    2in any such strike, or to impose an obligation to conduct, assis t or participate insuch a strike.

    ARTICLE II: ASSOCIATION RIGHTSA. In accordance with Section 93-8 of the General Municipal Law Chapter

    392, Laws of 1967, the Board of Education of West Hempstead UnionFree School District, West Hempstead, New York, agrees to deductfrom the salaries of its employees the sum of dues for the Association,NYSUT, and AFT, as authorized by unit members and to transmit themonies promptly to the local association for distribution. Authorizationsshall be in writing in the form agreed upon, and said authorization shallbe continuous unless revoked in writing by September 21 of the year inwhich the agreement is effective and all new authorizations will be filedby October 1, of said year, or within one month of the first day ofservice. If the Association should change the rate of its membershipdues, Administration must be notified by the end of the first week of theschool year.Association dues will be deducted start ing with the first payday inOctober. An equal amount will be deducted for ten (10) consecutivepay periods.

    B. The President, Vice President, one Record ing Secre tary, oneCorresponding Secretary, Grievance Chairperson, and Treasurer ofthe Association will not be assigned any building duties other thanproctoring. In addition, where scheduling permits, the President will be

    3assigned a reduced teaching load. In the event the President is anelementary (K-5) school teacher, in addition to Article II C, he/she shallbe permitted to leave school to attend scheduled activities of theAssociation five (5) minutes earlier than the end of the teachers schoolday, such early dismissal being limited to a maximum of one day perweek. In the event that any officer of the Association is an elementary(K-5) school teacher, he/she shall be permitted to leave school toattend scheduled activities of the Association five (5) minutes earlierthan the end of the teachers school day, such early dismissal beinglimited to a maximum of two days per month.

    C. Should any of the officers of the Association be from the elementaryschools, that person will be assigned a special class for the last periodof the day, two days a week. In such event the special subject teacherwill be responsible for the dismissal of the class. If the AssociationPresident is from the elementary school, the assignment of a specialclass will be made for the last period of the day, five days per week.

    D. Where required attendance is necessary at hearings of the PublicEmployment Relations Board or courts, Association officers and al lother parties directly related to the proceedings will be permitted toattend without deduction of personal day or accumulated sick leave.

    E. The Board agrees to furnish to the Association upon its request, andwithin reasonable time limitations, such information as may be requiredby law.

    4F. Space shall be provided for Association files, records, and materials.C. Master schedules for each school year shall be available in the office

    of each such school and a copy thereof shall be furnished to thePresident of the Association, by September ~1st of each school year.

    H. Professional leave will be granted without loss of pay, sick leave orpersonal days to serve as official de legate to the NYSUTRepresentative Assembly. The length of leave will be equal in days tothe number of school days the Assembly is in session, plus one day fortravel, if necessary.There will be one (1) bulletin board in each school building which willbe placed in the faculty lounge for the purpose of displaying notices,circulars, and other Association material.

    J. The Association will have the right to use the school buildings withoutcost at reasonable times for meeting.

    K. The Association will be permitted the use of the district mailboxes andinter-school mail delivery for the purpose of notices, circulars and otherteacher organization materials.

    L. The Association shall be given a place on the agenda of the orientationprogram for teachers.

    M. Upon request, the building principal will announce at a building facultymeeting that the Association will hold its own meeting at the end of thefaculty meeting.

    N. The Association will be allowed the use of office machines forAssociation purposes pursuant to current practice.

    0. Three copies of Board policies and regulations together withamendments thereto as may be made from time to time will befurnished to the Association.

    P. The Association will be informed with respect to staffing patterns andafforded an opportunity to present its views for consideration prior tothe making of a final decision by the Board.

    ARTICLE III: TEACHER RIGHTSA. The Board of Education reaffirms that teachers will be entitled to full

    rights of citizenship and no religious or political activities of any teacher(provided such activities do not take place during working hours) or thelack thereof will be grounds for any discipline or discrimination withrespect to the professional employment of such teacher.

    ARTICLE IV: TEACHING DAY. TEACHING YEAR AND TEACHING LOADA. The teachers school day will mean the time between required sign-in

    time and the earliest allowable sign-out time. The teachers school dayin secondary schools will be seven hours. Effect ive September 1,2002, the teachers school day in the elementary schools shall beextended to seven hours with the following conditions:(i) The elementary student school day shall be no longer than

    six hours and fifteen minutes.

    6(ii) During the period after student dismissal but before teacher

    sign-out (K-5) teachers may be required to supervise their classas follows:

    a) As to any school where students are discharged from acentral location within the school, teachers shall be obligatedto escort the entire class to that location at which time riderswill be discharged to the aides. Thereafter, the teacher willexit the building with the walkers where they will bedischarged.

    b) As to those schools where riders are marshaled outside thebuilding, teachers shall be required to escort the entire classto the bus loop or area where the riders will be discharged toaides and walkers shall be released.

    Except as referred to herein, the time between teacher sign-in and thebeginning of the student day, and between the end of the student dayand teacher sign-out, shall be used for professional activities asdetermined by the building principal after consultation with individualteachers. The professional period shall not be included in thecalculation of free time referred to in Paragraph K of this article. Theactivities to be performed on any given day during the professionalperiod shall be determined by the building principal from the list setforth below. On such days when the principal does not exercisehis/her right to assign a teacher to perform specific professional

    activities, the teacher shall select specific activities from said list:

    Extra help sessions for students assigned to the teachersclass limited to no more than two times per week. Teacherswith split building assignments will alternate the extra helpsessions by building and shall coordinate with the principalsto resolve scheduling issues so long as the teachers day isnot extended. The principal will consult with individualteachers prior to establishing an extra help schedule. Anadministrator will be present until all students have beendismissed from extra help sessions. Subject to relevant lawand Board policy, teachers shall have the authority toremove disruptive students from extra help sessions. Extrahelp sessions will not be in lieu of AIS workshop, or existingreview classes for which a stipend is currently paid. Thisprovision, however, shall not constitute a guarantee that anyof the above shall remain in existence.Meetings with teachers, child study team meetings, sitebased team meetings, grade level meetings and specialeducation meetings.Familiarization with educational technology and websites.Conferences/calls with parents, other teachers, etc.

