Vehicles Used In Carnivals Policy

Carnivals The Wiltshire Police recognises and supports carnivals as an important part of community life within Wiltshire and throughout the region. However, the movements of slow oversize or overweight vehicles travelling to, during or from carnivals must be controlled to ensure road safety. This document has been compiled to provide guidance to everyone involved in the movement of carnival vehicles through Wiltshire.

The Wiltshire Police, in conjunction with the Department of Transport, Transport Technology & Standards, will now insist that all carnival vehicles falling outside the Road Vehicles (Construction and Use) Regulations 1986 are covered by a Vehicle Special Order (VSO).

This policy is similar to that in force in the Avon and Somerset Police area and may apply to other police areas in our region. Vehicles This Policy Does Not Apply To Vehicles that comply with the Road Vehicles (Construction and Use) Regulations 1986, as amended, and are not deemed by their dimensions to be classified as abnormal loads will not be required to notify the Police of their movements to and from the venue and may not require a VSO. Guidance notes on the Road Vehicles (Construction and Use) Regulations 1986 are attached at Appendix C.

Abnormal loads are vehicles/combinations that exceed the following dimensions: - a) 2.9 metres (9ft-6ins) in width or exceed the width of the vehicle/trailer (excluding wing mirrors) by more than 12 inches(30cm). b) 18.28 metres (60ft) in length c) 44 tons in weight (unless plated for less)

Vehicle Special Order (VSO) For Carnivals In order to standardise and improve the safety of carnivals, the Secretary of State, in exercising his powers under section 44 of the Road Traffic Act 1988, has extended, by order, the use of Vehicle Special Orders (VSO’s) for carnival vehicles. Such an order allows the use on roads of a vehicle combination, notwithstanding that the vehicles do not comply in all respects with the requirements of the Road Vehicles (Construction and Use) Regulations 1986, as amended. An application form for a VSO is included at Appendix A. Further application forms may be obtained by the relevant Carnival Club by applying to, TSG, VCA Midlands Centre, Watling Street, Nuneaton, Warwickshire, CV10 0UA. (Appendix D). They are issued annually. An example of the conditions applied to a VSO can be found at Appendix A. A VSO should only be applied for once the Carnival Club is satisfied that the construction meets all the requirements of the VSO and has been examined by a competent person. A competent person is one who is eligible to check and inspect such vehicles and whose qualifications should be included with the Examination Report. This person will not be a police officer. In the event of passengers being carried during a procession, yet the vehicle complies with the Construction and Use Regulations, a VSO is still required to cover that one aspect. Relevant contact details for the movement of carnivals can be found at Appendix A.

The following information is produced in the hope that it will provide all the relevant information to make applying for a Vehicle Special Order (VSO) a straightforward process. It covers, amongst other things, lengths, widths, weights, braking requirements, what we mean by a competent person, the use of a locomotive instead of a tractor. If your vehicle combination complies fully with the regulations outlined below in this document you do not need to apply for a Vehicle Special Order. However if your vehicle combination does not comply with any one of the below regulations, you will need to apply for a Vehicle Special Order. Road Traffic Act 1988 Order of the Secretary of State under section 44 The Secretary of State in exercise of his powers under Section 44 of the Road Traffic Act 1988 hereby authorises the use on roads of the vehicle combination described in Schedule hereto, and hereinafter referred to as 'the vehicles', notwithstanding that the said vehicles do not comply in all respects with the requirements of the Road Vehicles (Construction and Use) Regulations 1986 S.I. 1986 No. 1078, as amended, subject to the following conditions. For the purpose of this Order 'carnival procession route' means: - A route agreed by the Police and procession organisers between two points defined as the 'designated assembly point' and the 'designated dispersal point'. Condition applying to use at all times: - 1. The vehicles shall be operated only by - (name of clubs) 2. The vehicles shall be operated only when they are proceeding to and from a carnival and

on carnival procession route. 3. The vehicles shall tow no more than one trailer. 4. The overall length of the vehicle combination shall not exceed 24.5 metres

(80ft-6ins) 5. The overall width of the vehicle combination shall not exceed 3.5 metres (11ft-6ins) at

any time. 6. Each vehicle combination shall be equipped with working brakes on all its axles. 7. One passenger only may be carried on the trailer to and from each carnival to alert the

driver of any congestion caused by its presence on the public highway. 8. Each trailer shall be fitted with a parking brake that can be easily applied by a person or

persons on the ground or on the trailer. 9. The driver of the vehicles must have a clear all round field of vision at all times. 10. The vehicles shall at all times be fitted with brake lights, indicator lights, position lights

and side marker lights as required by the Road Vehicles Lighting Regulations 1989. S.I. 1989 No. 1796 as amended. (Side marker lights shall be fitted at intervals of at least 3.05 metres.

