AMENDMENT TO THE MONTREAL PROTOCOL ON SUBSTANCES

THAT DEPLETE THE OZONE LAYER

BEIJING, 3 DECEMBER 1999

ADOPTION OF AMENDMENT

The Secretary-General of the United Nations, acting in his capacity as depositary, communicates the following:

At the Eleventh Meeting of the Parties to the above Protocol, held in Beijing from 29 November to 3 December 1999, the Parties adopted, in accordance with the procedure laid down in article 9, paragraph 4 of the 1985 Vienna Convention for the Protection of the Ozone Layer, the Amendment to the Montreal Protocol as set out in Annex V to the report of the Eleventh Meeting of the Parties (Decision XI/5).

..... The text of the above Amendment, in the six official languages of its conclusion, is attached as an Annex to this notification.

In accordance with its article 3, paragraph 1, the Amendment shall enter into force on 1 January 2001, provided that at least twenty instruments of ratification, acceptance or approval of the Amendment have been deposited by States or regional economic integration organizations that are Parties to the Montreal Protocol on Substances that Deplete the Ozone Layer. In the event that this condition has not been fulfilled by that date, the Amendment shall enter into force on the ninetieth day following the date on which it has been fulfilled.

After its entry into force, the Amendment, in accordance with its article 3, paragraph 3, shall enter into force for any other Party to the Protocol on the ninetieth day following the date of deposit of its instrument of ratification, acceptance or approval.

Decision XF/5. Further Amendment of the Montreal Protocol

To adopt, in accordance with the procedure laid down in paragraph 4 of Article 9 of the ViennaConvention for the Protection of the Ozone Layer, the Amendment to the Montreal Protocol asset out in annex V to the report of the Eleventh Meeting of the Parties;

AMENDMENT TO THE MONTREAL PROTOCOL ON SUBSTANCES THAT DEPLETETHE OZONE LAYER

Article 1: Amendment

A. Article 2, paragraph 5

In paragraph 5 of Article 2 of the Protocol, for the words:

Articles 2A to 2E

there shall be substituted:

In paragraphs 8(a) and 11 of Article 2 of the Protocol, for the words:

C. Article 2F, paragraph 8 . .

The following paragraph shall be added after paragraph 7 of Article 2F of the Protocol:

8. Each Party producing one or more of these substances shall ensure that for the twelve-month periodcommencing on 1 January 2004, and in each twelve-month period thereafter, its calculated level ofproduction of the controlled substances in Group I of Annex C does not exceed, annually, the averageof:

(a) The sum of its calculated level of consumption in 1989 of the controlled substances in GroupI of Annex C and two point eight per cent of its calculated level of consumption in 1989 ofthe controlled substances in Group I of Annex A; and

(b) The sum of its calculated level of production in 1989 of the controlled substances in Group Iof Annex C and two point eight per cent of its calculated level of production in 1989 of thecontrolled substances in Group I of Annex A.

However, in order to satisfy the basic domestic needs of the Parties operating under paragraph 1 ofArticle 5, its calculated level of production may exceed that limit by up to fifteen per cent of itscalculated level of production of the controlled substances in Group I of Annex C as defined above.

D. Article 2 I

The following Article shall be inserted after Article 2H of the Protocol:

Article 21: Bromochloromethane

Each Party shall ensun; that for the twelve-month period commencing on 1 January 2002, and in each twelve-month period thereafter, its calculated level of consumption and production of the controlled substance inGroup III of Annex C does not exceed zero. This paragraph will apply save to the extent that the Partiesdecide to permit the level of production or consumption that is necessary to satisfy uses agreed by them to beessential.

E. Article 3

In Article 3 of the Protocol, for the words:

F. Article 4, paragraphs Iquin. and Isex.

The following paragraphs shall be added to Article 4 of the Protocol after paragraph 1 qua:

1 quin. As of 1 January 2004, each Party shall ban the import of the controlled substances in Group I ofAnnex C from any State not party to this Protocol.

