A regularly scheduled work session of the Lockport Town Board was conductedat 1: 00 p. m. on Wednesday, July 9, 2018 at the Town Hall, 6560 Dysinger Road,Lockport, New York.
Present were: Deputy Supervisor: Paul W. Siejak
Town Council Members: Patricia Dufour
Thomas Keough
Darlene DiCarlo
Absent: Mark C. Crocker
Also present: Dave Miller, Highway Superintendent; Brian D. Seaman, TownAttorney; Rob Klavoon, Wendel Engineering and Judith A. Newbold, Town Clerk.
Deputy Supervisor Siejak welcomed everyone and opened the meeting asfollows:
1. Deputy Supervisor
Deputy Supervisor Siejak inquired if everyone has received the Supervisor' sfinancial report in their mailbox.
2. Town Clerk— nothing to report.
3. Attorney— nothing to report.
4. Engineer
Town Court HVAC Improvements( Contract 18- 3)
Rob Klavoon reported that the bids for this project were received on June 13,2018 and the lowest responsive bidder was Greater Niagara Mechanical, Inc.This bid included two alternate bid items, one to replace the furnace in the back
section of the NYS Troopers building and one to clean the duct work which is notslated to be replaced. Three bids were received and he recommends that theTown Board award the base bid and alternate bid# 1 and# 2 to Greater NiagaraMechanical, Inc. for a total bid price of$ 400, 000. 00. He has conversed with the
vendor and they are prepared to begin installation to meet the timeline ofOctober. Deputy Supervisor Siejak inquired about the budget increase for thisitem.
MOTION ( 2018- 146) on a motion by Councilmember Keough and seconded byCouncilmember Dufour, the following resolution was duly ADOPTED: AYES-4,NAYS- 0. Voting AYE: Siejak, Dufour, Keough and DiCarlo.

WHEREAS, bids on the above referenced project were opened on June 13, 2018
in accordance with the Notice to Bidders previously authorized, now therefore beit

RESOLVED, that the Lockport Town Board authorizes award of Contract No. 18-
3 ( Base Bid, Alternate# 1, and Alternate# 2) to Greater Niagara Mechanical, Inc.,
7311 Ward Road, North Tonawanda, New York 14120 in the amount of
400,000. 00 contingent upon the Town Attorney's review of the Contractor' sBonds and Insurances.
Phase 2 Waterline Replacement Project( Contract 159W)
Rob announced the Phase 2 Waterline replacement bid was also held on June
13, 2018 and two bids were received. The lowest responsive bid was Concrete
Applied Technologies Corp. dba CATCO in an amount of$ 3,446, 231. 50. Headded waterlines would be replaced on Wicks, Slayton Settlement( short section)
and Lockport-Junction Road. Attorney Seaman stated there is an issue with aneasement on Wicks Road that needs to be addressed. The Town Board will
revisit this project on Wednesday evening.
Deputy Supervisor Siejak inquired about the status of the phone line conversion.Rob stated there are still a couple of lines that are being changed over to the newvendor. Verizon and Comtel are working on this part of the project. Rob willspeak to Supervisor Crocker upon his return.
Phase 1A Waterline Replacement( Contract 158W)
Rob distributed a budget summary sheet and explained that upon completion ofthis project there is a decrease change order necessary in the amount of
156, 966. 75. The original project price was 2. 18 million dollars and after the
change order# 1 was approved, the project and actual expenses came in under
the estimated amount of$ 2, 150, 000.00. Most of this savings was attributed tolimited rock excavation.
MOTION ( 2018- 147) on a motion by Councilmember Dufour and seconded byCouncilmember Keough, the following resolution was duly ADOPTED: AYES-4,NAYS- 0. Voting AYE: Siejak, Dufour, Keough and DiCarlo.
RESOLUTION
DEDUCT CHANGE ORDER NO. 2
TOWN OF LOCKPORT PHASE 1A WATERLINE REPLACEMENTCONTRACT NO. 158W
WHEREAS, the Town of Lockport awarded a bid to Concrete Applied
Technologies, Inc. dba CATCO, in the amount of$ 2, 179, 985. 00 by Contract No.158W, for the replacement of the Phase 1A Waterline, and
WHEREAS, the Town of Lockport Town Board previously authorized a netincrease Change Order No. 1 in the amount of$ 11, 806. 41 for the additional
materials and labor due to unforeseen field conditions for a total Contract Price of2, 191, 791. 41, and
WHEREAS, Wendel and Concrete Applied Technologies, Inc. dba CATCO have
mutually agreed on the adjustment of bid and change order quantities to matchactual quantities installed at the completion of the project, and now therefore be it
RESOLVED, that this Board authorizes deduct Change Order No. 2 in the
amount of$ 156, 966. 75 for a final Contract Price of$ 2, 034, 824. 66.
Rob also reported the project is ready for close out with a final expense total of2, 034, 824.66. Highway Superintendent, Dave Miller expressed he would like to
take a final walk through on Bowmiller Road with the contractor to address some
issues with the shoulder of the road. The Town Board will address the final close
out after the walk through is completed.