11. Amber beacons to be fitted to the front and rear of the combination and capable together

of being visible through 360 degrees around the combination. 12. When the vehicles are proceeding to and from each carnival no lights must be showing

other than those mentioned in Conditions 10 and 11 above. 13. Before the vehicles are used on a journey at least two clear working days prior

notification of the movement shall be given to the Chief Officers of Police in whose police area it is proposed that the vehicles shall be used and no journey shall be undertaken without the prior approval of the appropriate police authority. The notice to be given shall,

subject to any necessary modification, be in the form and contain the particulars specified in Schedule 5(4)(1) of the Road Vehicles (Authorisation of Special Types) General Order 2003 S.I. 2003 No. 1998 and herein after referred to as the STGO.

14. Before the vehicles are used on a journey at least five clear day’s prior notification of the

movement shall be given to the road and bridge authority for any road and for any bridge on which it is proposed that the vehicles shall be used; the notice to be given shall be in the form and shall contain the particulars specified in Part 1 of the Schedule 9 of the STGO and the provisions of Article 17 and 18 of the said STGO shall apply as respects any such notice.

15. Before the vehicles are used on a journey the highway authority for any road and bridge

authority for any bridge on the said route shall be indemnified: the indemnity shall be in the form specified in Part 2 of Schedule 9 of the said STGO and the provisions of Article 17 and 18 thereof shall apply as respects any such indemnity.

16. The restrictions of Article 18 (1) (restriction on the passage over bridges) of the STGO

shall apply to the road use of the vehicles, albeit that they are moved unladen; Article 18(3) of the STGO shall also be applicable.

17. Each trailer to be equipped with blocks, scotches or other similar device capable of

holding the trailer stationary when disconnected from the drawing vehicle. 18. Every trailer to be equipped with a safety chain capable of withstanding the load of all

trailers coupled to the towing vehicle in the event of failure of the towing hitch and the flexible brake connections must be such that they will not break through over extension when the chain is in use or the braking system must be such that the brakes will be applied automatically in the event of separation of the trailer from the drawing vehicle.

20. No combination of vehicles to be used at speeds exceeding 20mph. Conditions applying to use on carnival procession routes: - Additional conditions applying when on carnival procession route: - 21. At least one person, not in or on the cab, in addition to the driver of the motor vehicle

shall be employed in attending to the vehicles to give warning to the driver of any danger likely to be caused to any persons by reason of the presence of the vehicles, whilst in the carnival procession.

22. Condition 7 above shall not apply. 23. At least one person on any trailer carrying passengers must have the knowledge to and

be able to operate the parking brake. 24. Each drawing vehicle and trailer shall carry an easily accessible and suitable fire

extinguisher. 25. The gap between the drawing vehicle and each trailer within the combination shall be

fitted with expandable links either in the centre OR on each side depending on which is the most suitable for any particular combination to which shall be attached signs stating "Do not cross between the vehicles" to prevent pedestrians easily crossing between the vehicles whilst in the carnival procession.

26. Condition 3 above shall be amended to read "the vehicles shall tow no more than two trailers".

27. Condition 4 above shall be amended to read "the overall length of the vehicle

combination shall not exceed 30.5 metres" (100ft). 28. Condition 9 above shall be amended to read "whilst in procession the driver must be able

GUIDANCE NOTES FOR CARNIVAL VEHICLES All motor vehicles and trailers used on our roads in the UK must comply with, amongst other legislation, with the Road Vehicles (Construction and Use) Regulations 1986 (SI 1986/1078) (C&U): as amended and the Road Vehicles Lighting Regulations 1989 (SI 1989/1796): as amended. These regulations set the overall technical specifications such as weights, dimensions, braking systems, tyres, lights etc, for all vehicles.

Maximum Length of motor vehicle and trailer - Construction & Use REGULATION 7

Motor Vehicle

A wheeled motor vehicle 12 metres

Trailers

A trailer with at least 4 wheels which is drawn by a motor vehicle having a gross weight2

exceeding 3,500 KGs` 12 metres

A trailer drawn by a motor vehicle having a maximum gross weight under 3,500kg, (Excluding the length of the drawbar): 7 metres

Vehicle Combinations

A motor vehicle towing one trailer 18 metres 1 Maximum Gross Weight is the lower of the maximum weight permitted by C&U or that declared by the manufacturer of the vehicle. In the case of smaller vehicles, such as vans or 4 wheel drives, it will usually be displayed on the manufacturer’s plate, the vehicle handbook or be available from the manufacturer of the vehicle.

operated with those of the towing vehicle by the same control. ***************************

Springs and resilient material - Construction & Use REGULATION 22 Suspension of springs or resilient material is required to be fitted to both the towing vehicle and trailers if the combination is to exceed a travelling speed of more than 20 mph(32 K/mh).

