Core Spaces • 2015-2016 AAA President

Thank you for allowing me to serve as your President this year; it has most definitely been

an honor and I feel privileged to have been able to experience serving our industry in this capacity so far. To me, June seems to have been only a few short weeks ago and yet here I am in the home stretch of a busy, exhausting, but most definitely exciting and memorable twelve months. Would I have done a few things differently? I’m sure I would, but don’t get it twisted; this has been a great ride and the journey is one that I will take with me for the rest of my life. I can honestly say that serving in this role for this organization at this time in my life has played a role in shaping my thinking, my personality and my overall core as a human being. How often does that really happen in life?

Recently, Austin had a tremendous showing at the state level from a Professional of the Year standpoint. Each year the Austin Apartment Association submits the three finalists in each of six categories to compete for the same honor at the state level. Austin seems to always have a presence at the state level but I was excited to see that three of the six winners this year were from our association. Katya Watson was honored as this year’s Rita Kirby Regional Property Manager of the Year, Michael Garcia as this year’s Barbara MacManus Apartment Manager of the Year and Erica Diaz as this year’s Anita Marcino Leasing Professional of the Year. What an honor for them and they deserve a huge congrats from us every chance we get!

As the temperatures start rising, social calendars begin to fill up quickly. I ask that you spend some of that free time with us. May Madness is right around the corner and it’s as close to a guaranteed good time as it gets! Come see us at the Salt Lick and enjoy some time with some of your association leaders, present, past and future! Just being involved peripherally is how I started participating and if you’ve never

been to an association event, this one is a good one to make your first.

This industry is, and will always be, family. Although dysfunctional at times, (there, I said it), this is a pretty fantastic family to be a part of. Truth be told, I’ve always had a difficult time with being pigeonholed into a group or category that I’ve never really considered myself to be a part of. Resistance typically ensues but this is one instance where I’m glad I didn’t resist the upward trajectory that was in front of me. Being surrounded by so many other passionate individuals helped, along with a staff that’s so in tune with every aspect of this industry. We have a strong organization that represents us so well at all times. With so many wonderful individuals from all walks of life embedded within our association, we have different perspectives to form our

collective viewpoint. As our economy continues to strengthen, our AAA family will continue to grow along with it. Although I’ve said it before, the future is bright for our industry, not just because of the individuals who stay active within our organization, but also with the number of new individuals who have recently become involved and their ability to reenergize all avenues of this association. Every person counts!

It has been an amazing year and I am so grateful for the opportunity to have served as the President of such a remarkable organization. Although I have mixed emotions that my time is coming to a close, I look forward to the places our new leadership will take us under the leadership of Theresa Ebner. Thank you all for your support over the past year and more importantly for your continued support in making the Austin Apartment Association the best organization to be a part of.

City of Austin Ordinance Takes Aim at Criminal Background Checks

The Austin City Council has adopted a “Fair Chance Hiring” ordinance that now requires companies to delay checking the criminal history of job applicants until after they have received a conditional offer of employment. Sometimes also referred to as a “Ban the Box” ordinance because it eliminates the check-box section of a job application that asks the applicant to disclose any criminal history, the ordinance aims to increase job opportunities to those with criminal histories.

As adopted, the ordinance would apply to employers with at least 15 workers. A company can still refuse to hire a person based on criminal history but only after considering the “nature and gravity” of the offense, the length of time that has passed since the offense and the scope of the job the person wants.

The ordinance exempts any positions for which federal, state or a local law disqualifies an individual based on criminal history. The Austin Chamber of Commerce requested a change to allow a background check after an initial interview while the Austin Apartment Association requested an exemption from the ordinance for any position involving entering a person’s residence. Both requests failed to pass.

As it now stands, prospective employees alleging a violation of this ordinance can file complaints with the city’s Equal Employment and Fair Housing Office. For the first

year, violators of the ordinance will receive only a warning but beginning April 2017 the city may fine companies up to $500 for violating the ordinance. After April 2017 companies can receive a first-time offender warning with no fine if they participate in a training program to understand the requirements of the ordinance. The City of Austin will soon post information on best practices for complying with the ordinance as part of an education campaign about the ordinance.