1 sex. Within one ye;ir of the date of entry into force of this paragraph, each Party shall ban the import ofthe controlled substance in Group III of Annex C from any State not party to this Protocol.

G. Article 4, paragraphs 2 quin. and 2 sex.

The following paragraohs shall be added to Article 4 of the Protocol after paragraph 2 qua:

2 quin. As of 1 January 2004, each Party shall ban the export of the controlled substances in Group I ofAnnex C to any State not party to this Protocol.

2 sex. Within one year of the date of entry into force of this paragraph, each Party shall ban the export ofthe controlled substance in Group III of Annex C to any State not party to this Protocol.

H. Article 4, paragraphs 5 to 7

No State or regional economic integration organization may deposit an instrument of ratification, acceptanceor approval of or accession to this Amendment unless it has previously, or simultaneously, deposited such aninstrument to the Amendment adopted at the Ninth Meeting of the Parties in Montreal, 17 September 1997.

Article 3: Entry into force

1. This Amendment shall enter into force on 1 January 2001, provided that at least twenty instrumentsof ratification, acceptance or approval of the Amendment have been deposited by States or regional economicintegration organizations that are Parties to the Montreal Protocol on Substances that Deplete the OzoneLayer. In the event that this condition has not been fulfilled by that date, the Amendment shall enter intoforce on the ninetieth day following the date on which it has been fulfilled.

2. For the purposes of paragraph 1, any such instrument deposited by a regional economic integrationorganization shall not be counted as additional to those deposited by member States of such organization.

3. After the entry intoibrce of this Amendment, as provided under paragraph I, it shall enter into forcefor any other Party to the Protocol on the ninetieth day following the date of deposit of its instrument ofratification, acceptance or approval.

du Groupe I de 1'Annexe C; 2,8 % de son niveau calcule de consommation en 1989 des

substances reglementees du Groupe I de 1'Annexe A;

b) La somme de son niveau calcule de production en 1989 des substances reglementees du

Groupe I de 1'Annexe C; 2,8 % de son niveau calcule de production en 1989 des

substances reglementees du Groupe I de 1'Annexe A.

Toutefois, pour repondre aux besoins inte'rieurs fondamentaux des Parties visees au paragraphe1 de 1'article 5, son niveau calculi de production peut exceder cette limite d'un maximum de15 % de jon niveau calcule de production des substances reglementees du Groupe I de1'Annexe C tel que defini ci-dessus.

D. Article 21

Inserer 1'article d-apres a la suite de 1'article 2H du Protocole.

Article 21 : Bromochloromethane

Pendant la periode de douze mois commencant le premier Janvier 2002 puis pendant chaque periodede douze mois qui suivra, chaque Partie veille a ce que ses niveaux calcules de consommation et deproduction de substances reglementees du Groupe III de 1'annexe C soient egaux a zero. Ceparagraphe s'appliquera, sauf si les Parties decident d'autoriser le niveau de production ou deconsommation qui est necessaire pour repondre aux besoins en utilisations dont elles conviennentqu'elles sont esstmtielles.

E. Article 3

Article 3 : Entree en vigueur

1. Le present Amendement entre en vigueur le ler Janvier 2001, sous reserve du depot, a cettedate, d'au moin;; 20 instruments de ratification, d'acceptation ou d'approbation de 1'Amendement pardes Etats ou des organisations regionales d'integration economique qui sont Parties au Protocole deMontreal relatif a des substances qui appauvrissent la couche d'ozone. Si, a cette date, cettecondition n'a pa:> ete respectee, le present Amendement entrera en vigueur le quatre-vingt-dix-neuvieme jour suivant la date a laquelle cette condition aura ete remplie.

2. Aux fins du paragraphe 1, aucun des instruments deposes par une organisation regionaled'integration economique ne doit etre considere comme un instrument venant s'ajouter auxinstruments deja deposes par les Etats membres de ladite organisation.

