AT a meeting of the Executive Council held in theExecutive Council Chambers at Perth the 23rd day ofMarch, 1983, the following Order in Council was auth-orised to be issued:-

Child Welfare Act 1947-1982 .ORDER IN COUNCIL.

WHEREAS by section 19 (2) (a) of the Child WelfareAct 1947-1982, it is provided that the Governor mayappoint such persons, male or female, as he may thinkfit, to be members of any particular Children's Courtand may determine the respective seniorities of suchmembers: Now, therefore, His Excellency the Governorby and with the advice and consent of the ExecutiveCouncil doth hereby appoint John McGregor Thom asa Member of the Children's Court at Geraldton .

(2) The Minister for Lands and Surveys reservesthe right to refuse any application on thegrounds that the proposed development and ordevelopment programme is inadequate or un-suitable or that the applicant has failed toshow adequate capacity to fund his develop-ment programme .

(3) On payment of the first instalment of purchasemoney a licence will be available upon whicha mortgage can be registered . A Crown Grant(freehold) will not issue until the purchaserhas complied with the building requirementsas defined .

(4) Prior to commencement of construcion theMinister shall advise the purchaser of theextent of development that will be necessaryto enable the issue of a Crown Grant (free-hold) .

(5) The purchaser shall, within six (6) monthsnext following the date of approval of thesale of the land, commence to erect or con-struct or cause the erection or constructionto be commenced and will thereafter diligentlyproceed with an complete or cause to be com-pleted, within the two (2) years next follow-ing the date of approval of the sale, theerection or construction on the said land ofpremises designated and constructed for thespecific business of the purchaser . If thiscondition has not been complied with in thetime prescribed the land may be absolutelyforfeited together with all the purchase moneyand fees that may have been paid .

(6) It shall be the responsibility of the developerto ensure his power requirements, by contactwith the State Energy Commission as to:-

(i) Any power requirements beyond thespecific hectarage rate, and

(ii) the provisions of siting of substationswhich may be required to meet power ,requirements .

(7) Subject to agreement between the purchaserand the Minister the foregoing developmentobligations and other conditions set out hereinmay be varied or added to from time totime.

(8) A deposit of 10% of the purchase priceis payable on application and the balance ofpurchase money shall be paid within twelve(12) months of the date of approval of ap-plication by four (4) quarterly instalmentson the first days of January, April, July andOctober. The first instalment of purchasemoney shall become due and payable on thefirst day of the quarter next following thedate of approval of application, the CrownGrant fee being payable with the last instal-ment of purchase money. Nothing shall pre-vent the balance of purchase money and feesbeing paid at an earlier date should the pur-chaser so desire but a Crown Grant shall notissue until the conditions under which the lotwas made available for sale have been ful-filled .

A person in the employ of the State must applythrough the Under Secretary for Lands for the Gov-ernor's permission to hold this land . Written approvalof the Permanent Head concerned should accompanysuch application .

APPLICATION FOR LEASING .Department of Lands and Surveys,

APPLICATIONS are invited under section 32 of theLand Act 1933, for the leasing of Reserve 2564 in theNgalbain District containing an area of 1035.995 2hectares for the purpose of "Grazing" for a term of10 years at a rental of $25 .00 per annum .

The land is made available for leasing subject to thefollowing conditions :-

(1) The land shall not be used for any purposeother than "Grazing" without the priorapproval in writing of the Minister for Landsand Surveys .

(2) The rent shall be subject to reappraisement atthe end of the third year of the term of thelease and each successive three yearly periodthereafter .

(3) The lessee shall not without the previousconsent in writing of the Minister assign,transfer, mortgage sublet or part with thepossession of the demised land .

(4) The public generally shall have access at alltimes to any natural water supply situatedon the demised land .

(5) The lessee shall not cut, destroy or otherwiseinterfere with any timber or scrub standingon the demised land .

(6) The lessee shall indemnify the Minister againstall claims for damage to property or personsarising from the use of the land .

(7) The Minister or his representative may enterthe land for inspection at any reasonable time.

(8) Compensation shall not be payable to the lesseein respect of any improvements effected by himon the demised land and remaining thereonat the expiration or earlier determination ofthe lease .

(9) It shall be lawful for the lessee at any timewithin the three calendar months immediatelyfollowing the expiration of the term or earlierdetermination of the lease, to take down,remove, and carry away any buildings,structures, improvements and plant the propertyof the lessee .

(10) On determination of the lease, the lessee shallfill in, consolidate and level off any unevenness,excavation or hole caused by him during theterm of the lease or by removal of his improve-ments and shall leave the demised land in aclean, neat and tidy condition to the satisfactionof the Minister and shall remove any or allwaste matter as required by the Minister .

