The Managing Director, West Bengal Livestock Development Corporation Limited, LB-2, Sector-III, Salt Lake City, Kolkata–700 106, West Bengal, India, invites bids (in two bid system) from the Manufacturer/ Authorized Dealer/Distributor/Bona-fide Agency/Firm/Company for - MAKING AND SUPPLY OF SINGLE PAGE COLOURED WALL CALENDER, COLOURED DESK CALENDER AND DIFFERENT TYPES OF DIARY (EXECUTIVE AND SMALL DIARY) FOR THE YEAR 2020, REQUIRED FOR HEAD QUARTER, LB-2, SECTOR-III, SALT LAKE CITY, LAND MARK - NEAR 16 NO. WATER TANK, KOLKATA -700 106, WEST BENGAL, INDIA.

Rate along with delivery (F.O.R. destination), packing, insurance, loading, unloading, installation, commissioning and all other charges should be quoted against all individual items excluding GST. The GST to be quoted separately.

1) Earnest Money of Rs. 10,000/- (Rupees Ten thousand) only to be drawn in favour of - West Bengal Livestock Development Corporation Limited payable at Kolkata / Exemption Certificate is to be submitted in the office. The hard copy of the E.M.D. / Exemption Certificate is to be submitted in the office of the undersigned on or before 15.11.2019 up to 1:00 PM at LB-2, Sector-III, Salt Lake City, Kolkata- 700 106 along with a forwarding letter.

NO TENDER WILL BE ACCEPTED IF THE SAME IS NOT SUPPORTED WITH ALL THE ABOVE DOCUMENTS MENTIONED AT SL.NO. a) TO d) IN BID–A IN STATUTORY COVER.

Rate should be quoted NET in decimal coinage in figure inclusive of delivery (F.O.R. Destination) packing, insurance, loading & unloading charges, installation & commissioning etc. excluding applicable GST, if any, for supply of those articles throughout West Bengal and BOQ (Bill of Quantities) in financial Bid (BID-B) in the dedicated column for the year 2019-20.

THE OFFERED RATES SHOULD BE VALID FOR AT LEAST 1 (ONE) YEAR FROM THE DATE OF APPROVAL OF RATE, which may be extended for a year upon mutual discussion/agreement.

Technical proposal (BID-A) should contain statutory & non statutory document as described above. Financial proposal (BID-B) should contain the following documents in one cover (folder) i.e. Bill of Quantities (BOQ). The bidder is to quote the rates of items in the space marked for quoting rate in the BOQ.

Supply along with installation & commissioning is to be completed positively within 10 days or the time specified in the order from the date of issue of order.

After evaluation of Technical Bid, those who will qualify, their Financial Bid shall only be opened. The technical proposal (BID-A) will be opened. There is no need to be present of Bidders or authorized representatives in the office of the undersigned at the time of opening of the Technical Proposal (BID-A).

For further information, the bidders are requested to please contact the undersigned.

No Tender will be accepted across the table and no such receipt will be issued thereon.

In the event of any discrepancy between downloaded tender document and master copy of the same available in the office then the latter will be accepted & binding on the bidder. No claim will be entertained.

In case quoting the rate anywhere other than BOQ, the tender is liable to be summarily rejected.

All the tender documents including N.I.T., terms & conditions for submission of tender & B.O.Q. will be the part & parcel of the bid documents.

The undersigned reserves the right to reject any tender/all tenders at any stage without assigning any reason thereof.

The tender is to be submitted in two Bid System: One Technical Bid & other Financial Bid. The documents will get encrypted (transformed into non readable formats).

A. TECHNICAL BID : ‘BID-A’

(a) STATUTORY COVER containing the following documents:

RATE per unit as per list including excise duty, Incidental charges, i.e. delivery charges (F.O.R. destination), Installation, commissioning, packing, insurance, loading & unloading, and all other charges excluding of GST, to be quoted in the bill of quantities (BOQ) for supply.

The original Demand Draft towards Earnest Money Deposit (EMD) or documents in support of EMD exemption should be submitted. The original copies of EMD/Exemption Certificate along with Original Literature/Brochure/Technical Write-up of the quoted items should be submitted physicallytothe office of the West Bengal Livestock Development Corporation Limited, LB-2, Sector-III, Salt Lake City, Kolkata – 700 106 as per scheduled date & time under sealed cover before opening of Technical Bid (BID-A) through a forwarding letter in a sealed cover super scribing EMD of tender for.

No original EMD as well as any other technical documents will be accepted after closing date of submission.

