    FOREWORD

    West Bengal Election Watch, which is an associate of National Election Watch, is a civil society initiative

    for dissiminating to the public information about those who offer themselves for election to thelegislature. The West Bengal Elections Watch is conducted by non political persons whose only concern

    has been to create awareness of the public about the relevant information which the candidates

    themselves furnish about themselves.

    West Bengal Election Watch conducted scrutiny of the affidavits of 1263 candidates who had contested

    the recently held General Election to the West Bengal Legislative Assembly and published the

    background information about them in several phases. The said background information about the

    candidates included whether criminal cases were pending against them, their educational qualifications,

    value of their assets, whether they were paying income tax, etc.

    The Election Commission of India ought to be congratulated for peacefully conducting the said General

    Election of 2011 in which the majority of voters could freely and without fear exercise their franchise.

    The same was possible largely because of deployment of large contingent of police and para military

    forces. One would hope that use of such security personnel would be required every time an election is

    held in future. In near future every voter ought to be able to freely cast his vote without the need for

    police protection.

    Matter of immediate concern is election of a fairly large number of members who have criminal

    background and of those who have increasing money power.

    Thus among 184 Trinomul Congress Legislators, criminal cases are pending against 69 (38%), 17 (41%) ofout of 42 Congrss members have criminal cases against them. There are criminal charges against nine

    ministers of the West Bengal Government. None out of 40 CPM members have criminal cases pending

    against them (18%).

    Forty seven members of the current Legislative Assembly are Crorepati, the richest among them is

    worth 12 crore. There are several other disturbing features about several members of the West Bengal

    Assembly which have come out from the particulars furnished by them.

    One is reminded about the speech deliverd by Dr. Rajendra Prasad who was the President of the

    Constituent Assembly, after the Constitution was finally adopted on 26thNovember 1949, when asked

    whether India would be able to keep its independence, Dr. Rajendra Prasad had expressed hope that the

    Country would produce men of strong character, men of vision who will not sacrifice the interest of the

    Country at large for the sake of smaller groups and who would rise above the prejudices of these

    differences. When the same question was put to Dr. B. R. Amedkar, he among other things had

    emphasized that while Constitution had provided for political equality but social and economic equality

    among all sections must be also achieved.

    The aim of this publication about the particulars of candidates in the last General Election is to bring

    about more transparency and to ensure greater public awareness about the profile of those whom they

    have elected as members of the West Bengal Assembly.

    West Bengal 2011 Assembly Elections

    West Bengal Assembly Elections, 2011 was held during the months of April-May, 2011. A total of

    1792candidates contested in the West Bengal State Assembly Elections and out of which, West Bengal

    Election Watch (WBEW) & Association for Democratic Reforms (ADR) have analyzed the data of 1306

    candidates. This report includes the analysis of criminal, financial, educational and other details of 1306

    candidates and 294 MLAs. Information provided by the Election Commission of India and details

    from the affidavits filed by the candidates have been used for the analysis.

    Representation of political parties

    In West Bengal 2006 Assembly Elections, 34 political parties contested, which increased to 56 in West

    Bengal 2011 Assembly Elections. This reflects an increase of 61% in the number of political parties

    contested the election from West Bengal 2006 Assembly Elections to West Bengal 2011 Assembly

    Elections.

    Growth in number of candidates

    Out of 1792 candidates contested in 2011 Assembly Elections, there were 1618 (90%) men and 174

    (10%) were women candidates. In 2006, out of 1654 candidates contested, 1515 were men (92%) while

    139 (8%) were women. Hence, the percentage of women candidates has increased by 2% from 2006

    Assembly Elections to 2011 Assembly Elections.

    Executive summary of MLAs and Candidates

    Summary of MLAs

    Affidavits of all 294 MLAs were analyzed by West Bengal Election Watch (WBEW).

    Out of 294 MLAs analyzed, 102 (35%) have pending criminal cases against them. Comparing this to

    West Bengal 2006 Assembly Elections, out of 283 MLAs analyzed, 45 (16%) had pending criminal

    cases against them.

    Out of these 102 (35%) MLAs with pending criminal cases, there are serious criminal cases pending

    against 75 MLAs (26%). Comparing this with West Bengal 2006 Assembly, there were 45 MLAs with

    pending criminal cases, out of which 30 MLAs (11%) had serious pending criminal cases againstthem.

    Out of 102 MLAs with pending criminal cases in West Bengal 2011 Assembly, 69 MLAs are from

    AITC, 17 from INC, 7 from CPI(M), 4 from AIFB, 3 from GJM , 1 from RSP and 1 is an Independent

    MLA .

    There were a total of 245 IPC charges of heinous nature against the MLAs. These include murder,

    attempt to murder, robbery, kidnapping, extortion, etc.

    The number of crorepati MLAs has increased from 7 (2%) in West Bengal 2006 Assembly Elections to

    47 (16%) in West Bengal 2011 Assembly Elections.

    Out of 47 crorepati MLAs in West Bengal 2011 Assembly, 37 are from AITC, 7 are from INC and 1

    each are from RSP, DSP (PC) and AIFB.

