BUYERS’ COMMISSION
20% (excluding VAT) is added to the hammer price of all lots. Anadditional fee of 3% (excluding VAT) is charged to on-linebidders.
ROOM BIDDERS
1. Room bidders must register and obtain a bidding numberon arrival. Proof of identity is required from clients new to us.
2. If successful in obtaining a lot please ensure you display yournumber clearly to the auctioneer and that it is your numberthat is called out. If there is any doubt about the hammerprice or buyer, please draw this to the attention of theauctioneer immediately
3. Payment may be made by cash, bank draft, cleared cheque,debit or credit card — we accept Mastercard or Visa (a chargeof 2% is made on credit card transactions). There is no chargeon debit card transactions..
ABSENTEE BIDDING
1. If you are unable to attend you may bid before the sale, usingthe form provided. Enter the maximum you are prepared tooffer for each lot and the auctioneer will represent you as ifyou are personally attending the sale. Lots are knocked downat one step above the next highest bid, and not necessarilyat your highest bid. Example: your bid is €1,000 and nexthighest bid is €800 – the hammer price is €850.
2. LIMIT BIDDING: Absentee bidders may limit their totalpurchases to a set amount by entering their limit on thebidding form. This is especially useful for bidders wishing tocover as many lots as possible while setting a maximumamount to spend.
3. “OR” BIDDING: Absentee bidders who wish to bid on two ormore lots, but only wish to purchase one, may do so byentering “OR” between the bids – the lots will be bid on incatalogue order.
4. EQUAL BIDS: In the event of equal bids being received forthe same lot the first received will be given preference. If theinstruction “break ties” is entered on the bid form theauctioneer will increase the bid by one step in the event ofequal bids being received or in the event of a tie with a roombidder.
5. “BUY” BIDS: Unless otherwise instructed bids of “Buy” or “Buyat Best” shall be taken to indicate bids of up to three times thestated higher estimate in the catalogue.
6. LIVE INTERNET BIDDING: You may watch and/or bid live withvideo and audio link to the saleroom on our websitewww.whytes.ie
7. LIVE TELEPHONE BIDDING may be arranged on request,subject to availability and given at least 24 hours notice. This
facility is only available on lots estimated at €1,000 or more,and a minimum bid may be requested.
8. INVOICING AND PAYMENT: Successful absentee bidders willbe sent a pro forma invoice immediately after the sale withdetails of payment methods. All invoices must be paid within7 days of the date of the sale or the lot(s) may be deemed indefault and any subsequent losses incurred on resalebecome the responsibility of the bidder. The Auctioneers andHouse Agents Act, under which we are licensed to hold publicauctions, only allows for lots to be handed over to purchaserswhen paid for in full.

EXPORT LICENCES
Purchasers from outside the State are reminded that exportlicences are required for all archaeological items, as well asartworks and documents that have been in the State for morethan 25 years. Furher details are available from the NationalMuseum, The National Gallery of Ireland or the Department ofThe Arts, Heritage and the Gaeltacht. The onus on obtainingsuch licences is on the purchaser or the purchaser’s shipper.

The venue for the auction is Freemasons Hall, 17 MolesworthStreet, Dublin 2 and the sale starts at 2pm.
Bidder registration will take place here from 1pm on Saturday10 December and the sale starts at 2pm. Complimentary teaand coffee will be served in the café.
COLLECTION OF LOTS
Lots may be collected from our Molesworth Street premises upto 7pm on day of sale, otherwise Monday to Friday 10am to5pm. Purchasers must pay for and collect all lots within 7 daysof the date of sale. Any lots not collected within that time will betransferred to an offsite secure storage facility, incurring storagecharges. Lots that have been transferred offsite may only becollected at two days notice once storage charges have beenpaid for in full.

