3 Questions

How does work affect SSI and/or SSDIbenefits?

If a recipient loses SSI and/or SSDI dueto work, will the recipient also loseMedicaid or Medicare?

What can recipients do to avoid aproblem with SSI or SSDI benefitswhen working?

3Disability Law Center

SSI Benefits and Work

SSI is a “needs-based” benefit.

SSA must consider countable monthlyincome for ongoing SSI eligibility

SSA must also consider countable“resources” for ongoing SSI eligibility.

SSI Benefits and WorkEffect of Wages

For SSI recipients the main workincentive is the earned incomededuction.

For SSI, wages count when paid.

For working SSI recipients, the questionis:

How much of my wages will count toreduce my SSI benefit?

5Disability Law Center

SSI Benefits and WorkEffect of Wages

For employees, SSA considers grossmonthly wages when paid

To compute countable monthly wages, deduct $65 plus ½ of the remainder

A good estimate of countable wages is½ of gross monthly wages

6Disability Law Center

SSI Benefits and WorkEffect of Wages

SSI recipients may also deduct the $20“general income disregard” fromwages, if not used on “unearned”income.

Unearned income includes SSDI,interest, pensions, worker’scompensation, alimony and otherincome that is not wages

SSI Benefits and WorkEffect of Wages – Example 1

Carmen receives $735 in SSI & $114.39SSP in Mass. for disability in 2017.

She takes a job paying $985 in grosswages per month.

Will Carmen remain eligible for SSI withthese wages?

What should Carmen do when shetakes this job?

8Disability Law Center

SSI Benefits and WorkEffect of Wages – Example 1

SSA will count $450 of the wages [$985– 85 ($65 + $20) divided by 2 = $450].

Her new benefit amount will be$399.39 ($735- $450 +$114.39=$399.39)

Total gross monthly income will be$1384.39 ($985 + $399.39). It was$849.39 before she had earnings.

9Disability Law Center

SSI Benefits and WorkEffect of Wages – Example 2

Joe receives $520 in SSDI, $235 in SSI& $114.39 in SSP benefits based ondisability per month in 2017.

He also takes a job paying $985 permonth in gross wages.

These wages make him SSI ineligible.

What should Joe do when he takes thisjob?

Page 4: Work and SSI and SSDI 2017.6 (1).ppt - Mass Legal Services and SSI... · Disability Law Center 7 SSI Benefits and Work Effect of Wages – Example 1 Carmen receives $735 in SSI &

10Disability Law Center

SSI Benefits and WorkEffect of Wages – Example 2

$520 SSDI - $20 = $500 countable SSDI

$985 gross wages - $65 = $920

$920 divided by 2 = $460 countable wages.

$500 + 460 = $960, in countable income forSSI/SSP purposes – too much to remaineligible for SSI/SSP.

Joe’s new total gross monthly income is$1505. ($985 + $520)

Keeping MassHealth WhileWorking - Loss of SSI

Will SSI recipients lose MassHealthcoverage if they make too much moneyto receive SSI benefits, even with allthe deductions they can take?

Probably not – they should be eligiblefor “1619b Medicaid” or MassHealthCommonHealth.

26Disability Law Center

SSI Benefits and Work1619b Medicaid

1619b Medicaid is continued Medicaid for SSIrecipients who make too much money to beeligible for an SSI cash payment

These individuals can be “deemed” eligiblefor MassHealth - if they continue to meet allother SSI eligibility criteria, including theasset limit, AND if they meet the “MedicaidTest.”

27Disability Law Center

SSI Benefits and Work1619b “Medicaid Test”

The individual must:

have been eligible for SSI for at least1 month;

remain medically disabled;

need MassHealth in order to work;and

have insufficient income to replaceMedicaid and SSI.

SSI Benefits and Work1619b Medicaid

The beauty of 1619b Medicaid is thatindividuals can move back and forthbetween SSI cash eligibility and 1619bMedicaid as the ability to fluctuate – aslong as they remain medically disabled– without having to reapply for SSI.

29Disability Law Center

SSI Benefits and Work1619b Medicaid

What is SSDI(Social Security Disability Insurance)?

SSDI is a Social Security insurance programthat pays a monthly cash benefit to peoplewho are:

Disabled = same definition of disability as withSSI (for adults), AND

Insured = worked and earned enough SocialSecurity credits by paying FICA taxes. For mostadults, this means working for about 5 of the last10 years before becoming disabled.

SSDI has no income or asset limits.

38Disability Law Center

Earning Credits to BecomeInsured for SSDI

Earn 1 credit for every $1300 earned in 2017.$5200 earned = 4 credits. ($1320/$5280 in2018).

Maximum of 4 credits/year.

Must pay FICA taxes. No credits for “underthe table” work.

Special SSDI Rule for Young Adults: To be insured for SSDI, adults under 24 years old

only need to earn 6 credits in the 3 years beforethey become disabled.

39Disability Law Center

More About SSDI The SSDI benefit amount depends on how much you

earned. Average is @ $1166, but could be muchlower or higher. Maximum is $2687 in 2017.

Certain dependents of the wage earner may beeligible for benefits on SSDI recipient’s wage record.

SSDI recipients receive Medicare after 24 months ofeligibility (Recipients with ALS do not have to wait 24months.) SSDI recipients may also qualify forMedicaid, but need to apply for it.

SGA Example

Carmen gets SSDI based on disability. She isin her EPE. Her gross earnings in October2017 were $1200.

In October 2017 she paid for the followingimpairment related work expenses:

$10 for prescription copays

$65 for therapy

$25 for her support dog Max

Are her countable earnings presumed SGAfor October 2017?

57Disability Law Center

The Answer

NO. It’s not presumed SGA.

IRWEs: $10 + $65 + $25 = $100

Gross income $1200 – $100 IRWEs

= $1100 countable income for SGApurposes., which is less than the 2017

presumed SGA amount of $1170.
