WHEREAS it is enacted by Section 19 of "The HealthAct, 1911-19;" that the Governor may alter the boun-daries of any Health District constituted by the Gov-ernor under the said Act: And whereas it is desiredto alter the boundaries of the Maylands Health Districtwhich was so constituted: Now, therefore, His Excel-lency the Governor of Western Australia, by and withthe advice of the Executive Council, does hereby alterthe boundaries of the said Health District in mannerfollowing, that is so say:

Pearling Act, 1912-1924.ORDER IN COUNCIL.

1550/25.WHEREAS by Subsection 5 of Section 33 of "ThePearling Act, 1912-1924," it is provided that when theremuneration to which a diver or other pearl-fisher em-ployed in pearling in connection with any ship con-sists wholly or in part of an allowance or lay calculatedwith reference to the quantity of pearl-shell or pearlsfished by him or with his assistance, then the right tosuch allowance or lay shall be deemed to be a right toshare in the results or proceeds of pearling within themeaning of the said section, unless the allowance orlay is calculated on such basis as shall be prescribedand at a percentage not exceeding the prescribed per-centage: And whereas it is desirable to prescribe thebasis and maximum percentage on or at which such al-lowances or lay as aforesaid shall be calculated withreference to the pearls fished or found: And whereaspower is given to the Governor by the said Act to makeregulations with regard to various matters: Now, there-fore, His Excellency the Governor, acting with theadvice and consent of the Executive Council, doth here-by in exercise of all powers him in this behalf en-abling, make the following regulations, that is to say:

1. Such allowances or lays as are referred to in Sec-tion 33 of "The Pearling Aet, 1912-1924," shall be cal-culated with reference to pearls fished or found on thebasis of the actual values of such pearls at a maximumpercentage of ten per centaur on such values and thatwhen such allowance or lay as aforesaid is paid to morethan one pearl-fisher on any pearling ship the aggregateof such allowances or lays shall not exceed the amountwhich would be payable to one person in accordancewith the foregoing provision.

2. After the termination of the engagement of apearl-fisher, the owner of the pearling ship on whichsuch pearl-fisher was engaged shall at or before thetime of the discharge of the pearl-fisher, produce andshow, or cause to be produced and shown to the Super-intendent, any wages accounts in the possession, cus-tody, or power of himself or any agent of his, relatingto or connected with the employment of the pearl-fisherduring the said engagement. Any contravention byact or omission of the provisions of this regulationshall be an offence punishable on summary convictionby a penalty not exceeding £20.

CHOWERUP CEMETERY.By-laws.

HIS Excellency the Governor in Executive Council hasbeen pleased to approve of the following By-laws underSection 14 of "The Cemeteries Aet, 1897" (61 Vict.,No. 23), for the management of the Chowerup Cemetery(Reserve 18904).

By virtue of the powers vested in them the Board ofTrustees make the following By-laws and Regulations:-

1. All fees and charges payable to the Trustees, agset forth in Schedule "A,"'are to be paid at the timewhen the applications are made or orders given.

2. Any person desiring ground in the Cemetery forany grave, private grave, vault, or tombstone, monu-ment or enclosure, or for any other purpose, shall makeapplication therefor on prescribed form. Upon suchapplication being approved of the Trustees shall causeto be issued to such person so applying a Certificate ofRight of Burial in the form specified in the Act (secSchedule "B").

3. All applications for interment shall he made atthe office of the Trustees in time to allow of at least five(5) working hours, notice being given to the Secretaryat the Cemetery prior to the time fixed for burial, other-wise an extra charge shall be made. No free intermentshall he allowed unless the application and order there-for be handed in at the office in time to allow of at leastsix (6) working hours' notice being given as above.

4. The name, age, late place of residence, probablecause of death of deceased, and any other particularsmentioned in Schedule "D," shall be furnished at thetime of giving the order.

5. The Trustees shall cause all ordinary graves to bedug, but any person requiring a brick grave or vaultshall be permitted to construct the same under the super-vision of the Secretary, after submitting a plan of sameand obtaining a written approval of the Trustees there-to, and on payment of the necessary fees; and everycoffin placed therein shall be bricked in, cemented, andcovered by a slab of stone, slate, or iron, unless specialexemption be obtained from the Trustees in writing.

6. Every coffin shall have upon the lid an approvedmetal plate, bearing the name of the deceased stampedor otherwise indelibly inscribed, in legible charactersthereon.

7. .Every grave shall be at least 7ft. deep, and nointerment shall be allowed in any grave with less depththan 3ft. from the top of coffin to the original surfaceof the surrounding ground after such interment.

S. No interment shall be allowed in any privategrave or vault without the production of the Certificateof Right of Burial, as in Schedule "B," or other satis-factory evidence that the person desiring to bury thereinis entitled to do so, except in such cases as are providedfor in the following By-law.

9. In the case of an application for interment in anyprivate grave or vault to which the deceased had noclaim during life, the written consent of the owner shallbe handed in with the application.

