INTRODUCTION

With reference to the GCC Common Law on Antidumping, Countervailing and Safeguard Measures and its Rules of Implementation, this questionnaire aims to obtain the necessary information to carry out the antidumping investigation subject of the Public Notice in the Official Gazette of the Bureau of the Technical Secretariat for Anti-Injurious Practices in International Trade (TSAIP) and initiated upon the complaint presented by the GCC domestic Industry of the product “---------------------” (hereinafter referred to as the “product under investigation"). It is in your own interest to reply to this questionnaire as accurately and completely as possible and to attach all supporting documents.

It is imperative for the continuation of the proceeding to reply to all questions in the formats requested and within the time limits specified by the TSAIP as indicated in the general instructions hereby. All documents attached to this questionnaire shall be signed and stamped by or on behalf of your company.

If you have any difficulties completing the questionnaire, please contact the TSAIP officials in charge of the proceedings who will provide you with the required explanations about any question contained in this questionnaire.

GENERAL NOTES

1. Before completing the questionnaire you are requested to read

and review carefully all instructions hereby and the glossary of

dumping terminology attached as Annex2.

2. This questionnaire is intended for the GCC producers of the GCC

like product classified within the following HS

codes:------------------- .

3. The material Injury investigation period for the GCC industry,

upon which information in this questionnaire is requested (xxxx),

(xxxx), (xxxx)] taking into consideration that the last year is the

dumping investigation period (POI).

4. The purpose of this questionnaire is to permit the TSAIP to

obtain the necessary information to carry out the investigation

and on the basis of which preliminary and final determinations

will be made with reference to the GCC common Law and its

Rules of Implementation.

5. The response to this questionnaire must be completed in Arabic

or English on the official paper of your company with the official

stamp. Please rewrite each question along with its answers in the

exact order presented in this questionnaire. Furthermore, a table

of attachments shall be provided indicating their numbers.

6. The responses to the questionnaire must be based on sufficient

evidence supporting the data contained therein, which requires

identifying the sources of the data submitted.

7. Please respect the deadline specified to reply to this

questionnaire within 40 days of dispatching the questionnaire.

However, before the end of the init ial deadline, any interested

party upon a proper justification may request an extension of 10

days.

8. If you encounter difficulties with answering questions within the

requested format, you should contact the TSAIP officials in

charge.

9. The TSAIP may carry out on-the-spot verification visits to

examine the records of your company and to verify all

information provided in this questionnaire. In such case, you will

be informed when it is decided to conduct such a visit . For this

reason, all worksheets, documents and records used in answering

this questionnaire must be retained.

10. When confidential treatment is required, please specify all

the information and documents, for which such treatment is

required and the reasons for that. Any information or document

provided as confidential must be labelled as ‘’confidential’’.

These confidential data will not be made available to any other

interested party unless with your permission.

11. The TSAIP will make all the non-confidential information in the

public file available for all interested parties whenever i t is

required. Therefore, any party providing such ‘’confidential’’

information is required to provide a non-confidential summary

thereof. Such summaries shall be in sufficient detail to permit a

reasonable understanding of the data submitted as ‘’

confidential’’. All the documents and data submitted without

“confidential stamps”, a request for confidential treatment, or

have no reasons for such treatment will be treated as non-

confidential.

12. The questionnaire with its attachments should be submitted

(confidential and non-confidential) in hard copy and soft copy

(using WORD for text and EXCEL for data).

SECTION 2- THE GCC LIKE PROUCT AND THE PRODUCT UNDER

INVESTIGATION

THE GCC LIKE PRODUCT PRODUCED BY YOUR

COMPANY

1. Describe the GCC like product produced by your company and attach in

Attachment (2-1) all documents related to the GCC like product such as

catalogues and brochures clarifying the detailed description of the product in

terms of:

Physical characteristics of the product (and provide standards and

specifications if any);

End-uses;

HS Code when exporting;

Summary of the main stages of the production process and the raw

materials used in production (Arabic and English);

Distribution channels;

Annual periods in which the product sale process is active;

Product measurement unit;

Other.

2. For the purpose of fair comparison between the prices of the product under

investigation and the GCC like product, a classification to the product has to

be made by (Model/Type/Size) by using a “Product Control Number” (PCN)

for each model/type/size. Such PCN has to be as detailed as possible (i.e.

specify the type, weight, grade, concentration, color, dimensions, capacity,

any other specifications that best describe the product…..etc) with

clarification on how the PCN can be read. It is worth mentioning that this PCN

will be used all over the response to this questionnaire and it will also be used

for the purpose of fair comparison between the prices of the product under

investigation and the prices of the GCC Like Product. Moreover, in case that

your company is using certain coding system for production and sales,

describe in detail your company’s product coding system with regard to each

type/model/size of the GCC Like Product in correlation with the PCN in

Attachment (2-2).

3. In case substantial changes had been made by your company (i.e. increasing

the production capacity, factory development, marketing improvement….etc.),

please explain such changes indicating the type of the change, date, and

reasons for that.

