Loose wire heating system

The Warmup loose wire system is suitable for tile, carpet, vinyl, wood, stone and ceramic floors and ideal for quick and easy installation in irregular shaped areas with our plastic fixing guides.

At 3.4 watts per linear foot, a standard 3” spacing will provide a heat output of 14 watts per square foot.

Mat heating system

The Warmup mat heating system is ideal for tile, carpet, vinyl, wood, stone and ceramic tile floors. The system is made up of advanced fluoropolymer insulated heating strands that are pre-spaced on to a thin fibreglass mesh to give an even and consistent heat output. This system is ideal for larger regular shaped rooms.

The cut & turn foil panel by Warmup is an ultra thin electric radiant floor heating system designed for use under carpet, laminate, cork, engineered wood and other floating floors.

It can be conveniently installed under the floor finish in both dry and wet areas without the need for additional earth grids.

In-slab heating system

Warmup in-slab heating cable is excellent for installation within a concrete slab of any size. Once installed, the heated slab can be covered with any flooring type, including hardwood, vinyl, flagstones and more. The in-slab system is ideal for primary heating in conjunction with a suitable thermal block below the cable. The programmable thermostat can be set to utilize off-peak electricity making this application a perfect energy efficient thermal storage system.

The 3iE™ energy-monitoring thermostat is the world’s first fully interactive, touch technology floor heating thermostat.

The Warmup 3iE™ is also the first programmable thermostat to come with Active Energy Management™, which can save you up to 10% on your energy bills by actively prompting you to use lower energy consumption levels.

The Warmup floor heating programmable thermostat WUDG is a digital thermostat with four (4) easy-to-program on/off settings per day. The master thermostat can be combined with one or more relays to heat large areas.

Warmup insulation board (WIB) is made of waterproof extruded polystyrene with a fiberglass mesh embedded on each face into a cement polymer adhesive.

Warmup insulation board (WIB) is approved for installation over all subfloor types and is suitable to provide insulation under most flooring material.

Easy to cut with a knife, it installs to any surface and with its excellent load-bearing it is ideal for thinset and tiles. Free of harmful asbestos, this board poses no health or safety risks and is unaffected by the freeze/thaw cycle.

Snow melting system

Warmup snow melting mats and cables are uniquely designed for snow melting in parking lots, driveways, pavements, stairs and more. The cable has a layer of shielding and insulation, suitable for low temperatures, is UV resistant and environmentally friendly, making it ideal for outdoor use.

Can be installed under asphalt, concrete or pavers. The dual core cable has an output rating of 50W/sq ft, at 3” spacing.

Warmup self-regulating cables are ideal for keeping roofs, gutters and pipes snow and ice free in all commercial and residential applications.

Outdoor controllers

The Warmup all-in-one sensor/controller (USASE-DS2/5) has a built-in sensor (external sensor for DS8) to automatically activate the heating system. It is ideal for projects like stairs and driveways.

The Warmup snowmelt thermostat (USET02) is used for multiple-zone projects such as a combined roof and ground application. The system automatically activates via readings from temperature and moisture sensors.

The Warmup line voltage thermostats (TF115 and TRF115-005) is perfect for small and medium sized jobs. The devices come with a 5 ft remote capillary sensor (TRF115-005) or a control-mounted sensor (TF115) which activates heating cables on Roof & gutter applications or in Pipe freeze protection applications.

1. APPLICATION OF TERMS AND CONDITIONS OF SALE The following terms and conditions shall govern the sale by Warmup Inc. (Canada) (“Company”) of orders for resistive wire, foil under floor heating, ice & snow melting, self regulating cables and all associated components, controllers and thermostats for correct operation (hereinafter “Products”) sold to Customers (located in Canada (hereinafter “Customer”).The Customer agrees to be bound by and accepts these Terms and Conditions of Sale (referred to throughout as “Terms and Conditions”). Warmup Inc. (Canada) reserves the right to add, delete or amend these Terms and Conditions without prior written notice at any time, at Company’s sole discretion.“Customer” means any person or company ordering Products from the Company.“Third Party Products” means any component, accessory or item that is not branded Warmup but is offered for sale by the Company“Warmup Products” means any resistive wire, component or thermostat supplied by the Company that is branded with the Warmup trademark and is offered for sale by the Company. “Products” means collectively both Warmup Products and Third Party Products sold by the Company.“Contract” means any contract between the Company and the Customer for the sale and purchase of Products, incorporating these conditions.