    5. Grading of student assignments/tests, preparation ofassessment reports, review of student records.

    6. Meetings with central/building administration includingindividual personnel meetings.

    7. Teacher preparation for classes, special classroom or gradelevel activities, such as embarking on thematic units, holidaycelebrations, trips, test schedules, and plays.

    8. Special Ed referral forms and reports.9. Other activities as mutually agreed upon between the District

    and the Association.If the educational program must be altered for valid educationalreasons, an increase of not more than 10 minutes may be permittedafter consultation with the West Hempstead Education Association.Teachers will discharge their professional duties. Discharge ofprofessional duties will include the following:1. Secondary teachers will be available one (1) day per week for one

    (1) hour after the close of the teacher day or before the start of theteacher day with the permission of the building principal, for thepurpose of providing extra help on Mondays, Wednesdays andThursdays pursuant to a schedule developed by the buildingprincipal in consultation with individual teachers. In establishing aschedule of extra help assignments, the following shall apply:a. Extra help assignments in the secondary schools will be

    9made each semester by the building principal, inconsultation with the teacher, utilizing teacher preferenceforms. Teachers will submit forms by June 1st for the fallsemester, and by November 3O~ for the spring semester.Fall assignments will be posted by June 15111 and springassignments will be posted by January 151.

    b. Teachers with split building assignments will alternate theextra help sessions by building and/or department.

    c. Sixth grade teachers will provide extra help only to sixthgrade students. All other secondary teacher assignmentswill be by department pursuant to certification and recentteaching experience of subject matter (within the last three(3) years.)

    d. The principal will assign each teacher an appropriateclassroom for the extra help session.

    e. In the event that the principal or assistant principal assignsstudents to extra help, he/she will provide the extra helpteacher with a list of assigned students prior to the beginningof the school day(s) on which extra help sessions will takeplace.

    f. Guidance counselors may instruct a student to attend extrahelp, but only the building principal or assistant principal canassign students to a particular teachers extra help session.

    I0g. Teachers will maintain attendance records of students at

    each extra help session.h. Student performance in extra help sessions will not be used

    as a basis for teacher evaluation.Curriculum covered at each extra help session is at thediscretion of the teacher in charge.

    j. Except as to physical education, extra help sessions are notto be used as a make-up class for purposes of studentattendance.

    k. Subject to relevant law and Board policy, teachers have theauthority to remove disruptive students from the extra helpsession.No extra help sessions will be required the afternoonpreceding a school holiday.

    m. Union officers and executive board members shall not beassigned to conduct extra help on the designated unionmeeting day. In June, the Union will notify theSuperintendent of the designated union executive boardmeeting day.

    n. An administrator will be present until all students have beendismissed from extra help sessions.

    o. The extra help session will not be in lieu of any AISworkshop, Regents review class, Homework Center or

    existing review classes for which a stipend is currently paid.This provision, however, shall not constitute a guarantee thatany of the above shall remain in existence.

    2. Teachers shall inform their students and their principals eachsemester of the days they will be available to provide help or meetwith parents. If there is a problem regarding scheduling, either theteacher or the supervisor may request a consultation.

    3. Teachers will not be required to perform these services the daybefore a holiday or vacation.Any and all adjustments and exceptions, which do not lengthen theschool day for teachers, must be approved by the principal of theschool.Teachers shall complete their term of employment as per theofficial school calendar and shall not be released early for travel orsummer school attendance except upon approval of theadministration.Teachers will submit lesson plans weekly to the director,department chairman and/or building principal. Teachers shall notbe obligated to maintain duplicate plans in order to fulfill thisobligation.Wherever possible, and within existing facilities, staffing andequipment, secondary school teachers will not be assigned to morethan two rooms, nor be required to teach more than 2 subject

    12areas, nor more than 3 teaching preparations within said areasduring any one semester.In grades 6-12 every effort will be made to assign a teacher nomore than 3 classes and/or duties in succession. No teacher will beassigned more than 4 classes and/or duties in succession withoutprior notice and consultation.If possible, t ime spent in inter-school travel will not be deductedfrom teachers free time.Homeroom assignments in grades 6-12 will provide for equitablerotation of such duty among classroom teachers.Every effort will be made to notify guidance counselors concerningsummer assignment by May 15.Grades K-5 shall have a minimum of 200 minutes free time perweek, which will not be obtained by doubling classes. Every effortshall be made to schedule free periods of at least 30 minutes at atime, subject to existing staff, student enrollment and facilities.Notwithstanding any past practice to the contrary, teachers wholeave the building during the school day (lunch, free) shall berequired to sign in and sign out.The district will guarantee a consecutive 45 minute lunch period inthe elementary schools with the possible exception of a 30 minutelunch period twice a month in the event of an emergency. Grades

    6-12 shall have the equivalent of one class period free time per

    Assignment to learning centers pursuant to a program developedby the Superintendent of Schools lim ited to one such assignmentper week. Assignm ent to learning centers shall be upon the

    following conditions:a. There shall be no formal observations or evaluations.

    However, teachers may be observed and evaluated as towhether they are complying with their obligations as to thisassignment.

    b. Students may participate on their own volition and may beassigned to learning center by teachers, counselors andbuilding administration. No more than seven students mayparticipate during a particular period. The building principalshall determine which students shall participate in the eventthe maximum is exceeded in a given period.

    15c. Centers are not to serve as time-out rooms or suspension

    centers.d. Centers are not to serve as advisor/advisee programs.e. Centers are for the purpose of reinforcing/supporting and re

    teaching material previously delivered in class.f. Assignment to a learning center shall be limited to the

    subject for which the teacher is certified.g. Teachers shall not be responsible for grading student work.h. While no formal lesson plans are required, there must beevidence of planning and communication between the

    teacher assigned to the center and the classroom teacher inorder to address students needs.