(11) Power is reserved to the Minister to directthat the number of stock depasturing on thedemised land shall be reduced if the Ministeris of the opinion that the demised land isoverstocked to an extent sufficient or likely tocause permanent damage to the land ; failure tocomply with any such direction will result inthe forfeiture of the lease .

A person in the employ of the State must applythrough the Under Secretary for Lands for theGovernor's permission to hold this land . Writtenapproval of the Permanent Head concerned shouldaccompany such application .

PART 1 PRELIMINARY .

1 .1 This Town Planning Scheme may be cited as theShire of East Pilbara Town Planing Scheme No . 1(Newman Townsite) hereinafater called "The Scheme"and shall come into operation on the publication ofnotice of the Minister's final approval thereof in theGovernment Gazette .

1 .2 The Scheme shall apply to the whole of the landset out as Scheme Area in the map forming part of theScheme.

1 .3 The responsible authority for carrying out theScheme is the Council of the Shire of East Pilbara here-inafter referred to as "the Council" .

1 .4 Arrangement of Scheme : The Scheme Text isdivided into the following parts:-

PART I Preliminary .PART II Reserved Land .PART III Zones .PART IV Policies and General Pro sions relating

to Zones .PART V Non Conforming Uses of Land .PART VI Finance and Administration .

The remaining documents of the Scheme are asfollows:-

1 . Land Use Maps .

2 . Scheme Maps .

PART II Reserved Land .Reservation of Land and Development Thereof .2.1 (a) Land set aside under this Scheme for the

purposes of a reservation is deemed to be reservedfor the purposes indicated on the Scheme Map .

(b) Except as otherwise provided in this Part aperson shall not carry out any development on landreserved under this Scheme, other than the erectionof a boundary fence, without first applying for andobtaining the written approval of the Council .

(c) In giving its approval the Council shall haveregard to the ultimate purpose intended for the reserveand shall in the case of land reserved for the purposesof a public authority confer with that authority beforegiving its approval .

(d) No provision of this Part shall prevent thecontinued use of land for the use for which it wasbeing lawfully used immediately prior to the Schemehaving the force of law, or the repair and maintenance,for which the prior consent in writing of the Councilhas been obtained, of buildings or works lawfullyexisting on the land.

2 .2 (a) Where a Council refuses approval for thedevelopment of land reserved under the Scheme on theground that the land is reserved for public purposes,or grants approval subject to conditions that areunacceptable to the applicant the owner of the landmay, if the land is injuriously affected thereby, claimcompensation for such injurious affection .

(b) Claims for such compensation shall be lodged atthe office of the Council not later than six monthsafter the date of the decision of the Council refusingapproval or granting it subject to conditions that areunacceptable to the applicant.

(c) In lieu of paying compensation the Council maypurchase the land affected by such decision of theCouncil at a price not exceeding the value of theland at the time of refusal of approval or of thegrant of approval subject to conditions that areunacceptable to the applicant .

PART III Zones .3 .1 The Scheme Area is divided into eleven zones as

set out hereunder:-Residential A.Residential B .Town Centre .Other Commercial.Industrial .Hotel/Motel .Service Station .Private Clubs and Institutions .Place of Public Assembly .Special Sites .Rural.

3 .2 Table No. 1 appended to Clause 3 .3 of thisPart indicates the several uses permitted by this Schemein the various zones, such uses being determined bycross reference between the list of "Use Classes" onthe lefthand side of the Table and the list of "Zones"on top of that Table .

3 .3 The symbols used in the cross reference inTable No. 1 appended to this clause have the followingmeanings:-

"P"-A use that is permitted under this Scheme .

"AA"-A use that is not permitted unless approvalis granted by the Council .

"IP"-A use that is not permitted unless such useis incidental to the predominant use as decidedand approved by the Council .

"X"-A use that is not permitted .

3 .4 Development and its Approval .

3 .4.1 Except as hereinafter provided, no development,including a material change in use, shall be carriedout on any land or in any building within the SchemeArea, without the prior written consent of the Council .Such consent is hereinafter referred to as a "planningapproval" and is required in addition to a buildinglicence .

3 .4.2 Application for Planning Approval shall be inwriting addressed to the Shire Clerk and shall beaccompanied by such plans or explanatory documentsas may be necessary to enable Council to gain acomplete understanding of the proposal and its effecton the locality .

3 .4.3 The Council, when considering granting itsapproval to a use marked AA in Table 1, will takeinto consideration the effect which such use will haveon the amenity of the area likely to be affected by theuse, the effect on the road system of the locality andany other matters which it may consider relevant tothe establishment of the use, and may-

(a) grant approval ;(b) grant approval subject to such conditions and

requirements as it deems fit ; or(c) refuse to grant approval, giving its reasons .

Without limiting the generality of the foregoing theCouncil may, where it deems appropriate, limit theperiod of validity of any approval granted and may grantapprovals for development for limited periods of time .