2. QUOTESSubject to the terms contained in this section, any quotation provided by the Company will be valid for the duration stated in the quotation. If no duration is stated, such quotation will be valid for 30 days unless it is withdrawn.Although the Company strives to provide accurate product and pricing information, errors or misprints may occur. The Company cannot confirm the price of a Product until after you order the Product. Notwithstanding anything contained in this section 2, in the event that a Product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, the Company has the right, at our sole discretion, to refuse or cancel any orders, or part of an order placed or subsequently processed by the Company for that Product and terminate the purchase agreement without further liability. In the event that a Product is priced in error or a Product information error occurs, the Company may, at our sole discretion, contact you for instructions, cancel your order and notify you of such cancellation, terminate the purchase agreement and/or correct the error on our web site.

3. DESCRIPTION3.1 The quantity and description of the Goods shall be as set out in the Company`s quotation or acknowledgement of order.3.2 All samples, drawings, descriptive matter, specifications and advertising issued by the Company and any descriptions or illustrations contained in the Company’s catalogues or brochures are issued or published for the sole purpose of giving an approximate idea of the Products described in them. They shall not form part of the Contract and this is not a sale by sample.

4. PAYMENT TERMSPayment shall be made by credit card or some other pre-arranged method of payment acceptable to the Company. Where payment is made by credit card, such payment is subject to the approval of the financial institution issuing the credit card and the Company shall not be liable in any way if such financial institution refuses to accept or honor the credit card for any reason. If the Customer has an active credit account, the Customer may enter into a Contract to purchase Product from the Company using the credit account provided that it is in good standing and all prior payments are up to date.

5. PRODUCT AVAILABILITYProduct availability may be limited. Products ordered may not be available for immediate delivery. The Company reserves the right, without liability or prior notice, to revise or cease to make available any or all Products. If there are any revisions to or cessation of Products, Warmup Inc. may, with the Customer’s consent, ship Products which have similar functionality and specifications to the Products originally ordered. Customers will be given the opportunity to either reject or accept the substitute Product and price for the substitute Product which may differ from the price of the original Product.

6. PRICES, SHIPPING AND HANDLING CHARGES AND APPLICABLE TAXESWarmup Inc. (Canada) will only ship to Canadian locations. Products shipped may not be re-routed by the Customer. Prices quoted for the Product do not include charges for shipping and handling. A separate charge for shipping and handling will be shown separately on the invoice if applicable. Sales taxes will be charged at the prevailing rate for each Province unless the Customer provides a valid and correct tax exemption certificate applicable to the order’s ship to location, prior to the Company’s acceptance of the order.

7. TITLE AND RISK OF LOSS OR DAMAGE; DELIVERY Title in the Product and risk of loss shall pass to Customer and acceptance will occur upon delivery to the “ship to” address or, if special shipping arrangements are agreed to, upon delivery to Customer’s carrier or designee. Ownership of the Product shall not pass to the Customer until the Company has received in full (in cash or cleared funds) all sums due to it in respect of the order.Warmup Inc. (Canada) may deliver the Products ordered in installments. Any delivery or shipment dates given by the Company are estimates only and Warmup Inc. (Canada) is not liable for any loss, damage, cost or expense for any failure to deliver in accordance with the given delivery or shipment date.

8. RETURN OF GOODSTo request a return authorization please contact our offices at (888) 592-7687. Returned product in resalable condition will be refunded upon receipt and inspection. A 25% re-stocking fee may apply.