On this topic, the current edition of the REDBOOK offers guidelines for property owners to consider when a job applicant has record of committing a felony. The REDBOOK cites that lawsuits against employers have been filed under the theory that criminal background checks can have a “disparate impact” on protected classes regardless of their original intent, and notes that the Equal Opportunity Employment Commission has taken the position that criminal history screening should be undertaken later in the employment process and has further cautioned against penalizing applicants for distant crimes or crimes not relevant to the position. Members of the AAA joined with that National Apartment Association (NAA) and nearly 170 affiliated associations from across the country for their largest ever advocacy campaign during the annual Capitol Conference recently held in Washington, D.C.

In NAA’s effort to have apartment industry professionals visit all 535 members of Congress, the AAA did its part by visiting the offices of every congressional member that represents the Austin area. During the visits the AAA contingent helped convey the message that, nation-wide, the apartment industry provides homes to 38 million Americans, contributes $1.3 trillion annually to the economy and supports 12.3 million jobs.

When discussing the issues, AAA members joined the chorus of NAA voices and focused on these three key issues:

The Americans with Disabilities Act (ADA) and Fair Housing Accessibility: That the industry supports legislation that provides a business owner with the opportunity to cure an

alleged ADA deficiency prior to the initiation of a lawsuit.National Flood Insurance Program (NFIP) and

Reauthorization: That legislation reforming the NFIP and providing for long-term reauthorization of the program before it expires in September 2017 is needed, and;

Section 8 Housing Choice Voucher Program: That the Senate must take up and approved legislation already approved by the House that reforms the Section 8 program, including the contract term, property inspections, tenant screening and funding stream.

During the NAA Capitol Conference, delegates from around the county gave presentations on Accessibility, Section 8 and National Flood Insurance to members of U.S. Congress.

Accessibility: Fair Housing and ADA NAA members support the accessibility design and

construction requirements. However, enforcement efforts should recognize compliance methods that address real-world conditions. The opportunity to cure alleged incidents of non-compliance would also support the goals of both the ADA and the Fair Housing Act by improving access for persons with disabilities. The “ADA Education and Reform Act of 2015” provides a business owner up to 120 days to cure an alleged ADA design defect prior to initiation of a lawsuit.

Section 8 Housing Choice Voucher ProgramThe public-private Section 8 Housing Choice Voucher

Program could be the nation’s most effective affordable housing and community development tool. However, it is plagued

with inefficiencies, burdensome regulatory requirements and a flawed funding system. Lawmakers should address these issues to attract private housing providers’ participation in the voluntary program. The “Housing Opportunity through Modernization Act” provides common sense reforms in the Section 8 Housing Voucher Program.

National Flood Insurance ProgramGiven federal requirements for apartment owners to

purchase flood insurance, Congress should support measures that ensure the NFIP program can continue to operate long term and that affordable coverage options exist. The “Flood Insurance Market Parity and Modernization Act” expands coverage options for at-risk property owners by clarifying that insurance from private carriers outside of the National Flood Insurance Program meets existing requirements.

AAA graduated its fourth year of Leadership Lyceum students in 2016. This program works to identify and develop a well-formed and highly motivated group of emerging multifamily housing leaders within the Austin membership, as well as develop people with a broad based vision for - and strong commitment to - the mission and strategic objectives of the association. With the 2016 AAA Property of the Year Awards right around the corner, maybe

you’re wondering how you can make your community a property of the year contender next year. Perhaps, by following this advice, we’ll see your property in the list of finalists in 2017.

MAINTENANCEMake-readies1. External: Too often maintenance

focuses all their attention inside the unit during a turn. If time permits I’d recommend also detailing the entrance leading up to the unit, as well as all entryways to office, amenities, and laundry areas. This includes pressure washing the breezeways, stairs and painting the front door. First impressions mean everything to new residents and prospective residents. If an apartment is on the ground level and near A/C units, make sure there are no squeaky fan motors or noisy compressors. Reduce the noise of a compressor with compressor blankets if necessary.

