ADOPTION D'AJUSTEMENTS

Le Secretaire general de 1'Organisation des Nations Unies,

agissant en sa qualite de depositaire, communique :

Le 7 decembre 1995, & la .septieme reunion des Parties au

Protocole de Montreal relatif a des substances qui appauvrissent la

couche d'ozone, qui s'est tenue a Vienne du 5 au 7 decembre 1995, un

certain riombre d'ajustements au Protocole ont ete adoptes par les

Parties.

On trouvera en annexe a cette notification le texte des

ajustements adoptes.

Conformement au paragraphe 9 de 1'article 2 du Protocole , les

ajustements aux annexes A, B et C entreront en vigueur pour toutes

les Parties & 1'issue de six mois a compter de la date de la presente

notification, soit le 5 aout 1996.

L'ajustement a 1'Annexe E entrera en vigueur comme indigue

a la decision VII/3 de la septieme reunion des Parties, le

ler Janvier 1997.

ADJUSTMENTS TO THE MONTREAL PROTOCOL ON SUBSTANCES THAT DEPLETETHE OZONE LAYER RELATING TO CONTROLLED SUBSTANCES IN ANNEX A

The Seventh Meeting of the Parties to the Montreal Protocol on Substancesthat Deplete the Ozone Layer decides, on the basis of the assessments madepursuant to Article 6 of the Protocol, to adopt adjustments and reductions ofproduction and consumption of the controlled substances in Annex A to theProtocol as follows:

Article S: Special situation of developing countries

The following paragraph 8 bis shall be inserted after paragraph 8 ofArticle 5 of the Protocol:

8 bis. Based on the conclusions of the review referred to in paragraph8 above:

(a) With respect to the controlled substances in Annex A, a Partyoperating under paragraph 1 of this Article shall, in order to meet its basicdomestic needs, be entitled to delay for ten years its compliance with thecontrol measures adopted by the Second Meeting of the Parties in London, 29 June1990, and reference by the Protocol to Articles 2A and 2B shall be readaccordingly;

The Seventh Meeting of the Parties to the Montreal Protocol on Substancesthat Deplete the Ozone Layer, decides, on the basis of the assessments madepursuant to Article 6 of the Protocol, to adopt adjustments and reductions ofproduction and consumption of the controlled substances in Annex B to theProtocol as follows:

Article 5; Special situation of developing countries

The following subparagraph shall be inserted after subparagraph (a) ofparagraph 8 bis of Article 5 of the Protocol:

(b) With respect to the controlled substances in Annex B, a Partyoperating under paragraph 1 of this Article shall, in order to meet its basicdomestic needs, be entitled to delay for ten years its compliance with thecontrol measures adopted by the Second Meeting of the Parties in London, 29 June1990, and reference by this Protocol to Articles 2C to 2E shall be readaccordingly.

ADJUSTMENTS TO THE MONTREAL PROTOCOL ON SUBSTANCES THAT DEPLETE THE OZONELAYER RELATING TO CONTROLLED SUBSTANCES IN ANNEXES C AND E

The Seventh Meeting of the Parties to the Montreal Protocol on Substancesthat Deplete the Ozone Layer decides, on the basis of the assessments madepursuant to Article 6 of the Protocol, to adopt adjustments and reductions ofproduction and consumption of the controlled substances in Annexes C and E to theProtocol as follows:

Article 2F. paragraph 1 (a): Hvdrochlorofluorocarbons

In paragraph 1 (a) of Article 2F, for the words:

Three point one

there shall be substituted:

Two point eight

Article 2F. paragraph 5; HvdrochlorofluorocarbonsK

The following sentence shall be added to the end of paragraph 5 of Article2F of the Protocol:

Such consumption shall, however, be restricted to the servicing ofrefrigeration and air conditioning equipment existing at that date.

Article 2H: Methvl bromide

Article 2H of the Protocol shall read as follows:

Article 2H: Methvl bromide

1. Each Party shall ensure that for the twelve-month period commencing on1 January 1995, and in each twelve-month period thereafter, its calculated levelof consumption of the controlled substance in Annex E does not exceed, annually,its calculated level of consumption in 1991. Each Party producing the substanceshall, for the same periods, ensure that its calculated level of production ofthe substance does not exceed, annually, its calculated level of production in1991. However, in order to satisfy the basic domestic needs of the Partiesoperating under paragraph 1 of Article 5, its calculated level of production mayexceed that limit by up to ten per cent of its calculated level of production in1991.

2. Each Party shall ensure that for the twelve-month period commencing on1 January 2001, and in each twelve-month period thereafter, its calculated levelof consumption of the controlled substance in Annex E does not exceed, annually,seventy-five per cent of its calculated level of consumption in 1991. Each Partyproducing the substance shall, for the same periods, ensure that its calculatedlevel of production of the substance does not exceed, annually, seventy-five per

cent of its calculated level of production in 1991. However, in order to satisfythe basic domestic needs of the Parties operating under paragraph 1 of Article 5,its calculated level of production may exceed that limit by up to ten per cent ofits calculated level of production in 1991.