5. Highway Superintendent
Dave Miller, Highway Superintendent has received correspondence regardingflooding issues in the Hallmark Lane and Harford Drive area. Rob has maps onthe ditches between Hallmark and Hartford with all easements that have been
filed. He will bring these maps to the department head meeting to review anddiscuss flooding issues. He will also deliver copies to the HighwaySuperintendent' s office. Dave reported the Highway Department crew is verybusy paving Locust Street Extension and they will be starting Old Beattie Roadbetween Rapids and Bartz) next. He will also be researching a third set ofsoccer fields for Day Road Park. Councilmember Keough inquired if there wouldbe drainage required for these new fields.
Dave also inquired about the Department of Environmental Conservation check
zone. Rob explained the DEC" check zone" and the" 100 ft. wetland buffer". Heexplained once a wetland is defined, a 100 ft. buffer is designated around thisarea. If there are possible wetlands, a wetlands biologist must walk the area todistinguish the presence of wetlands. This has resulted in a variable border.
Dave reported the EFTS work on the Town Hall Annex is complete and the crewwill be beginning the foundation for the New York State Troopers garage near6564 Dysinger Road soon.
Councilmember Keough received a memo from NYS stating there are cybersecurity grants available. He will speak to Marc Smith, Director of EconomicDevelopment to see if this is something the Town of Lockport will be able toutilize. He also received information regarding encrypted passwords. It wasdecided he will look into the ability to set up these passwords.
There was some discussion regarding the electronic recycling program and thepossible options.
Councilmember DiCarlo reported that the Town of Lockport Recreation
Commission will be hosting the Community Day celebration from 1: 00- 3: 00 p. m.on Sunday, July 15, 2018. The entertainment will be presented by a new singer,Mike Nuget, who will perform jazz standards and classics from 1: 00- 2: 45 p. m.
She also inquired on the status of the memorial trees. Dave Miller reported all
the 4x4 stands have been completed and are ready for the plaques to beinstalled. Some of the trees have been mulched, but there are a couple trees
that are struggling to grow and will need some additional care.
Councilmember Dufour announced that the Dale Association caregiversprogram that was due to run for six weeks has been canceled due to lack ofparticipation.
She also encouraged the Councilmembers to study the monthly sales report fromJill Lederhouse, Assessor. The sale prices of homes in the Town of Lockport areincreasing to 17% - 50% above assessed value. She feels given this trend, next
year the assessments will continue to rise.
6. Deputy Supervisor
Deputy Supervisor Siejak was elated over the progress that has been made onthe Niagara County Dysinger Road/ Old Beattie Road intersection realignmentproject.
The Town Clerk distributed the 2017 Audit from the accounting firm of Lumsdenand McCormick. Deputy Supervisor Siejak asked all Town Board members to

review the audit; any questions can be referred to Kate Carter in the Supervisor'soffice. He stated he would like to consider taking action at a future meeting.
He also informed the Councilmembers that Marc Smith will be submitting anapplication for a Niagara Greenway Grant for the Murphy Road bike pathextension. He will need a letter of Town Board approval to accompany theapplication.
MOTION ( 2018-148) to approve a Greenway Grant Application for the Town ofLockport Trail and authorize the Supervisor to sign the application and anynecessary documents was made by Councilmember DiCarlo, seconded byCouncilmember Keough. The motion was APPROVED. AYES-4, NAYS- 0.Voting AYE: Siejak, Dufour, Keough and DiCarlo.
He also reminded everyone in attendance that the Lockport Historical Society willbe holding their Erie Canal Cruise from 3: 00- 5: 00 p. m. Sunday, July 22, 2018.Tickets are available at the Town Clerk' s office and cost$ 20. 00. Councilmember
Keough commented that the Historical Society is really beginning to grow.Deputy Supervisor Siejak commended the new leadership on the significantnumber of programs that they have added.
7. Executive Session
MOTION ( 2018- 149) to enter executive session at 1: 43 p. m. to confer with the TownAttorney and to discuss litigation was made by Councilmember Dufour, seconded byCouncilmember DiCarlo. The motion was APPROVED. AYES— 4, NAYS— 0.Voting AYE: Siejak, Dufour, Keough and DiCarlo.
Executive Session ended, Work Session reconvened
MOTION ( 2018- 150) to resume the work session and regular business meeting at2: 05 p. m. was made by Councilmember Dufour, seconded by CouncilmemberDiCarlo. The motion was APPROVED. AYES— 4, NAYS— 0. Voting AYE: Siejak,Dufour, Keough and DiCarlo. No action was taken during Executive Session.
8. Adjournment
MOTION ( 2018- 151) to adjourn at 2: 05 p. m. was made by Councilmember Keough,seconded by Councilmember DiCarlo. The motion was APPROVED. AYES— 4,NAYS— 0. Voting AYE: Siejak, Dufour, Keough and DiCarlo.