2. Big picture/little picture: Apart

from the bigger picture of making a unit ready, focus on smaller details

as well. This includes having all face plate screws facing vertically, caulking between baseboards and flooring, and using the appropriate screws that come with hinges. Over a period of time the wood behind the hinge will warp out and make-ready techs use black sheetrock screws. A trick for this is to put a metal anchor behind the hinge so that the original screw can be used.

3. Caulking: Caulking could really

make or break the way a unit looks cosmetically. Thinner is always better, so I’d suggest scraping off all old caulking with a scraper and using rubbing alcohol as well. Always fill a tub with water prior to caulking it. If you caulk a dry tub, the caulk will separate after the first time the tub is used. Kitchen & bathroom countertops are other areas that can be caulked along the edge of backsplash and wall as well.

4. Rule of right: Always follow the

rule of right to avoid commonly missed items during a turn. The rule of right is performed when making a parts list and doing the actual make ready itself. The way it works is to start off at the very front entry and work your way around the unit - always moving to the right -

checking for defects until you’re back to where you started. Once supplies are gathered, the tech should then disperse those parts where the defects are, start work to the right side of the entry and finish where they began.

5. Quality Control: Once a unit

has been marked off as complete, have both the service manager and property manager perform a thorough walk-through. The more “eyes on,” the better and also reduces the chance for defects. Apart from checking the maintenance items, look for housekeeping items such as dirty window sills/framing, clean baseboards, and cleanliness inside drawers and cabinets.

Low Budget1. Create a list: Prior to having your

property inspected, create a list of curb appeal items that can be done in-house a week or two prior. I recommend walking the entire perimeter and interior of the property and looking for the following: detached gutters, broken slats of fencing, entry gates not working, broken concrete parking stops, lights on during the day, and areas that can use some touch

up paint. After you’ve made your list, have your service manager delegate the workload amongst the staff and follow up daily to check the progress.

2. Painting: At all entryways throughout the property,

I’d suggest painting the fire lanes, fire hydrants, and restriping the road bumps and parking lanes. You’ll also want to touch up paint trash containers as well and any other areas internally and externally throughout common areas and the office. Most towing companies and trash refuse companies have it in their contract to paint these areas free of charge; just reach out to your sales representative.

3. Maintenance: Apart from exterior curb appeal,

have one of the service team members perform a mini-make ready in the office, model, laundry rooms, and all amenities. Although these common areas should stay in top condition year-round there are still chances for running toilets, leaky faucets and air conditioning not working. To expedite the process have an office member create a list of make ready items that need attention and additionally create a list for the housekeeping.

4. Grounds: On the day of the inspection, have your

entire service team arrive an hour or two early so that a detailed sweep of the grounds can occur. This includes putting yourself in the eyes of the person inspecting the community from the moment they drive up the street, walk into the office, and inspect the common areas. Assign each service team member a section of each building to do a detailed sweep of grounds; include the bushes, stairwells, and parking lot of the section. While the service team is inspecting the grounds, have housekeeping do a final touch-up of all common areas and clean the mail centers with stainless steel cleaner and brush off any cobwebs around the ceilings and walls.

5. Patio partners: Set up weekly patio partners

between maintenance and office staff. The way this system works is by assigning a number of buildings to one office and maintenance staff member to check on a weekly basis. One person will walk the building looking for damaged blinds, trash on patios/breezeways, and unauthorized items on patios such as BBQ pits. Notices should be typed up after the list is made from each employee and then sent to the resident. If issues are not corrected then fees can be charged to remove trash, replace blinds, etc.

6. Inspect what you expect: The manager should

arrive early the day of inspection as well and inspect each assigned section of grounds, common areas, and be looking for last minute defects or items that can be corrected. The manager should also inspect the maintenance shop as well and ensure that it’s in tip-top shape.