3. Each Party shall ensure that for the twelve-month period commencing on1 January 2005, and in each twelve-month period thereafter, its calculated levelof consumption of the controlled substance in Annex E does not exceed, annually,fifty per cent of its calculated level of consumption in 1991. Each Partyproducing the substance shall, for the same periods, ensure that its calculatedlevel of production of the substance does not exceed, annually, fifty per cent ofits calculated level of production in 1991. However, in order to satisfy thebasic domestic needs of the Parties operating under paragraph 1 of Article 5, itscalculated level of production may exceed that limit by up to ten per cent of itscalculated level of production in 1991.

4. Each Party shall ensure that for the twelve-month period commencing on1 January 2010, and in each twelve-month period thereafter, its calculated levelof consumption of the controlled substance in Annex E does not exceed zero. EachParty producing the substance shall, for the same periods, ensure that itscalculated level of production of the substance does not exceed zero. However,in order to satisfy the basic domestic needs of the Parties operating underparagraph 1 of Article 5, its calculated level of production may exceed thatlimit by up to fifteen per cent of its calculated level of production in 1991.This paragraph will apply save to the extent that the Parties decide to permitthe level of production or consumption that is necessary to satisfy uses agreedby them to be critical agricultural uses.

5. The calculated levels of consumption and production under this Articleshall not include the amounts used by the Party for quarantine and pre-shipmentapplications.

Article 5. paragraph 8 ter: Special situation of developing countries

The following paragraph 8 ter shall be inserted after paragraph 8 bis ofArticle 5 of the Protocol:

8 ter. Pursuant to paragraph 1 bis above:i

(a) Each Party operating under paragraph 1 of this Article shall ensurethat for the twelve-month period commencing on 1 January 2016, and in eachtwelve-month period thereafter, its .calculated level of consumption of thecontrolled substances in Group I of Annex C does not exceed, annually, itscalculated level of consumption in 2015;

(b) Each Party operating under paragraph 1 of this Article shall ensurethat for the twelve-month period commencing on 1 January 2040, and in eachtwelve-month period thereafter, its calculated level of consumption of thecontrolled substances in Group I of Annex C does not exceed zero;

(c) Each Party operating under paragraph 1 of this Article shall complywith Article 2G;

(d) With regard to the controlled substance contained in Annex E:

(i) As of 1 January 2002 each Party operating under paragraph 1 ofthis Article shall comply with the control measures set out inparagraph 1 of Article 2H and, as the basis for its compliancewith these control measures, it shall use the average of itsannual calculated level of consumption and production,respectively, for the period of 1995 to 1998 inclusive;

(ii) The calculated levels of consumption and production under thissubparagraph shall not include the amounts used by the Partyfor quarantine and pre-shipment applications.

Annex E; Methyl bromide

For "0.7" in the third column of Annex E substitute "0.6".

La septieme Reunion des Parties au Protocole de Montreal relatif a dessubstances qui appauvrissent la couche d'ozone decide, en se fondant sur lesevaluations realisees en application de 1'article 6 du Protocole, d'adopterles ajustements et les reductions concernant la production et la consommationdes substances reglementees inscrites a 1'annexe A du Protocole comme suit :

Article 5 : Situation oarticuliere des pays en developpement

Le paragraphe 8 bis ci-apres est inserS apres le paragraphe 8 de1'article 5 du Protocole :

8 bis. Sur la base des conclusions de 1'examen visS au paragraphe 8plus haut :

a) S'agissant de substances rSglementees de 1'annexe A, une Partievis€e au paragraphe 1 du present articlfe est autorisee, pour satisfaire sesbesoins interieurs fondamentaux, 4 surseoir pendant dix ans au respect desmesures de reglementation adoptSe par la deuxieme Reunion des Parties &Londres, le 29 juin 1990; il conviendra en consequence de lire toutereference dans le Protocole aux articles 2A et 2B en tenant cqmpte de ce quiprecede;

4. Chaque Partie produisant cette substance veille ft ce que,pendant ces m@mes periodes, son niveau calcule de production de laditesubstance n'excede pas zero. Toutefois, pour r pondre aux besoins interieursfondamentaux des Parties visees au paragraphe 1 de 1'article 5, son niveaucalculi de production peut exc6der cette limite d'un maximum de quinzepour cent de son niveau calcule de production de 1991. Le present paragraphes'applique sauf dans le cas ou les Parties decident d'autoriser le niveau deproduction ou de consommation qui est necessaire a la satisfaction desutilisations qu'elles jugent essentielles pour 1'agriculture.