    Teacher AssistanceTeacher assistance is defined as the assignment of a teacher to theclassroom of another teacher within the department, limited to onesuch assignment per week, for the purpose of assisting ininstruction. Assignment to teacher assistance shall not be used forthe following conditions:a. provide substitute teaching service unless the teacher

    receives substitute teaching pay pursuant to Paragraph Phereof;

    b. serve as mentoring programs.c. to participate in classroom management.

    16The District shall provide ongoing professional training with respectto a teachers responsibilities under paragraphs 10 and 11 above.In addition, the parties agree that the total obligation of teacherspursuant to paragraphs 10 and 11 hereof shall not exceed oneperiod per week.

    12. Other activities as mutually agreed upon between the District andthe Association.

    Notwithstanding any past practice to the contrary, teachers who leave thebuilding during the school day (lunch, free) shall be required to sign in and signout.

    M. During each school year, the District may require teachers to attendBack to School Night and one other evening meeting. The natureof the services provided during the addit ional evening meeting shallbe determined by the Board of Education, upon therecommendation of the Superintendent of Schools. This additionalmeeting shall be no more than three and one-half hours duration (31/2), and will conclude by 9:30 p.m. Teachors with splitassignments shall not be required to provide more than one (1)additional evening of service.

    N. Teachers may be excused from their duties for the purpose ofattending I.E.P. conferences involving their students, at the solediscretion of the building principal. Teachers may not be directed,however, to attend I.E.P. conferences during their lunch period.

    17Staff Development All teachers shall be obligated to participate ineighteen (18) hours of staff development sessions annually withoutadditional compensation. Such sessions shall commence no laterthan 15 minutes after teacher dismissal at the latest c losing schoolwhose teachers are participating in the session. Staff developmentsessions shall be no more than two (2) hours in length. Teachersshall be provided with at least thirty (30) days notice of staffdevelopment sessions. To the extent that sessions occur otherthan on those Tuesdays on which teachers are not obligated toattend meetings as set forth below, notice of staff developmentsessions shall be provided prior to the beginning of the semester.Every effort will be made to conduct such sessions on thoseTuesdays on which teachers are not obligated to attend facultydepartment or grade level meetings after teacher dismissal. In noevent, however, shall staff development sessions be scheduled onFridays or on the day immediately preceding a school holiday.Secondary teachers may volunteer to provide substitute teachingservice during their free period and/or their lunch period. Theselection of volunteers to perform substitute teaching servicespursuant to this paragraph shall be at the discretion of the buildingprincipal. Teachers selected shall be compensated at the rate of$25.81 per period for the 2005 2006 school year; $26.58 perperiod for the 2006 2007 school year, $27.44 per period for the

    182007-2008 school year and $28.30 for the 2008-2009 school year.The provisions of this paragraph shall not decrease or otherwisealter the principals authority to periodically assign teachers to coverclasses during their duty period as a duty assignment withou tadditional compensation. In addition, the principal shall have theauthority to assign teachers to substitute teaching service duringtheir duty period to a maximum of three (3) consecutive days and toan overall maximum of eight (8) days annually without additionalcompensation.

    ARTICLE V: ASSIGNMENTS AND TRANSFERSA. The parties recognize that changes in grade assignments in theelementary schools, changes in subject assignments in the secondaryschool grades, and transfers between schools may be necessary.While the right of determination to assign or transfer is vested in theSuperintendent with approval of the Board, wherever possible theSuperintendent or designee will not assign or transfe r a teacherwithout prior discussion with or notif ication to said teacher. In theevent an assignment or transfer is made during the summer, theSuperintendent or designee will notify the teacher by certified mail atsaid teachers last recorded address. The teacher shall have a right toa conference. Such transfers and changes of assignments shall be ona voluntary basis whenever possible. In making involuntaryassignments or transfer, the convenience and wishes of the individualteacher shall be honored to the extent that these considerations do

    19not conflict with the instructional requirements and best interests ofthe school system and the pupils.Notice of transfer will be given to teachers as soon as practicable andunder normal circumstances not later than June 1.If a teacher is transferred, the school district will assist the teacherwith all physical aspects of the transfer.In making changes in grade assignment in the elementary schoolsand in subject assignment in the secondary schools, the wishes of theindividual teacher shall be considered to the extent that these do notconflict with the instructional requirements and best interests of theschool system and the pupils.Under normal circumstances, teachers who desire a change in gradeor subject assignment shall file a wriften statement of such desire withthe office of the Superintendent no later than February 1.Such statement will include the grade and/or subject to which theteacher desires to be assigned. As soon as practicable and undernormal circumstances not later than one week prior to the end ofschool, the Superintendent shall notify each teacher of the actiontaken in regard to the request for change.In arranging schedules for teachers who are assigned to more thanone school, an effort shall be made to limit the amount of inter-schooltravel. Such teachers shall be notified of any changes in theirschedules as soon as practicable.

    20G. Actual or expected vacancies in existing or newly created positions for

    the forthcoming school year will be posted monthly for a period of 10school days. A vacancy will not be deemed to exist if an individual ison sabbatical, child care or personal leave.

    ARTICLE VI: PROMOTIONS AND VACANCIESPromotional positions will mean a position as supervisor, director, principal,

    assistant principal and department chairperson. Actual or expected vacanciesin the above positions or newly created promotional positions will be postedfor ten school days in an announced, designated space in each building insufficient time to permit convenient application therefore. The notice willcontain a brief description of the qualifications required. During the summermonths such notice will be mailed to teachers in a stamped self-addressedenvelope provided by each interested teacher for this purpose.Preference in filling such positions will be given to qualified teachers in thedistrict but this will not preclude the Board from inviting and consideringapplications from outside the district. A vacancy will not be deemed to exist ifan individual is on sabbatical, child care or personal leave.

    ARTICLE VII: TEACHER EVALUATIONSA. All observations of the work performance of a teacher will be

    conducted openly and with full knowledge of the teacher. Teacherswill be given a copy of any report of such observation prepared bytheir supervisors and of any evaluation which is included in theteachers file.