3 .4 .4 The Council shall convey its decision on anysuch application for planning approval to the applicantwithin 60 days of the date upon which it was firstreceived at the Council offices, unless the Council shallhave first obtained the applicant's approval in writingfor an extension of that period . In the event that adecision has not been made within that period orextended period the application shall be deemed to havebeen refused .

3 .4.5 The following classes of development may beundertaken without the approval of the Council andare referred to as permitted development :-

(a) Development by public authorities and localauthorities for the purpose of their undertakingof functions on land owned by them at the timeof the coming into operation of this scheme .

(b) The maintenance and repair of any buildingprovided that no works of a structural natureare being undertaken and no material changein the external appearance of the building isinvolved .

(c) Subject to the provisions of this scheme,changes in the uses of land and buildingswhich do not give rise to :-

(i) a material change in the appearanceof the property concerned ;

(ii) the need, according to the provisions ofthis Scheme and/or as may bedetermined by the Council by experienceof similar uses elsewhere, for additionalcar parking accommodation, loadingand unloading accommodation, land-scaping or other special site treatments ;

(iii) significant increases in the amount oftraffic attracted to the site ;

(iv) the need for the provision of signific-antly improved public services . andutilities of any kind .

PART IV Policies and General Provisions Relating toZones .

4 .1 Council's primary objective will be to ensurethat development within the town occurs in accordancewith social and economic needs and is consistent withretention and enhancement of the town's amenity for thebenefit of residents .

4 .1 .1 Notwithstanding that a proposed developmentconforms in all other respects with the requirements ofthe Scheme, Council may at its discretion refuse togrant approval if in its opinion such developmentwould, by its siting, design or construction, result in asignificant deterioration of the amenity of landscapequality of the town .

4.2 Residential Development : Residential PlanningCodes .

4 .2 .1 For the purpose of this Scheme "ResidentialPlanning Codes" means: The Residential Planning Codesadopted as a policy by the Board on 26 July 1982together with all amendments or additions thereto orany Code, By-laws or Regulations replacing them andapplying or being applicable within the District .

4 .2.2 A copy of the Residential Planning Codesshall be kept and made available for public inspectionat the offices of the Council .

4 .2 .3 In the event of there being any inconsistencybetween the Residential Planning Codes identified byClauses 1 .1 and 1 .2 the provisions in the documentidentified in Clause 1 .1 shall prevail.

4 .2 .4 Unless otherwise provided for in the Schemethe development of land for any of the residentialpurposes dealt with by the Residential Planning Codesshall conform to the provisions of those codes and theschedules to those codes .

4 .3 Variations to Residential Planning Codes :Notwithstanding the provisions of the R .12 .5 ResidentialPlanning Code, Council may permit the front setbackto be reduced to 6 metres .

4.4 Residential A Zone : Council's objective is toensure that the zoned areas provide for low densityresidential uses within an urban environment of thehighest possible standard, together with other uses andactivities compatible with the basic use .

Council policy will therefore be to-(a) retain and enhance the residential environment

of single and duplex houses .(b) permit certain non-residential uses as set out

in Table 1 provided that these are of suchnature, siting, and activity as to be compatiblewith the residential character of the zone ;

(c) permit, under annual registration, homeoccupations as defined in Part I of the Schemesubject to ensuring that such uses do notadversely affect the residential enjoyment ofproperties in the immediate vicinity .

4 .4 .1 Development for residential purposes withinthe zone shall conform to the provisions of the R.12 .5code .

4 .5 Residential B Zone: Council's objective is toallow for development of flats and other forms ofmedium density residential housing to densities andstandards appropriate to enhancement of the urbanenvironment and to satisfaction of the various housingneeds of the community .

Council policy will therefore be to-(a) adopt a residential density code permitting

housing up to and including multiple unithousing, with provision for open space, w2sereappropriate, so as to achieve an overall densityapproximating that existing in flat developmentin the town ;

(b) preclude home occupation from dwelling unitsother than detached or duplex houses exceptwhere home occupation does not entail directsale to the public from the premises or thestorage of goods for sale .

4 .5 .1 Development for residential purposes withinthe zone shall conform to the provisions of the R.50code except that in new development where other thandetached, attached, grouped houses, or multiple dwellingsnot greater than eight in number are proposed on a site,an area equivalent to one third of the total site shallbe set aside for open space in addition to any otherrequirement of the Code .

4 .6 Town Centre Zone : Council's objective is toensure that the zoned area develops as the principalcommercial, civic, and public activity area of Newmanto maximum possible standards of civic design andfunction .

Council policy will therefore be to-(a) prepare and amend from time to time an

overall strategy for the zone which takes intoaccount appropriate disposition of Town Centreuses, economic servicing and proper standardsof Civic design ;

(b) approve permitted uses provided these areproposed in accordance with the principles ofthe overall strategy.

