In the event of not exercising option within the stipulated three months' period, such employeeshall be deemedto have elected to draw pay under the above Revised Pay Rules, 2017 w.e.f. 01.01.2016.

Sub: Adoption of Rajasthan Civil Services (Revised Pay) Rules, 2017effective from 01.01.2016.

In light of the recommendationsof the Coordination Committee in its 8th

meeting held on rh November, 2017 and approval of the State Government,

conveyed by the Energy Department, GoRvide its letter No. F.4(43)Energy/2017

dated 01.01.2018 [Finance (Rules) Department ID No.211700442 dated 1.1.2018],

the Chairman & Managing Director, RVPN, in consultation with the Director

(Finance) is pleased to adopt, mutatis mutandis, the pay scales revised by the

Government of Rajasthan vide Notification No.F.15(1)FD/Rules/2017dated 30th

October, 2017 (Annexure-'A') and memorandumNo. F.15(1)FD(Rules)/2017dated

30th October, 2017 (Annexure-'B'), read with notification No.F.15(1)FD(Rules)1

2017 dated 9th December, 2017 (Annexure-'C') w.e.f. 01.01.2016 for Nigam's

employeeson scale to scale basis.

(1) The rules and procedure prescribed under RajasthanCivil Services (RevisedPay)Rules,2017appendedto this order will be followed, as it is, for fixationof pay, option to elect the existing pay scale or the revised pay scale, dateof increment, removal of anomalies,payof employeesappointed on or after1.1.2016and application of Assured Career Progression (ACP)scheme etc.The fixation shall be made in the corresponding PayMatrix. (2) The procedure of fixation in the RevisedPayScales, 2017, as adopted bythe Nigam herein above, shall be done as prescribed in Government ofRajasthan's Memorandum No.F.15(1)FD (Rules)/2017 dated 30.10.2017(Annexure- 'B'). For the purpose of fixation, the employee shall exerciseoption in the proforma enclosedat Annexure- 'D' in writing, to be furnishedto the respective Head of Office within a period of three (3) months fromthe date of issueof this order. In the event of not exercising option withinthe stipulated three months' period, such employeeshall be deemedto haveelected to draw pay under the above Revised Pay Rules, 2017 w.e.f.01.01.2016.

(3) Notwithstanding anything contained in this order and in the Rajasthan CivilServices (Revised Pay) Rules, 2017, no arrear of pay and allowances thereonwhatsoever on any account, shall accrue to any employee, whether existing orappointed between 1.1.2016 to 31.12.2016 (both days inclusive) for the periodupto 31.12.2016.

(4) The amount of arrears for the period from 01.01.2017 to 31.12.2017 accruingas a result of adoption of the above Rajasthan Civil Services (Revised Pay)Rules, 2017 shall be payable as under:-

i) Arrear for the period from 01.01.2017 to 31.12.2017 shall be payablein cash during the financial year 2018-19 in three installments in theratio 30:30:40 as under:-

Note : - The payment of arrears shall be subject to TDS on account ofincometax and deduction for CPF(in respect of CPFholders) as perrules applicableat the time of payment.

ii) The amount of recovery of rent of Nigam's/ Govt. accommodationw.e.f. 1.1.2017shall be adjusted from the arrears.

(5) Payand allowancesat the re~ised rates shall be subject to all deductions asmay be necessary as per rules/ regulations/ orders in force or amendedfrom time to time.

(6) Amount of fixed remuneration for a Probationer-Trainee -A Probationer Trainee shall draw fixed remuneration during the period ofProbation Training. Only onsuccessful completionof the period of probation­training, he will be allowed minimumof Level (first Cell) in the PayMatrixwithout any initial higher start. These provisions shall be applicable to theexisting 'probationer trainees' as well as newrecruits.

This is subject to ratification by the Boardof Directors.

In exercise of the powers conferred by the proviso to Article 309 of Constitution, the Governoris pleased to make the following rules, prescribing revised pay structure and principles governingfixation of pay in the revised pay structure, namely:-

Rajasthan Civil Services (Revised Pay) Rules, 2017

1. Short title, extent and commencement.-(i) These rules may be caUed the Rajasthan Civil Services (Revised Pay) Rules, 2017,(ii) They shall come into force with effect from 18t October, 2017.

Categories of Government servants to whom the rules apply.-These rules shall apply to persons other than members of All India servicesappointed to Civil Services and posts in connection with the affairs of the State andwhose pay is debitable to the Consolidated Fund of the State.

(ii) Tnese rules shall not a!)ply to.-

(I) Arty other class or category of persons who may be specifically excludedwholly or in part by the Governor from the operation of these rules.

3. Relaxation of Rules .- Where the Governor is satisfied that the operation of any provision ofthese rules causes undue hardship in any particular, case, he may, in the public interest, byorder, dispense with or relax the reqUirements of that rule to such extent and subject to suchconditions as he may consider necessary for dealing with the case in a just and equitablemanner.

4. Power of Interpretation. - If any question arises relating to the interpretation of these rules, itshall be referred to the Government in the Finance Department whose decision thereon shallbe final.

5. Definitions. - In these rules, unless there is anything repugnant in the subject or context,-(i) "existing basic pay" means pay drawn in the prescribed eXisting Running Pay Band

and Grade Pay but does not include any other type of pay such as special pay,personal pay, if any, etc;

(ii) "existing running Pay Band and Grade Pay" means the Running Pay Band and theGrade Pay applicable to the post held by the Government servant as on 01.10.2017whether in a substantive capacity or in officiating capacity while retaining lien on apermanent post or in a temporary capacIty;

Explanation.· (a) In the case of a Government servant on deputation out of Indiaor on leave or on foreign service or one who would have officiated in one ormore lower posts but for his officiating in a higher post, "Existing RunningPay Band and Grade Pay n includes the scale applicable to the post whichhe would have held but for his being on deputation out of India or on leaveor on foreign service or officiating in a higher post.

