Q1.What is Temporary Registration and its Purpose?

MV Act Sec 43.

No Specific purpose prescribed in the statute. Equivalent to a valid registration under chapter 4

(For Non Transport Vehicle)


Q2.During the Temporary Registration Period can the vehicle be used as a normally registered vehicle, If No.? What is the Restrictions in Usage of the Vehicle?

For Non Transport vehicles- No restriction

For Transport Vehicles usage as a transport vehicle is restricted without permanent regn

and fitness certificate subject to the conditions in sec 66(permit conditions)


Q3.Can a Temporary Registration be cancelled? If yes what is the mandatory requirements of

the sameSec 55(1-4-5)-Cancellation of registration

Permanent cancellation onlyIn case of total damage & permanent removal

from India or registration obtained by filing bogus documents

Fresh temporary Regn. mark not eligible in any condition


Q4.What is Permit and what are the different kinds of Permit and Its Classification. If the same expires, is

the vehicle permitted to be driven?

Conditions listed under Sec 66(3) (a to p)

Permitted to driven but not permitted

to serve the purpose


Q5.What is Fitness and if the same expires, is the vehicle permitted to be driven?

Sec 56Only for transport vehicles,

the regn. validity is the validity of fitness certificate

Q6.Vehicles are restricted to area of operations by specific permit area. To what extend is the violation of permit

Qualification for issue of a License

For Non transport vehicles-No Basic qualification prescribed

For Transport Vehicles-A pass in the 8th standard or above is

mandatory


Q8.In case of a LMV Driving License Holder with Validity to Drive Transport vehicle, if the

Validity of LMV-NTV expires and that of LMV-TV is valid, is he authorised to drive LMV-NTV?

Situation is imaginary under the present statute. This situation is arising due to clerical error or by the omission of the officer who renews the license.

Can be deemed valid since the holder is not responsible for this error


Q9.What is International License? What is its validity and can the same be renewed? If the International License Holders normal license has expired can he drive a vehicle under the International License in

India? CMVR-2(t) & 16(4)

(International Driving permit)This is issued by the Licensing authority of the region to an

Indian National and a valid Indian License holderTo be endorsed by the Licensing authority where the holder

deportsValidity - Maximum of 1 year or upto the expiry of the Indian

license, which ever is earlierNo renewal is allowed but reissue can be done


Q10.What are the condition for classifying a vehicle for Handicapped Person’s Usage and what are the exemptions granted for such

vehicles

Q11,Motor Vehicle Acts always speaks about Chassis Alteration and does not say anything about Chassis

Replacement. In an accident the chassis of the vehicle has been damaged and is beyond the scope of economical repairs.

What are the conditions specified by the Motor Vehicle Department for replacement of the chassis. If the New Chassis is coming with no Chassis No., which Chassis No. needs to be

punched on to it and if the New Chassis is coming with a Chassis No. should the same be erased or endorsed in the RC

Book.All the above are considered under chassis alteration

It is permitted after genuine enquiry with relevant documents only

In the case of chassis supplied with chassis number engraved by the manufacturer, the

same is endorsed in the RC with remarks

In the case of Chassis without number, allowed to engrave the existing old chassis number

and this will be endorsed in the RC with remarks


Q12,In case of Articulated Vehicles. The Tractor can be attached to any Trailer. Does the RC of Tractor specify the details of

Trailers to be used? Can the trailer attached to a tractor be used with any other Tractor?

Tractor Trailer combination is not an articulated vehiclei.e, every tractor and trailer should have separate

registration and connected recordsBut articulated vehicle is a combination of prime mover

and semi trailer(semi trailer itself is not a motor vehicle)

Additional semi trailers can be attached with prime mover and the technical specifications of each should

be endorsed in the RC and can be interchanged


Q13,A vehicle is used in a factory for internal purpose use inside the premises only. Is it mandatory for the vehicle to be Registered and Should the Driver

hold a Driving License?

Registration and License is mandatory

as in sec 2(34) r/w sec 3& 39 where public place is defined

Q14,Is the extract of Vehicle Details or Driving License Details from www.keralamvd.gov.in can be treated as a valid information for insurance

claim processing?

Not coming under the perview of M V Act and Rules

But may be decided by the authority as a policy matter

Q15,A Driving License is valid throughout India. What is the procedure of renewing it (as per MV act or Rules) from an

authority in another state?

Can be renewed any where after ascertaining the genuineness of the documents with the application for

change of address


Q16What is the criteria on which the type of Reg. Number Plate to be Display (Yellow with Black Writing / White with

Black Writing )

CMVR 50{2(d)}Form and manner is based on the category of

vehicles viz. Transport or Non Transport

Transport-Black colour on Yellow background

Non Transport-Black colour on white background(Size of the above is prescribed in CMVR 51)


Q17,What is the procedure to be followed in case of loss of Driving License or RC Book?

RC lost cases-CMVR-53Application followed by the procedure prescribed in

citizens charterMDL Lost cases-KMVR-29

Application followed by DLLD Form and documents prescribed in citizens charter


Q18,The Learner’s Licence Holders has time restriction for the learning process. What is the

permitted time of driving the vehicle for a learner’s driving license holder?

No time restriction in this statute(Other conditions as endorsed in form no 3)


Q19,Is a Non Transport Vehicle Registered in any other state, How long can the same be used in

another state ?

Sec 49 Change of address application should

be forwarded within 30 days to the concerned Registering authority

Q21,Earlier the www.keralamvd.gov.in website was providing an option to identify the vehicle using

Chassis. No or Engine No. This was very helpful for the insurance industry to identify the Registration No, of the vehicle. What is the alternative for the same? If there is no alternative, please provide a

solution for the same.This may be represented before the Govt

of Kerala for policy decision

• Q22,When ever an insurance premium check bounces the insurer informs the same to the owner of the vehicle, registering authority by registered letter. What action can the M V Dept can take up in case of such violations? If the insurer fails to intimate the check bounce what action can be taken by the M V Dept? It would be good if the insurer informs the check bounce and non validity of the insurance police to the local enforcement authority as well as the vehicle details of any vehicle when access through the M V Dept website should also display insurers details. (Suggestions…..)
