OBITER DICTUM “. . . A patent issued to Allstate mentions using sensors and cameras to record ‘potential sources of driver distraction with the vehicle (e.g. pets, phone usage, unsecured objects in vehicle).’ It mentions gathering information on the number and types of passengers – whether adults, children or teenagers. And the insurer, based in suburban Chicago, isn’t just interested in the motoring habits of its own policyholders. Underscoring companies’ interest in collecting and analyzing information on you, known as big data, the patent envisions gathering information on nearby cars so it can compare its policyholder’s habits to other motorists in the area. The patent, called ‘traffic-based driving analysis,’ is for a server that will receive driving behavior data from sensors, cameras and other devices. ‘So my car spies on me and on other drivers near me?’ Bob Hunter, insurance director for the Consumer Federation of America and a former Texas insurance commissioner, said upon reviewing the patent. ‘Even if I give permission for this intrusive technology, my car spies on unsuspecting passengers and even on unsuspecting pedestrians or cars passing by?’ Hunter wondered about the ‘liability for that intrusiveness’ as well as the potential to pick up such sensitive data . . . It’s at least the second patent in recent months that the insurer has been issued related to connected cars. In June, Allstate received a patent for a driving behavior database it said might be useful for health insurers, lenders, credit rating agencies, marketers and potential employers. That patent said the invention has the potential to evaluate such physiological data as heart rate, blood pressure and electrocardiogram signals that could be recorded from steering wheel sensors. In May, Allstate floated the idea of possibly selling policyholders’ driving data and in doing so held up Google as Exhibit A . . .” From an article which appeared in the Pittsburgh Tribune-Review ● ● From The Wall Street Journal : [1] “Attacks leveled on the Supreme Court recently by some GOP presidential candidates are a natural part of the political discourse, Justice Stephen Breyer said, adding the high court is fair game for debate. ‘In America, everything is a political issue,’ he said in a recent interview, noting that the court long has been a central one. ‘In my own lifetime, think of the ‘Impeach Earl Warren’ signs,’ he said, recalling billboards that sprouted across the South after Chief Justice Warren’s 1954 opinion against school segregation. ‘Judges are sometimes wrong. I’m not saying any particular case is right or wrong, but we’re human and when it’s 5-4, obviously somebody’s wrong,’ Justice Breyer said. Sen. Ted Cruz (R., Texas), a former Supreme Court litigator and law clerk to the late Chief Justice William Rehnquist, says the justices should face retention elections. Former Arkansas Gov. Mike Huckabee, who has suggested defying a June ruling recognizing same-sex marriage, said last week he has developed ‘a detailed plan to stop this out-of-control Supreme Court.’ Justice Breyer suggested such lively discussion of the court is to be expected. ‘Nobody’s above debate,’ he said. ‘I would prefer the debate be civil, always – I’m not thinking of any particular [candidate ]– but debate is a good thing.’ Republican presidential contenders also have castigated the high court for affirming that Affordable Care Act insurance subsidies are available nationwide. Justice Breyer’s remarks come with the launch of his book ‘The Court and the World,’ which seeks to refute one particular complaint from the right – that U.S. courts have dangerously looked for guidance from abroad. In recent years, several states have weighed or adopted measures forbidding their judges from citing foreign sources. In

IN THE COURT OF COMMON PLEAS OF WASHINGTON COUNTY, PA CIVIL DIVISION

IN RE: WASHINGTON COUNTY ORPHANS’ COURT LITIGATION MEDIATION PROGRAM

ADMINISTRATIVE ORDER AND NOW, this 19th day of November, 2015, pursuant to the Washington County Local Orphans’ Court Rule of Procedure 1.4, it is hereby ORDERED that for cases submitted to the Orphans’ Court Litigation Mediation Program, each party shall be required to pay a mediation fee of $300.00, made payable to the County of Washing-ton, and submitted to the Office of the Court Administrator for processing. It is further ORDERED that the Washington County Controller shall collect an admin-istrative fee in the amount of $50.00 from each case submitted to the Mediation Pro-gram. The mediator may elect to have the remaining mediation fee be paid directly to him/her, made payable to the mediator’s firm, or donate the fee to the Washington County Bar Foundation. L-1.4 WASHINGTON COUNTY ORPHANS’ COURT MEDIATION PROGRAM

a. Cases filed in the Orphans’ Court division may be ordered into the

Orphans’ Court Mediation Program by the judge to whom the case is assigned.