(b) In case of a Government servant drawing pay on 30.09.2017 in a scaleother than the Rajasthan Civil Services (Revised Pay) Rules, 2008, asamended from time to time, his fixation of pay in the Rajasthan CivilServices (Revised Pay) Rules, 2017 shall be made only after his pay hasfirst been fixed in the Rajasthan Civil Services (Revised Pay) Rules, 2008,as amended from time to time, in respect of post held by him on30.09.2017.

"existing pay structure " means the present system of Running Pay Band andGrade Pay applicable to the post held by the existing Government servant as on01.10.2017 whether in a substantive or offiCiating capacity while_retaining lien on apermanent post or in a temporary capacity;.

(iv) "existing emoluments" mean the sum of (i) existing basic pay (ii) Personal Pay, ifany and (iii) existing dearness allowance at index average as on 1Sf day of January2016 i.e. @ 125%;

"lever in the Pay Matrix shall mean the Level corresponding to the existingRunning Pay Band and Grade Pay specified in Part 'A' of the Schedule-I;

"Pay Matrix· means Matrix specified in Part '8' of the Schedule-I, with Levels of payarranged in vertical Cells as assigned to corresponding existing Running Pay Bandand Grade Pay;

(vii) "pay In the Level" means pay drawn in the appropriate Cell of the Level as specifiedin Part 'B' of the Schedule-I;

(viii) "revised pay structure" means the Pay Matrix and the. Levels specified thereincorresponding to the existing Running Pay Band and Grade Pay of the post unless adifferent revised Level is notified separately for that post;

(ix) "basic pay" in the revised pay structure means the pay drawn In the prescribedLevel in the Pay Matrix:

(x) "revised emoluments" means the pay in the Level of a Government servant in therevised pay structure;

(xi) ·Schedule" means the Schedules appended to these rules

(xii) "Existing Government Servant" means a Government servant who is in service on151 October, 2017 and drawing pay in an existing running pay band and grade pay.

Explanation - Government servants, who were appointed on or after 1st October, 2017 in theLevels of the Pay Matrix under the Rajasthan Civil Services (Revised Pay) Rules,2017 are not 'existing Government servants'.They will draw pay in the Levels of thePay Matrix applicable to their posts under the Rajasthan Civil Services (Revised Pay)Rules, 2017 as a result of retrospective operation of these rules. Pay of suchemployees in respect of post held by them on 1st October, 2017 or on the date ofappointment subsequent to 1st October, 2017, whichever is later, shall be fixed at theminimum of the Levels (first Cell) of the Pay Matrix as per Schedule-I Part '8' onlyafter successful completion of the probation period as per provisions of relevantservice rules.

(xiii) "Regular Service" means and includes service rendered by a Government servanton his appointment after regular selection in accordance with the provisionscontained in the relevant recruitment rules for that post. The period of servicerendered on ad-hoc basis I urgent temporary basis shall not be counted as theregular service. In other words the period of service which is countable for seniorityshall only be counted as regular service.

6. Level of posts.- As from commencement of these rules the Level of posts shall bedetermined in accordance with the various Levels as assigned to the corresponding existingRunning Pay Band and Grade Pay as specified in the Pay Matrix and as indicated In column7 of Section 'A', 'B' and 'C' of Schedule-II.

7. Drawal of pay In the revised pay structure.- (i) Save as otherwise provided in theserules, a Government servant shall draw pay in the Level in the revised pay structureapplicable to the post which he is holding as on 01.10.2017 or to which he is appointed on orafter 161October, 2017:

(ii) In respect of any servicel cadre or class of posts for which no rules regulatingrecruitment and conditions of service have been framed under proviso to Article 309of the Constitution or where a post! posts have not been included in the Scheduleappended to the rules regulating recruitment and conditions of service, the academicqualifications and experience as prescribed by or with the concurrence of the FinanceDepartment from time to time shall continue to be operative and shall be deemed tohave been made applicable to such service I cadre or class of posts in the Level inthe Pay Matrix w.eJ. 1st October, 2017. .

8. Option to elect the eXisting Running Pay Band and Grade Pay.-

(1) The Level of posts in the Pay Matrix shall apply to every existing Government servantprovided that a Government servant may elect to continue to draw pay in theexisting pay structure until the date on which he earns his next or any subsequentincrement in the existing pay structure or until he vacates his post or ceases to drawpay in the existing pay structure:

Provided further that in cases where a Government servant has been placed in ahigher grade pay between 1st October, 2017 and the date of notification of theserules on account of promotion or upgradation or ACP, the Government servant mayelect to switch over to the revised pay structure from the date of such promotion orupgradation or ACP, as the case may be.

(2) An existing Government servant may exercise option to retain existing Running PayBand and Grade Pay under proviso to sub-rule (1) in any of the followingcircumstances: -

(a) while holding a permanent post in substantive capacity, but not Officiatingona higher post;

(b) while holding a permanent or temporary post in a temporary capacity withouthaving any lien on any post;

(c) while offlclatinq on a higher post, whether permanent or temporary, retaininglien on a permanent post or where he would have officiated in one or moreposts but for his being on leave or on foreign service, provided that _

(i) the option in such cases shall be admissible in respect of existingrunning pay band and grade pay attached either to the post held byhim in offiCiatingcapacity or to his SUbstantivepost and not for boththe existing running pay band and grade pay; and it such aGovernment servant exercises option to retain existing running payband and grade pay in respect of the post 'held by him in offiCiatingcapacity, his pay, in the event of his reversion to the lower post heldin substantive capacity shall be fixed under these rules only; and

the option to retain eXisting running pay band and grade pay inrespect of the post held in officiating capacity shall nol be allowed toa Government servant who was not ql.lalified to hold the higher post;or who was fortuitously appointed on purely temporary basis, forexample against leave vacancy or against a short term vacancycaused by deputation of the senior person for training within India orabroad or deputation to foreign service etc.