4. Provide details about the end-uses of the GCC like product as raw material to

produce other products. What is the percentage of the utilization of the GCC

like product as raw material in the production of these products?

THE PRODUCT UNDER INVESTIGATION

1. Complete the Attachment (2-3) relating to the differences, if applicable,

between the product under investigation and the GCC like product indicating

the differences in the manufacturing process, characteristics, marketing

methods, and distribution channels between the product under investigation

and the GCC like product.

2. If there are any differences between the Like product produced by your

company and the product under investigation, please indicate whether or not

such differences substantially affect your company’s sales of the GCC like

product.

3. Are the product under investigation and the GCC like product substitutable? If

yes, please indicate what are the factors or characteristics by which both

products can be substituted for each other.

4. List the names and addresses of importers and exporters / foreign producers of

the product under investigation.

5. Provide any studies or publications about the current situation of the

international market for the product under investigation.

SECTION 3- FINANCIAL STATEMENT AND ACCOUNTING

SYSTEM1. Identify your company’s accounting year. If any changes have occurred

regarding this accounting year during the Injury investigation period, please

explain these changes.

and its effect on cost.

4. If your company uses accounting software, provide the name of the software

and its beginning date of usage.

5. Attach copies of the audited financial statements of your company including

all auditors’ reports, notes and opinion in Attachment (3-2) for the years

(from xxxx to xxxx).

6. Provide in Attachment (3-3) the income statement related to the GCC like

product for the injury investigation period and indicate the allocation methods

used for the costs’ allocation.

7. Provide in Attachment (3-4) the cash flows related to the GCC like product

for the injury investigation period.

8. Provide in Attachment (3-5) the investments of the company related to the

GCC like product along with the return on investment during the injury

investigation period. Explain the calculation method of the investment.

9. Please indicate what are the products (other than the GCC like product) that

can be produced by using the same machines used in producing the GCC like

or to increase its capital during the injury investigation period by indicating for

last year along with all their relevant documents (i.e. purchase orders,

proforma and commercial invoices, discounts, notes payable or receivable,

long-term or short-term contracts, freight contracts, and bank receipts proving

the payment).

9. Describe the GCC market during the period of investigation regarding the

ANNEX 1: CERTIFICATE

ANNEX 2: GLOSSARY

Antidumping agreement

The GCC Common Law on Anti-Dumping, Countervailing and safeguard measures

The GCC Common Law

Exporting a product to GCC Member States at less than its normal value in the ordinary course of trade for the like product in the exporting country.

Dumping:

Injury shall mean material injury to a GCC industry, threat of material injury to a GCC industry or material retardation of the establishment of such an industry.

Injury

Causal relationship between the dumped imports and the injury to the GCC industry. It should be determined on the basis of examination of all relevant evidence. The investigation authority will take actions only against the dumped imports which cause injury to the GCC industry. The injury caused by other factors must not be attributed to dumped imports.

Causal link

The price paid or payable for the product under investigation when sold for export from the exporting country to the GCC market

Export price:

The price paid or payable, for the like product in the ordinary course of trade when destined for consumption in the exporting country

Normal value:

The difference between the normal value and the export price during the period of investigation

Dumping amount:

Percentage of dumping amount relatively to the export price

Dumping margin

A fair comparison has to be made between the export price and the normal value. Due allowances have to be made in each case, on its merits, for differences which affect price comparability, including discounts, rebates and quantities, transport, insurance, handling, loading and ancillary costs, packing, credit, after-sales costs, commissions.

Adjustments

It shall be considered to be de minimis if the dumping margin is less than two percent (2), expressed as a percentage of the export price. In this case the investigation shall be terminated

Product under investigation:

GCC products which are identical or alike in all respects to the product under investigation, or in the absence of such a product, another product which, although not alike in all respects, has characteristics closely resembling those of the product under investigation

GCC Like products:

GCC Industry: Member States’ producers as a whole of the like products or those of them whose collective output of the products constitutes a major proportion of the total domestic production of those products. For the purpose of safeguard investigations, the term GCC industry shall mean total Member States producers as a whole of the like or directly competitive products operating within the territory of Member states, or those whose collective output of the like or directly competitive products constitutes a major proportion of the total domestic production of those products.

Combined markets of the GCC Member States.

Under relevant trade laws, transactions between affiliated companies are subject to particular scrutiny. Affiliated persons (affiliates) include (1) members of a family, (2) an officer or director of an organization and that organization, (3) partners, (4) employers and their employees, and (5) any person or organization directly or indirectly owning, controlling, or holding with power to vote, five percent or more of the outstanding voting stock or shares of any organization and the organization. In addition, affiliates include (6) any person who controls any other person and the other person, and (7) any two or more persons who directly control, are controlled by, or are under common control with, any person. “Control” exists where one person or organization is legally or operationally in a position to exercise restraint or direction over the other person or organization.