b. The mediators shall be practicing attorneys that are members of the Washington County Bar Association, with an emphasis in their prac-tice on Orphans’ Court matters. A list of mediators shall be main-tained by the District Court Administrator, and selected by the Court in consultation with the Washington County Bar Association.

c. Upon appointment, the mediator shall schedule the mediation within sixty (60) days of the order of court. The attendance of lead counsel, the parties, and a representative, including an insurance carrier, with authority to enter into a full and complete compromise and settlement is mandatory. If lead counsel, the parties, or a representative fail to appear absent good cause, the mediation will not be held and sanc-tions shall be entered against the non-appearing individual(s) by the Court upon request of the mediator. Sanctions may include an award of reasonable mediator and attorney’s fees and other costs.

d. At least ten (10) days prior to the mediation, each party shall file a mediation statement which must include the following: (1) a succinct explanation of the facts and relief sought; (2) significant legal issues that remain unresolved; (3) summary of medical and expert reports (if applicable); (4) itemized list of damages; and (5) settlement pos-

ture and rationale. Failure to file a mediation statement may result in sanctions if requested by the mediator.

e. Each party to a case selected for mediation shall pay a mediation fee to be made payable to the County of Washington and submitted to the Office of the District Court Administrator for processing. The mediation fee shall be set by administrative order, and information regarding the fee shall be available in the Office of the District Court Administrator.

f. If the case has not been resolved, within ten (10) days from the date of the mediation, the mediator shall send the Court a report setting forth the mediator’s assessment of the case and the mediator’s recom-mendation regarding settlement A copy of the report shall be provid-ed to and maintained by the District Court Administrator until the case is closed.

g. If the case is resolved and a settlement agreed upon, the mediation shall send a letter to the Judge, with copies to counsel and the District Court Administrator.

h. The mediator shall not be subpoenaed or requested to testify or pro-duce documents by any party in any pending or subsequent litigation arising out of the same or similar matter. Any party, person, or entity that attempts to compel such testimony or production shall be liable and indemnify the mediator and other protected participants for all reasonable costs, fees and expenses. The mediator shall have the same limited immunity as judges pursuant to the applicable law as it relates to Common Pleas Judges.

i. Notwithstanding the preceding subsections the Court may in its dis-cretion set a case for an alternative dispute resolution (“ADR”) be-fore a private mediator. The method of selection of the private medi-ator shall be in the discretion of the Court. All parties shall bear equally the costs of any Court-ordered private mediation; provided, however, that the Court will take appropriate steps to assure that no referral to ADR results in an unfair or unreasonable economic burden on any party.

Note: When selecting a case for ADR before a private mediator, the Court should con-sider various criteria, including the nature of the claims involved and their complexity, whether any of the litigants is pro se, the potential for a successful resolution, and the interests of justice. (1) The method of ADR shall be addressed to the discretion of the private mediator. (2) The fact that a case is selected for ADR shall not delay the sched-uling of any matter in the case. (3) Nothing in this rule shall prevent the parties from voluntarily en-gaging in ADR before a private mediator on their own initiative.