4 .6 .1 Uses permitted by the Scheme will be subjectto conformity with a Town Centre Strategy adoptedby Council from time to time and with other provisionsof the Scheme .

4.7 Commercial Zone : Council's objective is topermit development of shopping and other commercialuses on lots not within the Town Centre so as toprovide for localised community shopping in associationwith residential precincts .

Council policy will therefore be to-(a) initiate procedures for re-zoning to Commercial

of land appropriately situated so as to providefor convenience shopping and other furtheruses within the residential precincts ;

(b) ensure that proposals for local convenienceshopping are limited to a retail floor space of300 square metres ;

(c) require applications for re-zoning to show thatthe site proposed is of adequate size andsuitable location so as to conform to the carparking provisions of the Scheme and to ensureproper accessibility and traffic safety .

4 .8 Industrial Zone: Council's objective is to ensureprovision for uses of an industrial nature, and toencourage re-location of such uses into the area fromresidential and commercial zones.

Council policy will therefore be to-(a) ensure development of a range of lot sizes in

stages

according to

requirements

andservicing considerations ;

(b) require reticulated water supply to be providedto each lot, and a satisfactory method of onsite disposal of effluent to be approved as acondition of building.

(c) exercise adequate controls over developmentsand use so as to ensure a satisfactory visualstandard prevails .

4 .8 .1 Within the zone the following shall apply :For industries uses-

Minimum Lot size-1500 square metres .Minimum Lot frontage-30 metres .

4 .8 .2 Between the frontage of a lot and the buildingline, land shall not be used for any purpose other than-

(a) vehicle parking ;(b) landscaping ;(c) with the approval of Council, Trade Display .

4 .9 Car Parking.4 .9 .1 Within the Scheme Area development of land

for any of the uses listed in Table 2 shall make provisionfor on site car parking spaces constructed to thesatisfaction of Council in accordance with the require-ments of that Table,

4 .9.2 Notwithstanding the provisions of Table 2Council may waive requirements for on site car parkingif it is satisfied that adequate constructed car parkinghas been provided in close proximity to the proposeddevelopment . Where constructed car parking is notavailable Council may accept a cash payment in lieuof provision of parking for application in terms ofClause 4 .9.3 below.

4 .9 .3 Any payment made in terms of Clause 4 .9 .2above shall-

(a) not be less than the estimated cost of providingand constructing the parking spaces requiredby the Scheme, plus the value, as estimated bythe Chief Valuer of the Department of StateTaxation, of the area of land which might havebeen occupied by the parking spaces ;

(b) be paid to Council under this clause, into aspecial fund to be applied solely to theprovision, construction and maintenance offurther car parking facilties in reasonableproximity to the premises from which themonies were derived .

4.10 Building Lines .

4 .10 .1 Within the Scheme Area Building lines shallbe in accordance with the provisions of Table 3 .

4 .11 Special Sites : A list of Special Sites andassociated land description is included at Appendix Bof this text. The list details the respective purposes forwhich those sites may be used or developed. The SpecialSites are also shown on the Scheme Maps .

PART V Non-conforming Use of Land .5 .1 No provision of this Scheme shall prevent-

(a) the continued use of any land or building fol'the purpose for which it was being lawfullyused at the time of the coming into force ofthe Scheme; or

(b) the carrying out of any development thereonfor which, immediately prior to that time, apermit or permits required under the TownPlanning and Development Act 1928 (asamended), and any other law authorising thedevelopment to be carried out had been dulyobtained and was current.

5 .2 (a) Where in respect of land reserved underPart II of the Scheme a non-conforming use exists orwas authorised as mentioned in Clause 5 .1 of this Parton that land all or any erections alterations or extensionsof. the buildings thereon or use thereof shall not becarried out unless the approval of the Council has beenobtained in writing .

(b) Where in respect of land zoned under Part IIIof the Scheme, a non-conforming use exists, or wasauthorised as mentioned in Clause 5 .1 of this Part,on that land, and provided the prior consent, in writing,of the Council has been obtained; buildings may beextended by 10% of the floor area of the buildingexisting at the time of gazettal of this Scheme, or bysuch greater percentage which Council considers willnot prejudice the objectives of the Scheme, and pro-vided that such extension is within the building linesprovided in this Scheme .

5 .3 Change of Non-conforming Use : The Councilmay permit the use of any land to be changed from onenon-conforming use to another non-conforming use,provided the proposed use is, in the opinion of theCouncil less detrimental to the amenity of the neigh-bourhood than the existing use, or is, in the opinionof the Council, closer to the intended uses of the zone .

5 .4 Discontinuance of Non-conforming Use .(a) Notwithstanding the preceding provisions of

this Part, except where a change of non-conforming use has been permitted by theCouncil under Clause 5 .3, when a non-conforming use of any land or buildings shallnot thereafter be used other than in conformitywith the provisions of the Scheme .

