1. D.D. for Tender fee & EMD should be placed in separate envelope which should attached separately with Technical bid cover as per instructions contained in Tender documents.

2. Technical and qualifying criteria of bid details specification (envelope No.1) will be opened first and subject to evaluation, based on the qualification criteria contained in the individual bid document. Price bids (Envelope No.2) of bidders who are assessed and declared as substantially technically responsive on evaluation of the technical bid will be opened for further commercial evaluation.

Terms & Condition: -

It is necessary to specify the name of the work on closed cover while bidding the tender. The full particulars can be had in the tender, which can be obtained from the office of the CHIEF ENGINEER (C & O), Gujarat State Electricity Corporation Limited Wanakbori TPS, and Tal. Thasra, Dist. Kheda, Pin. 388239.

Earnest Money Deposit & Tender Fee will be accepted only by demand draft or by Bank guarantee of any Nationalized Bank as per rules of GSECL in favor of GUJARAT STATE ELECTRICITY CORPORATION LIMITED Payable on DENA BANK at Wanakbori Thermal Power Station. Cheques are not accepted. The tender may be opened in the presence of contractors who wish to remain present at the time of opening. The GSECL reserves the right to reject any or all tenders without assigning any reasons thereof. Any clarification regarding the tender shall be obtained before opening the tender.

N.B.: (1) Tender will be accepted only by RPAD. Each tender should be posted separately. Tender received late will

not be accepted. Any alterations, modifications to bids received after opening of tender shall not be considered unless called for by the GSECL

(2) In negotiations. It is necessary to produce the latest solvency certificate from nationalized bank of 20% value of estimated cost and Experience certificate or similar evidence for the works carried out in past at the time of purchasing of tender copy. All these certificates along with details of jobs carried out along with documentary evidence and /or satisfactory completion certificate from respective clients should be attached with technical bid for deciding of the opening of price bid.

(3) Tenderers should quote the reference of payment of EMD i.e. MR. No. & Date or DD. No. & Date or Bank guarantee issued by following banks will only be accepted.

(A) Bank guarantee issued by following bank will be accepted as SD/EMD on permanent basis. (1)All nationalized banks including the public sector banks – IDBI Limited.

(2)Private sector banks authorized by Reserve bank of India to undertake State Government Business (At present - Axis Bank, ICICI Bank, HDFC Bank)

(B) Bank guarantee issued by following banks will be accepted as SD/EMD. (6)Issue of tender documents to any party will not automatically qualify the party as to its capability etc to execute the job and GSECL shall assess the capability of the party at the time of evaluation of technical bids. (7) Tenderers shall also certify that quoted tender is ‘UNCONDITIONAL’ on tender covers itself. (8) The tender’s documents are of two bid systems. [A] The technical bid, which is to be submitted in separate sealed envelope mentioning ‘TECHNICAL BID’ on envelope with details given special note for qualification criteria with mentioning of E.M.D. payment. [B] The commercial [price] bid, which is to be submitted with the rest page of tenders including Schedule-B in separate sealed envelope mentioning ‘COMMERCIAL BID’. Both the bids should be submitted in another separate sealed cover on due date of submission with name of work superscripted thereon and with note ‘TENDER- DO NOT OPEN’ written prominently. Annexure-A

Sub: Job work related to 6.6 KV VCBs/ SF6 for Cleaning, oil topping & shifting

of oil barrel for ESP Rectifier Transformer of Unit no. IV, V, VI WTPS

Stage-II

[Scope of Work] [01 to 13]

1. Ensure the isolation of VCB/ SF6 breakers, from concerned section with the help of technician.

2. Remove the isolated breakers from breaker cubicle/ panel in presence of technician of concerned section safely.

3. Clean the breakers by cotton waste and other cleaning agents, if required. 4. Clean the breakers cubicle/ panel by cotton waste and other cleaning agent, if

required. Note: Do not open the shutter in side panel if bus bar is charged.

5. Put the cleaned VCB/ SF6 breakers in cubicle/ panel after completion of work.

6. If oil is not available for oil topping/ oil replacement, oil drums are to be collected from main store and shift the drums to EMD-II site store and at ESP top.

7. Required quantity of consumable like cotton waste, breakers, oil cleaning agents etc. will be given from EMD-II section for the work.

8. Used cotton waste is to be collected & thrown in the dust bin. In no case same shall be left at site. Area cleaning is to be maintained by the contractor during job/work execution & after job/work completion.

9. Removed/ used Rectifier Transformer oil is to be filled in separate oil drums which are put separately for crediting in main store.