L-810 WASHINGTON COUNTY CIVIL LITIGATION MEDIATION PROGRAM

a. Cases listed for trial shall be submitted to the Washington County

Civil Litigation Mediation Program. This rule shall not apply to asbestos cases, cases ordered to private mediation under this rule, or medical malpractice cases.

b. The mediators shall be practicing attorneys that are members of the Washington County Bar Association, with an emphasis in their practice on civil litigation. A list of mediators shall be maintained by the District Court Administrator, and selected by the Court in consultation with the Washington County Bar Association.

c. The District Court Administrator shall select the cases for mediation from the combined civil trial lists, with preference given for the oldest cases by date of filing. The Court may also at its discretion refer a case to mediation once it is placed on the trial list. The selec-tion of a case for mediation shall not delay any scheduled trial of the matter.

d. Upon appointment, the mediator shall schedule the mediation within sixty (60) days of the order of court. The attendance of trial coun-sel, the parties, and a representative, including an insurance carrier, with authority to enter into a full and complete compromise and settlement is mandatory. If trial counsel, the parties, or a representa-tive fail to appear absent good cause, the mediation will not be held

1. This requirement shall be deemed satisfied if a

party has previously filed a pre-trial statement pursuant to Washington County Local Rule 212.2, in which case the mediation statement shall only provide updated or additional infor-mation.

2. Failure to file a mediation statement may result

in sanctions, if requested by the mediator.

f. Each party to a case selected for mediation shall pay a mediation fee to be made payable to the County of Washington and submitted to the Office of the District Court Administrator for processing. The mediation fee shall be set by administrative order, and information regarding the fee shall be available in the Office of the District Court Administrator.

g. If the case has not been resolved, within ten (10) days from the date

of the mediation, the mediator shall send the Court a report setting forth the following information: (1) Plaintiff’s final settlement de-mand; (2) Defendant’s final settlement offer; (3) the mediator’s as-sessment of liability; (4) the mediator’s assessment of damages; (5) the mediator’s opinion regarding the potential range of a verdict and the settlement value of the case; and (6) the mediator’s recommenda-tion regarding settlement of the case. A copy of the report shall be provided to and maintained by the District Court Administrator until the case is closed.

h. If the case is resolved and a settlement agreed upon, the mediator shall send a letter to the Judge, with copies to counsel and the District Court Administrator.

i. The mediator shall not be subpoenaed or requested to testify or pro-

duce documents by any party in any pending or subsequent litigation arising out of the same or similar matter. Any party, person, or entity that attempts to compel such testimony or production shall be liable and indemnify the mediator and other protected participants for all

Explanatory Comment

This local rule reflects the strong judicial policy in favor of parties voluntarily settling lawsuits expressed by the Supreme Court of Pennsylvania in Rothman v. Fillette, 469 A.2d 543 (Pa. 1983). The use of Court-directed ADR processes reduce the expense of litigation and often times leads to a quicker and more satisfying alternative when com-pared to continuing on a more traditional path of litigation. An ancillary benefit to ADR is the potential of reducing the burden on the finite resources of the Court.

Congress, more than a dozen House Republicans are sponsoring a bill to bar federal courts from deciding any issue ‘in whole or in part on the authority of foreign law,’ unless required to do so by Congress or the Constitution. Justice Breyer, appointed by President Bill Clinton, said he understands fears that American values could be watered down. ‘One object of this book is to show to the contrary, to preserve those values . . . it is necessary to learn what’s going on abroad and to deal with the kinds of problems I present.’ . . .” (Article by Jess Bravin); [2] “A federal appeals court is set to decide whether judges can tear up corporate prosecution agreements they deem too lenient, in a case that Justice Department officials fear will disrupt the agency’s deals with companies under criminal investigation. Deferred prosecution agreements have been the Justice Department’s preferred means for punishing large companies without leaving the scar of a criminal conviction, but judges, who must approve such deals, have become increasingly skeptical of them. DPAs allow companies to avoid prosecution by paying a fine and submitting to certain conditions for a period of probation, after accepting responsibility for wrongdoing. In February, a federal district judge in Washington, D.C., rejected a DPA he considered weak in a case involving Fokker Services BV, a Dutch aerospace firm accused of making more than 1,000 illegal shipments to Iran and other sanctioned countries from 2005 to 2010. The U.S. Court of Appeals for the D.C. Circuit is now reviewing the judge’s decision, with arguments scheduled for this week and a ruling expected in coming months.