(30.48 x 40.64cm)Born in London, the son of artist Sir Muirhead Bone and author Gertrude Dodd, Stephen Bone first exhibited at the NEAC at the age of sixteen, and shortly afterward enrolled at the Slade School of Art (1922-24). In 1928 he collaborated with his friend, the Irish artist William Eric Horsbrugh-Porter (see lot 132), painting murals for Piccadilly Underground; the pair also shared a flat in Knightsbridge. The following year he married the artist Mary Adshead, and together they travelled across Britain, Italy and Greece. Around the same time Bone seems to have also visited Ireland, for in 1929 he held a joint exhibition with another Irish artist, Sine MacKinnon, at the Fine Art Society, London, where he exhibited mainly Connemara landscapes. At the outbreak of World War II he re-visited Dublin; it was during this visit in 1939 that Bone exhibited the work, The Walls of Dublin, at the RHA. During the war he served as a camouflage officer (1939-43) and as an official war artist attached to the navy (1943-45). He returned to Dublin in 1947, painting views of O’Connell Street Bridge, the Customs House and Trinity College (all of which sold through these rooms, 19 November 2001, lots 19 and 20 and 19 September, 2006 lot 29, respectively).Estimate €600-€800 (£520-£690)Large Image & Place Bid Lot 34

The oil of Our Lady, Queen of Ireland was commissioned by the Gill family of Dublin - owners of the publishing company, which later became Gill and Macmillan. The model for Our Lady was Sarah (‘Sally’) Byrne (later Deale), a student of Seán Keating’s at the College of Art and later a staff member there. Her portrait was widely painted by her contemporaries at the time, including Keating whose son Justin was the model for the figure of the child in the present work. Justin later became a Labour Party minister in the 1970s government of Liam Cosgrave. In his article - Taking a politician unawares - for the Irish Times on June 16, 2012 Michael Parsons reflected on the artwork commissioned for the 31st International Eucharistic Congress in Dublin 80 years ago and focused on the present work. 1581916 A bottle of 100 year old whiskey by Dublin Whiskey Distillery.Matured in cask for over fifty three years, in bond since 1916 until bottled by P & F McGlade, 96 Donegall Street, Belfast, in 1966. As far as we can ascertain this is the oldest Irish whiskey to ever be offered at auction. Accompanied by correspondence with Lyle & Kinahan including a letter to the latter, dated 22 March 1966 instructing the firm to sell 2 of the casks to a broker and to bottle the remaining cask. As far as we are aware only four bottles remain extant, of which this is one.Original content was 75cl; level is now just below the neck. 70 proof.Provenance:Frank McGlade;Thence by descent
P & F McGlade’s Bar was located at 96 Donegall Street, and 31 Little Donegall Street Belfast. It was founded in 1888 by Patrick and Frank McGlade, members of an established family of publicans in the city, and was initially named The Arcade. Patrick and Frank were already owners of a number of bars in the city including the Queens Cafe in Queen’s Arcade. Within ten years the brothers monopolised the licensed trade in the area of Donegall Street, owning the International Restaurant Bar & Billiard Hall (destroyed by German bombs in 1941), and the Grand Metropole Hotel.Located beside the offices of the Irish News and The Belfast Telegraph McGlade’s became a favourite haunt for both local journalists and those from out of town - in more recent times including many from the Republic, Britain and elsewhere, sent to cover the Troubles. In one year alone the vistors book boasted over 1,000 entries from journalists. During the war the bar attracted huge numbers of American GI’s. Other clientele included students and staff from the Art College, local politicians including Gerry Fitt, lawyers from the courts nearby, and others. According to one review “it was one of the few places during the Troubles that could be considered a true “melting pot”. Rich and poor, Protestant and Catholic all mingled in harmony. A haven in a sea of madness.””It had a Penny Farthing bicycle mounted on the wall in the upstairs back lounge, boasted the longest bar counter in Ireland in the downstairs public bar and Mr Frank McGlade, the owner, sported a fresh flower in his buttonhole every day. The pub was unfortunately burnt down in a fire caused by an electrical fault in 1983. Ironic and tragic considering so many other Bars in town were destroyed in much less innocent circumstances.” It had passed into the hands of Bass Ireland a year before the fire. Dan McDermott, brother of Seán McDermott, one of the signatories to the Proclamation worked behind