This wall chart presents most up-to-date information on legal grounds on which abortion is permitted, as well as estimates of induced abortion rate and some related indicators, in 196 countries, including all 193 Member States and 3 non-member States (Cook Islands, the Holy See and Niue) of the United Nations. The designations employed and the presentation of the material in this wall chart do not imply the expression of any opinion whatsoever on the part of the Secretariat of the United Nations concerning the legal status of any country, territory, city or area or of its authorities, or concerning the delimitation of its frontiers or boundaries. The designations "more developed regions", "less developed regions", "developed countries" and "developing countries" are intended for statistical convenience and do not necessarily express a judgment about the stage reached by a particular country or area in the development process. The term "country" as used in this wall chart also refers, as appropriate, to territories or areas. The more developed regions comprise all regions of Europe plus Northern America, Australia, New Zealand and Japan. Countries in the more developed regions are denominated “developed countries”. The less developed regions comprise all regions of Africa, Asia (excluding Japan), Latin America and the Caribbean plus Melanesia, Micronesia and Polynesia. Countries in the less developed regions are denominated "developing countries". The least developed countries include 49 countries (34 in Africa, 9 in Asia, 5 in Oceania and 1 in Latin America and the Caribbean), as defined by the United Nations General Assembly resolutions 59/209, 59/210, 60/33, 62/97, 64/L.55 and 67/L.43. Total fertility and abortion rates are not shown for countries or areas with a population of less than 100,000 inhabitants in 2010. A cross (X) indicates that abortion is permitted. A hyphen (-) indicates that abortion is not permitted on that specific ground. Two dots (..) indicate that data are not available. An em dash (—) indicates that the item is not applicable. 1 Preliminary data. 2 Laws on abortion either expressly allow abortion to be performed only to save the life of a woman or are governed by general principles of criminal legislation which allow abortion to be performed for that reason on the ground of necessity. In addition, the British case of R. v. Bourne or local application of that decision apply. Under that decision, the ground of necessity was interpreted to encompass abortion performed on grounds of preserving physical and mental health. 3 Laws on abortion do not expressly allow abortion to be performed to save the life of a woman, but general principles of criminal legislation allow abortion to be performed for that reason on the ground of necessity. 4 Adjusted. 5 Data pertain to a non-standard definition of unmet need for family planning. 6 Estimate. 7 Infecundity measured, in part, with question on current use of contraception instead of ever use of contraception. 8 Data pertain to pre-secession Sudan, including data for South Sudan. 9 Data pertain to a non-standard age or marital status group. 10 Nigeria has two laws on abortion: one for the northern states and one for the southern states. Both laws specifically allow abortion to be performed to save the life of a woman. In addition, in the southern states, the decision of R. v. Bourne is applied, which allows abortion to be performed on grounds of preserving physical and mental health. 11 Although the law allows abortion for economic or social reasons, it provides no specific reference to abortion performed on grounds of mental health or because of foetal impairment. 12 Data refer only to Japanese nationals residing in Japan. 13 Excluding areas in the South zone. 14 The law allows abortion to be performed in order to save the life of a woman or to provide necessary treatment. The law does not indicate which abortions constitute necessary treatment. 15 Excluding the Northern Province. 16 Data pertain to Peninsular Malaysia. 17 Data pertain to nationals of the country. 18 Data pertain to a population subgroup. 19 Data pertain to unmet need for limiting only. 20 Data pertain to a specified time period for current use of contraception. 21 Including some cases of sterilization for non- contraceptive reasons. 22 Refers to the abortion law of England, Wales and Scotland. 23 Excluding Northern Ireland. 24 Laws on abortion have been amended to remove all grounds on which abortion might be performed legally. However, it is not clear whether a defense of necessity might be allowed to justify an abortion performed to save the life of a woman. 25 The Penal Code makes no exceptions to the general prohibition on the performance of abortion; the Code of Medical Ethics, however, allows abortion for therapeutic purposes. 26 Laws on abortion are adopted at the state level. The grounds reported reflect those in the Federal Penal Code. 27 Data pertain to men and women. Notes: Grounds on which abortion is permitted: Indicates legal provisions under which the Government permits induced abortion in the country. Induced abortions are those initiated by deliberate action taken with the intention of terminating pregnancy; all other abortions are considered spontaneous. Seven grounds on which abortion is permitted are distinguished: (1) to save the life of a woman; (2) to preserve a woman’s physical health; (3) to preserve a woman’s mental health; (4) in case of rape or incest; (5) because of foetal impairment; (6) for economic or social reasons and (7) on request. Abortion rate: Number of legally induced abor- tions per 1,000 women aged 15 to 44 years. Sources: Data on the number of induced abor- tions are from national sources and from United Nations, Department of Economic and Social Affairs, Statistics Division, United Nations Demographic Yearbook (various issues), avail- able from http://unstats.un.org/unsd/demograph- ic/products/dyb/dyb2.htm. Data on the number of women aged 15 to 44 years are derived from United Nations, Department of Economic and Social Affairs, Population Division, World Population Prospects: The 2010 Revision. DVD Edition – Extended Dataset in Excel and ASCII formats (United Nations publication, Sales No. E.11.XIII.7). Unsafe abortion rate: Number of unsafe abortions per 1,000 women aged 15 to 44 years. According to the World Health Organization, unsafe abortion is a procedure for terminating an unwanted preg- nancy carried out by persons who may lack the necessary skills or conducted in an environment lacking minimal medical standards or both. An unsafe abortion may be performed by the preg- nant woman herself, by a person lacking medi- cal training or by a health worker in unhygienic conditions or using unsafe methods. Government support for family planning: Indicates the type of support that the Government provides to family planning services within the country. Governments may provide direct support, indirect support, no support or may limit family planning services in their countries. Direct support implies that family planning information, guidance, sup- plies and services are provided through govern- ment-run facilities or outlets. Indirect support implies that the Government does not provide family planning services through government outlets, but instead supports the private sec- tor, including non-governmental organizations, in providing those services. No support means that the Government allows the private sector to provide family planning services without giving it any material support. Not permitted means that the Government does not allow family planning programmes or services within its jurisdiction. Contraceptive prevalence: Percentage of women aged 15 to 49 years who are married or in a union and are using a contraceptive method. Two different measures are provided: (1) percentage of women using any method of contraception, whether modern or traditional and (2) percent- age of women using a modern method of con- traception, that is, sterilization, the pill, the IUD, injectable, implant, condom or a vaginal barrier method. A union involves a man and a woman regularly cohabiting in a marriage-like relation- ship. Estimates for the world and its regions are population-weighted averages derived from the data for the countries shown. Source: United Nations, Department of Economic and Social Affairs, Population Division, World Contraceptive Use 2012 (United Nations publication, POP/DB/ CP/Rev2012). Unmet need for family planning: Percentage of women aged 15 to 49 years who are mar- ried or in a union with an unmet need for fam- ily planning. Women with an unmet need for family planning are those who are fecund and sexually active but are not using any method of contraception although they report not wanting any more children or wanting to delay the next pregnancy. Total fertility: Average number of children a hypo- thetical cohort of women would have at the end of their reproductive period if they were subject during their whole lives to the fertility rates of a given period and if they were not subject to mortality. Source: United Nations, Department of Economic and Social Affairs, Population Division, World Population Prospects: The 2010 Revision. DVD Edition – Extended Dataset in Excel and ASCII formats (Sales No. E.11.XIII.7). Maternal mortality ratio: Number of maternal deaths over a year per 100,000 live births in that year. According to the World Health Organization, a maternal death is the death of a woman while pregnant or within 42 days of termination of pregnancy, irrespective of the duration and site of the pregnancy, from any cause related to or aggravated by the pregnancy or its management but not from accidental or incidental causes. In circumstances in which cause of death attribu- tion is inadequate, a maternal death is defined as the death of a woman while pregnant or within 42 days of termination of pregnancy, irrespec- tive of the cause of death.