(b) The Councd may effect the discontinuance ofa non-conforming use by the purchase of theaffected property, or by the payment of com-pensation to the owner or the occupier or toboth the owner and the occupier of thatproperty, and may enter into an agreementwith the owner for that purpose .

PART VI Finance and Administration .6 .1 Disposal of Land: The Council may deal with

or dispose of any land which it owns or which it hasacquired pursuant to the provisions of the Scheme, inaccordance with the Act and in conformity with theprovisions of the Scheme, and for such purpose maymake such agreements with the owners as it deems, fit .

6 .2 Compensation : Claims for compensation byreason of the Scheme, other than for the purpose ofPart II, shall be made not later than six months fromthe date on which notice of approval of the Schemeis published in the Government Gazette, except in thecase of reserved land where the provisions of Part IIshall apply .

6 .3 Compliance with scheme .(a) A person shall not use land or any buildings or

structure thereon contrary to or otherwise thanin accordance with the provisions of theScheme .

(b) If pursuant to the provisions of the Schemeapproval has been granted subject to condi-tions, a person shall not commit a breach of,or neglect to carry out, any of those condi-tions . Failure to comply shall constitute acontravention of the Act and the Council maytake action in terms of section 10 of the Act .

(c) Twenty-eight (28) days notice in writing ishereby prescribed as the notice to be givenpursuant to section 10 of the Act where theconditions of this subclause are not compliedwith, and any expenses incurred by the Councilunder that section may be recovered from theperson in default as a single contract debtin such court of civil jurisdiction as is com-petent to deal with the amount of the claim .

6 .4 Entry to Premises: The Council may by anauthorised officer enter at all reasonable times anybuilding or land for the purpose of ascertaining whetherthe provisions of the Scheme are being observed.

6 .5 Penalties: Any person who fails to comply withany of the provisions of the Scheme is guilty of anoffence and without prejudice to any other remedygiven herein is liable to such penalties as are prescribedby the Act .

6 .6 Appeals: Any person who is aggrieved by anydecision of the Council, made or deemed to have beenmade in terms of this Scheme, shall have a right ofappeal, within 60 days, in terms of Part V of the Act .

Schedule A .Interpretation.

In this Scheme the terms will have the respectiveinterpretations set out hereunder :-"Additional Dwelling" means a dwelling attached to

and forming part of a dwelling unit andoccupied by a relative of the occupier of theprincipal dwelling unit as provided for byBy-law 53.5 of the Uniform Building By-laws1974 ;"Attached Dwelling" means a dwelling house,constructed as part of a group of two or more,each standing on its own separate lot andwhich may be attached to another house ;"Board" means the Town Planning Board constitutedunder the Act ;"Building" shall have the same meaning as isgiven to it in and for the purposes of theUniform Building By-laws ;

"Building Line" means the line between which andany public place or public reserve a buildingmay not be erected except by or under theauthority of an Act ;

"Car Park" means a site or building used primarilyfor parking private cars or taxis whether as apublic or private car park, but does not includeany part of a public road used for parking orfor a taxi rank, or any land or buildings onor in which cars are displayed for sale ;

"Car Sales Premises" means land and buildingsused for the display and sale of motor vehicles,whether new or second-hand, but does notinclude a workshop ;

"Caretaker's House" means a building used as aresidence by the proprietor or manager of anindustry carried on upon the same site orby a person having the care of the building orplant of the industry ;

"Caravan Park" means an area set aside for theparking of caravans in conformity with theCaravan and Camp Regulations, 1961, madepursuant to the provisions of the Health Act1911 (as amended), and the Local GovernmentModel By-law (Caravan Parks) No . 2 madepursuant to the powers conferred by the LocalGovernment Act 1960 (as amended), and anyamendments to those Regulations or to thatModel By-law ;

"Civic Building" means a building designed, usedor intended to be used by GovernmentDepartments, statutory bodies representing theCrown, or Councils as offices or foradministrative or other like purposes ;

"Consulting Rooms" means a building or part of abuilding (other than a hospital) used in thepractice of his profession by a legally qualifiedmedical practitioner or dentist, or by a physio-therapist, a masseur or a person ordinarilyassociated with a medical practitioner in theinvestigation or treatment of physical ormental injuries or ailments ;

"Defined Site" in relation to a "grouped dwelling"means that area of the land on which a groupof dwellings is to be erected which is allottedor set aside on the plans of the proposeddevelopment for the exclusive use of eachsuch dwelling unit ;

"Drive-In Theatre" means an open air cinema thatmakes provision for the audience or spectatorsto view the entertainment while seated in motorvehicles ;

"Dry Cleaning Premises" means land and buildingsused for the cleaning of garments and otherfabrics by chemical processes ;

"Dwelling Unit" or "Dwelling" means a separateself contained domicile ;

"Dwelling House" means a building used primarilyfor living purposes of one separate family unit,and includes rooms separate from such buildingbut ancillary thereto . The term also includes

"Educational Establishment" means a school, college,university, technical institute, academy or othereducational centre, or a lecture hall, but doesnot include a reformative institution orinstitutional home ;"Effective Frontage" means the distance along aline parallel to the street alignment at adistance from the lot frontage equivalent tothe building set back required by the schemeand measured between the intersection of theset back line and the two side boundaries ;"Existing Use" means the use of any land orbuilding for the purpose for which it waslawfully used immediately prior to the gazettaldate of the Scheme, in accordance withconditions set out in Part 5 Non-ConformingUse of Land.