The aforesaid option shall not be admissible to any person appointedto a post on or after the 1st October, 2017, whether for the first time.inGovernment service or by transfer from another post and he shall beallowed pay only in the Level in the Pay Matrix.

(ii)

Explanation -

9. Exercise of Option. -

(1) The option under Rule 8 shall be exercised in writing in the form appended to theserules, so as to reach the authority mentioned in sub-rule (2) of this rule within threemonths of the date of publication of these rules, provided that -

(i) in case of a Government servant who is, on the date of publication of theserules, out of India on leave or deputation or foreign service or in case ofRajasthan Armed Constabulary Personnel posted in the border areas or aCivilian Government servant permitted to take up Military Service, the optionshall be exercised within three months from the date these rules are broughtto the knowledge of the Government servant by his superior authority;

(ii) where a Government servant is under suspension or on leave or on trainingor on foreign service within India on the date of publication of these rules, theoption may be exercised within three months of the date he takes over thecharge of the post.

(iii) In cases where a Government servant who has already exercised optionunder these rules for lower post, if promoted to a higher post throughDepartmental Promotion Committees of earlier years from a date earlier to 15t

October, 2017, may opt these rules within a period of 3 months from the dateof joining on higher promotion post.

(2) The option shall be intimated by the Government servant in the prescribed formappended to these rules in the following manner: -

(i) if he is a non-gazetted Government servant or a gazetted Governmentservant whose pay and allowances are drawn by the head of office to thehead of office concerned;

(ii) if he himself is a head of office I head of department to the Accounts Officeror Assistant Accounts Officer-I, as the case may be, of the department inwhich he is posted;

(iii) if he is a retired Government servant on the date of publication of theserules but was in Government service on 1stOctober, 2017 to head of office ofthe office where from he had retired.

(3) (i) In case the intimation regarding option is not received within the timespecified in sub-rule (1) the Government servant shall be deemed to haveelected to draw pay under these rules with effect from 1st October, 2017.

(ii) where a Government servant expires before exercising option within theprescribed period or had expired before publication of these rules, he may bedeemed to have exercised option in favour of the existing running pay bandand grade payor revised pay structure under these rules, whichever isadvantageous to him, and his pay shall be fixed accordingly.

(4) Government servant holding post on 181 October, 2017 for which no Level has beenprescribed for any reason, whatsoever or where the Level or conditions attached tothe drawal of pay under these rules are subsequently changed, amended or revised,. shall exercise option I re-option under this rule within a period of three months of thedate of notification of revised pay structure or any other change related to the Level ofthe post.

(5) The option once exercised shall be final.

Special Pay. - The rates of Special Pay, which shall be drawn with the revised pay structure,are given in Schedule - III appended to these rules.

11. Fixation of pay in the revised pay structure.-

(1) The pay of a Government servant who elects, or is deemed to have elected underrule 9 to be governed by the revised pay structure on and from the 1st October, 2017,shall, unless in any case the Governor by special order otherwise directs, befixed separately in respect of his substantive pay in the permanent post on whichhe holds a lien or would have held a lien if such lien had not been suspended, andin respect of his pay in the officiating post held by him, in the following manner,namely:-

(A) in the case of all employees-

(i) the pay in the applicable Level in the Pay Matrix shall be the pay obtainedby multiplying the existing basic pay by a factor of 2.57, rounded off to thenearest rupee and the figure so arrived at will be located in that Level in thePay Matrix and if such an identical figure corresponds to any Cell in theapplicable Level of the Pay Matrix, the same shall be the pay, and if nosuch Cell is available in the applicable Level, the pay shall be fixed at theimmediate next higher Cell in that applicable Level of the Pay Matrix.

(ii) if the minimum payor the first Cell in the applicable Level is more than theamount arrived at as per sub-clause (i) above, the pay shall be fixed atminimum payor the first Cell of that applicable Level.

(8) In the case of Medical Officers in respect of whom Non PractiCingAllowance (NPA) isadmissible, the pay in the revised pay structure shall be fixed in the following manner:

(i) The existing basic pay shall be multiplied by a factor of 2.57 and the figureso arrived at shall be added to by an amount equivalent to DearnessAllowance on the pre-revised Non-Practicing Allowance admissible as on1st day of January, 2016. The figure so arrived at will be located in that Levelin the Pay Matrix and if such an identical figure corresponds to any Cell inthe applicable Level of the Pay Matrix, the same shall be the pay, and if nosuch Cell is available in the applicable Level, the pay shall be fixed at theimmediate next higher Cell in that applicable Level of the Pay Matrix.

(ii) The pay so fixed under sub-clause (i) shall be added by the pre-revised NonPracticing Allowance adrnlsslble on the existing basic pay.

(2) A Government servant who is on leave on the 1st October, 2017 and Is entitled toleave salary shall be entitled to pay in the revised pay structure from 1111 October,2017 or the date of option for the revised pay structure.

A Government servant who is on study leave on the 1st October, 2017 shall beentitled to the pay in the revised pay structure from 1$1 October, 2017 or the date ofoption.