the bar at McGlade’s in the early 1900s. Seán spent some time in Belfast as well, where he worked as a tram conductor from 1905 until he became a full time organiser for Sinn Fein in 1907. Dublin Whiskey Distillery Company (which became known as DWD) was a limited company formed by a consortium of seven businessmen including James Walker and William Sealy, better known as printers and paper merchants. The distillery, in Jones Road, was completed in 1873 and by the 1880s was producing over 500,000 gallons of whiskey a year. The distillery was state of the art for the time with an electric turbine driven either by a wheel in the Tolka or steam engines. a big wheel in the adjoining River Tolka or by one of the plant’s steam engines.In 1891, DWD joined forces with George Roe and William Jameson - to form the Dublin Distillers Company Limited (DDC). Each one of these distilleries had huge output and only used pot stills, totally ignoring the profitability and efficiency of Coffey Stills and grain whiskey, which was increasing being used by the Scots. Each member of DDC continued to produce Irish pot still whiskey under its own brand name and were therefore often in direct competition to each other. World War I, Irish Independence, the Civil War and American Prohibition were to deal deadly blows to all three of these distilleries which had an overproduction capacity for their ever diminishing markets. It is likely that the Jones Road Distillery stopped full time distilling in 1926, however it appears that they may have continued distilling irregularly until 1945. The last known whiskey from Jones Road was a bottling of a whiskey distilled in 1942. An apartment complex, named The Distillery is on the site and incorporates some of the original buildings.

TASTING NOTE: Bright bronze in colour with the faintest green tinge. The aromas are harmonious and enticing with touches of beeswax, melon, white chocolate, linseed oil, dried apricots, sultanas and poached pears. Very typical of old Dublin pot still whiskeys, with just a faint hint of old engine oil on the nose. The palate is dry and very smooth. No harsh oak as can often be found in very old whiskeys. Flavours of honey, pepper, sultanas, stewed fruits, mocha and rich sherry. The quality really shines through on the finish which is long lasting and rich. Comments and opinions, which may be found in or on lots as labels,notes, lists, catalogue prices, or any other means of expression, do notconstitute part of lot descriptions and are not to be taken as such unless theyare made or specifically verified by Whyte’s.Clause 1 (a) Each lot is put up subject to any reserve price imposed by the vendor(b) Subject to sub-clause (a) of this clause, the highest bidder for each lot shallbe the buyer thereof(c) If any dispute arises as to the highest bidder the auctioneer shall haveabsolute discretion to determine the dispute and may put up again and re-sellthe lot in respect of which the dispute arisesClause 2(a) The bidding and advances shall be regulated by and at the absolutediscretion of the auctioneer and he shall have the right to refuse any bid orbids. The buyer will be responsible for all removal, storage and insurancecharges in respect of any lot which has not been collected within 7 days ofthe date of sale.(b) If any buyer fails to pay in full for any lot within 7 days of the date of salesuch lot may at any time thereafter at Whyte’s discretion be put up for sale byauction again or sold privately; if upon such re-sale a lower price is obtainedthan was obtained on the first sale the buyer in default on the first sale shallmake good the difference in price and the expenses of re-sale which shallbecome debt due from him.(c) Interest at 2 per cent per month and legal costs (if any) for recovery ofmonies due shall be payable by the buyer on any overdue account.Clause 5(a) All lots are made available for inspection before each sale and each buyer,by making a bid, acknowledges that he has satisfied himself as to the physicalcondition, age and catalogue description of each lot (including but notrestricted to whether the lot is damaged or has been repaired or restored).(b) All lots are sold with all faults and imperfections and errors of descriptionand Whyte’s and its employees, servants or agents shall not be responsible forany error of description or for the condition or authenticity of any lot, save forClause 5 (c) below.Written or verbal condition reports may be supplied by Whyte’s on request but these are merely statements of opinion, and any error or omission in thesereports may not be taken as grounds for a cancellation of sale or refund of any part of the purchase price or the cost of any repairs to the lot or lotsreported on.
