From Bloomberg Businessweek: [1] What Fair Debt Collection Practices Act? “On the night of Jan. 27, a Molotov cocktail crashed through the window of a house in the central Russian city of Ulyanovsk, badly burning a toddler. Prosecutors charged a 44-year-old man with the firebombing, saying, he had threatened the child’s grandfather over past due payments on a 4,000-ruble ($51) loan . . . As Russia’s economy falters, its citizens are sinking deeper into debt - and bill collectors are going after them with vehemence. In re-cent months, collection agents have been charged with assaulting debtors, vandalizing their cars, even destroying baby carriages parked outside apartments. A preschool in southern Russia was evacuated in December after a caller threatened to attack the building unless an employee paid a debt owed by her husband . . . Outrage over such tactics has spurred calls for tougher regulation; social media sites have emerged where victims can post stories with photos and videos documenting harassment . . . Russians went on a borrowing spree as their economy recovered from the 2008 global financial crisis. Total consumer debt more than doubled . . . with the economy in recession, about 10 percent of consumer debt is in arrears, including an overdue rate of more than 25 percent on debt to payday lenders, ac-cording to the credit bureau. (Only 4 percent of mortgage loans are in the arrears.) . . . Pay-day lenders offer short-term unsecured loans, often with interest compounded dai-ly.” (Article by Carol Matlack and Anna Andrianova; [2] “Robert Murphy is 65 and broke . . . Four years ago, hoping for a fresh start, he declared bankruptcy. But there’s one debt he hasn’t been able erase: the $246,500. he amassed paying for his three children to attend college. From 2001 to 2007, Murphy took out 12 Parent PLUS loans originally valued at $220,765. Like those made directly to students, Parent PLUS loans are federally backed and almost impossible to discharge - that is, to be forgiven. The total outstanding education loans held by people 65 and older, including debt that financed their own schooling and their children’s, grew to $18.2 billion in 2013, the most recent year available from the U.S. Government Accountability Office (GAO), from $2.8 billion in 2005. That’s twice as fast as the overall growth in student debt. The number of borrowers age 60 and up has increased to 2.2 million, from 700,000 in 2005, according to the Federal Reserve Bank of New York. Twenty-seven percent of education loans held by people age 65-74 were in default in 2013, meaning they hadn’t made a payment in 270 days or more. More than half of education loans held by people 75 or older were in default. And the government can garnish wages or suspend tax refunds for anyone who fails to pay their student loans, but it has an extra tool when it comes to senior citizens: taking money out of their Social Securi-ty payment. In 2013, 155,000 seniors lost part of their retirement benefit to repay educa-tion debt, up from 31,000 in 2002, according to the GAO. ‘There’s no statue of limitations, so these loans go with you to your death,’ says John Rao, a lawyer with the National Con-sumer Law Center, a consumer rights nonprofit. ‘That makes it different for someone who is elderly who might think at a certain point in their life they are immune from collec-tions.’” (Article by Natalie Kitroeff ); [3] “The destruction of a mausoleum cannot com-pare to the rape and murder of innocents. stand trail. The idea that the intentional destruction of culturally valued property is a war crime isn’t new. This case would mark the first time such an act is the main charge in a war crimes tribunal. The seriousness of the crime is beyond doubt. The purpose of de-stroying cultural heritage is to eliminate all the attachments of a people under attack - to obliterate not only one’s enemies, but also any trace of their existence. As the court’s prosecutor made clear in her opening statement, at stake is more than simply ‘walls and stone.’ The accused was attempting to ‘destroy the roots of the entire people’ . . . The court has been accused, not without reason, of irrelevance, incompetence and unfairness. It’s possible that this case will show it’s not too late for it to serve the vital purpose for which it was established almost 14 years ago • • From an editor ial which appeared in The Wall Street Journal: [1] “Justice Scalia’s death has propelled a wave of compa-nies to fold and preemptively settle with the trail bar, including Dow Chemical’s $835 million disposition of an antitrust class action. The dispiriting Apple denouement is an-other reminder of how important his replacement on the High Court will be.”; [2] “Harvard Law School will no longer use a seal with the crest of an 18th century slavehold-er who played a key role in the school’s history, following calls for the image’s ouster by students and professors. Harvard University’s governing body said in a letter Monday to Harvard Law Dean Martha Minow that it agreed with a recommendation by a committee of professors, alumni and students to stop using the seal. At the same time, the letter said, ‘the school will actively explore other steps to recognize rather than to suppress the reali-ties of its history.’ . . . The seal in question, first introduced in 1936, depicts the family crest of Isaac Royall, Jr., a sugar plantation owner who gave land to Harvard that was used to fund the school’s first endowed law professorship . . . Not everyone on the com-mittee agreed with the recommendation.
