tribution to the improvement of the lives of its residents and to open up a way for the economic development of the country, it is found necessary to enable the city cope with time through self-renewal so that its operations and processes become efficient, effective and eqUitable as well as change generative and receptive; / WHEREAS, it is found necessary to replace the Addis Ababa City Government Charter Proclamation No. 87/1997 by taking mto account experiences gained in its application and by looking into the organization and management of the city from the perspective of democratic principles and good governance as well as contemporary trends of growth and development; .     REVISED CHARTER PROCLAMATION

    WHEREAS, it is believed that Addis Ababa must.become a suitable urban space for work and residencemeasurable by modem standards in view of the fact that it isthe capital of the Government of the Federal DemocraticRepublic of Ethiopia and the seat of the African Union and ofa variety of International Organizations as well as it is areflection of a lar~e and growmg residents representative ofNations, Nationahties and Peoples; .

    2. Definitions

    Unless the context indicates otherwise, in this Charter,1) "City" means the Addis Ababa City;2) "City Government" means the Addis Ababa City

    Government;3) "Mayor" means the chief executive officer of the

    City Government;4) "Municipal Service" means water and sewerage

    service, road construction service, fire and emer-gency service, day to day services for residentsincluding civil status record operations, land de-velopment and management, City sanitation andbeautification and other services to be designated assuch by the City government;

    5) 'Sub-City" means a second administrative stratumof the City;

    6) "Qebele" means a third administrative stratum ofthe City but a unit of a sub-city;

    7) "Conditions of work" means the entire relationsbetween the City Government and its officials andemployees and shall include hours of work, salary,leaves, payments due to dismissal, if any, health andsafety, compensation to victims of employmentinjury, grievance procedure and othe similar matters.

    3. Legal Personality

    The City Government shall have legal personality.

    4. Name

    The name of the City is Addis Ababa.

    5. Boundary

    Without prejudice to the existing boundary of the city,the boundary of the City shall be delimited by anagreement to be made between the City Government andthe Oromia Regional Government or according to thedecision of the Federal Government.

    Working Language

    The working language of the City Government isAmharic.

    7. Rights of Residents

    1) Without prejudice to the Constitution of the FederalDemocratic Republic of Ethiopia and other laws ofthe country, the residents of the City have the right toseek and receive information, forward theiropinions, invoke questions, and receive repliesconcerning decisions relating to the city.

    2) Residents have the right to get services to berendered by the City Government in accordance withthe principles of equality, transparency and equity.

    3) Policies, budgets, plans and directives of the CityGovernment must be,publicized to residents.

    18. Deputy Spokesperson of the City Council:1) The Deputy spokesperson, being shall accountable

    to the spokesperson of the Council,(a) act on behalf of the spokesperson in the

    absence or incapacity of the latter.(b) perform other functions assigned to him by the

    spokesperson.2) The provisions set forth under Article 17(1) shall be

    applicable to the Deputy spokesperson.

    19. Secretary of the City CouncilThe Secretary of the Council. being accountable to thespokesperson of the Council, shall:1) prepare the agenda of the Council in consultation

    with the spokesperson, and record, publish and keepthe minutes of the Council.

    2) ensure that the minutes and documents of thecommittees of the Council are recorded and kept. Heshall also distribute minutes in accordance with theinternal Regulations of the Council.

    3) have a term of office of the Council, provided,however, that he may be removed from office byresignation, suspension or termination of his mem-bership of the Council. The details thereof shall beset out by the internal Regulations of the Council.

    4) perform other functions assigned to him by thespokesperson.

    PART FOURExecutive Bodies of the City

    20. Constitution of the Executive Organ of the CityThe political party occupying the majority seats of theCouncil or, where such does not exist, the coalition ofpoliticalpartiesshallconstitute the executive organ of theCity.

    21. Mayor ,1) The Mayor, being accountable to the City Council

    and the Federal Government, shall be the chiefexecutive officer of the City.