10. Necessary arrangement for carting for oil drum, lifting equipments (chain pulley block, Siling etc.) for drums etc. are to be done by contractor wherever applicable.

11. The work has to be carried out as per norms of ISO 9001: 2008 and ISO 14001: 2004.

12. The time limit for above work order will be 11 months from the date of

written order for commencement of the work to be given by Engineer in

charge.

13. Regarding works of Schedule-B Item Sr no(07)

DIFFERENT WORKS TO BE CARRIED OUT ARE AS LISTED BELOW :

(i)In # 4, 5 & 6 the cleaning of different LT motors and motor foundation of EMD-II

(TG) / (BLR) area by air / cotton waste. (as & when required)

(ii)In # 4, 5 & 6 the cleaning of different HT motors and motor foundation of EMD-II

(TG) / (BLR) area by air / cotton waste. (as & when required)

(iii)In # 4, 5 & 6 the cleaning of different racks, cleaning the files & different records

in office (as & when required)

(iv)In # 4, 5 & 6 the cleaning of different racks of materials lying in different cabins

in 6.6 KV C/R (of EMD-II / TG)

(vii)In # 4 shifting of materials ( scrap, unused etc.) from EMD-II TG office / site to

main store as & when required.

(viii)In # 4 shifting of spares / materials required to be used in plant for different

works for different defect etc. on as & when required basis.

(ix)In # 4 shifting of removed spares / materials from plants after removal of

defective / damaged spare to site store of EMD-II TG section on as & when required.

(x)In # 4, 5 & 6 the cleaning of oily area near phase link man-holes in generator # 4,

5 & 6 as & when required.

(xi)Other works related to ISO 9001: 2008 and ISO 14001: 2004 required to be

carried out as & when required basis.

(xii)The stacking of sub store material of EMD-II (TG) / (BLR) and crediting scrape

materials from site to main store & collection of materials from main store, on as &

when required basis.

(xiii)In # 4, 5 & 6 shifting of LT motors from one place to required place as per

maintenance work scheduled on as & when required basis.

(xiv)In # 4, 5 & 6 cleaning of area near to ESP main transformer, on as & when

required basis.

(xv)In # 4, 5 & 6 replacement of ESP heaters & cleaning of ESP insulator provided at

top floor area on as & when required basis.

(xvi)In # 4, 5 & 6 cleaning of Station & Unit Batteries cells & topping of water and

acid as and when required and different routine electrical maintenance works in the

section.

Annexure-A1

GENERAL TERMS AND CONDITIONS OF CONTRACT [01 to 63]

(1) Contract means the documents forming tender and the subsequent agreement that

may be entered into. Work or Works means (name of work): Job work related to 6.6

KV VCBs/ SF6 for Cleaning, oil topping & shifting of oil barrel for ESP Rectifier

Transformer of Unit no. IV, V, VI WTPS Stage-II

(2) Contractor means a firm or an individual undertaking these works or offers the

rates for this work.

(3) The general rules and regulations of the GSECL for tender and contract for works will

apply to the extent of the same and not modified herein. The contractor is deemed to

have gone through and considered to be fully aware of the conditions mentioned therein.

(4) Earnest Money Deposit:

Tender should be submitted along with Earnest Money Deposit (EMD) at the rate of one

Percentage of estimated cost of the tender, without which tender is liable to be rejected.

(5) Security Deposit:

Successful bidder shall have to pay Security Deposit (SD) equivalent to 5% of the

ordered value. Within ten days from the date of issue of LOI otherwise, work order will

not be awarded.

(6) The amount of Security Deposit will be refunded after the satisfactory completion of

the contract after certification by the concerned Superintending. Engineer and after

deducting any dues of the GSECL.

(7) The sublet or to transfer the contract without prior approval of the GSECL shall be

treated, as breach of contract and it shall be punishable by forfeiting the SD as well as

termination of contract.

(8) The GSECL reserves the right to forfeit the SD in case of any breach of contract and

in case of disputes. The decision of Chief Engineer, Wanakbori TPS shall be final, binding

and acceptable to the contractor. If the contractor fails to start the work as stipulated,

the EMD and the SD shall be forfeited.

(9) The monthly payment to the laborers must be paid before 10th day of succeeding

month in the presence of Labour Welfare Officer, Wanakbori TPS. A copy of the same

must be submitted along with monthly RA Bill, duly certified by the labour Welfare

Officer. The certificate should contain details of average no. of labours deployed, total

wages / salaries paid and overtime amount separately.