"Extractive Industry" includes the extraction ofsand, gravel, clay, turf, soil, rock, stoneminerals or similar substance from the land,and also the manufacture of products fromthose materials when the manufacture iscarried out on the land from which any ofthose materials is extracted or on landadjacent thereto ;"Fish Shop" means a shop where the goods keptexposed or offered for sale include wet fishor fish fried on the premises for consumptionoff the premises ;"Flats" shall have the same meaning as is givento it in and for the purpose of the UniformBuilding By-laws and includes single unit flatsas described in By-law 1 .3 of the UniformBuilding By-laws ;"Floor Area" shall have the same meaning as isgiven to it in and for the purposes of theUniform Building By-laws ;"Frontage" shall have the same meaning as isgiven to it in and for the purposes of theUniform Building By-laws ;"Fuel Depot" means a depot for storage of bulksale of solid or liquid gaseous fuel, but doesnot include a service station ;"Funeral Parlour" means land and buildingsoccupied by undertakers where bodies arestored and prepared for burial or cremation ;"Gazettal Date" means the date on which notice ofthe approval of the Minister to a planningScheme is published in the GovernmentGazette ;"General Industry" means any industry other thana hazardous, light, noxious, rural, extractiveor service industry;"Grouped Dwelling" means a dwelling unit,constructed as one of a group of two or moreon one lot such that no dwelling is placedwholly or partly vertically above any other,and which may be attached to another dwell-ing.

Where there are special conditions of landscape ortopography the local authority may vary therequirement that no dwelling is placed whollyor partly above any other.

"Hazardous Industry" means an industry which byreason of the processes involved or the methodof manufacture, or the nature of the materialsused or produced, requires isolation from otherbuildings ;

"Health Centre" means a maternal or x-ray centre,a district clinic, a masseur's establishment, ora medical clinic ;

"Height" has the same meaning as is given to itin and for the purposes of the Uniform Build-ing By-laws ;

"Hospital" means any building or part of a build-ing, whether permanent or otherwise, in whichpersons are received and lodged for medicaltreatment or care ;

such outbuildings as are ancillary to thedwelling house but does not include a"residential building" or part of such abuilding ;

"Home Occupation" means a business carried onwith the permission of the responsible auth-ority within a house or the curtilage of ahouse that does not-

(a) employ in its operation persons otherthan those normally resident on thepremises;

(b) operate outside the time between thehours of 8 a .m. and 6 p.m . ;

(c) occupy an area of the premises greaterthan 20 sq. metres ;

(d) attract vehicular traffic which, in theopinion of Council, is in excess of thatappropriate to a residential street ;

(e) cause to be parked on the road carriage-way or verges any vehicle other than ona casual basis ;

(f) cause any nuisance, including noise orthe emission of dust or noxious fumes,which is, in the opinion of Councildetrimental to the residential amenity ofthe area ;

(g) require the provision of any essentialservice or services of a greater capacitythan normally required in the zonewithin which it is located ;

(h) require the outdoor storage of materialsor supplies .

"Hotel" means land and buildings the subject ofa Publican's General Licence, an Hotel Licenceor a Wayside-House Licence granted under theprovisions of the Licensing Act, 1911 (asamended), or of any Act in substitution forthe Act, but does not include a motel ;

"Industry" means the carrying out of any processfor and incidental to-

(a) the making, altering, repairing or orna-mentation, painting, finishing, cleaning,packing or canning or adapting for sale,or breaking up or demolition of anyarticle or part of any article ;

(b) the winning, processing, or treatmentof minerals ;

(c) the generation of electricity or theproduction of gas, and

(d) the manufacture of edible goods forhuman or animal consumption, being aprocess carried on in the course of tradeor business for gain, other than opera-tions connected with :

(i) the carrying out of agriculture;(ii) site work on buildings, work or

land; and(iii) in the case of the manufacture

of goods referred to in subpara-graph (d) above, the preparationon the premises of a shop offood for sale ;

and includes, when carried out on landupon which the process is carried outand in connection with that process,the storage of goods, any work of ad-ministration or accounting, the sale ofgoods resulting from the process andthe use of land for the amenity ofpersons engaged in the process ;