3. Posterieursment a son entree en vigueur, tel que prevu au paragraphe 1, le present instrument

entre en vigueur pour toute autre Partie au Protocole le quatre-vingt-dix-neuvieme jour suivant la datedu depot de son instrument de ratification, d'acceptation ou d'approbation.

Articulo 1: Enmienda

A. Artfculo 2, parrafo 5

En el parrafo 5 del artfculo 2 del Protocolo las palabras:

Despues del parrafo 7 del artfculo 2F del Protocolo se anadira el parrafo siguiente:

8. Toda Parte que produzca una o mas de estas sustancias velar£ por que en el periodo de 12 mesescontados a partir del 1° de enero de 2004, y en cada periodo sucesivo de 12 meses, su nivelcalculado de produccion de las sustancias controladas enumeradas en el Grupo I del anexo C nosupere, anualmente, el promedio de:

a) La suma de su nivel calculado de consume en 1989 de las sustancias controladasenumeradas en el Grupo I del anexo C y el 2,8% de su nivel calculado de consumo en1989 de las sustancias controladas enumeradas en el Grupo I del anexo A;

b) La suma de su nivel calculado de produccion en 1989 de las sustancias controladasenumeradas en el Grupo I del anexo C y el 2,8% de su nivel calculado de produccion en1989 de las sustancias controladas enumeradas en el Grupo I del anexo A.

No obstante, a fin de satisfacer las necesidades basicas internas de las Partes que operan al amparodel parrafo 1 del artfculo 5, su nivel calculado de produccion podra superar ese Ifmite hasta en unacantidad igual al 15% de su nivel calculado de produccion de las sustancias controladas enumeradasen el Grupo I del anexo C defmidas supra.

D. Artfculo 21

Despues del artfculo 2H del Protocolo se anadira el siguiente artfculo:

Artfculo 21: Bromoclorometano

Cada Parte velara por que en el periodo de 12 meses contados a partir del 1° de enero de 2002, y en cada

periodo sucesivo de 12 meses, su nivel calculado de consumo y produccion de las sustancias controladasenumeradas en el Grupo IK del anexo C no sea superior a cero. Este parrafo se aplicara salvo en la medidaen que las Partes deddan permitir un nivel de produccion o consumo necesario para satisfacer los usosesenciales segun lo aiordado por ellos.

Ningiin Estado u orgaiiizacidn de integracidn economica regional podra depositar un instrumento deratificacion, aceptacioc o aprobacion de esta Enmienda, o de adhesion a ella, a menos que haya depositadoprevia o simultaneamente un instrumento de ese tipo en relacidn con la Enmienda adoptada en la NovenaReunion de las Partes oelebrada en Montreal, el 17 de septiembre de 1997.

Artfculo 3: Entrada en vigor

1. La presente E'lmienda entrara en vigor el 1° de enero de 2001, siempre que se hayan depositado almenos 20 instrumentos de ratificacion, aceptacidn o aprobacion de la Enmienda por Estados u organizacionesde integracion econdmica regional que scan Partes en el Protocolo de Montreal relative a las sustancias queagotan la capa de ozono. En el caso de que en esa fecha no se haya cumplido esta condicidn la Enmiendaentrara en vigor el non.igesimo dfa contado desde la fecha en que se la haya cumplido.

2. A los efectos c!el parrafo 1, los instrumentos depositaries por una organizacidn de integracioneconomica regional no se contaran como adicionales a los depositaries por los Estados miembros de esaorganizacidn.

3. Despues de la sntrada en vigor de la presente Enmienda, segiin lo dispuesto en el parrafo 1, laEnmienda entrara en vi »or para cualquier otra Parte en el Protocolo el nonagesimo dfa contado desde lafecha en que haya depositado su instrumento de ratificacion, aceptacidn o aprobacion.