    2) Without prejudice to the generality of the provisionsof Sub-Article (1) of this Article, the Mayor shall:(a) execute decisions, laws, annual plans and bud.

    gets adopted by the City Council:(b) propose to the City Council various policies,

    economic and social development plans, andannual budget of the City after consultationthereon by the Cabinet and ensure implemen-tation thereof upon approval;

    (c) represent the City as an ambassador thereof;(d) ensure the observance of law and order in the

    City;(e) nominate, from among members and non-mem-

    bers of the City Council and seek the Council'sapproval of the appointment of Cabinet mem-bers and shall direct the cabinet;

    (f) propose three external auditors to the CityCouncil where the latter resolves, as may benecessary, to appoint an external auditor;

    (g) hire the City Manager by a contract of em-ployment for a definite period of time on thebasis of his professional competence and inconsultation with the Cabinet;

    (h) handle grievances of residents;

    (i) represent the City in ceremonies of national andpublic holidays;

    (k) submit annual report to the Council. He shallalso submit to the Council periodical report asnecessary as may be determined by the latter.Likewise, he shall submit report to the Ministryof Federal Affairs according to the provisionsof Article 61(6) of this Charter;

    (1) ensure that a standardized municipal servicedelivery is implemented;

    (m) prepare and propose to the Federal Govern-ment the amount of support needed from thelatter after consulation thereon by the CityCabinet;

    (n) prepare and propose drafts of proclamationsand Regulations to the Council after consul-tation thereon by the Cabinet;

    (0) appoint the heads of the executive bodies of theCity other than those whose appointments mustbe approved by the Council. He shall alsodesignate the chairpersons and members of theboards of public enterprises and other bodies ofthe City;

    (p) organize his Office;(q) award prizes in accordance with law;(r) perform other functions assigned to him by the

    City Council and by the Federal Government.3) The term of office of the Mayor shall be that of the

    him by the Mayor.2) The provisions of Article 21(3) shall be applicable to

    the Deputy Mayor.

    23. The City Cabinet1) The City Cabinet, being accountable to the Mayor

    and for its joint decision to the City Council, shall:(a) ensure that Proclamations, Regulations,

    resolutions and standards adopted by the CityCouncil and by the Federal Government areimplemented;

    (b) ensure that policies adopted by the Council areimplemented;

    (c) initiate city\vide policies and drafts ofProclamations and Regulations;

    (d) deliberate over the annual plans and budgetsof the City;

    (e) decide on the organizational structure of theexecutive bodies of the City Government;

    (f) issue Regulations according to the authoritygiven to it by Proclamations to be issued by theCouncil.

    (g) perform other functions assigned to it by theMayor and by the Council.

    2) The term of office of the Cabinet shall be that of theCouncil.

    24. City Manager1) The City Manager, being accountable to the Mayor,

    shall be the executive of municipal services.2) Withoutprejudice to the generality of the

    provisions of Sub-Arti~le (1) of this Article, theCity Manager shall:(a) propose to the Mayor to establish municipal

    service bodies accountable to the CityManager .or to implement other service de-livery alternatives;

    (b) propose the appointment of the heads ofmunicipal bodies. Upon the approval of theirappointments, he shall supervise theiroperations and discharge them in accordancewith law;

    (c) hire and administer competent professionalsas Sub-City managers by contract of em-ployment for a definite period of time anddischarge them as the case may be; he shallalso receive, examine and decide upon annualreports and, where necessary, periodicalreports from Sub-City managers;

    (d) prepare and submit to the Mayor action plansand budget proposals concerning citywide andinter Sub-City. municipal services and im-plement same upon approval;

    (e) develop and propose to the Mayor servicedelivery indicators and guidelines and im-plement same upon the endorsement thereof;

    (t) ensure the delivery of efficient, effective andequitable municipal services;

    (g) implement decisions concerning municipalservices;

    (h) prepare and propose to the Mayor policyinitiatives and legal drafts concerningmunicipal services;

    (i) recommend'to the Mayor the employment ofthe deputy City manager and hire him uponapproval thereof;

    U) submit, to the Mayor work performancereports. .

    (k) receive and handle as well as give immediatereplies to the pleas of residents concerningmunicipal services;

    (I) constitute and direct a management committeeconsisting ofthe heads of municipal services inhis charge;

    (m) perform other functions assigned to him bythe Mayor.

    3) The City Manager may participate, without a vote,in meetings of the City Council.

    25. Deputy City ManagerThe Deputy City Manager, being accountable to theCity Manager, shall:1) act on behalf of the City Manager in the absence or

    incapacity of the latter.2) perform other functions assigned to him by the City

    Manager.