5. Les niveaux de consommation et de production calculus au titre dupresent article ne tiennent pas compte des quantity's utilisees par la Partieconsideree ft des fins sanitaires et pour les traitements prealables ft1'expedition.

Article 5. paraqraphe 8 ter : Situation particuliere des paysen developpement - -

Le paragraphe 8 ter ci-apres est irisere apres le paragraphe 8 bis de1'article 5 du Protocole :

8 ter. Conf,ormement au paragraphe 1 bis ci-dessus :

a) Chaque Partie visee au paragrsiphe 1 du present article veille ace qu'au cours de la piriode de douze mois debutant le ler Janvier 2016, etpar la suite au cours de chaque periode de douze mois, son niveau calcule deconsommation annuelle de substances reglementees du groupe I de 1'annexe Cn'excede pas son niveau calcule de consommation de 2015;

b) Chaque Partie visee au paragraphe 1 du present article veille ace qu'au cours de la periods de douze imois debutant le ler Janvier 2040, etpar la suite au cours de chaque periods de douze mois, son niveau calcule deconsommation annuelle de substances reglementees du groupe I de 1'annexe Csoit nul.

c) Chaque Partie visee au paragraphe 1 du present article seconforme aux dispositions de 1'article 2G.

d) S'agissant de substances reglementees figurant H 1'annexe E :

i) A compter du ler Janvier 2002 chaque Partie visee auparagraphe 1 du present article se conforme aux mesures dereglementation enoncees au paragraphe 1 de 1'article 2H et,pour determiner si elle se conforme a ces mesures dereglementation, elle recourt a la moyenne de son niveaucalculi de consommation et de production annuelle,respectivement, pour la periode allant de 1995 a 1998inclus;

ii) Les niveaux de consommation et de production calculSs autitre du present alin§a ne tiennent pas compte desquantites utilisees par la Partie consideree a des finssanitaires et pour les traitements prealables a1'expedition.

Annexe E : Bromure de methvle

Dans la troisieme colonne de 1'annexe E, remplacer "0,7" par "0,6".

Cada Parte velara por que en el periodo de doce meses contados a partirdel 1° de enero de 1995, y en cada periodo sucesivo de doce meses, su nivelcalculado de consume de la sustancia controlada que figura en el anexo E nosupere, anualmente, su nivel calculado de consume de 1991. Cada Parte queproduzca la sustancia velara por que, durante los mismos periodos, su nivelcalculado de produccion de la sustancia no supere, anualmente, su nivelcalculado de producci6n de 1991. 4. Cada Parte velara por que en el periodo de doce meses contados a partirdel 1° de enero de 2010, y en cada periodo sucesivo de doce meses, su nivelcalculado de consume de la sustancia controlada que figura en el anexo E nosea superior a cero. Cada Parte que produzca la sustancia velara por que,durante los mismos periodos, su nivel calculado de produccidn de la sustanciano sea superior a cero. No obstante, a fin de satisfacer las necesidadesbasicas internas de las Partes que operen al amparo del p&rrafo 1 delarticulo 5, su nivel calculado de produccidn podra superar dicho limite hastaen un quince por ciento de su nivel calculado de produccidn de 1991. Elpresente parrafo se aplicara salvo en la medida en que las Partes decidanpermitir el nivel de produccidn o de consumo que sea necesario para los usosque, segun hayan convenido, sean usos agricolas criticos.

5. Los niveles calculados de consumo y produccidn en virtud del presentearticulo no incluiran las cantidades utilizadas por la Parte paraaplicaciones de cuarentena y previas al env£o.

Articulo 5, parrafo 8 ter: Situacidn especial de lospaises en desarrollo

Despues del parrafo 8 bis del articulo 5 del Protocolo se anadira elsiguiente parrafo 8 ter;

8 ter. De conformidad con el pfirrafo 1 bis supra:

a) Toda Parte que opere al amparo del pSrrafo 1 del presente articulovelarS. por que en el periodo de doce meses contado a partir del 1° de enerode 2016, y en cada periodo sucesivo de doce meses, su nivel calculado deconsumo de las sustancias controladas que figuran en el grupo I del anexo Cno supere, anualmente, su nivel calculado de consumo de 2015;

i) A partir del 1° de enero de 2002, toda Parte que opere alamparo del parrafo 1 del presente articulo cumplira lasmedidas de control estipuladas en el parrafo 1 del articulo 2Hy, como base para determinar su cumplimiento de esas medidasde control, empleara el promedio de su nivel calculado deconsume y producci6n anual, respectivamente, correspondienteal periodo 1995 a 1998 inclusive;

ii) Los niveles calculados de consume y preducei6n en virtud delpresente apartado no incluiran las cantidades utilizadas porla Parte para aplicaciones de cuarentena y previas al envio.