A Government servant under suspension, shall continue to draw subsistenceallowance based on existing pay structure and his pay in the revised pay structureshall be subject to the final order on the pending discipUnaryproceedings.

Where a Government servant holding a permanent post and is officiating in ahigher post on regular basis and the pay structure applicable to these two posts aremerged into one Level, the pay shall be fixed under sub-rule (1) with reference to theofficiating post only and the pay so fixed shall be treated as substantive pay.

Where the existing emoluments exceed the revised emoluments in the case ofany Government servant, the difference shall be allowed as personal pay to beabsorbed in future increases in pay.

Where in the fixation of pay under sub-rule (1), the pay of a Governmentservant, who, in the existing pay structure, was drawing immediately before the 1st

October, 2017 more pay than another Government servant junior to him in the samecadre, gets fixed in the revised pay structure in a Cell lower than that of such junior,his pay shall be stepped up to the same Cell in the revised pay structure as that ofthe junior.

Where a Government servant is in receipt of personal pay immediatelybefore the date of notification of these rules, which together with his existingemoluments exceed the revised emoluments, then the difference representingsuch excess shall be aHowedto such Government servant as personal pay to beabsorbed in future Increases in pay.

In cases where a senior Government servant promoted to a higher post before the151 October, 2017 draws less pay in the revised pay structure than his junior who ispromoted to the higher post on or after the 1st October, 2017, the pay of seniorGovernment servant in the revised pay structure shall be stepped up to an amountequal to the pay as fixed for his junior in that higher post and such stepping up shall

be done with effect from the date of promotion of the junior Government servantsubject to the fulfillment of the following conditions, namely:-

(a) Both the junior and the senior Government servants belong to the samecadre and the posts in which they have been promoted are Identical in thesame cadre;

(b) The existing pay structure and the revised pay structure of the lower andhigher posts in which they are entitled to draw pay are identical;

(c) The senior Government servants at the time of promotion are drawingequal or more pay than the junior;

(d) The anomaly is directly as a result of the application of the provisions of Rule20 of these rules or any other rule or order regulating pay fixation on suchpromotion in the revised pay structure:

Provided that If the junior officer was drawing more pay in the eXisting paystructure than the senior by virtue of any advance increments granted tohim, the provisions of this sub- rule shall not be invoked to step up the pay ofthe senior officer. .

12. Increments in the Pay Matrlx.- The increment shall be as specified in the vertical Cells ofthe applicable Level in the Pay Matrix.

13. Date of next increment in revised pay structure.-

(1) There will be a uniform date of annual increment viz. 1st July of every year afterfixation of pay under these rules. Employees completing 6 months and above in anyLevel as on 1st of July will be eligible to be granted the increment.

(2) Every new recruit on completion of probation period successfully shall be allowed firstannual increment on 1sl July, which immediately follows the date of completion ofprobation period.

14. Scheme of Assured Career Progression (ACP).- The scheme of Assured CareerProqresston (ACP) with three financial upgradations shall be as under: _

(1) The scheme will be available to all posts in Class IV, Ministerial, Subordinate Services andthose holding isolated posts and drawing pay under these rules upto Level 13 excluding Stateservices.

Benefit of pay fixation available at the time of normal promotion shall be allowed at the time offinancial upgradations under the scheme. Thus, one increment shall be given in the Level

Existing Government servants who have already availed three benefits of financialupgradation will not be eligible for the grant of ACP. Those Government servants who haveavailed benefit of one ACP / one promotion will be eligible for second and third ACP oncompletion of 18 and 27 years of regular service, respectively. Similarly those Governmentservants who have availed benefit of tWoACP's / two promotions / one promotion and oneACP, as the case may be, will be eligible for third ACP on completion of 27 years of regularservice.

(6) The authority competent to make appointment on the post held by the Government servantshall be competent to grant ACP.

The detailed guidelines for grant of Assured Career Progressions (ACP) shall be as containedin Schedule-VI appended to these rules.Scheme of Assured Career Progression (ACP) for State Service Officers-The scheme ofACP with three financial upgradations shall be allowed to State Service Officers as under: -

The scheme will be available to all posts in State services and isolated posts in the Level 14and above.Benefit of pay fixation available at the time of normal promotion shall be allowed at the time offinancial upgradations under the scheme. Thus, one increment shall be given in the Levelfrom which the employee is granted ACP and he shall be placed in the Cell equal to the figureso arrived at in the Level from which ACP is to be given and if no such Cell is available in theLevel to which ACP granted. he shall be placed at the next higher Cell in that Level.

There shall be no further fixation of pay at the time of regular promotion, if promotion is in thesame Level as granted under ACP. However. if promotion is on the post carrying higher Levelthan only the pay in that Level in the Pay Matrix shall be fixed at the equal Cell and if there isno equal Cell than at the immediate next Cell.For grant of financial upgradation under the Assured Career ProgreSSion(ACP) Scheme. theservice shall be counted from the date of the direct entry in service and shall be admissible oncompletion of 10, 2.0and 30 years regular service respectively.

Existing Government servants who have already availed benefits in Ministerial! Subordinateservice I State Service of three ACPs will not be eligible for the grant of ACP. ThoseGovernment servants who have availed benefit of one ACP lone promotion will be eligible forsecond and third ACP on completion of 20 and 30 years of regular service, respectively.Similarly those Government servants who have availed benefit of two ACPs I two promotionslone promotion and one ACP, as the case may be, will be eligible for third ACP oncompletion of 30 years of regular service.