Mid/High-Range Budget1. Uniformity: Straighten out all the condensing

units that are ground level, place on pads, and reinsulate the copper tubing. Over the years, insulation will begin to deteriorate and previous service team members may have

looking good throughout the year.

unit or installed them crooked instead of straight and centered. This is also a good time to remove the brand name decals of the A/C units to have better uniformity. If the decals must be kept on, they snap off easily and can be repositioned to face the same direction. (MID-RANGE)

2. Carpentry/Painting: At an older

community, fascia and soffit material will rot out over the years from water intrusions and heavy rains. If it’s in the budget, have a contractor provide a detailed scope of work to repair woodwork throughout the community. In addition to repairing the woodwork, consider painting the buildings and doors. Painting the community can really, “breathe new life” into a community and will be aesthetically pleasing to the eye! (HIGH-RANGE)

3. Pools: After a long period of

time, stains will form at the bottom of the pool and no amount of scrubbing or vacuuming will resolve this. When this occurs it’s best to have the pool re-plastered or re-tiled. It may be costly but the investment will extend the life of your pool and greatly reduce the chances of losing water through small cracks, which can result in a high water bill. Getting new pool furniture is a good idea if it’s outdated and doesn’t look great cosmetically. (HIGH-RANGE)

4. Lighting: I’d encourage switching out

old, outdated compact fluorescent fixtures with LED wall-packs and breezeway lights. The upfront cost will be higher, but on top of increasing the curb appeal, you will save money on energy bills in the long run. Select a style of lighting that’s more modern. I’d also recommend installing motion-sensing lights in common areas and shops to reduce kilowatts being used. (HIGH-RANGE)

5. Parking lots: Asphalt will tend to break down over the years and create pot holes. There are cost effective solutions for smaller pot holes that can be done in house but when the area exceeds a 12”x12” dimension its best to have a contractor saw cut the area and add new asphalt. This will not only make the area look its best but will reduce wear and tear on a vehicles shocks. (MID-RANGE)

have we awoken the urban cowboy?

“Are you a real cowboy?” asks Sissy (Debra Winger) of Bud Davis (John Travolta) in the movie Urban Cowboy. Responds Bud, “Well that depends on what you think a real cowboy is.” Gilley’s Club in Pasadena, Texas, where those famous lines were spoken, has been levelled. But the urban cowboys who once frequented that historic venue have a new way to strut their western heritage, whether actual or perceived. New gun legislation was passed in Texas, and the open carry of handguns is now legal in the Lone Star State as of January 1, 2016. Have we awoken the Urban Cowboy? An online commenter, who goes by the screen name LTUME1978, seems to think the “privilege to play cowboy” has come with a higher than anticipated price. More from him later.

As strange as it may seem, prior to passage of this Texas law, 44 other states already permitted the open carry of handguns. Currently only Florida, California, Illinois, New York and South Carolina prohibit the open carry of pistols. It is not permitted in the District of Columbia either.

Most of us have heard, or received some training relating to, the requirements for signage to permit the owner of an apartment community to ban both open carry and concealed carry of guns on all or part of its premises. Stated another way, forty-five states’ constitutions recognize and secure the right to keep and bear arms in some form, and none of those prohibit the open carrying of firearms.

Any private business in Texas, which would include an apartment community, which wishes to ban the concealed or open carry of handguns in some form or fashion, must display strictly regulated signs. The signs are provided for in the Texas Penal Code, in Sections 30.06 and 30.07. New slang

terminology has been coined to describe the signs and what they represent: “30.06” (for concealed handguns) and the “30.07” (for openly carried handguns).

The signs themselves are strictly regulated and must contain precise language, be of a precise size, and adhere to precise requirements for lettering size, font, and contrast with the background. Unless you want to prohibit both concealed carry and open carry, you need not have both the “30.06” and “30.07” signs. You can choose which sign, if either, states your position.

The signs are to be posted at all entrances to areas to be affected by the prohibition. The prohibition can be for the entire apartment property, or just parts of it, like the leasing office and swimming pool area. Again, you can prohibit open carry, concealed carry, or both.

A few definitions are helpful in understanding this gun legislation. The term “open carry” generally means the act of publicly carrying a firearm on one’s person in plain sight. The term “plain site” is broadly defined as, “not being hidden from common observation.” This definition varies from state to state, hinging upon whether the firearm is partially visible or fully visible.

In addition, the issue of what constitutes a “loaded weapon” is common among the 45 states which presently permit the open carry of firearms. Considerations include (1) whether a live round of ammunition is actually in the firing chamber of the weapon, (2) whether a magazine with ammunition is inserted into the firearm, regardless of whether or not a round is in the chamber, and (3) whether a person simply has both the firearm and its ammunition in possession, without regard to the earlier two considerations.