EVALUATION OF TENDERS:

During the tender Evaluation Process, the Technical proposal (BID-A) will be opened first. Those bidders who will qualify the Technical proposal as described in BID-A containing Statutory / Non statutory documents including Literature/Brochure will be identified and only their Financial Cover (BID-B) shall be opened. The Financial cover (BID-B) will not be opened and will be summarily rejected if that Bidder fails to meet the technical requirements participating in the tender. The bidder offering the item rate if found suitable & as per the tender specification will only be selected.

Technical Evaluation of the Tender will be held on two parts, i.e. opening & evaluation of tender.

Opening of the Technical Proposal:

Technical proposal will be opened by the authorized officer of the undersigned. Cover (folder) for Statutory Documents and non statutory documents will be opened. If there is any deficiency in the Statutory

Documents the tender will summarily be rejected. Pursuant to scrutiny & decision of the Tender Evaluation Committee the summary list of eligible bidders will be submitted in

the tender documents. During evaluation the committee may summon of the bidders and seek clarification/information/demonstration or additional

documents or original hard copy of any of the documents already submitted and if these are not produced within the stipulated time frame, their proposal will be liable for rejection.

The Financial Cover (BID-B) of those bidders passing the technical requirements will only be opened. The sample may be examined by our technical experts before opening of the Financial Cover.

THE DECISION OF UNDERSIGNED/TENDER COMMITTEE WILL BE FINAL BINDING & ABSOLUTE IN THIS REPECT.TENDER PRE-REQUISITES

1. Copy of Original Trade License, PAN Card, GST Registration Certificate, Prof. Tax paid Challan / Clearance certificate (all valid up to 31.03.2019, EMD Exemption Certificate), Brochure of quoted items are required to be furnished along with the tender.

2. In no case, Affidavit of any Statutory/non-statutory documents will be accepted.3. Authorized dealer/ distributor may furnish documentary evidence to that effect along with offer will have to be documented as

mentioned in Statutory cover (BID-A).4. Legal document regarding appointment of agent/Stockiest/Distributor, if manufacturer or bidder wants to execute through

Agent/Stockiest/Distributor are to be documented as mentioned in Statutory cover (BID-A).5. In case the Bidder if exempted from GST/Sales Tax or if he enjoys the benefit of deferment, he must upload documentary

evidence to that effect in Non-statutory cover (BID-A) in place of GST.6. It is compulsory for the bidder to enclose their brochure/printed leaflet/Technical Write-up (NEITHER PHOTOCOPY NOR

CYLOSTYLED) for which rates are quoted to be documented as mentioned in Non-Statutory cover (BID-A).7. Prescribed Application Form duly filled in and signed & affix with the seal of the firm by indicating full communicating address

with PIN Code No. Telephone No./FAX/e-mail address/website etc., mentioning NIT No. is to be documented.

RATE

Rate(s) is /are to be quoted in BOQ (Bill of Quantities) in FINANCIAL COVER. Only one rate should be quoted for only one item/specification to be purchased.

Rate should be quoted in NET in decimal coinage inclusive of all incidental charges including delivery (F.O.R. destination) to the different units as mentioned in NIT, Installation, Commissioning, attachment, cabling, accessories, loading, un-loading, Insurance, etc. if any. The GST to be quoted separately.

Rates are to be quoted for each item as per the list.

1. Rates shall remain valid for a period of 1 (one) year from the date of approval and may be extended for 1 (one) more year upon mutual agreement.

2. Rates quoted which are not as per specification mentioned in the Tender will not be accepted.3. Under no circumstances enhancement of rate whatsoever will be accepted after closing of bid submission, whatever the

reasons given thereafter. Abnormally LOW RATE of any item(s) quoted by the Tendering Firm in the offer with some mala-fide intension will not be accepted, if detected.

4. The authority does not guarantee purchase of all the items and/or quantity mentioned in the NIT. Hence, rate should be quoted accordingly.

5. Bidder, if they desire so, may cite the Brand Name/Model Number etc.6. Rates should be quoted in terms of the Unit specified, rates quoted which are not as per specification will not be accepted.

Rates in no case shall excess the controlled price of any item in force at the time of submission of tender, if there by any.7. Quantity ordered is not likely to be enough to consider “AS TRUCK LOAD” and the bidder must effect supply/delivery of any

small quantity of order placed in favour of them.

VALIDITY1. Rate quoted will be valid for one year from the date of approval of rate by the Tendering Authority, if situation arise and within

the validity period, bidders must supply at the approved rate and refusal to supply will be dealt with as per Tender Rule.2. The validity period of rate may further be extended/curtailed at the discretion of the undersigned/Tender Committee at the

time of finalization of tender or after expiry of the period of validity.