Provided further that if a Government servant is appointed on another post as aProbationer - trainee on newhigher post after fixation of pay under these rules, the pay drawnby him on the previous post shall be allowed during the period of probation training includingincrement and on successful completion of probation training period, his pay on the higherpost shall be fixed with reference to his pay on the lower post at an equarCerrof the higherpost and if there is no such equalCell than in the next Cell of the new post.

18. Advance Increment- A Governmentservant shall be entitredto advance increment with therevised pay structure, as provided in Schedule-V appended to these rules.

Fixation of pay in the revised pay structure, subsequent to the 1st October, 2017.Where a Government servant continues to draw his pay in the existing running pay band andgrade pay is brought over to the level from a date later than the 1st October, 2017, his payfrom the later date in the Level shall be fixed in the followingmanner: _

(i) For the purpose of fixation of pay in the revised pay structure the basic pay shall beappllcabl~on the later date. The pay in the applicable Level in the Pay Matrix shall bethe pay obtained by multiplyingthe eXistingbasic pay by a factor of 2,57, rounded offto the nearest rupeeand the figure so arrived at will be located in that Level in the PayMatrix and if such an identicalfigure correspondsto any Cell in the applicable Level ofthe Pay Matrix, the same shall be the pay, and if no such Cell is available in theapplicable Level, the pay shall be fixed at the immediate next higher Cell in thatapplicable Level of the PayMatrix,

Fixation of pay on promotion on or after 1stOctober, 2017.-The fixation of pay in caseof promotion from one level to another in the revised pay structure shall be made in thefollOwingmanner, namely:-

One increment shall be given in the Level from which the employee is promoted and he shallbe placed at a Cell equal to the figure so arrivedat in the Level of the post to which promotedand if no such Cell is available in the Level to which promoted, he shall be placed at the nexthigher Cell in that Level.

21. Method of fixation of pay in the Level further revised after 01.10.2017:· The initial pay ofa Government servant who elects or deemed to have elected Level of the post furtherrevised after 01.10.2017 shall be fixed at an equal Cell of that post. If no such Cell isavailable in the applicable Level, the pay shall be fixed at the immediate next higher Cell inthat applicable Level in the Pay Matrix. In case the pay last drawn in the previous Level isless than the minimum of first Cell of the further revised Level of that post, he shall be fixedat first Cell of further revised Level In the Pay Matrix.

22. Overriding effects of Rules. - The provisions of the Rajasthan Civil Services (Revised Pay)Rules, 2008 and grant of Assured Career Progressions, as amended from time to time, shallnot, save as otherwise provided in these rules, apply to cases where pay is regulated underthese rules, to the extent they are inconsistent with these rules.

Note:-1. The Probationer-trainee shall be entitled only to fixed remuneration as above and he/she will

not be entitled to Special Pay, Dearness Allowance, House Rent AllOWance. CityCompensatory Allowance. Non-Practicing Allowance, Non-Clinical Allowance, Mess Allowance,Washing Allowance or any other aflowance(s) called by whatever name. Similarly, he/she willnot be eligible far grant of Ad-hoc Bonus and uniform/liveries except wearing of uniform is alegal compulsion under the rules.

2. No Travelling Allowance shall be admissible for joining as a probationer-trainee. In casejourney on duty, he/she shall be allowed TA as on tour and in case of transfer only MileageAllowance on the basis of fixed remuneration shall be admissible. In case of transfer only theactual period required for travel will be treated as on duty.

3. Na deduction towards General Provident Fund and State Insurance shall be made from thefixed remuneration.

4. Probationer-trainee shall be eligible for Casual Leave of 15 days in a calendar year and forperiod of less than a calendar year, it shall be admissible in proportion on the basis ofcompleted months.

5. No Deputation Allowance shall be admissible to a Probanoner-tralnee, if, deputed to 'ForeignService" for training etc.

6. An existing employee already in regular service shall have an option to opt either for the "Fixedremuneration' or the Pay in the Level in the Pay Matrix (not the Level of his/her newappointment), whichever is beneficial to him/her while he/she is under probation. Aftersuccessful completion of probation period, Pay shall be fixed as per the rules, where such aGovernment servant will get due advantage of being in a regular Level earlier, and will get dueprotection of his/her pay.

7. (l) Probationer-trainee shall earn no leave during the period of probation.(ii) Female Probationer-trainee shall be granted Maternity Leave as per Rule 103 and 104 of

Rajasthan Service Rules, 1951(iii) Male Probationer- trainee shall be granted Paternity Leave as per Rule 103A of Rajasthan

Service Rules, 1951

8. Extraordinary Leave upto 30 days may be sanctioned by the appointing authority to aProbationer-trainee during the entire period of Probation Training. Beyond 30 days and notmore than one year by the appointment authority after prior approval of AdministrativeDepartment.

9. Grant of Medical Attendance Allowance Rs 17400/- (including hard duty allowance etc. if any)during the probation period in addition to fixed remuneration to newly appointed MedicalOfficer.

10. Mediclaim Insurance coverage for the Probationer-trainee during the period of probation shallbe applicable, as applicable to Government servants.

11. Contribution towards New PensIon Scheme (NPS) @ 10% of fixed remuneration shall be madeby the Probationer-trainee and employer both.