    26. Office of the City Government Chief Auditor1) The City Government shall have the Office of the

    Chief Auditor which inspects and reports to theCity council the efficiency, performance effec-tiveness, resoruce utilization and administrationthereof.

    2) The office of the Chief Auditor shall perform it~functions independntly.

    3) The Chief Auditor shall not be removed from hisoffice before retirement, except for resignation orfor reasons set forth below:

    (a) disciplinary breach, grave incompetence or. poor performance;(b) proven inability to fulfil his responsibilities

    because of illness; or(c) where the City Council decides to that effect.

    4) The Chief Auditor shall prepare and submit to theCity Council the budget of his office and administersame upon approval.

    27. Addis Ababa City Police Commission1) The City Police Commission, being accountable

    primarily to the Federal Police Commission and bydelegation, to the City Government, shall:(a) be estblished by Regulations the Council of

    Ministers issues in accordance with theFederal Police Commission Proclamation;

    (b) prepare and submit its plan and budgetproposal to the Mayor and implement sameupon approval. It shall also submit periodicalperformance reports to the Mayor, whichshall be examined and decided by the CityCabinet and by the City Council.

    2) The City Police Commissioner and Deputy Com-missioner shall be appointed by the Minister of theFederal Affairs.

    3) The responsibility to follow up the daily operationsof the City Police Commission shall be of theMayor.

    28. Public Prosecution Office of the City Government1) The City Public Prosecution Office shall Prosecute

    such penal offences that fall under the jurisdictionof the City Courts and carry out other relevantfunctions in accordance with the appropriate law.

    2) The organization of the Office shall be determinedby law to be issued by the City Council.

    29. Ethics and Anti-Corruption Commission of the CityGovernment

    The City Government shall have Ethics and Anti-Corruption Commission which is to be established andto function in accordance with law the City Councilmakes.

    PART SIXSub-City and Qebeles

    30. Sub-Cities1) A Sub-City shall function as a municipality within

    the bounds of the physical space located for it inaccordance with the principle of decentralizationand in coordination with the organs of power of theCity Government.

    2) A Sub-City shall administer the Qebeles under itsjurisdiction.

    3) Sub-Cities shall have the responsibility of ensuringthe observance of law and order in their locality.

    4) The term of office of a Sub-City Council shall befive years.

    31. Boundaries of Sub-Cities and Qebeles1) Without prejudice to the provisions of Article 5 of

    this Charter, the boundaries of Sub Cities andQebeles shall be delimited by the City Council.

    2) The City Council may either establish new SubCity or Qebele or reorganize the existing Sub Citiesor Qebele taking into account the opinions of therespective residents, suitablility of service delivery,urba!1development plan and the size of population.

    32. Sub-City Council1) A Sub-City. Council, being accountable to the

    residents of the respective Sub-City and to the CityCouncil, shall:(a) approve the economic, social development

    and municipal plans of the respective Sub-City;

    .

    (b) elect, from among its members, the Spokes-person, Deputy Spokesperson and Secretaryof the respective Council;

    (c) elect the chief executive and the deputy chiefexecutive of the Sub-City from among itsmembers upon the nomination of the politicalparty occupying majority seats in the Council;

    (d) approve the appointments of the members ofthe standing committee of the respective Sub-City upon the nomination of the chief ex-ecutive;

    (e) allocate the budget set aside to it by the CityCouncil;

    (t) constitute its committees;(g) receive, examine and decide upon the annual

    and periodical reports from the Sub-City chiefexecutive;

    (h) issue internal Regulations which govern itsoperations.

    2) The City Council shall dissolve a Sub-City Councilwhere it belives that the decision of the Sub-CityCouncil is unlawfull or that it jeopardizes theinterests of the residents of the Sub-City in question.It shall also specify the deadline of re-institution andthe conditions under which daily operations resume.This shall similarly be applicable to the decision of aSub-City Council where it dissoives a QebeleCouncil.

    33. Spokesperson, Deputy Spokesperson and Secretary of aSub-City CouncilThe provisions of Articles 17, 18 and 19 of this Chartershall be applicable to the powers and functions of theSpokesperson, the Deputy Spokesperson and theSecretary of a Sub City, respectively.

    34. Chief Executive of a Sub-City1) The chief executive of a Sub-City, being accoun-

    table to the respective Sub-City Council and to theMayor, shall govern the respective Sub-City.