LITERATURE1. Literature of the offered item must be produced along with EMD before the scheduled date & time. The sample may

have to be produced when asked for.

2. In case, Literature if approved, one set of such Literature shall have to be kept in with this Corporation during the tenure of tender. Supply should be made according to the approved Literature. Only valid Bidder’s sample will be examined.

3. Unapproved sample(s) will have to be taken back by the Bidder within one month from the date of submission of sample. The Authority will not take any responsibility/ liability for any loss/damage for the unapproved samples beyond that period.

4. Inspection of materials may be undertaken at the supplier’s premises whenever necessary by the Tendering Authority/any officer authorized by the undersigned.

5. In the event of non-submission of literature, it will be treated unwillingness/inability to supply and such tender will not be considered.

AGREEMENTThe successful bidder will have to enter into a contractual agreement with the Corporation in the standard format (already submitted along with NIT) embodying the tender terms & conditions in Non-judicial Stamp Paper worth Rs.10/- (Rupees ten) only to be provided by the successful bidder. Prescribed Agreement must be signed also by the Authorized Signatory of the Tendering firm concerned.

APPOINTMENT OF AUTHORISED DISTRIBUTOR1. THE TERMS DISTRIBUTOR IMPLIES AUTHORIZED /DISTRIBUTOR/DEALERS/ AGENT IN WHATEVER FASHION

ADDRESSED WHO SHALL FACILITATE THE PROCESS OF TAKING ORDER, ENSURING TIMELY SUPPLY AND COLLECTING PAYMENT ON BEHALF OF THE MANUFACTURER.

2. Firms located outside the State of West Bengal have to execute supply through their local branches of this State or Authorized Distributors/Agent/Dealers of this State.

3. If manufacturer or bidder wants to supply through distributor/dealer/agent/ stockiest, legal documents regarding appointment of distributor/dealer/stockiest is to be documented.

SECURITY MONEY DEPOSIT1. The successful bidder will have to deposit Security Money @ 5% (2% EMD+3%SMD) or Maximum Rs.15,000.00 (Rupees

Fifteen Thousand) ad-valorem shall be deducted and shall be returned after expiry of guarantee period from the date of satisfactory completion of work.

2. The Security Money will not carry anyinterest. This Corporation is not liable for deposition of excess Security Money.3. Security Money will be refunded after one year of satisfactory completion of the work. No proportionate refund of security

money will be allowed if the supplied quantity falls below the ordered quantity.

SUPPLY/DELIVERY1. The work to be completed strictly as per given schedule printed in the order. The schedule may be revised

(increased/decreased/temporarily postponed) by the indenting authority, depending upon requirement.2. The ordered item must be packed suitably to avoid any transit loss & weathering to maintain quality. The supply must

comport to the given specification in tender.3. Work must be commenced within specified time frame from the date of placement of formal order or the date as indicated in

the order.4. Supply will normally be accepted on all working days between 10.30 am & 5:00 pm. Successful bidder must provide the

requisite number of labour to store/install the materials in the respective store/places as will be indicated without any additional charges. No supply will be accepted on Saturday, Sunday & Govt. Holidays unless otherwise desired by the receiving authority.

5. IT IS OBLIGATORY FOR THE BIDDER TO NOTE THAT FAILURE TO MAINTAIN DELIVERY SCHEDULE FOR SUPPLY OF ORDERED ITEM WILL LEAD TO SEVERE DISLOCATION IN CARRYING OUT PUBLIC SERVICE FOR WHICH SUCCESSFUL BIDDER WILL BE HELD RESPONSIBLE & ACTION WILL BE TAKEN STRICTLY AS PER TENDER RULES LAID DOWN HEREIN WITHOUT ANY PREJUDICE. ANY SHORT OF PLEA WILL BE CONSIDERED, EXCEPT ANY INCIDENT OCCURRED ‘BY ACT OF GOD’ MAY BE CONSIDERED SYMPATHETICALLY.

6. Replacement of supply against any rejected consignment must be made positively within given time frame from the date of intimation, failing which action will be taken as per tender rule.

7. Training to the operator will have to be imparted free of cost.8. After sales support: Vendor should have their own service support in the district HQ as well as in Kolkata and must respond

to any call should be within 6 (Six) hours or within a reasonable time.9. On demand, the bidder will have to inform the details of service support network in due course.10. 3 (three) years of free AMC after expiry of warranty period. The AMC has to be given on quarterly basis.