Schedule VI(Rule No. 14 & 15)

Guidelines for grant of Assured Career Progression Scheme to State Government Employees

The State Government have revised pay scale of the State Govemment employees underRajasthan Civil Services (Revised Pay) Rules, 2017 w.eJ. 01.10.2017. Under Rule 14 and 15 of theserules, the Government servants are eligible for financial upgradations.The detailed guidelines for grantof Assured Career Progression (ACP) shall be as under: -(1) There shall be three financial upgradations. The service shall be counted from the date of

joining of a post in regular appointment direct entry Level. The employees in Class-IV,Ministerial, Subordinate Services and those holding isolated post upto Level 13 shall be eligiblefor ACP on completion of regular service of 9 years as provided in Rule 14 of Rajasthan CivilServices (Revised Pay) Rules, 2017. The State Service Officer and those holding isolated postin Level 14 and above shall be eligible for ACP on completion of service of 10 years asprovided in Rule 15of Rajasthan Civil Services (Revised Pay) Rules, 2017.

(2) The ACP Scheme envisages merely placement in the immediate next Level in the hierarchy ofthe Level as given in Part 'A' of the Schedule-I of the Rajasthan Civil Services (Revised Pay)Rules, 2017. Thus, the Level at the time of financial upgradation under the ACPS can, incertain cases where regular promotion is not between two successive Level, be different thanwhat is available at the time of regular promotion. In such cases, the higher Level attached tothe next promotion post in the hierarchy of the concerned cadre will be given only at the time ofregular promotion.

(3) Benefit of pay fixation available at the time of regular promotion shall also be allowed at thetime of financial upgradation.under the Scheme. Thus, one Increment shall be given in theLevel from which the employee granted ACP and he shall be placed in immediate next Level inthe Cell equal to the figure so arrived at in the Level from which ACP is to be given and if nosuch Cell is available in the Level to which ACP granted, he shall be placed at the next higherCeli in the Level. There shall, however, be no further fixation of pay at the time of regularpromotion, if promotion is in the same Level as granted under ACP. However, if promotion is onthe post carrying higher Level than only the pay in that Level in the Pay Matrix shall be fixed atthe equal Cell and if there Is no equal Cell than at the immediate next Cell.

(4) In case where the date of increment and the date of eligibility for ACP is the same, in suchcases first increment shall be allowed in the existing Level and thereafter pay shall be fixed inthe immediate next Level as per provisions of item (3) above.

(5) (i) Regular service for the purpose of grant of ACP shall be as defined in Rule 5(xiii) of RajasthanCivil Services (Revised Pay) Rules, 2017 reproduced below; -"5(xiil) "Regular Service" means and includes service rendered by a Government servanton his appointment after regular selection in accordance with the provisions contained in therelevant recruitment rules for that post. The period of service rendered on ad-hoc basis I urgenttemporary basis shall not be counted as the regular service. In other words the period ofservice which is countable for seniority shall only be counted as regular service."

(ii) Regular service for grant of benefits under the ACP Scheme shall be counted from the date ofjoining ot a post in direct entry Level on regular basis on direct recruitment.

(iii) Service rendered on ad-hoel contract basis before regular appointment shall not be taken intoreckoning. However, past continuous regular service in another Government Department in apost carrying same Level prior to regular appointment in a new Department, without a break,shall also be counted towards qualifying regular service for the purpose of ACPS only (and notfor the regular promotions). However, benefits under the ACPS in such cases shall not beconsidered tiil the satisfactory completion of the probation period in the new post. To illustrate,in case of Patwari regularly recruited is appointed to another post of LDC in the same Level. theperiod of service rendered by him as Patwari shall be reckoned for the purpose of grant of ACPas LDC after satisfactory completion of probation period.

(iv) 'Regular Service' shall include all periods spent on deputation I foreign service, study leave andall other kind of leave (except Extraordinary Leave beyond 90 or 30 days, as the case may be,

~; ( granted to a Probatloner-fralnsaj, duly sanctioned by the competent authority.

(6) (i) The financial upgradatlon would be on non-functional basis subject to satisfactory servicerecord on the basis of which the concerned employee is eligible for promotion on higher post.For this purpose, the service record of the concerned employee of last continuous 7 yearsservice is to be seen. In cases where the service record of last continuous 7 years is notavailable, the following procedure shall be adopted:-

(a) In case 7 years Annual Performance Appraisal Report (APAR) of Government Servant arenot available for grant of ACP in that case upto 3 APARs of previous years of the officer ofthe State Service and upto 2 APARs of previous years of employees other than StateService shall be taken into account.

(b) Even after that 7 years APAR is not available than remaining APAR may be considered ofthe next years for grant of ACP.

(c) Any departmental or criminal proceeding may not be pending.

(d) In the past years annual increments were regularly granted.

(e) The Controlling Officer shall issue a certificate of satisfactory service.

(ii) In case of employee who could not be granted ACP due to his unsatisfactory record, he will begranted ACP from .thedate he becomes eligible for promotion to the higher post on the basis ofsatisfactory service record subject to the fulfillment of other conditions prescribed in this regard.

(iii) The appointing authority shall also obtain an affidavit from the employee with reference tohaving only two children on or after 01.06.2002 prior to granting ACP. An employee who hasmore than 2 children on or after 01.06'.2002 shall not be granted next ACP for 3 years from thedate on which his/her' ACP becomes due and it would have consequential effect on thesubsequent financial upgradation which would also get deferred to the extent of delay in grantof previous financial upgradation. The employee having more than 2 children shall not bedeemed to have been disqualified, so long as the number of children he/she has on 01.06.2002does not increase.

Provided that while counting the total number of children of an employee, the child born fromearlier delivery and having disability shall not be counted.

Provided further also that any Government Servant who is remarried, which is not against anylaw and before such remarriage he/she is not disqualified for grant of Assured CareerProgression under this clause, he/she shall be entitled to Assured Career Progression, if anychild is born out of single delivery from such remarriage.

