3. APPLICATION AND APPROVALS REQUESTED

Ontario Energy Board

IN THE MATTER OF the Ontario Energy Board Act, 1998, S.O. 1998, c. 15 (Sched. B), as

amended (the “OEB Act”);

AND IN THE MATTER OF an application by Imperial Oil Limited under section 90(1) of the OEB

Act for an order granting Leave to Construct of a hydrocarbon distribution pipeline and ancillary

facilities to serve the Greater Toronto and Hamilton Area;

LEAVE TO CONSTRUCT

APPLICATION: WATERDOWN TO FINCH PROJECT

1. The Applicant, Imperial Oil Limited (“Imperial”) is a body corporate duly formed pursuant to the laws

of Canada having an office in the City of Calgary. Imperial is an integrated energy company that

explores for, produces, refines and markets products essential to society. At every link in the energy

chain, Imperial seeks to advance innovation and technology to deliver energy Canadians need – with

a commitment to high standards. Imperial was founded in Ontario in 1880 and, after more than a

century, Imperial continues to be part of the community and economy.

2. Operating safely for many decades, Imperial’s Sarnia Products Pipeline (“SPPL”) is important

infrastructure that provides refined products used by households and businesses across the Greater

Toronto and Hamilton Area. To support continued safe, reliable, and environmentally responsible

transportation of products, Imperial is planning to construct and operate a new pipeline that will

replace the transportation capabilities of the existing SPPL.

3. Imperial hereby applies (“Application”) to the Ontario Energy Board (“OEB”), pursuant to section 90(1)

of the OEB Act for Leave to Construct (“LTC”) the Waterdown to Finch Project (the “Project”). The

Project involves the proposed installation of approximately 63-kilometres of 12-inch diameter pipeline

and associated infrastructure between Imperial’s pump station in rural Hamilton (Waterdown Pump

Station) and its terminal storage facility in Toronto’s North York area (Finch Storage Terminal). To

accommodate reliable supply of products throughout this process, the Project involves the

construction of the new pipeline while the existing pipeline continues to operate. Once the new

pipeline is successfully installed, the existing line will be safely deactivated and the new pipeline will

operate in its place.

4. The new pipeline will be constructed following the existing SPPL as closely as possible, in

consideration of environmental and social constraints, and other infrastructure and land uses in the

area. The existing pipeline is located within an Imperial right-of-way (“ROW”) for approximately 18.8

km, and within a ROW managed by Hydro One Networks Inc. (“HONI”) for approximately 43.7 km.

New easements will be required on a limited number of private lands and Imperial will work directly

with the affected landowners to obtain these agreements. New easements will also be required within

the HONI ROW, and Imperial is working with HONI and Infrastructure Ontario to secure the

necessary agreements. Pipelines owned by other operators inside the ROW will continue to operate

without disruption as crossing agreements and safety buffers will be put in-place.

5. Pending LTC approval receipt of permits and agreements, Project construction is planned from

December 2019 to November 2020. The purpose, need, description of the Project and project timing

are included in Exhibit C, Tab 1, Schedule 1. An overview map showing the proposed route is

included in Exhibit C, Tab 1, Schedule 2 filed with this Application.

6. Imperial has planned the Project pursuant to the OEB’s Environmental Guidelines for the Location,

Construction, and Operation of Hydrocarbon Pipelines and Facilities in Ontario, 7th Edition (2016)

(“Environmental Guidelines”). The Environmental Report (“ER”) is a component of the LTC

application to the OEB and has been prepared to satisfy the OEB’s Environmental Guidelines. The

primary objective of the ER is to describe the actions taken to date to confirm the location, or route,

for the pipeline and the related construction methods and activities, considering the physical,

environmental, socio-economic, archaeological, and cultural heritage (i.e. the environmental and

socio-economic) conditions and to minimize or mitigate potential risks.