"Institutional Home" means a residential buildingfor the care and maintenance of children, theaged, or the infirm, and includes a benevolentinstitution; but does not include a hospitalor a mental institution ;

"Land" includes air stratum titles, messuages,tenements and hereditaments and any estatein the land, and houses, buildings, works andstructures, in or upon the land ;

"Light Industry" means an industry-(a) in which the processes carried on, the

machinery used, and the goods andcommodities carried to and from thepremises will not cause any injury toor prejudicially affect the amenity ofthe locality by reason of the emissionof noise, vibration, smell, fumes, smoke,vapour, steam, soot, ash, dust, wastewater, waste products, grit, oil or other-wise; and

(b) the establishment of which will not orthe conduct of which does not imposean undue load on any existing or pro-jected service for the supply or provi-sion of water, gas, electricity, seweragefacilities, or any other like service ;

"Lot" has the meaning given to it in and for thepurposes of the Act, and "allotment" has thesame meaning;

"Milk Depot" means a depot to which milk isdelivered for distribution to consumers but inwhich milk is not processed or pasteurised ;

"Motel" means a building, group of buildings orplace used or intended to be used to accom-modate patrons in a manner similar to a hotelor boarding house but in which special provi-sion is made for the accommodation of patronswith motor vehicles ;

"Motor Repair Station" means land and buildingsused for or in connection with mechanicalrepairs and overhauls, including tyre recapping,retreading, panel beating, spray painting andchassis reshaping :

"Multiple Dwelling" means a separate, self-contained dwelling within a building containingtwo or more such dwellings, but the term doesnot include any part of a grouped dwellingor attached house ;

"New Street Alignment". See "Street Alignment";"Non-Conforming Use" means the use of land

which, though lawful immediately prior tothe coming into operation of this Scheme isnot in conformity with the Scheme ;

"Noxious Industry" means an industry in whichthe processes involved constitute an offensivetrade within the meaning of the Health Act,1911 (as amended), but does not include fishshops or dry cleaning establishments ;

"Office" means the conduct of administration, thepractice of a profession, the carrying on ofagencies, banks, typist and secretarial servicesand services of a similar nature or, where notconducted on the site thereof, the administra-tion of or the accounting in connection with anindustry ;

"Open Air Display" means the use of land as a sitefor the display and/or sale of goods and equip-ment ;

"Open Space" means that area of a lot or definedsite which is not occupied by building, butshall include accessible roofs, drives, car park-ing areas, and private balconies ;

"Owner" in relation to any land includes the Crownand every person who, jointly or severally,whether at law or in equity-

(a) is entitled to the land for any estate infee simple in possession ; or

(b) is a person to whom the Crown haslawfully contracted to grant the feesimple of the land ; or

(c) is a lessee or licensee from the Crown ;Or

(d) is entitled to receive or is in receipt of,or if the lands were let to a tenant,would be entitled to receive, the rentsand profits thereof, whether as a bene-ficial owner, trustee, mortgagee in pos-session or otherwise ;

"Petrol Filling Station" means land and buildingsused for the supply of petroleum products andautomotive accessories ;

"Plot Ratio" has the same meaning as is given toit in and for the purposes of the UniformBuilding By-laws ;

"Private Hotel" means land and buildings usedfor residential purposes in respect of whichmay be granted an hotel licence under theprovisions of the Licensing Act, 1911 (asamended), or any Act in substitution for thatAct ;

"Private Recreation" means the use of land forparks, gardens, playgrounds, sports arenas orother grounds for recreation which are notnormally open to the public without charge ;

"Professional Offices" means any building used forthe purpose of his profession by an accountant,architect, artist, author, barrister, chiropodist,consular official, dentist, doctor, engineer,masseur, nurse, physiotherapist, quantity sur-veyor, solicitor, surveyor, teacher (other thana dancing teacher or a music teacher), or townplanner; and "professional person" has a cor-responding interpretation ;

"Public Amusement" means the use of land as atheatre, a cinema, a dance hall, a skating rink,swimming pool or gymnasium or for games ;

"Public Assembly-Place Of" means any specialplace of assembly including grounds for athle-tics, all sports grounds with spectator provision,racecourses, trotting tracks, stadia or show-grounds .