The open carry law which took effect in Texas on January 1, 2016 authorizes properly licensed individuals to openly carry a holstered handgun. A properly licensed individual may openly carry a handgun in the same places where a concealed handgun may be carried. There are a few exceptions to this, which are not necessary to explore at this time.

If the weapon is not going to be concealed, but rather carried openly, it must be carried in a shoulder holster or a

belt holster, whether loaded or unloaded. Persons who previously held, prior to January 1, 2016, a valid Concealed Handgun License (CHL) may now carry openly or in a concealed manner with that license. A new license will not be required for open carry, nor will any additional fee be required to be paid.

The Texas Department of Public Safety (DPS) encourages first-time applicants for a License to Carry (LTC) to submit an online application, to be supplemented

by in-person fingerprinting. Applicants seeking the LTC must also complete four to six hours of classroom training, pass a written examination, and pass a proficiency demonstration pertaining to their ability to shoot. In Texas, all classroom and proficiency testing is to be conducted by an LTC instructor certified by the DPS.

An applicant for an LTC must be 21 years of age to apply for a Texas handgun

license in most situations. If a person is a member or veteran of the United States Armed Forces, however, which includes the Reserves or National Guard, they can apply at the age of 18. Those individuals, if not current Armed Forces members, have to have been discharged under honorable conditions. A dishonorable discharge will equate to a disqualification for the license.

Additional clarity will soon be coming to Texas gun legislation concerning the

situations where persons with an LTC intentionally display the handgun in plain view of another person in a public place. Under the law to take effect August 1, 2016, it will be an exception to criminal liability if the handgun was partially or wholly visible, but was carried in a shoulder holster or a belt holster by the license holder. This will be the general rule, applicable generally to “a public place.”

The additional clarity will come through specifics about public places for which there are no exceptions to an intentional display of a handgun in plain view of another person (open carry). These include institutions of higher education, and streets, sidewalks, parking lots, driveways and parking areas of an institution of higher education.

In addition, even a CHL holder commits an offense if that person intentionally, knowingly, or recklessly carries a handgun, regardless of whether the handgun is concealed or carried in a shoulder holster or a belt holster, on or about their person, in specific locations. These include the premises of a business that has a permit or license to serve alcoholic beverages, where such business derives 51% or more of its income from the sale or service of alcoholic beverages for on-premises consumption. It also

includes premises where a high school, collegiate, or professional sporting event or interscholastic event is taking place. In general, the knowing or reckless carrying of a handgun on the premises of a correctional facility, the premises of a hospital or nursing facility, an amusement park, or the premises of a church,

religious worship will also be expressly prohibited under the law which will take effect August 1, 2016.

What happens when a person with an LTC carries a concealed handgun, in violation of “30.06”, or openly carries a handgun, in violation of “30.07” where they should not? First, they must actually be carrying, in a concealed or open manner, without the effective consent of the property owner. Remember, in this scenario the “30.06” and “30.07” signs, in full compliance with law, have been properly posted. Having the sign(s) in place has the effect of providing notice that entry onto the property by an LTC holder with a concealed handgun, or an LTC holder openly carrying a handgun on the property, is forbidden.

It is possible, likewise, for written communication to be given by means of a card or other document, on which is written in the language contained in the pertinent section of the Texas Penal Code, stating that a person licensed in this state to carry a concealed handgun, or openly carry a handgun, may not enter this property with the concealed or openly carried handgun. Again, “30.06” pertains to concealed carry, while “30.07” pertains to open carry.

One who violates the prohibition commits a Class C Misdemeanor, punishable by a fine not to exceed $200.00. If notice of the prohibition is verbally transmitted to the person with the weapon, the offense will rise to a Class A Misdemeanor.

There is an interesting twist concerning the signs. There is actually a third sign, commonly referred to as the “ 51% sign” which pertains to the prohibition against carrying a gun into the premises which have a permit or license to sell or serve alcoholic beverages for on-premises consumption.

