NOTICE OF PUBLIC HEARING ON A CONVEYANCE OF REAL PROPERTY

Notice is hereby given that the Board of Directors of the West Des Moines Community

School District will hold a public hearing on the 29th day of August, 2014, at 12:00 o’clock P.M. central time, in the Learning Resource Center located at 3550 Mills Civic Parkway, West Des Moines, Iowa, on the conveyance of real property, pursuant to Iowa Code Sections 279.8 and 297.22. The real property is locally known as Phenix School, located at 415 7th Street, West Des Moines, Iowa.

At the time and place set for the public hearing, interested individuals will be given the

opportunity to express their views, both orally and in writing, on the following:

Proposal to convey the property to the City of West Des Moines for $535,000 plus interest, payable over 5 years.

The proposal may be subject to conditions as may be stated either in the proposal, the Resolution of the Board of Directors of the West Des Moines Community School District, or documents entered into between the parties. A copy of the proposal may be reviewed at the office of Secretary of the Board of the

West Des Moines Community School District, Learning Resource Center, 3550 Mills Civic Parkway, West Des Moines, Iowa.

After the public hearing, the Board may make a final determination to accept or reject the proposal as submitted, or upon condition that certain terms be changed, or the Board may defer action on any or all of the proposals until a subsequent meeting.

Board Agenda V SBRC Application for FYE ’13 ELL Deficit

The District has historically operated its ELL program in a deficit. The School Budget Review Committee (SBRC) can grant Modified Supplemental Amount (formerly known as Modified Allowable Growth). The District’s ELL Defiict for FYE ’13 was $1,1,24,234. Modified Supplemental Amount will impact the District’s Unspent Balance and will impact the amount of budget reductions, if granted.

The Administration recommends the Board Approve the District’s SBRC application requesting $1,124,234 for Modified Supplemental Amount for its FYE ’13 ELL Deficit.

a. New Tech Visit – Charter Bus Agreement The district has arranged for school visits to Plymouth, Indiana September 24-26, 2014. We will be visiting four schools during this time and will be taking several teachers, administrators, community, and business leaders with us on the trip. In order to accommodate transportation needs for up to 30 individuals, we would like to charter a bus through CIT Signature Transportation. We will leave the Learning Resource Center at 4:00 p.m. on September 24th and will return to the Learning Resource Center the evening of September 26th. Total cost for round trip bus service is $3,680.00. This will be paid for using Title I. We recommend board approval.

TERMS AND CONDITIONS

TERMS & CONDITIONS: 1) Please email, fax, or mail a detailed itinerary including addresses of all locations to be visited 14 days prior to departure. 2) The chartering party is responsible for providing our chauffeur with a single, non-smoking motel room on overnight trips unless otherwise specified. 3) The chartering party is responsible for all tolls, parking, ferry, and entrance fees incurred on this trip. 4) Chauffeurs gratuity is not included in this price (suggested gratuity is 10% of the amount due). If we do not receive full payment and a final itinerary 14 days prior to your trip, we reserve the right to cancel your motorcoach.

AMENITIES: CIT Charters, Inc. luxury motorcoaches come equipped with: DVD player, PA system, restroom, reclining seats, armrests, footrests, individual light & air controls, and air conditioning. Failure of motorcoach amenity equipment, such as DVD player, WIFI, sound system, or public address system shall not be cause for refund.

RESPONSIBILITY: CIT Charters, Inc. shall not be liable for delay or non-performance resulting road failure, road or weather conditions, labor difficulties, or any other cause beyond their control.

DAMAGE & INDEMNITY: The chartering party will be liable for any damage to the bus or its contents that is caused by the passengers. Only CIT Charters, Inc chauffeurs will be allowed to open and close luggage doors. The chartering party agrees to protect, defend and indemnify CIT Charters, Inc. from and against any and all loss, costs, damage and expenses occasioned by, or arising out of any accident or other occurrence causing or inflicting injury or damage to any person or property, happening or done in, upon or about the motorcoach, or due directly or indirectly to the use of alcohol, by members of the chartering party. Your responsibility, as the groups leader while on the motorcoach, is to see that your group remains quiet, orderly and that they do not damage the vehicle/equipment; or, potentially harm themselves by sitting on arm rest, standing in seats or leaning backward over a seat. The motorcoach should be kept neat and clean by the chartering party. The chartering party will be held responsible for cleaning costs deemed by CIT Charters, Inc. in excess of routine cleaning. (IE: liquid spills, soiled or stained seats, vomiting and or trash left on the motorcoach)

CARRIER: CIT Charters, Inc. reserves the right to use leased or substitute equipment to fulfill this agreement.

FOOD & BEVERAGE: With the exception of sunflower seeds, food and non-alcoholic drinks are allowed on the motorcoach. Canned beer is the only alcoholic beverage that may be consumed on the motorcoach. However, special permission from CIT Charters, Inc. Management is necessary and we do require a $250.00 refundable damage and cleaning deposit.

TOBACCO: Use of cigarettes and chewing tobacco, is strictly prohibited while on any CIT Charters, Inc. motorcoach and is also a violation of Federal Regulations.

VIDEO: DVD players are available on all motorcoaches. Use of them is available at no extra charge. The chartering party must supply their own movies. Only our chauffeurs or group leader may operate the DVD player.

FUEL SURCHARGE: The total price of this charter is based on current market rate of diesel fuel. If the average cost of diesel fuel nationwide exceeds this amount by 5% or more, a fuel surcharge may be invoked. Please budget a fuel allowance into the cost of your trip.

SAFETY: The chartering party agrees to respect our professional chauffeurs decision regarding road conditions, equipment, and safety. Federal regulations allow chauffeurs to be on duty 15 hours per day, including a maximum of 10 hours driving. A chauffeur must then have 8 complete hours off duty before coming back on duty. The chartering party also understands that chauffeurs who drive through the hours of 1:00 AM and 6:00 AM have the discretion to take periodic rest breaks to counteract the increased risks of night time driving.

LOST ITEMS: CIT Charters, Inc. is not responsible for any items left on the motorcoach. If our chauffeur is away from the luxury motorcoach, it will be locked at all times.

CANCELLATION POLICY: A full refund will be made if notice is given 30 days from departure date. A penalty of $100.00 or 10% of the charter price (whichever is greater) will be charged between 29 and 3 days. Within 72 hours of departure, 50% of the total charter price will be assessed to the chartering party. Exclusions may apply if noted on contract.

ADVERSE WEATHER CONDITIONS: The above cancellation fees will be waived in the event of adverse weather conditions if the charter is rescheduled with CIT Charters. In the event the trip is cancelled after our chauffeur has left our terminal, the chartering party will be assessed the miles they have traveled at our current deadhead rate plus any other expenses incurred.

Use option 3 for charter service and then use option 2 to direct you to the Manager on Duty in case of an emergency.

CASH DISCOUNT: All prices quoted by CIT Charters, Inc. reflect the benefit of a CASH DISCOUNT. Failure to make cash or check payment to CIT Charters, Inc. 14 days in advance of the trip date will result in revocation of the CASH DISCOUNT.