The least developed countries include 49 countries

(34 in Africa, 9 in Asia, 5 in Oceania and 1 in Latin America and the Caribbean), as defined by the United Nations General Assembly resolutions 59/209, 59/210, 60/33, 62/97, 64/L.55 and 67/L.43.

1Preliminary data.2Laws on abortion either expressly allow abortion to be performed only to save the life of a woman or are governed by general principles of criminal legislation which allow abortion to be performed for that reason on the ground of necessity. In addition, the British case of R. v. Bourne or local application of that decision apply. Under that decision, the ground of necessity was interpreted to encompass abortion performed on grounds of preserving physical and mental health.3Laws on abortion do not expressly allow abortion to be performed to save the life of a woman, but general principles of criminal legislation allow abortion to be performed for that reason on the ground of necessity.

4Adjusted.5Data pertain to a non-standard definition of unmet need for family planning.6Estimate.7Infecundity measured, in part, with question on current use of contraception instead of ever use of contraception.8Data pertain to pre-secession Sudan, including data for South Sudan.9Data pertain to a non-standard age or marital status group.10Nigeria has two laws on abortion: one for the northern states and one for the southern states. Both laws specifically allow abortion to be performed to save the life of a woman. In addition, in the southern states, the decision of R. v. Bourne is applied, which allows abortion to be performed on grounds of preserving physical and mental health.11Although the law allows abortion for economic or social reasons, it provides no specific reference to abortion performed on grounds of mental health or because of foetal impairment. 12Data refer only to Japanese nationals residing in Japan.13Excluding areas in the South zone.14The law allows abortion to be performed in order to save the life of a woman or to provide necessary treatment. The law does not indicate which abortions constitute necessary treatment.