"Public Authority" means a Minister of the Crownacting in his official capacity, a State Govern-ment Department, State trading concern, Stateinstrumentality, State public utility and anyother person or body, whether corporate or not,who or which, under the authority of anyAct, administers or carries on for the benefitof the State, a social service or public utility ;

"Public Recreation" means the use of land for apublic park, public gardens, foreshore reserve,playground or grounds for recreation whichare normally open to the public withoutcharge ;

"Public Utility" means any works or undertakingconstructed or maintained by a public auth-ority or municipality as may be required toprovide water, sewerage, electricity, gas, drain-age, communications or other similar services ;

"Public Worship-Place Of" includes buildingsused primarily for the religious activities of achurch, but does not includes an institutionfor primary, secondary or higher education, ora residential training institution ;

"Radio and T.V . Installation" means land,buildings, devices or structures for the trans-mission or receiving of signals and/or picturesbut does not include domestic radio and tele-vision receivers ;

"Redevelopment" means revision or replacement ofan existing land use according to a controlledplan ;

"Reformative Institution" includes

a penalinstitution ;

"Residential Building" means a building, otherthan a dwelling house, designed for use forhuman habitation together with suchoutbuildings as are ordinarily used therewith,and the expression includes a hotel, an hoteldesigned primarily for residential purposesand a residential club ;

"Rural Industry" means an industry handling,treating, processing or packing primaryproducts grown, reared or produced in thelocality, and a workshop, servicing plant orequipment used for rural purposes in thelocality ;

"Rural Use" means the use of land for thepurposes of agriculture, farming or grazingincluding the growing of fruit or vines .

"Service Industry" means an industrial use in whichindustrial operations are conducted for theexpress purpose of rendering services directlyconcerned with the day to day needs of thelocal community and where the processescarried on, the machinery installed, the numberof persons employed and the amount ofvehicular traffic generated would not bedetrimental to the amenity of the areaconcerned by reasons of noise, vibration, smellor any other cause .

"Service Station" means land and buildings usedfor the supply of petroleum products andautomotive accessories and includes greasingtyre repairs and minor mechanical repairs ;

"Shop" means any building wherein goods arekept exposed or offered for sale by retail,and includes a cafe and a restaurant andreceiving depot ; but does not include a bank,fuel depot, a market, service station, petrolfilling station, milk depot, marine store, timberyard or land and buildings used for the saleof motor and other vehicles, or for anypurpose falling within the definition of industry ;

"Showrooms" means rooms in connection withwarehousing or offices, and intended for displayof goods of a bulky character ;

"Single Persons Quarters" means buildings usedfor the accommodation of single personsincluding such ancillary uses as laundryfacilities, toilet blocks, messing facilities, carparks and recreation ;

"Sports Ground" means any land used for anysport; but does not include land within thecurtilage of a dwelling, if not usedcommercially ;

"Street Alignment" means the boundary between theland comprising a street and the land thatabuts thereon, but where a new streetalignment is prescribed, means the new streetalignment so prescribed ;

"Tavern" means a tavern as defined in the LiquorAct No. 34 of 1970 ;

"Trade Displays" means the controlled andmoderate display of goods for advertisementas approved by Council ;

"Transport Depot" means land used for thegaraging of road motor vehicles used orintended to be used for carrying goods for hireor reward or for any consideration, or forthe transfer of goods from one such motorvehicle to another of such motor vehicles,and includes maintenance and repair ofvehicles ;

"Uniform Building By-laws" means the UniformBuilding By-laws, 1974, published in theGovernment Gazette on 19 December 1974,and amended from time to time thereafter bynotices published in the Government Gazette ;

"Warehouse" means any building or enclosed land,or part of a building or enclosed land, usedfor storage of goods and the carrying out ofcommercial transactions involving the sale ofsuch goods by wholesale ;

"Zone" means a portion of the Scheme area shownon the map by distinctive colouring, hatchingor edging for the purpose of indicating therestrictions imposed by the Planning Schemeon the erection and use of buildings or forthe use of land, but does not include landreserved .

1 . This order may be cited as the Prevention of Excessive Prices(Maximum Prices for Motor Fuel) Order 1983 .

2 . (1) In this order-"fixed" means fixed under section 12 of the Prevention of Excessive

Prices Act 1983 ;"metropolitan region" has the meaning given by section 6 of the

Metropolitan Region Town Planning Scheme Act 1959 ;"motor fuel" means super grade petrol-

(a) supplied for use in the State ; and(b) intended for use in propelling motor vehicles ;

"motor vehicles" has the meaning given in section 5 of the RoadTraffic Act 1974 ;

"Schedule" means Schedule to this order .(2) A reference in this order to an Act of the Commonwealth of

Australia is a reference to that Act, or to another Act of the Common-wealth of Australia in substitution for that Act, as amended from timeto time.

3 . The price specified-prices formotor fuel. (a) in the first column of Schedule 1 is hereby fixed as the maximum

bulk wholesale price at which motor fuel may be sold in themetropolitan region to resellers ;

(b) in the second column of Schedule 1 is hereby fixed as themaximum retail price at which motor fuel may be sold in themetropolitan region to persons who are not resellers ;

(c) in the first column of Schedule 2, increased by an amountequivalent to the amount (if any) that, at the time when therelevant sale is made, is the freight differential approved by thePetroleum Products Pricing Authority under the PetroleumProducts Pricing Act 1981 of the Commonwealth of Australiain respect of deliveries of motor fuel by the vendor to the place