A four-wheel drive, car or transit van, the gross weight of these vehicles are governed by the manufacturer – see footnote to Maximum Gross Weight.

A two axle lorry 17,000 kg – provided the distance between the two axles is at least 3.0 metres. If the

distance between the axles is less than 3.0 metres, lower limits apply.

A two axle, wheeled agricultural motor vehicle;-

Where the distance between the axles is less than 2.65 metres 14, 230 kg Where the distance between the axles is at least 2.65 metres 16, 260 kg (Vehicles with more than 2 axles are subject to higher limits)

Maximum permitted laden weight of a trailer REGULATION 75 The maximum permitted weight of the trailer can be limited by one of two requirements. The maximum permitted on the trailer itself, which, in the case of a conventional two axle trailer, is

14,230 kg or any lower weight specified by the trailer manufacturer.

The maximum permitted for the combination (the maximum train weight specified in REGULATION 76) which, in the case of a two-axle tractor and two axle trailer, is 24,390 kg or any lower towing weight

specified by the towing vehicle manufacturer. Where necessary the maximum trailer weight can be calculated by subtracting the weight of the towing vehicle from the maximum train weight given for the vehicle.

Note that the lower figure from either the C&U regulations or the vehicle manufacturer is always the one that applies.

A wheeled motor vehicle 1 trailer This is the normal requirement. In order to tow two trailers in carnival, a special order will be required, even if, individually, the vehicles and trailers meet the above conditions.

1.The Braking requirements and Braking Performances for 2016 are as follows. Vehicle combinations with a gross weight up to 24,390 kg: That means that both the tractor and each trailer (when more than one trailer is being towed in procession) only require brakes on half the number the number of wheels. In situations where one of your trailers has three axles, two should be braked. The overall service braking performance of the combination shall be a minimum of 25%. Vehicle combinations with a gross weight over 24,390 kg and up to 38,000 kg: all wheel braking is required on both the tractor and each trailer (when more than one trailer is being towed in procession). Four wheel drive tractor means a tractor which brakes through its transmission, or through each wheel. The overall service braking performance of the combination shall be a minimum of 25%. Vehicle combinations over 38,000 kg and up to 50,000 kg: all wheeled braking is required on both tractor and each trailer. Four wheel drive tractor means a tractor, which brakes through its transmission, or through each wheel. The overall service braking performance of the combination shall be a minimum of 50%. ALL BRAKING EFFICIENCES WILL APPLY FOR THE 2016 SEASON The braking efficiencies and the above percentages should have been achievable and recorded last season for inclusion on the application form this year

2. VEHICLE SPECIAL ORDER APPLICATION FORM (See Annex A) On occasions in the past there have been last minute problems when Orders have been issued for specific tractors and the day before the carnival the agricultural hire company or farmer has given that particular tractor to another club. To ensure that both parties do not have these last minute panics when completing your application please bear the following suggestion in mind; if your club is hiring or borrowing a tractor(s) please give the details of the MAKE & MODEL of the tractor(s). Then, if you are given a different tractor than the one promised, providing it is the same MAKE & MODEL you will not need to change your order. If the MAKE & MODEL is different giving different axle weights then this will need to be notified to VCA to decide if changes to the Vehicle Special Order are required. 3. Use of a Locomotive instead of an Agricultural Tractor: There has been increased interest in using a locomotive instead of an agricultural tractor to tow the combination in procession. It is possible to convert a commercial tractor unit into a locomotive by removing its fifth wheel coupling and imposing weight in the form of ballast to stop it from carrying a load. For the purposes of the Road Vehicles (Construction and Use) Regulations 1986 (SI 1986 No.1078) as amended: a locomotive is defined as “a mechanically propelled vehicle which is not constructed itself to carry a load other than the following articles, that is to say, water,