9. WARRANTY TERMS The warranties apply:1. Only to the original homeowner(s) from the date of purchase2. Only if the unit is registered with Warmup within thirty (30) days after purchase. Filling out the card accompanying this warranty or the form online in its

entirety will complete registration. In the event of a claim, proof of purchase is required, i.e. invoice and receipt. Such invoice and receipt should state the exact model that was purchased; and

3. Only for the duration of the lifetime of the floor covering under which it was originally installed if the purchaser of the heater remains the owner of the residence in which it was installed. If the original purchaser sells such residence, the warranty will transfer and continue for the duration of the warranty years from date of purchase.

4. Only if the heater has been grounded and protected by a GROUND FAULT CIRCUIT INTERRUPTOR (GFCI) at all times.

COVERAGE1. The warranty period begins on the date of purchase. 2. Warmup heating systems are guaranteed by WARMUP, INC. (“Warmup”) to be free from defects in materials and workmanship under normal use and maintenance

for the warranty years, provided the Product is installed in accordance with the accompanying Warmup installation manual, any special written design or installation guidelines by Warmup, Inc. for a particular project, the Canadian Electrical Code (CEC), Part 1 in Canada or National Electrical Code (NEC) in the USA, especially Article 424, Part V of the NEC ANSIINFPA 70, and all applicable local building and electrical codes; and

3. Provided Warmup heaters are installed under suitable floor types.4. During the period of Warranty, Warmup will arrange for the heater to be repaired or (at its discretion) have parts replaced free of charge. The costs of repair

or replacements are your only remedy under this Warranty. Such cost does not extend to any cost other than direct cost of repair or replacement by Warmup

and does not extend to costs of relaying, replacing or repairing any floor covering or floor.5. If Warmup, Inc. determines the repair of the product is not feasible; we will replace the product with equal or similar features and functionality at Warmup’s

sole discretion. WARMUP’S MAXIMUM LIABILITY IS LIMITED TO THE ORIGINAL PURCHASE PRICE OF THE HEATER MULTIPLIED BY THE PERCENTAGE OF THE WARRANTY PERIOD REMAINING.

EXCLUSIONSWarmup, Inc. shall in no event be liable for incidental or consequential damages, including but not limited to extra utility expenses or damages to property. This Warranty is null and void if1. The floor covering over the heater(s) is damaged, lifted, replaced, repaired or covered with subsequent layers of flooring.2. The heater fails due to damage caused during installation or flooring layout, unless damage is caused directly by an employee of Warmup. It is therefore essential

to check that the heater is working (as specified in the installation manual) prior to the flooring installation.3. Damage as a result of floods, fires, winds, lightning, accidents, corrosive atmosphere or other conditions beyond the control of Warmup, Inc.4. Use of components or accessories not compatible with Warmup heaters5. Warmup products installed outside Canada.6. Parts not supplied or designated by Warmup, Inc.7. Damage or repair required as a result of any improper use, maintenance, operation or servicing.8. Failure to start due to interruption and/or inadequate electrical service9. Any damage caused by frozen or broken water pipes in the event of equipment failure. 10. Changes in the appearance of the product that does not affect its performance.11. The owner, or his/her designated representative, attempts to repair the product without receiving prior authorization from Warmup. Upon notification of a

repair problem, Warmup, Inc. will issue an Authorization to Proceed under the terms of this Warranty.If Warmup is required to inspect or repair any defects caused by any exclusions referenced above, all work will be fully chargeable at Warmup’s inspection and repair rates then in effect.WARMUP, INC. DISCLAIMS ANY WARRANTY NOT PROVIDED HEREIN, INCLUDING ANY IMPLIED WARRANTY OF THE MERCHANTABLE OR IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. WARMUP, INC. CSA STANDARD LISTING REQUIREMENTS LIMIT THE HEAT OUTPUT OF WARMUP UNDERTILE HEATING, AS SUCH, USERS MAY OR MAY NOT BE SATISFIED WITH THE FLOOR WARMTH THAT IS PRODUCED. WARMUP DOES WARRANT

THAT ALL HEATERS WILL PRODUCE THE RATED WATT OUTPUT LISTED ON THE HEATER NAMEPLATE, WHEN OPERATED AT THE RATED VOLTAGE.