(c) If any lot sold at this auction is subsequently proved to be a “deliberateforgery”, Whyte’s will cancel the sale and refund to the buyer the total amount
paid by the buyer for the item, in the currency of the original sale. The onus ofproving a lot to be a “deliberate forgery” is on the buyer. For these purposes,“deliberate forgery” means a lot that in Whyte’s reasonable opinion is animitation created to deceive as to authorship, where the correct description ofsuch authorship is not reflected by the description in the catalogue (takinginto account any Glossary of Terms). No lot shall be considered a deliberateforgery by reason only of any damage and/or restoration and/or modificationwork of any kind (including repainting or overpainting). This guarantee doesnot apply if (i) either the catalogue description was in accordance with thegenerally accepted opinions of scholars and experts at the date of the sale, orthe catalogue description indicated that there was a conflict of such opinions;(ii) or the only method of establishing at the date of the sale that the item wasa counterfeit would have been by means of processes not then generallyavailable or accepted, unreasonably expensive or impractical to use; or likelyto have caused damage to the lot or likely (in Whyte’s reasonable opinion) tohave caused loss of value to the lot; or (iii) there has been no material loss invalue of the lot from its value had it been in accordance with its description.This guarantee is provided for a period of seven (7) years after the date of therelevant auction, is solely for the benefit of the buyer and may not betransferred to any third party. Whyte’s has discretion to extend the guaranteefor a longer period. To be able to claim under this Guarantee, the buyer must(i) notify Whyte’s in writing within three (3) weeks of receiving any informationthat causes the buyer to question the authenticity or attribution of the item,specifying the lot number, date of the auction at which it was purchased andthe reasons why it is thought to be a deliberate forgery; and (ii) return theitem to Whyte’s in the same condition as the date of the sale to the buyer andbe able to transfer good title in the item, free from the third party claimsarising after the date of the sale. Whyte’s has discretion to waive any of theabove requirements. Whyte’s may require the buyer to obtain at the buyer’scost the reports of two independent and recognised experts in the field,mutually acceptable to Whyte’s and the buyer. Whyte’s shall not be bound byany reports produced by the buyer, and reserves the right to seek additionalexpert advice at its own expense. In the event Whyte’s decides to rescind thesale under this Guarantee, it may refund the buyer the reasonable costs of upto two mutually approved independent expert reports.(d) Any lot listed as a “mixed lot, collection, range, portfolio etc.” or stated tocomprise or contain a collection or range of items which are not describedshall be put up for sale not subject to rejection and shall be taken by thebuyer with all (if any) faults, lack of genuineness and errors of description andnumbers of items in the lot, and the buyer shall have no right to reject the lot;except that, notwithstanding the foregoing provisions of this sub-clause,where before a sale a person intending to bid at the sale gives notice inwriting to, and satisfies Whyte’s that any such lot contains any item or itemsnot described in the sale catalogue and that person specifically describes thatitem or those items in that notice, then that item or those items shall, asbetween Whyte’s and that person, to be taken to form part of the descriptionof the lot.Clause 6The respective rights and obligations of the parties shall be governed andinterpreted by Irish law, and the buyer hereby submits to the exclusivejurisdiction of the Irish Courts.
SPECIAL CONDITIONS ((a) The buyer shall pay Whyte’s a commission at the rate of 20% (plus VATunder The Margin Scheme and which is not reclaimable). An extra charge of3% of hammer price applies to on-line buyers.(b) Whyte’s or its employees, servants or agents may, on request organisepacking and shipping of lots purchased or may order on the buyer’s behalfthird parties to pack or ship purchases. Under no circumstances does Whyte’saccept any liability whatsoever for any loss or damage howsoever occasionedin the course of such service.(c) The buyer authorises Whyte’s to use any photographs or illustrations of anylot purchased for any or all purposes as Whyte’s may require.The placing of a bid will be taken as full agreement to all the aboveconditions.