15Excluding the Northern Province.16Data pertain to Peninsular Malaysia.17Data pertain to nationals of the country.18Data pertain to a population subgroup.19Data pertain to unmet need for limiting only.20Data pertain to a specified time period for current use of contraception.21Including some cases of sterilization for non-contraceptive reasons.22Refers to the abortion law of England, Wales and Scotland.23Excluding Northern Ireland.24Laws on abortion have been amended to remove all grounds on which abortion might be performed legally. However, it is not clear whether a defense of necessity might be allowed to justify an abortion performed to save the life of a woman.25The Penal Code makes no exceptions to the general prohibition on the performance of abortion; the Code of Medical Ethics, however, allows abortion for therapeutic purposes.26Laws on abortion are adopted at the state level. The grounds reported reflect those in the Federal Penal Code. 27Data pertain to men and women.

Notes:

Grounds on which abortion is permitted: Indicates legal provisions under which the Government permits induced abortion in the country. Source: United Nations, Department of Economic and Social Affairs, Population Division, World Population Policies 2011 (United Nations publication, Sales No. E.13.XIII.2).

Abortion rate: Number of legally induced abor-

tions per 1,000 women aged 15 to 44 years. Sources: Data on the number of induced abor-tions are from national sources and from United Nations, Department of Economic and Social Affairs, Statistics Division, United Nations Demographic Yearbook (various issues), avail-able from http://unstats.un.org/unsd/demograph-ic/products/dyb/dyb2.htm.

According

to the World Health Organization, unsafe abortion is a procedure for terminating an unwanted preg-nancy carried out by persons who may lack the necessary skills or conducted in an environment lacking minimal medical standards or both. An unsafe abortion may be performed by the preg-nant woman herself, by a person lacking medi-cal training or by a health worker in unhygienic conditions or using unsafe methods. Source: Iqbal Shah and Elisabeth Åhman. 2010. Unsafe Abortion in 2008: Global and Regional Levels and Trends. Reproductive Health Matters, vol. 18, No. 36, pp. 90–101.

Government support for family planning: Indicates the type of support that the Government provides to family planning services within the country. Governments may provide direct support, indirect

support, no support or may limit family planning services in their countries. Direct support implies that family planning information, guidance, sup-plies and services are provided through govern-ment-run facilities or outlets. Indirect support implies that the Government does not provide family planning services through government outlets, but instead supports the private sec-tor, including non-governmental organizations, in providing those services. No support means that the Government allows the private sector to provide family planning services without giving it any material support. Not permitted means that the Government does not allow family planning programmes or services within its jurisdiction. Source: United Nations, Department of Economic and Social Affairs, Population Division, World

Population Policies 2011 (United Nations publica-tion, Sales No. E.13.XIII.2).

Contraceptive prevalence: Percentage of women aged 15 to 49 years who are married or in a union and are using a contraceptive method. Two different measures are provided: (1) percentage of women using any method of contraception, whether modern or traditional and (2) percent-age of women using a modern method of con-traception, that is, sterilization, the pill, the IUD, injectable, implant, condom or a vaginal barrier method. A union involves a man and a woman regularly cohabiting in a marriage-like relation-ship. Estimates for the world and its regions are population-weighted averages derived from the data for the countries shown. Source: United Nations, Department of Economic and Social

Affairs, Population Division, World Contraceptive Use 2012 (United Nations publication, POP/DB/CP/Rev2012).

Unmet need for family planning: Percentage of women aged 15 to 49 years who are mar-ried or in a union with an unmet need for fam-ily planning. Women with an unmet need for family planning are those who are fecund and sexually active but are not using any method of contraception although they report not wanting any more children or wanting to delay the next pregnancy.

Total fertility: Average number of children a hypo-thetical cohort of women would have at the end of their reproductive period if they were subject during their whole lives to the fertility rates of a given period and if they were not subject to mortality.

According to the World Health Organization,

a maternal death is the death of a woman while pregnant or within 42 days of termination of pregnancy, irrespective of the duration and site of the pregnancy, from any cause related to or aggravated by the pregnancy or its management but not from accidental or incidental causes. In circumstances in which cause of death attribu-tion is inadequate, a maternal death is defined as the death of a woman while pregnant or within 42 days of termination of pregnancy, irrespec-tive of the cause of death. Source: World Health Organization, Trends in Maternal mortality, 1990 to 2010: Estimates developed by WHO, UNICEF, UNFPA and the World Bank, available from http://apps.who.int/gho/data/#.