10. EXCLUSION AND LIMITATION OF LIABILITYFOR ANY BREACH OF THESE TERMS AND CONDITIONS, WARMUP INC. (CANADA)’s SOLE AND EXCLUSIVE MAXIMUM LIABILITY SHALL NOT IN ANY EVENT EXCEED THE TOTAL PRICE OF THE PRODUCTS ORDERED BY THE CUSTOMER. IN NO EVENT WILL WARMUP INC. (CANADA) BE LIABLE TO CUSTOMER FOR CONSEQUENTIAL, INCIDENTIAL, SPECIAL DAMAGES OR ECONOMIC LOSS, EXPENDITURES, INVESTMENTS, COMMITMENTS OR LOST PROFITS) ARISING FROM ANY CLAIM OR ACTION, INCIDENTAL OR COLLATERAL TO, OR DIRECTLY OR INDIRECTLY RELATED TO THE PURCHASE OF THE PRODUCTS HEREUNDER, WHETHER SUCH CLAIM IS BASED IN CONTRACT, STATUTE, TORT, IMPLIED DUTIES OR OBLIGATIONS OR OTHER LEGAL THEORY.WARMUP INC. (CANADA) SHALL NOT BE LIABLE IF IT IS UNABLE TO PERFORM ANY OF ITS OBLIGATIONS CONTAINED IN THESE TERMS AND CONDITIONS DUE, DIRECTLY OR INDIRECTLY, TO MATTERS BEYOND THE CONTROL OF THE COMPANY INCLUDING, BUT NOT LIMITED TO, THE FAILURE OF ANY MACHINE, SYSTEM OF AUTHORIZATION, DATA PROCESSING OR COMMUNICATION SYSTEM OR TRANSMISSION LINK OR ANY LABOUR DISPUTE OR ACT OF GOD.

11. GOVERNING LAW AND JURISDICTION These Terms and Conditions shall be construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein without regard to principles of conflict of law. Without limiting the foregoing, Customer and Warmup Inc. (Canada) irrevocably and unconditionally: (a) agree that any suit, action, or other legal proceeding arising out of or relating to these Terms and Conditions or any transaction hereunder must be brought in the Ontario Superior Court of Justice, in the city of Toronto, (b) consents to the exclusive jurisdiction of such court in any such suit, action or proceeding ; (c) waives any objection to the laying of the venue of any such suit, action or proceeding in any such courts; and (d) waives any right that it may have to assert the defence of forum non-conveniens in any such suit, action or proceeding.

12. EXPORT CONTROL By accepting this agreement you confirm that you are not located in (or a national resident of) any country under Canadian or U.S. Economic embargo or sanction, not identified on any U.S. Department of Commerce Denied Persons List, Entity List of proliferation concern or Canadian equivalent, on the US State Department Debarred Parties List or Treasury Department Designated Nationals exclusion list or any Canadian equivalent, and not directly or indirectly involved in the financing, commission or support of terrorist activities or in the development or production of nuclear, chemical, biological weapons or in missile technology programs as specified in the U.S. Export Administration Regulations (15 CRF 744) and hardware, software, technology, or services may not be exported, re-exported, transferred or downloaded to any such entity.

13. HEADINGSThe headings of each of these terms and conditions are for convenience of reference only and shall not form part of these terms and conditions. Such headings shall be ignored in the interpretation or construction of any of these terms and conditions.

14. NO ASSIGNMENT Customer may not assign its rights or obligations under this Agreement without the express written consent of Warmup Inc. (Canada).

15. INVALIDITY OF PROVISIONSIf any provision or provisions of this Agreement shall be held to be invalid, illegal or unenforceable, such provision shall be enforced to the fullest extent permitted by applicable law, and the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby. These Terms and Conditions of Sale supersede any preprinted terms on Customer’s orders and any previous written or oral communications or representations by either party related to the Products and may not be amended by Customer without prior written consent of Warmup Inc. (Canada).