There have been some questions posed to apartment owners and managers, at properties where concealed and open carry are prohibited, about the license holder’s ability to transport their gun from their vehicle to the apartment in which they reside. Even where concealed carry and open carry is prohibited by the property owner, a gun owner has a right in Texas to transport his gun to and from his residence and his vehicle. This exception is set forth

in Section 46.02 of the Texas Penal Code. That statutory provision provides that as long as the individual with the weapon is transporting it to or from his own premises, or premises under his control, and to or from a motor vehicle or watercraft that is owned by him or under his control, there will be no illegal activity involved. Stated another way, it is permissible for one to have her handgun in her apartment, in her motor vehicle or watercraft, or during the time she is traveling from one to the other. That is the case whether the “30.06” or the “30.07” sign is posted or not.

During such transport phase of the weapon, however, the handgun cannot be in plain view; and the person carrying the gun cannot be engaged in criminal activity, prohibited by law from possessing a firearm, or a member of a criminal street gang.

Anyone who can legally possess a firearm can carry it in a vehicle in Texas. If the possessor of that firearm does not have a handgun license which Texas issues, or a permit or license from another state or territory which Texas honors, the firearm must be concealed and cannot be on the person of the owner of the gun. It can be in the glove box, the interior console, or otherwise hidden from view. But it cannot be on the gun owner’s person. On the other hand, if you have a handgun license that is valid in Texas, you can openly carry your handgun in a vehicle, although it must be carried either in a shoulder holster or belt holster.

Despite the apparent “victory” for gun advocates when Texas adopted its open carry law, all has not been a bed of roses for them. There is an interesting organization, known as The Trace, which is “an independent, nonprofit news organization dedicated to expanding coverage of guns in the United States.” This author stumbled upon this website

while researching this article, and found an article by Jennifer Mascia, dated January 11, 2016. In her article, Ms. Mascia examined online posts on a popular online message board, and found that some “Lone Star State open carriers worry that the push to expand their rights may have done more harm than good.”

To begin with, she noted that when “30.07” passed, the signs previously utilized to prohibit concealed carry under “30.06” became obsolete. What was happening, it appeared, was that businesses which wanted to prohibit open carry, but did not care about concealed carry, were getting both the “30.07” (open carry) and the “30.06” (concealed carry) signs at the same time, from the same source. Stated another way, businesses which previously felt no need to prohibit concealed carry on their premises decided to prohibit both concealed carry and open carry when a “30.07” (open carry) sign became necessary.

Ms. Mascia quoted a person in her article who posted a comment, with the screen name “Distinguished Rick” (DR) who stated it was “just as easy to have both the 30.06 and 30.07 signs made at the same time.” According to Distinguished Rick, “we have lost more than we gained.” DR noted that “I had my CHL 20 years this year and I hardly ran into any legal signs back then. This has woken up the anti-crowd in a big way. So now the genie is out of the bottle and I don’t see a way to put it back.”

Ms. Macias quoted a couple of online commentators in her article. One, whose screen name was “android”, had this to say: “We were free to carry concealed at far more places before than now. You have the exact same ability to be safe carrying concealed as openly. Except that now you can’t do either in many places. So you’re not safer at all. Open carry is not a right. It’s a dress code and comfort issue. You were already freely bearing arms before 1 Jan. You’ve given up safety for comfort, and lost and freedom [sic] for all of us.”

Probably the most candid and opinionated online comment quoted by Ms. Macias in her article came from a poster known by the screen name LTUME1978, who opined: “I hope the right to walk around looking like Wyatt Earp is worth it to the open carry folks because a lot of us are loosing [sic] our right to concealed carry and it may cost some of us our lives for your privilege to play cowboy.”

In conclusion, open carry in Texas seems here to stay. Only five states out of 50 currently do not make it legal to openly carry handguns. As Distinguished Rick noted, “now the genie is out of the bottle and I don’t see a way to put it back.”

Genies, as we know, typically grant wishes. Let us wish, then, for a clear majority of Texas citizens to understand the strong opinions of gun advocates and gun opponents, be tolerant of both, and make it a common goal to not allow anger, ignorance, mental impairment or worse to enable a crime or create a needless victim.