10. No burial shall be allowed to take place in theCemetery without a certificate from the District Regis-trar of Deaths that the death has been registered, or aCoroner's order for burial. Such certificate or ordershall at the latest be handed to the Secretary upon thefuneral entering the Cemetery.

11. The hours fixed for burials shall be as follows:-Week days, from 8 a.m. to 5 p.m.; Sundays, 2 p.m. to5 p.m.

12. No burial shall be allowed to take place at anyother hour, except by written permission of the Trustees.

13. The time fixed for any burial shall be the timeat which the funeral is to arrive at the Cemetery.

14. At funerals no vehicles other than hearses shallbe allowed to enter the Cemetery gates.

15. All hearses shall proceed by such roads asdirected, and the drivers shall at all times observe suchdirections as may be issued to the Secretary by the Trus-tees from time to time for the regulation of the traffic.

16. No headstones, footstone, kerbing, monument orany other erection of any kind shall be permitted, norshall any inscription be allowed until the plans and par-ticulars of the same have been approved by the Trus-tees.

17. Every erection shall be placed on proper andsubstantial foundations, and if required by the Trusteesor their officers, such foundations shall extend to thebottom of the grave.

LS. The materials used in every erection shall be sub-ject to the approval of the Secretary or other officer ap-pointed by the Trustees, and any material rejected shallbe immediately removed from the Cemetery by the con-tractor or person responsible for the erection.

19. All material, refuse, and other rubbish remainingafter any work is completed shall be immediately re-moved from the Cemetery by the person responsibletherefor.

20. In the event of the refuse, rubbish, or materialreferred to in previous By-law not being so removed, theTrustees shall have power to cause the same to be 1T-moved, and to recover the costs of such removal from theperson or persons responsible therefor.

21. All materials required in the erection and com-pletion of any stone or other work shall, as far as pos-sible, be prepared before being taken to the Cemetery,and all materials required by tradesmen shall be ad-mitted at such entrance to the Cemetery and conveyedalong such roads or tracks as the Secretary shall direct,and no vehicle conveying any such material with wheelsless than 4in. broad shall be permitted to enter theCemetery.

22. The Trustees will not (unless in very excep-tional eases) permit the removal of any corpse fromany grave for re-interment in this or any other Ceme-tery.

23. Before any such exceptional case, as referredto in the last By-law, be dealt with by the Trustees,a written application., setting forth the reason for theproposed removal, and verified by a statutory declara-tion, shall be produced by the nearest available repre-sentative of the deceased, and in the event of suchapplication being granted, the permission of the ChiefSecretary, in addition to time permission of the Trustees,shall be obtained. If in the opinion of the Trusteesit is necessary, time coffin shall be enclosed in a secondand air-tight coffin prior to removal.

24. No wooden fences, railings, crosses, etc., shall beallowed.

25. The shape and height of all graves, etc., shall besubject to the approval and supervision of the Secretary.

26. No trees or shrubs shall be planted in any en-closure, except such as are approved by the Secretary.

27. All workmen, whether employed by the Trusteesor by any other person, shall at all times, whilst withinthe boundaries of the Cemetery, be subject to the super-vision of the Secretary, and shall obey such directionsas that officer may find necessary to give, and any work-man eommitting any breach of these Regulations andFly-laws, or refusing or neglecting to comply with anydirections of the said Secretary, shall be removed fromthe Cemetery.

28. Any person taking part in dressing or attendingto any grave shall comply with the following rules:-

(a) No rubbish, soil, sand, or any other materials re-moved in dressing a grave shall be placed onany other graves, and if placed on any otheradjoining ground shall be removed immediatelythe work is completed.

(b) No sand, soil, or loam shall he taken from anyportion of the Cemetery for the purpose ofdressing graves, except with the permission ofthe Secretary.

The dressing of all graves, and the wheeling andcarting of any material shall he subject to thesupervision of the Secretary.

(d) Work in all classes to be carried on with due des-patch, and only during regulation hours.

29. Children under the age of ten years shall not beadmitted to the Cemetery unless in charge of some re-sponsilde person.

30. No dogs shall be admitted into the Cemeteryand any found there shalt be liable to be destroyed.

31. Any person violating the rules of propriety anddeeortun, or committing any nuisance or trespass, or in-juring any trees, shrub, flower, border, or any ereetion;or in any way infringing "The Cemeteries Act, 1897,"or any rule, regulation, or by-law made for protectingthe Cemetery, shall be prosecuted as the law directs.

32. No person shall promote or advertise, or carry onwithin the Cemetery or its approaches, any trade, busi-ness, or calling, either by solieitaton, distribulon ofcirculars or cards, or otherwise, or by any other sysleinof advertisement whatsoever.

33. No person employed by or under the Trusteesshall be permitted to accept any gratuity Whateverwhilst in discharge of his duty, nor shall lie be pecuni-arily interested in any work in the Cemetery other thanthat for which he receives payment front the Trustees,any any person so employed accepting any gratuity, orbeing pecuniarily interested in any such work shall beliable to summary. dismissal.