(7) In the matter of disciplinary proceedings, grant of benefit under the ACPS shall be subject torules governing normal promotion. Such cases shall, therefore, be regulated under theprovisions of the Rajasthan Civil Services (Classification, Control and Appeal) Rules, 1958 andinstructions issued thereunder.

(8) The effect of penalty on grant of ACP shall be given as under:-

(9) The ACPS contemplates merely placement on personal basis in the immediate next Level Igrant of financial benefits only and shall not amount to actual I functional promotion of theemployees concerned.

(10) If a financial upgradation under the ACPS is deferred and not allowed due to the reason of theemployee being unfit or due to departmental proceedings, etc., this would have consequentialeffect on the subsequent financial upgradation which would also get deferred to the extent ofdelay in grant of previous financial upgradation.

(11) On grant of financial upgradation under the Scheme, there shall be no change in thedeslqnation, classification or higher status.

(12) Financial upgradation under the ACPS shall be purely personal to the employee and shall haveno relevance to his seniority position. As such, there shall be no additional financial upgradationfor the senior employees on the groun'd that the junior employee in the Level has got higherLevel under the ACPS.

(13) Pay drawn in the Level allowed under the ACPS shall be taken as the basis for determining theterminal benefits in respect of the retiring employee.

(14) Existing Government servants Including State Service Officer who have already availed benefitof three selection grades/ACP under order dated 25.01.1992 and 17.02.1998 and also underRCS(Revised Pay) Rules, 2008 will not be eligible for the grant of ACP. Those Governmentservants who have availed benefit of one ACP lone promotion will be eligible for second andthird ACP on completion of 18 1 20 and 27/30 years, as the case may be, of regular service,respectively. Similarly those Government servants, who have availed benefit of two ACP I twopromotions lone promotion and one ACP, as the case may be, will be eligible for third ACP oncompletion of 27/30 years of regular service respectively.

(15) In case an employee is declared surplus In his 1 her department and appointed in the sameLevel or lower Level in the new department, the regular service rendered by him 1 her in theprevious department shall be counted towards the regular service in his I her new departmentfor the purpose of giving financial upgradation under the ACPS.

(16) If a regular promotion has been offered but was refused by the employee before becomingentitled to a financial upgradation, no financial upgradation shall be allowed as such anemployee has not been stagnated due to lack of opportunities. If, however, financialupgradation has been allowed due to stagnation and the employee subsequently refuses thepromotion, it shall not be a ground to withdraw the financial upgradation. He shall, however, notbe eligible to be considered for further financial upgradation till he agrees to be considered forpromotion again and the second the next finanCial upgradation shall also be deferred to theextent of period of deferment due to the refusal.

(17) Illustration: -

(i) If a Government servant (Junior Assistant I Clerk Gr.-II) in Level-5 gets his first regularpromotion in Level-8 on completion of 8 years of service and then completes service offurther 10 years without any promotion then he would be eligible for 2nd financialupgradation under the ACP after completion of 18 years (8+10 years).

(Ii) In case he does not get any promotion thereafter, then he would get 3rd financialupgradation on completion of further 9 years of service l.e, after 27 years (8+10+9years).

~~ The next annual increment shall be granled on 1" July of Ihe year falling after grant of ACP.

(19) The word 'Level' shall also include 'Grade Payand Scale of Pay', if any.(20) The authority competent to make appointment on the post held by the Government servant

shall be competent to grant ACP.2. These provisions shall also be applicable to the Work-charged Employees drawing pay in'Level' under the RajasthanWork-chargedEmployees (RevisedPay) Rules, 2017.3. The undersigned is directed to invite attention to this Department NotificationNo. F. 15(1)FD/Rules/2017 dated 30.10.2017 under which the Rajasthan CivilServices (Revised Pay) Rules, 2017 have been promulgated.The Part 'A' & Part 'B'of Schedule-I and Section 'A',B' & 'C' of Schedule -II have been appended to theaforesaid rules with a view to facilitating and expediting fixation of pay in the PayMatrix.2. The rules provide that the Government servants should exercise option withinthree months from the date of publication of these rules indicating whether theydesire to come over to the prescribed Level in the Pay Matrix or to retain existingrunning pay band and grade pay. In the case of Government servants who does notexercise option to retain the existing Running Pay Band and Grade Pay within theprescribed time, he will be deemed to have opted for the Rajasthan Civil Services(Revised Pay) Rules, 2017 and thereupon his pay shall be fixed in Level in the PayMatrix. The option given by the Government servant may be pasted in his ServiceBook and a true copy of it be placed in his personal file. The fixation of pay in Level inthe Pay Matrix of the individual Government servant may, therefore, be done as andwhen option is received. The Heads of Departments/Offices should not wait orpostpone action in this respect until options from all Government servants servingunder them are received.3 (i) The pay of Government servants may be drawn in Level in the Pay Matrix

thereon after pay fixation statements have been checked by the Accountsofficer(s)1Assistant Accounts officer-I of the Department or the officer(s)specially authorized in this connection. A Proforma for the purpose offixation of pay in Level in the Pay Matrix is enclosed.

(ii) The Head of Offices/ Departments shall prepare pay fixation statementsofeach Government servant in the prescribed Proforma in triplicate andsend the same to the authorities as specified in para 5 of thisMemorandum. The original and duplicate copy of the fixation statement,after checking by Accounts Officer/ Assistant Accounts Officer-lorTreasury Officerl Assistant Treasury Officer as the case may be, shall bereturned to the concerned Head of Officel Department of the employee.The triplicate copy shall be retained by the checking authority for recordofhis office. The Head of Office shall attach original copy of the pay fixationstatement with the arrear bill and retain duplicate copy in his office in thepersonal file of the respective employee.