fuel, accumulators and other equipment used for the purpose of propulsion, loose tools and loose equipment and which the unladen weight exceeds 7370kg”. The regulations state that the maximum permitted weight of a locomotive, which is equipped with suitable and sufficient springs between each wheel and the frame, and with a pneumatic tyre or a soft or elastic material fitted to each wheel, is subject to the following conditions: - (a) if having less than 6 wheels ( 2 axles) 22,360kg (b) if having 6 wheels (3 axles) 26,420kg (c) if having more than 6 wheels (4 axles) 30,490kg The regulations state that the maximum total weight of all trailers, whether laden or unladen, drawn at any time by a locomotive shall not exceed 44,000kg. However, for the purposes of carnival, the heaviest vehicle combination will still be restricted to 50,000kg, irrespective of whether or not the towing vehicle is a locomotive. A locomotive does not require plating and testing. The driver will require a C+E light goods vehicle driving licence. We understand that, previously, light goods vehicle driving test centres within the Taunton area (and possibly further afield) have offered reduced prices for carnival clubs, who wish to operate locomotives, so that their drivers can obtain the C+E. I would recommend that each carnival club/committee should investigate this possibility on behalf of their members. The locomotive will also have to be taxed accordingly, dependent on its gross weight. The local Vehicle Registration Offices will tax the locomotive for a period of either six or twelve months – the unexpired portion being refunded.

Qualifications required by the Competent Person: The competent person’s role within the club is to ensure that, before building commences, an inspection is carried out on the existing chassis and axles to establish if there are any fractures or corrosion. This season axles may have to be fitted with new brakes, the competent person should ensure this task is completed and that the brakes fully comply with the braking requirements outlined within the VSO Application Form. Once the club secretary is ready to complete the VSO application form, the competent person should ensure that the towing vehicle and each trailer fully comply with all the requirements and that a full inspection of the vehicle combination is carried out. The form can then be submitted to VCA. It is expected that the competent person should hold one of the following qualifications in a relevant subject or to have undertaken the Competent Persons Awareness Course:

NVQ

University degree

Appropriate membership of a professional body.

Please supply a copy of the relevant qualification with the application for a Vehicle Special Order unless your qualications have been previously lodged with VCA. 5. GENERAL CONDITION OF THE VEHICLE THROUGHOUT THE CARNIVAL SEASON Throughout the carnival season it must be ensured that the vehicle combination stays roadworthy and safe. If these basic requirements are NOT carried out, the Special Order would become invalid and will be revoked. The Police may then decide to exclude the offending club from taking part in that particular carnival. Notification to the Police for Abnormal Loads Notification to the Police is required, in writing, if any of the following apply when travelling to and from the event: -

a) If the width exceeds 2.9 metres (9ft-6ins) on any vehicle.

b) If the overall combination lengths exceeds 18.65 metres (61ft). Notification, in writing, to the relevant Highways and Bridges Departments is required when travelling on the public roads, if any of the following apply: - a) Any axle weight exceeds 10,170 KGs. b) Gross vehicle or gross train weights exceeds 38,000 KGs. A copy of the notification to the Police can be found at Appendix C. The Wiltshire Police will generally permit movements subject to the roads being suitable and will make random checks on vehicle combinations to ensure that the regulations are being complied with. All aspects of road safety are the responsibility of the driver and the carnival clubs. The Wiltshire Police will review these arrangements at the end of each Carnival Season and if organisers wish to raise any matter please send details to Sergeant Gavin Brewster, at the address given at Appendix B.

This page should be completed by the last Competent Person to inspect the vehicles and trailers before

entry to the first carnival of the season and subsequent carnivals. Any defects should be reported here along with items such as like Lighting, Towbars Fire Extinguishers

and other items generally considered to be travelling items and as such installed prior to moving the

vehicles.

The responsibility in law for the vehicle and trailers to meet legal requirements when they are operated on

the roads is not that of the responsible person, the cart captain or the competent person it is solely the

responsibility of the driver and it is she/he who would be charged with any offence committed when the

vehicle and trailers are operated on the roads in an illegal configuration.

This sheet should be made available to the driver so that a check can be made that all items have

been attended to.

Enforcement authorities may request sight of this sheet before allowing the vehicle and trailers to take

Notification to the Police for Abnormal Loads Notification to the Police is required, in writing, if any of the following apply when travelling to and from the event: -

a) If the width exceeds 2.9 metres (9ft-6ins) on any vehicle.

b) If the overall combination lengths exceeds 18.65 metres (61ft). Notification, in writing, to the relevant Highways and Bridges Departments is required when travelling on the public roads, if any of the following apply: - a) Any axle weight exceeds 10,170 KGs. b) Gross vehicle or gross train weights exceeds 38,000 KGs. A copy of the notification to the Police can be found at Appendix B. The Wiltshire Police will generally permit movements subject to the roads being suitable and will make random checks on vehicle combinations to ensure that the regulations are being complied with. All aspects of road safety are the responsibility of the driver and the carnival clubs. The Wiltshire Police will review these arrangements at the end of each Carnival Season and if organisers wish to raise any matter please send details to Sergeant Gavin Brewster, at the address given at Appendix D.