34. Licenses for grave dressing or decorating may beissued by the Trustees in the form set out in Schedule"E"; such licenses to be renewed annually.

35. Subject to the directions of the Trustees, theSecretary shall exercise a general supervision and con-trol over all matters pertaining to the Cemetery.

1. No person shall place any water-trough, feed-bin,crate, wooden case, box, or other article, object or thingupon any road or public place so as to cause an obstruc-tion of such road or public place.

Any person committing a breach of this By-law shallbe liable, on conviction, to a penalty not exceedingTwenty pounds.

2. Any person who may have obstructed any road orpublic place by placing thereon any water-trough, feed-bin, crate, wooden case, box, or other article or thingshall remove such obstruction within fourteen days afterthe service on him by order of the Board of a noticein writing, signed by the secretary or otherofficer of theBoard, requiring such person to remove the obstruction.

Any person committing a breach of this By-law shallbe liable, on conviction, to a penalty not exceedingTwenty pounds.

3. Nothing in the foregoing By-laws shall affect theliability under Section 329 of "The Road Districts Act,1919," of any person to the penalty thereby prescribedfor the wilful obstruction of any road or way, or theright of the Board to recover the cost incurred by theBoard in removing the obstruction.

1118 Excellency the Governor in Executive Council hasapproved of the following amendments to the Regula-tions of the Education Department:Add to Regulation 25:

A teacher who completes the thesis requirements forthe "A" Certificate will, if the conditions relating toservice and efficiency have been fulfilled, receive his newclassification on that one of the following dates whichoccurs next after the writing of his final thesislstFebruary, 1st May, 1st August, 1st November.Delete the last 'four paragraphs of Regulation 22 and

the whole of Regulations 27, 28, 29, and 30, andsubstitute:

27. (1) A bead teacher with the "C" Classificationwill not be regarded as eligible for the headship of aschool higher than Class VI.

(2) A head teacher with the "132" Classification willnot be regarded as eligible for a school above Class V.,nor a teacher with a "B1" Classification for a schoolabove, Class Dr.

(3) A head teacher with the "A3" Classification willnot be regarded as eligible for a school above Class III.,nor a teacher with the "A2" Classification for a schoolabove Class II.

(4) Assistant teachers with the "A2" Certificate willnot be regarded as eligible for the headship of a schoolabove Glass IV; those with the "A3" Certificate willnot be eligible for a school higher than Class V.; orthose with the "B" Certificate for a school higher thanClass VI.

(5) Head teachers will be eligible only for the pro-motion list to the next class of school above that inwhich they are placed.

28. Relative claims for promotion to vacant positionsshall be determined by the Board of Classifiers. Apromotion list shall be formed for the headmastershipof each class of school above Class VII. The hoard willtake into consideration in each case the record of theteacher, the teacher's literary or scientific qualifications,and the length and nature of the teacher's service. Suchpromotion lists shall be compiled in each year before31st July, or at such other times as is appointed by theMinister, and shall govern the promotions until the com-pletion of the next mutual list.

29. (1) The Board of Classifiers shall consist of theChief Inspector, a Senior inspector nominated by theItinisier, and a lien I Teacher who is a member of theTeachers' Union, elected by the teachers in the follow-ing manner :

(2) Every head teacher and assistant on the per-manent staff of the :Department, and every head orassistant teacher on supply who tuts been toiainuouslyemployed as a teacher for not less than twelve monthsimmediately preceding the month in which the electionis held shall be entitled to vote. Notice shall be givenin the Cirottar, and votes must be received at the De-partment before Lite end of the month following thatiii winch the airequar is issued.

(3) No head teacher is eligible for election unless heor site holds the "Al" classification nail is drawing asalary equal to that Ivivified for such a teacher in,Class IA school. The elected Inciter shall hold hisposition for two years, and shall be eligible for re-election. A returning officer shall be appointed by agree-ment between the Department, awl the Teachers' [Jut toil

to conduct the election.(4) The board shall meet from time to time to con-

sider matters affecting the promotion and classificationof teachers, and to consider any appeal from teachersagainst their classilieathm or position on the promotionlist. No appeals against Inspeetor's report will liereferred to the Board.

(5) A teacher who wishes to appeal against a decisionof the Board of Classifiers may appeal to the Minister.His appeal must be made in writing; setting out fullytlm grounds upon which he Maims that an alterationshould be made. The NI inihter will eat' for a statementill writing from the Board of Classifiers showing thegrounds on which their decision was based. (6) Efficiency as a teacher shall be determined by thenature of the inspector's report, as indicated in theteacher's reeord. ,ln these reports Inspectors shall esti-nmte the teaoher's worth under various headings byusing any of the terms: Exeellent; Very good; Good;Very fair; Pais.; and Weak. Such an estimate' will bemade, so far as possible, for every teacher every year.

(7) The Board shall award efficiency marks, the pos-sible maximum being 90.
