DOT safety sensitive employees who violate the DOT Drug and Alcohol Testing Rules by testing positive or refusing to test for drugs and/or alco-hol are mandated to be evaluated by a Substance Abuse Professional (SAP).

The SAP will recommend the course of treatment and/or education. The SAP will conduct a follow-up evalua-tion to determine if the employee is eligible for return-to-duty by the em-ployer. The SAP will provide the Des-ignated Employer Representative (DER) the aftercare recommenda-tions.

When is a DOT Substance Abuse Professional (SAP) Evaluation required?

Employers must provide to each employee (including an applicant and/or new employee) who has a positive test or refuses to test (DOT violation) a listing of SAPs readily available to employee.