7. The route evaluation and decision are supported by desktop studies, existing survey information,

environmental, and socio-economic field surveys, consultation with regulators and other stakeholders,

and constructability design review. Because the Project will be sited within an existing Imperial

easement from kilometre post (“KP”) 0 to KP 18.8, an alternative route was considered only within the

urban area from KP 18.8 to KP 62.5. This alternative route underwent detailed review, but was

deemed not feasible because in comparison to the proposed Project route, it was significantly longer,

and crossed nearly twice as many watercourses and three times as many wetlands and impacted

more infrastructure and current land uses. It was determined that the proposed pipeline route is the only

reasonable option, particularly within the urban landscape, because it benefits from following the existing

utility corridors. The ER and routing evaluation is included in Exhibit D, Tab 1, Schedules 1 and 2, as

evidence to this Application.

8. Imperial recognizes the importance of engagement, which is an integral part of the Project’s planning

and supports the public interest consideration of the OEB’s regulatory process. Imperial identified and

engaged a broad range of interested parties – stakeholders, government regulatory agencies,

landowners and Indigenous communities – with a potential interest in the Project. Exhibit A, Tab 2,

Schedules 3 and 4 provides the list of Ontario Pipeline Coordinating Committee (“OPCC”) members

and the list of interested parties, respectively. Exhibit D, ER, Section 3 explains the engagement plan

implemented for the Project, the engagement activities carried out, comments received, and

responses provided by Imperial. Exhibit H, Record of Consultation and supporting documents,

includes a record of the consultation log and detailed supporting documents such as related

correspondence and meeting minutes.

9. With respect to Indigenous consultation, the Ministry of Energy, Northern Development and Mines

(“MENDM”) - Indigenous Energy Policy provided the Crown's direction on the duty to consult.

MENDM provided a letter dated Sept. 10, 2018 delegating the procedural aspects of the Crown's duty

to consult to Imperial (“Delegation Letter”), and included a list of Indigenous communities that should

be consulted about the Project, as follows:

o Huron-Wendat Nation;

o Mississaugas of the Credit First Nation (“MCFN”); and

o Six Nations of the Grand River;

the MENDM's Delegation Letter noted that Imperial is required to consult with both Six

Nations Elected Council; and

Haudenosaunee Confederacy Chiefs Council (“HCCC”), and all correspondence with the

HCCC should copy the Haudenosaunee Development Institute (“HDI”).

10. In addition, while Métis Nation of Ontario (“MNO”) was not listed in the Delegation Letter, Imperial

identified MNO as an Indigenous community to be informed of the Project for engagement and

provided notification to MNO. Imperial has followed the guidance of the MENDM and has prepared an

Indigenous Consultation Report to document the consultation activities with communities. The

correspondence letters related to the MENDM’s direction on the duty to consult and Imperial’s

submission of the Indigenous Consultation Report are included in Exhibit G as evidence to this

Application.

11. Exhibit E includes details on project design specifications, construction methodologies, pressure

testing procedures and key milestones.

12. Exhibit F includes a summary of land matters, negotiations to-date and a description of land related

permits and agreements required and copies of draft agreements to be offered to affected

landowners, where the need for an easement arises (Agreements are located in Exhibit F, Tab 1 and

Schedules 4 and 5). A redacted land list in Exhibit F, Tab 1, Schedule 6 describing the parcels is

included and filed as a hardcopy in accordance to OEB’s rules on confidentiality.

13. Imperial is a non-rate regulated private enterprise and the Project is financed by Imperial. There are

no cost impacts on ratepayers. Therefore, disclosure of project costs and an economic feasibility

assessment are not applicable. No exhibit supporting information is required relating to project costs

and economic feasibility assessment.

14. Imperial requests that this Application proceed by way of a written hearing in English.

15. Imperial requests that the OEB make the following orders:

(1) an order pursuant to section 90 of the Ontario Energy Board Act granting Leave to Construct

the pipeline; and

(2) an order pursuant to section 97 of the Ontario Energy Board Act approving the proposed form

of easement agreements found in Exhibit F, Tab 1, Schedules 4 and 5.

2. MENDM provided the Crown’s direction and delegated the procedural aspects of the duty to consult

to the following list of Indigenous communities that should be consulted about the Project:

o Mississaugas of the Credit First Nation (“MCFN”); and

the Ministry’s delegation letter noted that Imperial is required to consult with Six Nations

Elected Council; and

Haudenosaunee Confederacy Chiefs Council (“HCCC”), and all correspondence with the

HCCC should copy the Haudenosaunee Development Institute (“HDI”).