    2) Without prejudice to the generality of theprovisions of Sub-Article (1) of this Article, a Sub-City chief executive shall:(a) nominate, from among members and non-

    members of the respective Sub-City Counciland seek the approval of the appointment, bythe Sub-City Council, of the members of thestanding committee thereof; .

    (b) call and preside over the meetings of therespective standing committee;

    (c).~ submit to the respective Sub-City Council theproposal of the Sub-City's annual plan andbudgetarY allocation after consultationthereon by the Sub-City standing committee;

    (d) ensure the observance of law and order in therespective Sub-City and inform the Mayor inthe event of a security problem beyond theSub-City's capacity;

    (e) receive, examine and decide over the reportsfrom the respective Sub-City manager;

    (t) see to it that municipal service delivery isevaluated by the respective Sub-City standingcommittee and report to the Sub-City Counciland to the Mayor the outcomes thereof;

    (g) represent the Sub-City on the occasion ofnational ceremonies and public holidays.

    (h) submit annual and periodical reports to therespective Sub-City Council and to theMayor;

    (i) perform other functions assigned to him by hisrespective Sub-City Council and by the Mayor.

    38, Powers and Functions of a Qebele1) A Qebele shall be a centre of development and direct

    popular participation as well as a station for servicesthat may be delivered at that level, and(a) . it shall have powers and 'functions the City

    Council specifically confers thereon. The ac-countability of Qebele Administration is tor~sidents of the respective Qebele and to therespective Sub-City Aqministration.

    (b) it shall create conditions in which the respectiveresidents avail of services in their vicinity asclose as possible.

    2) A Qebele shall have a Council, a spokesperson, asecretary, a chief executive, a standing committee, amanager, a social court and different executivebodies. Their powers and functions shall be deter-mined by the law to be issued by the City Council.

    PART SEVENCity Courts and Other Bodies with

    Judicial Powers

    39. CourtsThe City Government shall have the following Courts:1) The Addis Ababa City Courts; and2) Qebele Social Courts.

    40. Other Bodies with Judicial PowersThe City Government shall have the following bodiesentrusted with judicial powers:1) Labour Relations Board;2) Civil S~rvice Tribunal;3) Tax Appeals Commission, and4) l!rban Land Clearance Matters Appeals Commis-

    sion.41. Jurisdiction of the Addis Ababa City Courts

    The Addis Ababa City Courts shall have jurisdiction overthe following matters:1) Civil Jurisdiction:

    (a) suits of possessory right, issuance of permit orland use relating to the enforcement of the CityMaster Plan;

    (b) suits arising in connection with the regulatorypowers and functions of the executive andmunicipal service bodies of the City Govern-ment;

    (c) suits arising from fiscal matters set out underArticle 52 of this Charter;

    (d) suits arising from the administrative contractsconcluded by the executive and municipalservice bodies of the City Government or by theenterprises under the ownership of the CityGovernment; .

    (e) suits arising between the executive andmunicipal service bodies or between the enter-prises of the City Government;

    (t) suits arising in connection with the governmentowned houses administered by the City Govern-ment;

    (g) applications to change names;(h) applications of succession and guardianship

    and/or tutorship or spousal certificates; and(i) applications for the declaration of absence or

    presumption of death.2) Criminal and Petty Offence Jurisdiction

    (a) offences committed in connection with fiscalmatters set out under Article 52 of this Charter;

    (b) cases of petty offences;(c) without prejudice to the jurisdiction of Federal

    Courts, remand in custody and bail applicationson Federal offences;

    42. Conflict of Jurisdiction and Power of Cassation

    1) The Federal Supreme Court shall decide on conflictof jurisdiction that arises between the Addis Ababacity courts and Federal courts.

    2) A party alleging a fundamental error of law in thefinal judgment rendered in cassation by the AddisAbaba City Appeallate Court may apply for cas-sation before the Federal Supreme Court.

    3) A party alleging a fundamentalerror of law in a finaljudgment of the Addis Ababa City appeallateCourtsmay apply for Cassation of the Federal SupremeCourt.

    43. Organizationand Procedures of the Addis Ababa CityCourts1) The City Courts shall have First Instance Courts and

    AppeallateCourts2) A First Instance Court shall have first instance

    jurisdiction over matters falling under the jurisdic-tion of the City Courts.