(10) Submission of the bill by the contractor:

Bills shall be submitted by the contractor for each month on or before the date fixed by

the Engineer-In-Charge, for all works, executed in the previous month and the Engineer-

In-Charge shall take or cause to be taken the requisite measurement for the purpose or

having the same verified and the claim so far as it is admissible, shall be adjusted, if

possible, within ten days from the presentation of the bills. If the contractor does not

submit the bill, within the time fixed, as aforesaid, the Site-In-Charge may depute a

subordinate to measure up the said work in the presence of the contractor or his duly

authorized agent, whose counter signature in the measurement list shall be sufficient

warrant and the Engineer-In-Charge may prepare a bill from such list which shall be

binding on the contractor in all respect. Along with the R.A. Bill, the contractor should

submit Material Account wherever applicable, proof of payment of provident fund and

other statutory dues, certificate issued by I.R.O. / L.W.O certifying average number of

labours deployed during the month and total amount of wages and salaries paid to

labours. The R.A. Bills along with the supporting documents will be paid within 30 days.

(11) Income Tax: Income tax will be deducted at source from each bill as per statutory

requirements.

(12) The GSECL will be entitled to deduct directly from the bills to be paid to the

contractor any sum or sums payable by the contractor and which sum/sums the GSECL

is required to pay as a principal employer on account of contractors default in respect of

all liabilities referred to in above clauses.

(13) (a) No sales tax, professional tax or any other taxes, cess or levy, excise duty,

octroi, royalty or other duties will be payable by the GSECL against this contract.

(b) Service tax at the rate prevalent during period of execution of contract and if

applicable will be reimbursed on production of certified copy of registration number and

paid challan for payment of service tax from time to time.

(14) The quantities mentioned in the Schedule-B are approximate only and may vary

widely. The contractor shall be paid for the actual works carried out at the rates quoted

by him.

(15) The TDS @ 2% as per Sections 57A and 57B GST Act shall be deducted from the

contractor’s bills.

(16)Documents required to be submitted by the Bidders with Technical bid:-

(a) Experience certificate:- At the time of submitting the tender, the contractor

shall attach experience certificates/past order copy of having carried out such/similar

type of work either in or any other well known organization.

(b) Special tools and tackles:- The bidder shall have to submit along with the

offer, the details of minimum tools, tackles & equipment in possession relevant to job.

(c) Provident fund code number:- The contractor shall have to submit along with

the offer the details of PF code number from appropriate authority without which the

offer is liable to be ignored.

(d)Solvency:-The contractor shall have to submit a copy of the solvency certificate

of minimum 20 % of the estimated cost of the tender of any schedule bank. The offer

without solvency certificate is liable to be rejected.

(e)Audited Annual account:- The contractor shall have to attach along with the

tender last three years audited annual accounts(i.e Profit and loss account statement

and balance sheet)if the tender estimated value is Rs.50.00 Lacs or more for one year

contract and Rs.1.00 crore or more for two year contract, otherwise the offer will be

liable to be rejected.

(f)Partnership Deed/Memorandum of Association & Article of association:-

If contractor is not a sole proprietor ,then the contractor shall have to furnish a

copy of the partnership deed along with the offer. In case of a company ,the M/A & A/A

is required to be submitted without which the offer is likely to be ignored. The contractor

shall also submit power of attorney.

(g)Labour license for labour contract:-The contractor should have to submit latest

labour License certificate along with the technical bid ,without which the offer is liable to

be ignored.

(h) Electrical License certificate:- The contractor should have to submit latest

Electrical License certificate from appropriate authority along with the technical bid

,without which the offer is liable to be ignored.

(17) Compensation for the Delay:

The time allowed for carrying out the work as entered in the Tender shall be strictly

observed by the contractor and shall be reckoned from the date on which the order to

commence work is given to the contractor. The work shall throughout the stipulated

Period of contract be proceeded with all due diligence (time being deemed to be the

essence of Contract) and the contractor shall pay, as compensation, an amount equal to

one percent or Such smaller amounts, as the Competent Authority (whose decision in

writing shall be final) may decide of the amount of the contracted cost of whole work as

shown by the tender for every day that the work remains un-commenced or unfinished

after the proper dates. Provided always that the total amount of compensation, to be

paid under the provisions of the Clause shall not exceed 10 percent of the contracted

cost of the work as shown in tender.