    21Teachers will have the right to discuss such reports with theirsupervisors.Subsequent to employment, no material derogatory to a teachersconduct, service, character, or personality wilt be placed in thepersonnel file unless the teacher has had an opportunity to reviewsuch material. The teacher will acknowledge the opportunity toreview such material by affixing his/her signature to the copy to befiled with the express understanding that such signature in no wayindicates agreement with the contents thereof. The teacher will alsohave the right to submit to the superintendent a written answer tosuch material, which shall be attached to the file.Any complaints regarding a teacher made to any member of theadministration by any parent, student or other person, which mayresult in disciplinary action, or a reprimand will be promptly called tothe attention of the teacher when such action is anticipated.The Association recognizes the authority and responsibility of aprincipal for disciplining or reprimanding a teacher for delinquencyin professional performance. If a teacher is to be disciplined orreprimanded by the superintendent or designee, said teacher mayrequest that a representative of the Association be present.This shall not preclude the superintendent or designee from havingprofessional conferences directly with teachers on any othermailers.

    No teacher will be disciplined, reprimanded, reduced in rank orcompensation or deprived of any professional advantage withoutjust cause.Teachers will have the r ight upon reasonable notice, to review thecontents of their personnel files and to obtain copies of anydocument in it with the exception o f privileged or confidentialdocuments solicited prior to their employment. A teacher will beentitled to have a representative of the Association accompanyhim/her during such review, which shall be made in the presence ofa representative of the superintendent.All evaluation forms will be developed by the administration inconsultation with the Association.No monitoring or recording of the work performance of a teachershall take place without the full knowledge and consent of theteacher.

    ARTICLE VIII: SUPPLIES, FACILITIES AND WORKING CONDITIONSInsofar as is practicable and consistent with existing facilit ies, allclassrooms and specialty rooms will be adequatoly lighted, heated, andventilated, and otherwise be maintained in a clean, safe and healthfulcondition appropriate to the teaching situation.

    23ARTICLE IX: LEAVES

    A. Personal I llnessAbsence from duty because of personal il lness on the part of the professionalstaff shall be excused with full pay on the basis of the following schedule:

    However, the schedule for all teachers appointed effective July 1, 1983 andthereafter, and granted tenure, shall be twelve (12) days per year. The schedulefor all teachers appointed effective July 1, 1985, whether or not granted tenure,shall be ten (10) days per year.

    1. Proof of IllnessAbsence must be accounted for by filing a disability certificate withthe Superintendent of Schools. If such absence is of three (3) ormore consecutive days a physician other than the school medicalexaminer may be required by the Superintendent to sign thecertifica te , unless the school medical examiner is also the staffmembers family physician.

    2. Unused Sick LeaveUnused sick leave in any school year shall be cumulative andavailable for future use as sick leave and br as provided in policy4156 to a maximum of 200 days. In determining the amount ofunused sick leave for retirement purposes in the final year ofserv ice ending with retirement, a teacher with 200 days of

    24accumulated sick leave at the beginning of said year shall begranted additional days as follows:The number of days absent due to illness for the previous 5 yearswill be averaged (added and divided by ~), subtracted from 20,divided by a~ and the resulting number shall be the number of daysavailable for use as sick leave in addition to the 200 days during thefinal year. The maximum value of unused sick leave under policynumber 4156 shall remain 100/200ths of the f inal years regularlyscheduled salary.The District shall notify each teacher as to the total amount of sickand personal leave such teacher has accumulated by November 15of each year.

    3. Extended IllnessIf a professional staff member has exhausted his/her accumulatedsick leave because of extended illness, he/she will be continued as aregular member of the staff at a rate of salary equal to the differencebetween his/her own daily salary and the minimum daily salary currentlypaid to substitute teachers after examination and certification by theschool medical examiner. In the case of continued absence the Boardmay require periodic examinations. This period of reduced salary willbegin only after the staff workers accumulated sick leave has beenexhausted and will continue for a period of days equal to the number ofyears a teacher has been in the school district multiplied by eight (8), up to

    25a maximum of 160 days. Subject to the discretion of the Board ofEducation, tenured teachers employed by the distr ict who are afflicted bya medically certified long-term illness of a catastrophic or termirfal naturemay be granted one full year extra sick time after their full dayaccumulated sick leave has been depleted which is to be followed by thepart salary accumulated sick leave time.

    B. FMLAThe parties agree that time spent on paid sick leave pursuant to this articleshall be excluded from the calculation of a teachers entitlement to unpaidleave pursuant to FMLA.

    C. Military LeaveMilitary leave will be granted according to sections 242 and 243 of MilitaryLaw.

    D. Personal Business and EmercjencyThe allowance for all teachers appointed prior to July 1, 1985, shall bethree days for personal emergencies. The allowance for teachersappointed effective Ju ly 1, 1985 shall be two days for personalemergencies.

    1. Leave shall be granted for personal emergencies such as:a. Sickness in the immediate family or household.Immediate family shall mean spouse and children, brotherand sister, mother and father, mother-in-law and father-inlaw, grandparents, grandchildren, son-in-law, daughter-in-

    law, brother-in-law and sister-in-law, guardians and fosterchildren.b. Legal or emergent personal mailers, which cannot beattended to outside of the school day.One of the days may be used for a private personal

    emergency and will be reported to the superintendent ofschools in advance if possible. The interpretation of personalemergency on this one day per year will be left to thepersonal integrity of the teacher.Unused personal leave in any school year shall accumulateto unused sick leave.Half-day utilization of personal days will not be permitted.

    E. BereavementThere will be allowed a maximum of 5 days for bereavement for death inthe immediate family or household. For thIs purpose, immediate familyshall mean spouse and children, brother and sister, mother and father,step-mother, step-father and step children, mother-inlaw and father-inlaw, and there will be allowed a maximum of 2 days for bereavement fordeath of grandparents, grandchildren, son-in-law and daughter-in-law,brother-in-law and sister-in-law, guardians and foster children.

    27F. Child Care Leave of Absence

    1. Childcare leave shall be granted for the balance of the school year inwhich the leave is granted plus one additional year in accordance withcurrent practice.

    2. Childcare leaves without pay shall be granted to regularly employedfull4ime teachers.

    3. The superintendent must be notified in writing no later than February 1whether or not a teacher on childcare leave expects to return inSeptember.

