    The Australian Whale Sanctuary

    Under the Environment Protection and BiodiversityConservation Act 1999 (EPBC Act) all cetaceans are

    protected in Australian waters:

    theAustralian Whale Sanctuary includes all

    Commonwealth waters from the three nautical milestate waters limit out to the boundary of the Exclusive

    Economic Zone (i.e. out to 200 nautical miles andfurther in some places)

    within the Sanctuary it is an offence to kill, injure orinterfere with a cetacean. Severe penalties apply to

    anyone convicted of such offencesall states andterritories also protect whales and dolphins within

    their waters

    Whale Watching Regulations

    Whale and dolphin watching is regulated in the Australian WhaleSanctuary.

    TheAustralian National Guidelines for Whale and DolphinWatching are reflected in the Environment Protection and

    Biodiversity Conservation Act Regulations.

    The regulations apply to all people interacting with whales anddolphins including commercial operators (tourist or otherwise)

    and people conducting recreational activities.

    The regulations specify how vessels, aircraft and people mustbehave around these animals. For example, vessels must notdeliberately approach whales closer than 100m. Within 300mvessels must use caution and travel at low speed. Touching or

    feeding whales and dolphins is prohibited.