(18) Wages to be paid, time of payment, etc., by the contractor:

The payment shall be disbursed in presence of the GSECL representative during the

working hours in the factory premises and the contractor shall get the entries certified in

the register of wages by the representative of the GSECL. Any default will result in

cancellation of contract forthwith or else the contractor shall be punishable to the extent

of Rs.100/- per day by way of fine. The contractor shall give his telephone number,

address to the GSECL, so that in case of labour unrest etc., the contractor can be

contacted. The contractor shall arrange to have his office outside the factory premises

and the contractor shall keep himself present throughout the working hours. It is

absolutely necessary that the contractor either himself and/or a fully authorized

representative having full power or authority concerning the contract shall have to

remain present at Wanakbori TPS. He must also contact the Executive Engineer (EMD-II)

daily at 08.00 hours, so that necessary instruction can be passed on to him. Also, he

must be available during working hours (general shift) and during failure of any MOCB

(equipment) at any time, so that he can be immediately contacted for any emergency

work. The contractor and/or his authorized representative shall not leave Wanakbori TPS

without specific permission from the Executive Engineer (EMD-II). If the period of

absence from Wanakbori TPS is more than three days, an alternative arrangement shall

be made and to be informed to the sectional head in writing.

(19) Labour Laws:

The labour laws applicable and amended from time to time have to be followed

scrupulously. A few of them for information are as under:

19.1: Person below the age of eighteen years shall not be employed for the works.

19.2: No female worker shall be employed in the night shift between 19:00 hrs & 06:00

hrs.

19.3: Contractor shall maintain a valid labour license under the Contract Labour

(Regulation & Abolition) Act for employing necessary manpower to be required by him.

In the absence of such license, the contract shall be liable to be terminated without

assigning any reasons thereof.

19.4: The contractor shall, at his own expense, comply with all labour laws and keep the

GSECL indemnified in respect thereof. Some of the major liabilities under various labour

and industrial laws, which the contractor shall comply with are as under:

(b) Payment of contribution of employees (contract labour) as well as employer's

(contractor’s) contribution towards provident fund, family pension scheme, deposit

linked insurance scheme, administration charges, inspection charges, etc., at the rates

applicable from time to time by the Government of Gujarat / Government of India or

other statutory authorities.

(c) Payment of deposit in respect of each contract labour at the rate as revised by the

Government from time to time with the Office of the Commissioner of Labour as per the

Contract Labour (R&A) Act.

(d) License fee as prescribed under the Contract Labour (R&A) Act and rules framed

therein depending upon the number of workers employed by the contractor.

(e) Paid leave facility and wages as per the provision of the Factories Act at the rate of

one dayfor every 20 days of working.

(f) Identity cards as prescribed under the Factories Act or by the Thermal power station

with photograph affixed thereon, for identification.

(g) Payment of retrenchment compensation, notice pay and other liabilities as per

IndustrialDisputes Act-1947. Any payment to the contractor’s employees arising out of

any claim or disputes under the Industrial Disputes Act -1947 or any other labour laws.

(h) Payment of compensation in case of accident injury, under Workmen’s Compensation

Act.

(I) Provision of creche if the female labour employed is more than 30.

(J) Maternity leave as per the provision of the Maternity Benefits Act.

The above are some of the major liabilities of the contractor in addition to other liabilities

prescribed under the various labour laws in force from time to time by the statutory

authorities,like State Government / Government of India, which the contractor shall have

to comply with.

(20) Provident Fund and Family Pension Scheme:

The contractor shall submit along with his bill (month-wise) a statement regarding

deductions against Employees Provident Fund (EPF) and Family Pension Scheme (FPS) in

respect of each concerned employee at the rate of 10%, or at the rates made applicable

by the government from to time, of wages. The contractors’ contribution and the

workers contribution towards PF and FPS shall be deposited by the contractor with the

Regional Provident Fund Commissioner Ahmedabad, or to the authority prescribed under

the Act along with the other charges.

(21) Deposit Linked Insurance Scheme:

The contractor shall have to deposit 0.50% (half percent) or the rate applicable from

time to time of the wages in respect of employees who are members of the PF, as the

contribution to the Deposit Linked Insurance Scheme, with the Regional Provident Fund

Commissioner, Ahmedabad.

(22) Minimum Wages Act:

The contractor shall pay prevailing minimum wages as applicable from time to time to

the labours engaged by him as per the minimum wages Act, in presence of the GSECL’s

officer or representative.

(23) E.S.I. Act.:

The contractors shall comply with the provisions of E.S.I. Act wherever applicable as per

the prevailing provisions of the Act and as amended from time to time.

(24) Administrative Charges: Administrative charges for maintaining Provident Fund

account shall be deposited by the contractor with the Regional Provident Fund

Commissioner, Ahmedabad, at the rates applicable.

(25) Paid Leave Facility:

Paid leave facility at the rate of one day for every twenty days of actual work by the

contract labour shall be provided by the contractor to his workers. He shall maintain

leave cords/verified and approved/certified by the authorized officer of the GSECL.