    4. A teacher will not accumulate additional leave days during childcareleave.

    G. Other Extended Leaves of AbsenceOther leaves of absence may be granted upon recommendation of thesuperintendent of schools and approved by the Board of Education.

    H. Professional LeavesProfessional leave will be granted without loss of pay, sick leave orpersonal days:1. To serve as a delegate to the New York State Retirement System,

    plus one day for travel, if necessary.2. Upon approval of the Superintendent, leave to visit other schools toobserve methods and programs or to attend professional

    conferences may be granted to teachers. Commencing in 1989-90

    28and thereafter, request for such leave of one days duration shall begranted to each teacher at least once in every two school years.

    Leave Without Pay for Personal ReasonsA leave of absence without pay or increment of up to one (1) year maybe granted for personal reasons. Additional leave may be granted atthe discretion of the Board of Education.

    J. General1. A teacher on leave of absence for a school year or more shall notifythe superintendent as to his/her intentions to return to service at leastfive (5) months prior to the expiration date of such leave. If theSuperintendent has not received timely notice, he/she shall send aletter of inquiry to the teacher at an address provided for such purpose.Failure to notify the Superintendent within two (2) weeks of receipt ofsuch inquiry shall be assumed to constitute a resignation.2. Except for military leave, a teacher will not accumulate additionalleave days for any unpaid leaves of absence, nor shall said teacherlose any previously accumulated leave days.

    K. Sabbatical LeavesSabbatical leave may be granted for a period of one schoolsemester or of one school year. Such leave may be granted by theBoard of Education for the purpose of study, travel or improvinghealth, upon recommendation of the superintendent.

    292. The applicant shall have completed at least seven (7) years of

    continuous service in this school district. Regularly approved leaveof absence on military duty shall not be considered as a break incontinuity of service, nor shall it be counted in reckoning the seven(7) year period of service.

    3. The applicant shall not be eligible for sabbatical leave unlesshe/she has given at least seven (7) years of continuous service tothe district since the date of termination of a prior period ofsabbatical leave.

    4. The applicant as a condition prerequisite of taking leave shall signan agreement in the form set forth on administrative regulations, toresume his/her professional service in this school district for aperiod of not less than one full school year immediately followingthe expiration of the period of leave.

    5. The applicant, upon return, shall be entitled to the increments,retirement credits, and accumulated sick leave that would haveaccrued to him/her had he/she continued in regular service.

    6. The applicant shall not, while on leave, accept any employmentwithout prior approval of the Board of Education. However, minoremployment supplementary to the purpose of the leave shall beexempt provided such employment is of a nature which could havebeen performed had the sabbatical leave not been granted.

    307. The applicant shall not be required, once leave is granted, to

    terminate that leave before the date of its expiration except forviolation of the conditions of the leave.

    8. Those employees on sabbatical leave may continue to havededucted from their salary all deductions for which they are eligible.

    9. Requests for sabbatical leaves of absence must be received by thesuperintendent of schools in writing no later than February 1, andaction must be taken on all such requests no later than March 30 ofthe school year preceding the school year for which the sabbaticalleave was requested.

    10. Not more than 2% of the professional staff eligible for membershipin the Association will be permitted to be absent on sabbatical leaveof absence at any one time. If more than 2% apply, selection shallbe made in accordance with seniority, other things being equal.From among applicants with equal prior service, selection shall bemade by the Board of Education upon the recommendation of theSuperintendent.

    11. The applicant, if leave is approved, shall be granted full salary for asemesters leave or half salary for a years leave; such salary to beat the rate of pay he/she would have received had he/shecontinued in regular service.

    12. The applicant, if the leave is to be granted for the purpose ofimproving ones health, shall be subject to examination by the

    31school physician who shall certify to the Board the necessity ofgranting such leave.

    13. The applicant, if leave is granted for travel or study, shall uponcompletion of leave, submit to the superintendent a report sellingforth the manner in which time was spent and benefits accruingtherefrom.

    14 . The applicant, if leave is granted, shall upon return be entitled to beplaced in a position of responsibility similar to that held at the timehe/she took leave. Position of responsibility shall be understoodto pertain to ones basic position and not necessarily to include aposition of extra responsibility for extra pay, which he/she may haveheld.

    ARTICLE X: SEVERANCE AND RETIREMENT BENEFITSEffective July 1, 2006, a teacher with at least 20 years of continuousservice with the District who retires from the District and from the NewYork State Teachers Retirement System shall be entitled to payment forunused accumulated sick leave at the rate of one days pay for every twodays of said entitlement to a maximum of one-half years salary. Paymentshall be made within 30 days of retirement from the New York StateTeachers Retirement System. In order to be eligible for this benefit,written notice of retirement must be provided to the Superintendent ofSchools on or before March l~ for retirements effective the following June30th For teachers who retire other than at the end of the year, four

    33Association shall be established. The Committee will consider and makerecommendations in the following areas:A. The courses to be offered in in-service education and the selection

    of instructors therein.B. The standardized testing programs.C. Such other matters as from time to time may be referred to the

    Committee by joint agreement of the parties hereto.In addition, the Committee will be consulted regarding the schoolcalendar. Past practice with regard to the length of the school yearfor teachers will act as a guideline.The Committee may organize ad hoc study committees to help inits deliberations. It is understood that the Committees function is toattempt to solve educational problems.The Committee shall be responsible to the parties to thisagreement.

    ARTICLE XII: DISRUPTIVE CHILDA. Subject to applicable law and District policy, a child who

    threatens or engages in physical violence to self, fellowstudents, or a teacher may be directed by the teacher to reportimmediately to the principal or other designated supervisorunder such escort as is prescribed by the school. Such pupil willnot be returned to the classroom without consultation among the

    34principal, the teacher, and other professional resource people,when deemed necessary by the principal.

    B. Pupils who so seriously disrupt the classroom work as toimpede effective instruction may be reported by the teacher tothe principal or other supervisors for appropriate attention.

    ARTICLE XIII: TEXTBOOKSIn making textbook selections and changes, the recommendations of amajority of classroom teachers who will use them shall be given mostserious consideration after they have had sufficient opportunity to consideralternate choices.