    3) The AppeallateCourt shall entertainappeals over thedecisions of the first instance court and other bodiesentrusted withjudi~ial power.

    4) The City Courts shall execute their functions inaccordancewith appropriate laws.

    5) Without prejudice to the provisions of Article 42,decisions rendered by the appeallate Court shall befinal.

    6) The organization of the City Courts shall be deter-mined by law to be issued by the City Council.

    44. Judicia}Administration Commission of the Addis AbabaCity Courts1) The Judicial AdministratioJ;1Commission, which

    directs thejudicial administrationof the City Courts,shall be constituted; and the details thereof shall beset out by the law the City Council makes.

    2) The Commission shall have a representative of theFederal Courts.

    45. Appointment and Term of Office of Judges1) The City Judicial Administration Commission has

    the responsibility to primarily shortlist judges forCiPpointmentand solicit the views of the FederalJudicial Administration Commission respecting thecandidatesand then to forward such viewsto the CityCouncil through the Mayor, together with its recom-mendations. If the Federal Judicial AdministrationCommission does not submit its views within threemonths, the shortlist .of the candidates shall beforwarded to the City Council for appointment.

    2) Nojudge shall be removed from his office except forresignationor for the following conditions:(a) 'Yherethe Judicial .t.dministrationCommission

    decides to remove him for violation of dis-ciplinary rules or on grounds of professionalincompetenceor poor performance:or

    (b), where a judge can no longer carry out hisresponsibiliteson account of illness;and

    (c) where the City Council approves by a majorityvote the decision of the Judicial AdministrationCommission.

    46. Labour Relations BoardThe provisions of the labour proclal11ationNo. 42/1993(as amended) shall apply with respecUo thejurisdiction,organization and procedures of the Labour RelationsBoard of the City Government.

    , 4) assess andcollectfrom indiviqual tradesmenlocatedin the City profit taxes, excise taxes and turn overtaxes;

    5) receive value added taxes which shall be collectedby the Federal Government from individual trades-

    men residing in the City and public enterprisesowned by the City;

    6) set and collect rents and/or lease prices of land in the

    City. It shall also levy housing taxes in the City;7) assess and collect income taxes from houses and

    8) assess and collect stamp duties from contracts and

    agreements as well as from ownership title regis-tration undertaken in the City;

    9) assess and collect from public enterprises under the

    ownership of the City Government profit taxes,

    .excise taxes and turn over taxes;10) set road users charge and collect same from vehicles

    that use the roads of the City;11) set and collect rents from houses and other proper-

    .ties under the ownership of the City Government;12) assess and collect, income taxes, royalties and land

    rents and/or lease prises from mining operationsundertaken in the City;

    13) set and collect, royalty for the use of forest resources

    in the City;14) set payments relating to the licenses and services

    delivered by the City Government;15) levy municipal taxes and duties as well as set and

    collect service charges;.16) assess and collect income taxes from the gains of

    rentals of intellectual property rights in the City;17) assess and collect, capital gains tax from a property

    situated in the City.

    53. Revenues Generation

    The City Government shall:1) generate revenues by means of the operations of

    institutionsrun by it, by undertaking incomeearningactivities through special permit, joint investment,fund investment, rentals and fund-raising fromdonors, so long as such is not otherwise prohibitedby law.

    2) Participate through contractual commitments in avariety of remunerative activities.

    54. Borrowing

    1) The City Government may, as per the authorization

    of the Federal Government, borrow directly fromdomestic and external sources by short-term andlong-term repayment arrangement or by sellingbonds.

    .

    .2) Such a borrowing should take into account the fact

    that it does not endanger the. macro-economicstability of the country and the financial potential of

    the City GQvernment to permanently andperiodically discharge its functions and obligations.

    5) All collected funds shall only be dep98ited i~ bankaccounts opened as per the authorization of financelaws.

    6) The City Government and Sub-Cites shall havebank accounts to be opened in their names.

    7) The City Government shall have power to lawfullyrevoke taxes, interests and fines as well as to writeoff debts.

    59. BudgetPreparation and Administration1) The city budget ary administration shall follow the

    budget ary principles of the Federal Government.2) The City budget shall be prepared transparently and

    in a manner that ensures the participation ofresidents. 'Budgetary offices and other concernedorgans shall give their opinions on a budgetaryproposal before it is approved. Mass media shall beemployed to maximize the participation ofresidents. The meetings of the Council deliberatingover budget proposals shall be open to residents whoshall be notified of deliberations to be made overnew work programmes, capital expenditures andincomes.