    Among major parties, the average asset per MLA for AITC is Rs. 85 lakhs, for INC it is Rs 62.85 lakhs,for AIFB it is Rs. 43.69 lakhs and for CPI (M) it is Rs. 16.93 lakhs.

    Average asset for a MLA from West Bengal is Rs 68 lakhs.

    Out of 294 MLAs analyzed, 49 had not declared their PAN details.

    A total of 97 MLAs (33%) out of 294 MLAs analyzed have declared that they have never filed Income

    Tax Returns.

    Out of the above 97 MLAs who have never filed ITR, 47 have not even given their PAN details.

    Out of 174 women candidates contested, only 34 won. Hence only 12% of MLAs in current West

    Bengal Assembly are women.

    More than 65% candidates (191 of 294 analyzed) are graduates & above.

    4 MLAs out of the 294 analyzed have declared their age to be less than 30 years while 13 MLAs have

    declared their age more than 71 years. 65 candidates out of the 1306 analyzed have declared their age to be less than 30 years while 30

    candidates have declared age more than 71 years.

    Summary of candidates

    West Bengal Election Watch (WBEW) has analyzed affidavits of 1306 candidates out of 1792

    candidates who contested in 2011 Assembly Elections.

    Out of these 1306 candidates analyzed, 275 candidates (21%) declared pending criminal cases

    against them. AITC had 82 out of 226 (36%) candidates with pending criminal cases, BJP had 58 out

    of 288 (20%), CPI (M) had 38 out of 213 (18%) and INC had 28 out of 66 (42%) candidates with

    pending criminal cases against them. Out of these 275 candidates with pending criminal cases, 178 (14%) out of the total candidates

    analyzed had pending serious criminal cases like murder, attempt to murder, kidnapping, robbery,

    extortion etc. against them.

    All major parties have given tickets to candidates with pending criminal cases, INC 42%, AITC

    36%, BJP20% and CPI (M)18%.

    There were a total of 13 red alert constituencies (i.e. where 3 or more contesting candidates had

    pending criminal cases). Jalangi, Baghmundi and Kalchini (ST)each had 4 candidates with pending

    criminal cases.

    A total of 73 candidates out of 1306 analyzed i.e. 6% were crorepati.

    A total of 10 candidates out of 1306 analyzed declared zero assets.

    A total of 29 candidates out of 1306 analyzed declared liabilities above 20 lakhs. Among major parties, the average asset per candidate for AITC was 75.36 lakhs, for INC was 48.39

    lakhs, for CPI (M) was 29.81 lakhs, for BJP was 20.99 lakhs and for BSP was 8.43 lakhs.

    31% of candidates (405 of 1306 analyzed) had not furnished their PAN card details.

    A total of 671 candidates (51%) out of 1306 candidates analyzed have declared that they have never

    filed Income Tax returns (ITR).

    Out of the above 671 candidates analyzed who have never filed ITR, 400 have not even given their

    PAN details.

    More than 52% candidates (679 of 1306 analyzed) were graduates & above.

    Number of women candidates was just 174 (10%) as compared to 1618 (90%) of men.

    WBEW has analyzed affidavits of all 294 MLAs. 102 MLAs out of these 294 MLAs from West Bengal

    Assembly, 2011 have pending criminal cases against them, and 75 MLAs out of 102 MLAs have serious

    criminal cases pending against them. Comparing this with West Bengal Assembly Elections 2006, 30

    MLAs had serious criminal cases pending against them.

    Out of total 102 MLAs with pending criminal cases, 69 MLAs are from AITC, 17 from INC and 7 from

    Serious crimes distribution for major parties-MLAs

    There are several cases of violent crimes like murder, attempt to murder, theft, extortion, robbery etc

    pending against MLAs in West Bengal 2011 Assembly Elections. The table below gives a summary of all

    serious violent offences related to murder, kidnapping, extortion, theft, robbery and dacoity. As can be

    seen from the table MLAs of AITC has 171 serious IPC counts against them, while MLAs from INC have 31

    and AIFBs MLAs have 19 serious IPC counts against them.

    Chances of winning based on assets

    As can be seen from the table below, higher the assets more are the chances of winning for a candidate.

    In the West Bengal 2011 Assembly Election, 86% of the candidates who declared assets more than 5

    crore and above won. On the other hand only 10% of candidates with assets less than 10 lakh won. The

    election results seemed to be highly influenced by the money power of candidates.

    17 MLAs of AITC are available from affidavits of 2006 Assembly Elections. These were matched with

    available affidavits of 2011 to reveal that the average asset increase for each re-elected MLA of AITC is

    Rs.29.77 Lakhs. The same procedure was followed for other parties and it was found that the available

    details for 15 re-elected MLAs from CPI(M) show an average asset increase of Rs. 13.37 Lakhs each.

    In percentage terms, the maximum asset increase is of Kallol Khan of AITC from Nakashipara

    constituency. His assets have grown by 6448%. He is followed by Dhiren Bagdi of CPI(M) from Sainthia

    (SC) constituency with a growth of 2771% in his assets and Asit Kumar Mal (INC) from Hansan with a

    growth of 2556% in his assets.