    ARTICLE XIV: TEACHER-ADMINISTRATION SCHOOL BOARD LIAISONA. The two (2) Association representatives of each school or their

    alternates shall meet with the building principal or the principalsduly author ized representative monthly during the school year toreview and consider building matters. These meetings may beinitiated by either party and may be waived by mutual agreement.

    B. Association representatives shall meet with the Superintendent ofschools or the Superintendents duly authorized representative atleast three times during the school year to review and considermailers relating to the administration of this agreement and other

    35areas of concern. These meetings may be initiated by either partyand may be waived by mutual agreement.

    C. Upon prior notification to the Superintendent, the Association maymeet upon request with the Board of Education at a mutuallyacceptable time; such request shall contain a brief description ofthe items to be discussed; such items having previously beenconsidered with the Superintendent.

    ARTICLE XV: TEACHER DUTIESA. Teachers in grades K-12 will not be assigned cafeteria or bus

    duties.B. In grades 6-12, teachers will be utilized as needed for hail duty up

    to a maximum of one hall duty per teacher per day.Representatives of the Association will be involved in theassignment of building duties. Wherever possible, assignments willbe rotated during the year.

    C. In grades K-5, relief will be provided from hall duties.D. Teachers of grades 1-6 shall be provided with one-half day per year

    for the purpose of marking hand-scored mandated New York StateTests and/or standardized tests. This provision shall only apply togrades 1-5 so long as the 6th grade is assigned to the MiddleSchool. Teachers of grade K shall be provided with (2) half daysper year for such purpose.

    36ARTICLE XVI: SALARIES AND COMPENSATIONA. For the school year 2005-06, the 2004-05 salary schedule shall be

    increased by 3.25% plus increment in accordance with Schedule A-2; forthe school year 2006-07, the 2005-06 salary schedule shall be increasedby 3.0% in accordance with Schedule A-3; for the school year 2007-08,the 2006-07 salary schedule shall be increased by 3.25% in accordancewith Schedule A-4; the 2008-09 salary schedule shall be increased by3.125% in accordance with Schedule A-5; copies of which are attachedhereto and made a part hereof.B. All teachers on staff as of July 1, 2005, and thereafter, have been

    placed and/or will be placed on Schedules A-2, A-3 and A-4. Forthe school year 1979-80 the differential factor for guidancecounselors shall be 1.06 and for school psychologists 1.10.Thereafter, guidance counselors and school psychologists shallreceive the same dollar differential as in 1979-80, computed at fulltime value, if appropriate. The dollar differential for said guidancecounselors shall be increased by $50.00 per step and for saidpsychologists by $100 per step to and including step 15. Forguidance counselors and psychologists whose employment iseffective on or after July 1, 1980 (hired on or after July 1, 1980), thedollar differential for guidance counselors shall be $300 on step 1and shall be increased by $50 for each step to and including step15 to a maximum of $1,000; and the dollar differential forpsychologists shall be $500 on step I and shall be increased by

    37$100 for each step to and including step 15 to a maximum of$1,900. All guidance counselors and psychologists whoseemployment is effective on or after July 1, 1983 and thereafter(hired on or after July 1, 1983) shall be paid in accordance with thesalary schedule for teachers without a differential.

    C. Auxiliary Salary Schedules, substitute service, tutoring rates anddean of students shall be subject to the same percentage increasesreferred to at Paragraph (A) above. The side letters of agreementregarding mentoring dated June 1, 2006 and translators datedMarch 20, 2005, shall be incorporated into the aforesaid auxiliaryschedules.

    D. Newly hired full-time teachers shall be credited for prior teachingexperience whether obtained in public, parochial, private, oroverseas schools as follows:

    One years credit for each of the first four years ofexperience.

    2. One years credit for the next two years of experience.3. One years credit for the next two years of experience.4. One years credit for the next two years of experience.

    Service in the Peace Corps or Vista will be included in theabove on a one-for4wo basis.

    38Additional credit for prior teaching and business experience may begranted upon the recommendation of the Superintendent ofSchools subject to review and approval of the Board of Education.

    E. West Hempstead teachers will be given preference for tutoringassignments. Written notification of tutoring opportunities will begiven to the professional staff. The rate for tutoring will be $47.30per hour for 2005-2006, $48.72 per hour for 2006-2007, $50.30 perhour for 2007-2008; and $51.87 per hour for 2008-2009.

    F. For the 2005/2006 school year the stipend for the position of Deanof Students shall be $5,576; for the 2006/2007 school year $5,743;2007/2008 school year $5,929; and 2008/2009 school year $6,114.

    C. The District shall provide for a voluntary direct depositprogram.

    ARTICLE XVII: EXTRA PAY FOR EXTRA RESPONSIBILITYA. The extra pay for extra responsibilities salaries for the school years

    2005-2006, 2006-2007, 2007-2008 and 2008-2009 shall be inaccordance with Schedules B-i, B-2, B-3, D-1, D-2, D-3, E-i, E-2,and E-3, copies of which are attached hereto and made a parthereof. The salary schedules referred to in this Article shall beimproved by the same percentages as set forth in Article XVI.

    B. Preference in filling extra pay positions will be given to qualifiedteachers in the district. This, however, will not preclude the Boardfrom inviting and considering applications from outside the district if

    39qualified district teachers do not apply. In addition, the preferencereferred to in this paragraph shall not apply in the event that onlyone qualified teacher in the District applies for any particular extrapay coaching position.

    C. Whenever a teacher assigned to a position referred to in this Articleis absent for more than five (5) consecutive days, (with thepossibility of an extended illness) the position shall be consideredto be temporarily open for application pursuant to the following:a) The new appointee shall be paid at the rate of l/l8& of the

    stipend per day, in lieu of payment to the originally assignedteacher.

    b) Regular faculty members will be offered the first opportunityto apply for the position.

    c) If no regular faculty member applies the per diem substituteor other applicant may be considered.

    ci) The regularly assigned teacher will be reinstated uponreturn.

    D. The District shall, upon application, reimburse each coach for one(1) coaching conference/clinic for each sport coached at least everyother year, up to a cost of $100 per conference/clinic.