4. \n the absence of pre-audit, there is a possibility of fixation of pay being donewrongly resulting ·in over-payments which shall have to be recovered subsequently.b To safeguard against such a contingency, the disbursing officers shall obtain

undertaking from each Government servant that in the event. of overpayment as aresult of incorrect fixation of pay, recovery may be made from his pay.

5. The Accounts Officer(s)/ Assistant Accounts Officers-I(s) ~re .herebyauthorized to check the pay fixation statements of employees servmg In theirrespective Departments. Where there is no Accounts Officer/Assistant AccountsOfflcer-l in a Department the fixation statement for checkingwill be sent by the Headof Office to the Treasury Officerwho passessalary claims of that office. The Treasuryofficer(s) and Assistant Treasury Officer(s) of such Treasuries are authorized tocheck such fixation statements.6. The fixation of pay of Government servants on deputation to variousundertakings, autonomous bodies etc. in Level in the Pay Matrix under RajasthanCivil Services (Revised Pay) Rules, 2017 shall be done by the AccountsOfficers/Assistant Accounts Officer-I of their parent departments to which theybelong. In case of members of Rajasthan Administrative Service and RajasthanAccounts Service and Rajasthan Subordinate Accounts Services, fixation of pay ofdeputationists in Level in the Pay Matrix, shall be done by the Department ofPersonnel, Government of Rajasthan and Director, Treasuries & Accounts,Rajasthan, Jaipur respectively.

(i) Fixation of pay in Level in the Pay Matrix under Rajasthan Civil Services(Revised Pay) Rules, 2017 in respect to left out posts which do not findplace in the department-:wiseSchedule-II, appended to these rules, maynot be done until the posts have been included in Section 'A', 'S' and 'C' ofSchedule-ll of the rules. .

(ii) No payment of Special Pay be made in any case where the entry ofSpecial Pay has not been included in Schedule-III appended to theserules, regardlessof drawal of Special Pay in the existing running pay bandand grade pay.

8. The Heads of Offices/Departments will ensure that entries with respect tofixation of pay in Level in the Pay Matrix are made on the basis of fixation statementsapproved by the Accounts Officer/ Treasury Officerl Assistant Accounts Officer-I!Assistant Treasury Officer in the Service Book of the employees under hisattestation. .

Subject: - Rajasthan Civil Services (Revised Pay) Rules, 2011.

In exercise of the powers conferred by the proviso to Article 309 of theConstitution of India, the Governor of Rajasthan is pleased to make thefollowing rules to amend further the Rajasthan Civil Services (Revised Pay)Rules, 2017 namely:-

1, These rules may be called the Rajasthan Civil Services (Revised Pay)(Second Amendment) Rules 2017. .

2. They shall be deemed to have come into force with effect from01.01.2016 excepting where otherwise specifically provided.

3. In the Rajasthan Civil Services (Revised Pay) Rules, 2017

(a) the existing words and figures "1st October, 2017" whereveroccurring in these rules shall be substituted by the words andfigures "1S1 January, 2016",

(b) the existing figures "01.10.2017" wherever occurring in these rulesshall be substituted by figures "01.01.2016",

(c) in Explanation (b) appearing below rule 5{ii), the existing figures"30.09,2017" shall be substituted by figures "31,12.2015",

(d) In the said rules - below the existing clause (8) of sub-rule (1) ofrule 11, the following proviso shall be inserted, namely.-

"Provided that in the case of Medical Officers drawing NPA, optto do practice at later stage, the amount of DA on NPA @125%included in the basic pay under these rules shall be deducted fromthe basic pay and the remaining basic pay shall be adjusted in theLevel of the Pay Matrix at same stage or next below stage, if nosame stage available,"

(e) the existing sub-rule (1) of rule 13 shall be substituted by thefollowing, namely.-

"11. Contribution towards New Pension Scheme (NPS) @10% offixed remuneration shall be made by the Probationer-trainee andemployee both. From 01.01.2017 to 30.09.2017 the contribution shallbe calculated on the revised flxed remuneration and shall bedeposited in NPS account of the concerned employee in threeinstalments in the ratio of 30, 30 and 40. The first, Second and Thirdinstalment shall be payable on or after 01.04.2018, 01.07.2018 and01.10.2018 respectively."

(k) In Schedule V - Advance Increments the existing figures"01.10.2017" wherever appearing shall be substituted by the figures"01.01.2016"

(I) In Schedule VI - Guidelines for grant of Assured CareerProgression Scheme to State Government Employees the existingfigures "01.10.2017"appearing in para 1, shall be substituted by thefigures "01.01.2016".

4. After the existing Rule 22, the following new rule 23 and 24 shall beinserted, namely;

"23. Non-accrual of Arrears.- Notwithstanding anythingcontained in these Rules, no arrear of Pay and Allowances thereon,on any account shall accrue to a Government servant, whetherexisting or appointed between 01st January, 2016 to31st December, 2016 (both days inclusive), for the period upto31.12.2016".

"24. Payment of Arrear.- The arrear under these rules for theperiod from 01.01.2017 to 30.09.2017 shall be payable in threeinstalment in the ratio of 30, 30 and 40. The first, second and thirdinstalments shall be payable on or after 01.04.2018,01.07.2018 and01.10.2018 respectively by crediting in GPF account of concernedemployee. The Government servant appointed on or after

01.01.2004 shall be paid amount of arrear in these instalments incash The revised pay and allowances thereon in cash shall bemad~with effect from 01.10.2017 payable on 01.11.2017".