    3) The City Council shall allocate contingency budget.The Mayor shall allocate the contingency budget forthe required work by notifying the City Cabinetthereabout and shall put it to use. He shall also notifyto the City Council to that effect.

    60. Public Enterprises of the City1) The public enterprises of the City shall be directed

    by Board.2) The public enterprises of the City are institutions

    which shall be governed as per the appropriate law.3) The Mayor shall designate board chairpersons and

    members from among candidates nominated by theCity Manager and the accountability of the boardsshall be to the City Manager.

    4) Public enterprises shall report to the City Manager.

    PART NINEIntergovernmentalRelationships

    61. The City Government and the FederalGoveJ nent1) The relationship that the City Governl nt main-

    tains with the Federal Government must. take cog-nisance of the responsibilitiesof the latter.

    2) The City Government is a component of the FederalGovernment. It shall be accountable to the FederalGovernment concerning security, diplomaticrelations, policies, laws and standards.

    3) The Federal Government has the power to dissolvethe City Governmentand to constitute a transitionalgovernment as per the decision of the House ofPeoples' Representatives where an act endangeringthe Constitution has been committed by the CityGovernment or where the City Government fails tocontrol security and emergency situations.

    4) The Federal. Government shall dismiss the CityGovernment in power and shall organize a tran-sitional government for the city where it is decidedas per Sub-Article (3) of this Article. The PrimeMinister shall ensure that such has been effectedwithin the time limit and as per the decision of theHouse of Peoples Representatives.

    5) The Ministry of Federal Affairs shall, as an agent ofthe Federal Government, follow up the performan-ces of the city government and shall support thecapacity-buildingundertakings of the City.

    ":4) Th~'PTovisional Government:(a) shall designate Sub-City and Qebele

    Provisional Governments;(b) shall implement Sub-City, an4Qebel~ d~-

    limita~ions,in accordance witp thi~ ~harter;(c) ..shallreorgapize the offices and public enter-

    prizes of the City Government and shall re-assign. hire and dismiss employees in ~ccor-dance with the organizational structure uapproves;

    (d) may establish during the transition periodCity. Sub-Cityand QebeleAdvisoryCouncilsin which residents"and representatives ofdifferent parts of society shall participate toen\1ance the organized participation ofresidents in development, building of de-mocracy and service delivery as well as torender decisions which meet the interests ofthe residents. The details thereof shall be setout by the Provisional Government of the

    , City.'4) The ProvisionalGovernmentof the City shallassign,

    train and may, where necessary, discharge theExecutiveCommitteemembersyet in power. It shallassign,by appointment, and transfer membersof theprovisional Government and may, where necessary,

    'discharge them from office., 5) The rights and duties of the organs or institution of

    the City Government by replacing or amalgamatingasper the organizationalstructureto be doptedby thelaw of the Provisional Government of the City shallbe transferred to the organs or institutions es-tablished; or it shall be decided by the provisionalGovernmentof the City, as the case may be.

    6) The Provisional Government of the City shall:(a) adopt Civil Service Law. As a result, the

    Federal Civil Service Laws shall not beapplicable to the City Government during thetransition period;

    (b) issue labour relations Regulations which setout the details under which the LabourRelations Proclamation No. 42/1993 (asamended) becomes applicable in the processof reorganizing the public enterprises of theCity.

    7) Proclamations, Regulations, decisions, orders anddirectives of the City Government that are in forceshallremaineffectiveso long as they are not replacedand in conflict with the provisions of this Charter.

    8) Cases pending in the Federal Courts and fallingunder the jurisdiction of the City Courts in accor-dance with this charter shall continue to be enter-tained by the Federal Courts.

    9) The Municipal First Instance Court and AppeallateCourt as well as Social courts hitherto at work shallhave the jurisdiction given to the respective courtsunder Article 41 and 50 of the Charter.

    67. Repi:aJed Laws

    1) The Addis Ababa City Government Charter

    Proclamation No. 87/1997 is repealed by this Char-

    ter.

    2). No law or practice in conflict with this Charter shallbe applicable to matters set forth by this Charter.