    ARTICLE XVIII: SUMMER SCHOOLThe Board may, at its option, determine to operate a summer schoolprogram. In the event such a program exists, teachers shall be paid

    40according to Schedules, C-I, C-2, and C-3. Summer school teachersshall be paid only for days actually worked and classes actually taught.Deductions for absences shall be based upon the per diem rate of the CSalary Schedules. The summer school calendar (30 days of instructionand one examination day) shall be established by the Superintendent ofSchools.Preference in filling summer school positions will be given to qualifiedteachers in the Distr ic t provided, however, that as a condition of summerschool employment, the District may require a teacher to teach a minimumof two sessions per day. This preference will not preclude the District frominviting and considering applications from within or without the District ifqualified District teachers do not apply. Summer school teachers shall notbe entitled or required to call in their own substitutes. The duties ofsummer school teachers shall include the marking of examinations ofstudents entitled to take such examinations even though said students arenot enrolled in the Districts summer school program. However, as tostudents who are not enrolled, teachers shall be compensated for markingexams at the rate of $5.00 per such exam.

    ARTICLE XIX: INSURANCEA. 1. The Board wil l continue its present policy #4155

    regarding the payment of health insurance premiums. TheDistrict will pay 90% of the health insurance premium.Effective July 1, 2006, this contribution shall be reduced to

    4187 1,4% and further reduced to 85% effective July 1, 2007and thereafter. The parties agree that for members whoretire prior to July 1, 2006 and current ret irees, the Districtshall pay 90% of the premium. For members who retireduring the 2006/07 School year, the District shall contribute87 %% and for members who retire July 1, 2007 andthereafter, the District shall contribute 85%. However, thisagreement shall not affect the Districts right to reduce itscontribution to the cost of health insurance for any and allretirees should Chapter 729 of the laws of 1994, asamended, be modified, repealed or allowed to lapse to theextent that said statute inh ib its the Districts right todetermine its contribution on behalf o f retirees independentof its obligations to current employees.

    2. The teachers contribution to the payment of healthinsurance premiums shall be billed in equal semi-monthlyinstallments.

    3. In the event that legislation is passed authorizing the Districtto consider health insurance to be part of a pre-taxcontribution program, the District shall consider saidinsurance to be part of such a program.

    The Board agrees to appropriate the sum of $110,500 for the2005/06 school year, $113,000 for the 2006/07 school year,

    42$115,500 for the 2007/08 school year and thereafter, toward thecost of group dental insurance. The Districts payments as referredto herein shall be made semi-annually, September 1st and February1st. Payment of the employees share will be made by payrolldeduction.

    C. The Board agrees to provide a group term life insurance policy toinsure each full-t ime teacher in the amount of $20,000 with a riderfor accidental death and dismemberment.

    ARTICLE XX: GRIEVANCE PROCEDUREIn order to establish a more harmonious and cooperative relationshipbetween teachers, administrators, and members of the Board ofEducation, it is hereby declared to be the purpose of these procedures toprovide a means for orderly settlement of differences, promptly and fairly,as they arise. An individual shall discuss the alleged grievance with his/herimmediate supervisor before initiating formal grievance procedures.Definitions1. Individual will mean an employee eligible for membership in the

    Association or any group of such employees, or the Association.2. Administrator shall mean any individual responsible for, or

    exercising any degree of supervision or authority over anotherindividual.a. Immediate supervisor shall mean the building principal to whom

    the individual is assigned.

    431. In case of personnel teaching in a private school of

    the district, the Superintendent shall designate theimmediate supervisor.

    2. Upon application of an individual who has beenassigned to more than one building principal, theSuperintendent may designate an immediatesupervisor.

    3. Representative shall mean the person or persons designated bythe aggrieved individual as his/her counsel or to act in his/herbehalf.

    4. Grievance shall mean a complaint concerning the violation,application or interpretation of a stated specific provision of thisagreement as to a matter expressly covered by this agreement.

    Basic Principles1. It is the intent of these procedures to provide for orderly

    settlement of differences in a fair and equitable manner.The resolution of a grievance at the earliest possible stageis encouraged.

    2. An individual shall have the right to present grievances inaccordance with these procedures free from coercion,interference, restraint, discrimination, or reprisal.

    443. An individual shall have the right to be represented at any

    stage of the procedures by a person or persons of his/herown choice.

    4. Written records shall be kept of all stages. Each party to agrievance shall have access at reasonable time to allwritten statements and records pertaining to the case inquestion. No record of the grievance shall be placed in thegrievants personnel file.

    5. All hearings and proceedings shall be confidential.6. It shall be the responsibility of the Superintendent of the

    district to take such steps as may be necessary to giveforce and effect to these procedures. Each Administratorshall have the responsibility to consider promptly eachgrievance presented to him/her and make a determinationwithin the author ity delegated to him/her within the timespecified in these procedures.

    7. The time periods of any step or these procedures may beextended by the written agreement of the aggrieved andthe supervisor.

    8. If dissatisfied with the decision rendered in any step ofthese procedures, the aggrieved must notify in writing theperson or group who rendered the unsatisfactory decision, c

    47his/her designee(s) shall render his/her decision in writing tothe aggrieved not later than ten (10) school days afterreceipt of the grievance by the Superintendent. If a designeeacts for the Superintendent, it shall have the same effect asif the Superintendent had rendered the decision, and ineither event the Superintendent shall be deemed to haveexercised his/her prerogative.Step 3If dissatisfied with the decision as rendered in Step 2, withinten (10) school days thereafter, the individual shall submithis/her grievance in writing to the Board of Education.He/she should include the written record of the previoussteps. The Board shall meet with the aggrieved in executivesession unless both agree to a public session. All parties tothe grievance must be present and may have counsel. TheBoard shall render a decision in writing to the aggrievedwithin thirty-five (35) school days after the receipt of thegrievance.Step 4If dissatisfied with the decision as rendered in step 3, withinten (10) school days thereafter, notice of intent to arbitratewill be given to the Board and then as soon as possible, thematter shall be submitted to an arbitrator selected by the

If the parties cannot agree on an arbitrator, eitherparty may request the American Arbitration Association todesignate a panel of arbitrators experienced in publicemployment relations with reference to schools, from which,in accordance with the rules then obtaining of the AmericanArbitration Association, an arbitrator will be selected ordesignated.The arbitrator shall issue his/her written determination andaward not later than 30 days from the close of the hearing orif oral hearings have been waived by both parties then fromdate of transmission of the final statements and proofs to thearbitrator. The voluntary labor arbitration rules of theAmerican Arbitration Association shall apply to theproceedings insofar as they relate to hearings, fees andexpenses. The arbitrators fee and expenses will be sharedequally by the parties. The arbitrator shall have no power toalter, add to or detract from the provisions of this agreement.As to grievances that arise after July 18, 2006, the award ofthe arbitrator shall be final and binding, subject to theprovisions of Article 75 of the CPLR and applicable law.