PENAL MEASURE1. The earnest money deposit furnished by a firm will be liable to be forfeited in full (Including excess amount of earnest money,

if deposited), if the firm withdraws tender as a whole or for any particular item at any stage during the tenure of tender or

fails/refuses to enter into written agreement once the rate for any/all items(s) is/are accepted within the time specified when requested to do so by this Corporation and/or refuses to deposit security money. Such firm’s offer will not be taken into consideration in future & shall liable to be black listed for 3 (three) years.

2. The security money deposit furnished by a bidder is liable to forfeit in full (including excess amount of security money, if deposited) along with cancellation of order without prejudice in the event of failure/refusal to maintain the delivery schedule and/or non-observance of terms & conditions of tender and/or contracted specification and/or quality/quantity and the authority will be at liberty to terminate the contract as a whole or part.

3. The price, at which the bidder sells the products of identical description to any other Govt. Directorate, Organization etc. shall not exceed the quoted rate. If such incident of quoting higher rate comes to the notice, the authority reserves the right to initiate legal/penal action against such firms.

4. In case, delivery programme is not followed & the competent authority is compelled to procure the ordered articles from the open market at a higher rate than the accepted price in tender, in that case the excess cost incurred on the account will have to be borne by the firm which will be deducted from their outstanding bill apart from forfeited of Security Money in full. Besides, failure to maintain the delivery schedule/stoppage of supply may lead to termination of contract along with forfeiture of Security Money Deposit in full and such firms shall liable to be Black Listed for 3 (three) years.

5. In consequence of submission of false or fabricated documents by any firm/ company for participating in the tender, if proved later on shall liable to be Black Listed for 3 (three) years.

6. Quoting absurdly high or low rate in opinion of tender selection committee, with the intention to vitiate the tender process will be dealt with in the context of NPPA norms or any other norms under Govt.PAYMENT:

1. Any request for Advance Payment will not be entertained.2. Tax Invoice against all supplies is/are to be sent in TRIPLICATE and should invariably be submitted along with receipted

challan duly signed with office seal.3. 70% of Payment shall be made after delivery of items for executing the order satisfactory in all respect and rest 30% of

payment will be made after commissioning and satisfactory demonstration to the authority. However, no interest shall be paid to the firm, if the payment is delayed due to whatsoever reasons. In no circumstances, delivery schedule should be affected & or linked with the payment of outstanding bills. The payment of bills shall be with held in case of violation of any tender terms & conditions.

4. No arbitration for the work will admissible, any mobilization/secured advance will be allowed.5. Irrevocable performance bank guarantee amounting 70% of the project value to be drawn in favour of - West Bengal

Livestock Development Corporation Limited.

MISCELLANEOUS

1. Tender pre-requisites such as Earnest Money Deposit, Trade License, etc. will not be accepted after scheduled date & time more clearly described in the time programme.

2. Conditional tenders & tenders not accompanied with the documents as mentioned above shall be summarily rejected without any reference made to the bidder and no correspondence will be entertained.

3. In case of products with Brand Name, the Tendering Firm is required to mention the Brand Name/Model Number against each item. In case, I.S.I. Marked products, the Tendering Firm have to produce License of manufacturing from B.I.S.

4. The offer may go to the next bidder, if the successful bidder fails to perform the contract.5. No negotiation/enquiry/subsequent representation regarding rate/quantity/quality or otherwise will be entertained after closing

of Bid submission Tender.6. No import License, any sort of permit, etc. in respect of any item will be provided from this Corporation and the Tendering

Firm should have relied on their own resources.7. Latest guidelines pertaining to purchase of stores issued by the Govt. of West Bengal will be followed provided that there is

no specific instruction of the Tender Committee in the regard.8. The undersigned reserved the right to reject any or all of the tenders at any stage without assigning any reason

thereof.9. Any dispute/difference arising out of this Tender will be referred to the sole arbitrator, the Secretary, ARD Dept., Govt. of

West Bengal or any other Officer appointed/authorized by him but not below the rank of Asstt. Secretary and the same will be held at Kolkata. Arbitrator will have the power to pass interim order award and will be guided by the Arbitration & Conciliation Act, 1996.

10. When a bidder submits their tender in response to this Notification, they will be deemed to have understood fully the contents, the requirement, terms & conditions of this tender. No extra payment will be made on the pretext that the bidder did not have a clear idea of any particular point. Any offer made in response to this tender when accepted by the Tendering Authority will constitute a contract between the parties.

11. Non-compliance to any terms & conditions laid herein shall constitute a breach of contract and penalty for non-compliance shall be enforced very rigidly.

12. Appointment to more than two agents/stockiest/distributors/dealers for whole of this State will not be accepted. Bidders may also supply directly by cancelling appointment of agents/stockiest/distributors/dealers, if they so desire for which no prior permission of this Corporation is necessary.