    ARTICLE XXI: TEACHING ASSISTANTSThe following constitutes the salary, benefits and working conditions of

    teaching assistants.

    A. Salary The hourly salary rate for all teaching assistants shall beincreased by the percentage increases set forth at Article XVI of thisagreement and in accordance with Schedule F attached hereto and madea part hereof. Effective for the 2006/07 school year and thereafter, theDistrict will implement a program to annualize salaries in order to providefor 26 paychecks to teaching assistants. However, the implementation ofthis system will not change the status of assistants as hourly workerswhose paychecks are subject to adjustment for time lost in excess ofaccumulated leave entitlement. For the purpose of computing daily pay,student calendar plus orientation day and twelve (12) holidays shall beutilized.

    B. Layoffs - In the event the Board determines to reduce the work force ofteaching assistants, layoffs are to be made on the basis of seniority insofaras compatible with the efficiency of the operation as determined by thesole judgment of the Business Manager of the Board. Due considerationwill be given to the competence of the individual person. In general, thelast person hired will be the first laid off, subject to the judgment of theBusiness Manager as aforesaid.

    C. Vacancies Notice of teaching assistant vacancies will be posted in eachbuilding of the District for a period of one week or five school days, withthe understanding that the District would not be precluded fromconsidering applicants not in the School District employ.

    . Paid Holidays Twelve (12) days at which schools is not in session willbe considered and treated as paid holidays.

    E. Bereavement Leave Teaching Assistants shall be entitled tobereavement leave as set forth at Article IX, Paragraph D of thisagreement.

    F. Health Plan The State-Wide Health Plan now in effect shall continue tobe available to all eligible employees.

    G. Dental Insurance Teaching Assistants shall be entitled to participate inthe Group Dental Insurance Plan set forth at Article XIX, Paragraph B ofthe Agreement.

    H. Closure of Schools If school is declared closed by the Superintendent ofSchools, as result of inclement weather or for other similar emergencies,such as, electrical outage, boiler shutdown, or fire, employees will be paidfor the normal hours of such day customarily worked by them.Grievance Procedure Teaching Assistants shall be entitled to thegrievance procedure set forth at Article XX of this agreement.

    J. Disability Insurance The policy of disability of insurance carried by theDistrict for the clerical and custodial units shall be extended to the teachingassistants.

    K. Personal Days Teaching Assistants who are assigned to five (5) hours aday will be entitled to two (2) personal days during a calendar year.

    L. Sick Days Teaching Assistants shall be entitled to four (4) paid sickdays per year. Effective for the 2006/07 school year and thereafter, this

    entitlement shall be increased to five (5) days annually. Effective June 30,2006, assistants shall be entitled to accumulate up to a total of 50 unusedsick days for use purposes. Unused personal days may be carried overas sick days.

    ARTICLE XXII: CALENDARThe parties agree that the Board of Education retains its right to establish

    the length of the school year annually.ARTICLE XXIII: MISCELLANEOUS

    A. With respect to mailers not covered by this contract, which are propersubjects for collective negotiations, the Board agrees it will make nochanges without appropriate prior negotiations with the Association,but such changes shall not diminish the terms and conditions ofemployment of any teacher.

    B. The Board will continue its present policies and established practiceswith respect to wages, hours and clearly defined working conditionssuch as leave (sick, military and child care), health, safety, and fringebonofits, except as these policies are modified herein and except aschange is commanded by law.

    C. There will be no reprisals of any kind taken against any unit memberby reason of his/her membership or non-membership in theAssociation or participation in its activities.

    52D. Copies of this agreement will be provided by the Board and a copy

    given to each unit member now employed or hereafter employed bythe Board.

    E. Each unit member will be given a District Handbook as early aspossible in the school year.

    F. If any provision of this agreement is found to be contrary to law orapplicable regulations of any governmental agency with jurisdiction inthe premises then only that provision will be deemed invalid but allother provisions will continue in full force and effect.

    C. The District will provide payro ll deduction to Nassau EducatorsFederal Credit Union upon the filing of requests on or about September30, and on or about January 31, of any year on forms provided by theAccounting Office of the District.

    H. Unit members wishing to participate in the NYSUT Benefit Trust shallbe entitled to payroll deduction for such purpose provided the unitmember executes a save harmless agreement on a form provided bythe District for such purpose. The District shall transmit such monthlydeductions promptly.Unit members shall be entitled to payroll deductions for VOTE COPE.

    J. It is agreed by and between the parties that any provis ion of thisagreement requiring legislative action to permit its implementation byamendment of law or by providing the addit ional funds therefore shall

    53not become effective until the appropriate legislative body has givenapproval.

    K. The parties agree that al l negotiable items have been discussed duringthe negotiations leading to this agreement and, therefore, agree thatthe negotiations will not be reopened on any item whether contained inthis agreement or not during the term of this agreement.

    L. The District shall join with the Association to make application toestablish or join a Teacher Center, under guidelines established by theNew York State Education Department. The terms and conditionsunder which the Teacher Center will operate, and the degree to whichDistrict staff will participate in said operation, shall be subject toagreement between the parties.

    This Agreement shall be effective as of July 1, 2005 and shall continue infull force and effect until June 30, 2009.