(26) Safety:

The contractor shall strictly observe all safety rules and provide safety equipment to the

contract labours as per the Factories Act, 1948, and whatever amendments made from

time to time to avoid any chance of accident. The contractor shall strictly observe all

instructions of Safety Officer and Factory Inspector to avoid any chance of accident.

The contractor has to provide safety articles to his contract labour as per the nature of

work they have to perform in the contract. A certificate in this regard has to be obtained

from Safety Officer then the detailed work order will be issued.

(27) Workmen’s Compensation Fund and Employer’s Liability Insurance:

Insurance shall be affected for all the contract employees engaged in the performance of

this contract. If any of the work is sublet after due permission in writing from the

GSECL, the contractor shall require the sub contractor to provide workmen’s

compensation and employer’s liability insurance for the later employees, unless such

employees are cover under the contractors insurance. It shall be the liability of

contractor for employees of his sub- contractor.

(28) Compliance to Security Matters:

The power station being a restricted / prohibited area, all the formalities as required by

the Security and Vigilance staff should be complied with, to whom the contractor should

contact.

(29) Submission of Returns & Maintenance of Records:

The contractor shall submit the returns under the Contract Labour Act, Payment of

Bonus Act, Payment of Gratuity Act etc. and shall have to maintain all up-to-date

records/registers in respect of his employees as prescribed under various Labour Laws

and produce the same as and when demanded by `s appropriate authorities.

(30) Execution of Agreement:

The successful bidder (contractor) will have to enter into an agreement with the GSECL

and the cost of the stamp paper will be borne by the contractor. The contractor will

also have to execute indemnity bond on required value of stamp paper as per GSECL’s

rules. The cost of stamp paper for indemnity bond will be borne by the contractor.

(31) Contractor to Indemnify the GSECL:

The contractor shall indemnify and keep indemnified the GSECL and every member,

officer and employees of the GSECL, including Engineer-In-Charge and his staff, against

all actions, proceedings, claims, demands, costs and expenses whatsoever arising out of

or in connection with the matters referred in above clauses and elsewhere and against

all actions, claims, demands, costs and expenses which may be made against the

GSECL, by any workman/employee of the contractor or sub-contractor or any other

person under any laws, rules or regulations having the force of law, including, but

not limited to, claims against the owner under Workmen’s Compensation Act,

1970. The GSECL shall not be liable for or in respect of or in consequence of any

accident or injury to any workman or other person in the employment of the

contractor. The contractor shall indemnify and keep indemnified the GSECL against

all such damages and compensation and against all claims, demands, proceeding

costs, charges and expenses whatsoever in respect thereof or in relation thereto. The

contractor shall also indemnify GSECL in all respect against any liability due to breach of

legal provisions contained in any of the Labour Laws.

(32)As a contractor, the contractor shall be responsible and liable to pay difference in

wages, if any, and/or observe the revised service conditions that may be awarded by

the Honorable Industrial Tribunal effective from the date directed in the award.

(33) The contractor must be maintaining regular labour record and should be paying all

acquired benefits to labour force and contractor should obtain certificates to this effect

from Labour Commissioner.

(34)Any other rules and regulations, conditions etc. that are in force at present and that

may be Framed by the GSECL from time to time in connection with the contract will be

binding and acceptable to the contractor.

(35) (a) The successful bidder (contractor) has to engage the 3-4 nos. of the labours of

the protected labours as per the Industrial Tribunal / High Court, Special Civil Application

No. / I.T. No. 727/98.

(b) Considering the recent trend of the Court / Tribunal and High Court in respect of

contract labours, it is advisable to the contractor to engage the labours, who have been

doing this work during the tenure of the last contract. The GSECL on demand will give

the list of such labours to the contractor.

(36) Because of this contract, the GSECL shall not accept any additional labour liabilities

than stated above.

(37) The contractor will make arrangements at his own cost to insure all men, materials

and equipment employed for this work. The GSECL will not be responsible for any loss

or damage either to the contractor’s personnel or his equipment.

(38) Dispute, if any, taking place between the contractor and labors must be intimated

to Labour Welfare Officer, Wanakbori TPS, immediately.

(39) The contractor must insure all the labours before starting the works.

(40) Any casualty will also have to be borne by the contractor for the period the

contract continues.

(41) The contractor shall not engage any sub-contractor without written prior

permission of the Chief Engineer or the authorized officer of the GSECL. In no case the

GSECL will be liable in any manner regarding any liability in respect of any contract

labour engage by the sub-contractor and the liability of such contract labour will solely

rest with the principal contractor.

(42) The contractor shall deploy with the adequate number of experienced staff at site

for daily supervision and for maintenance of various registers and records required under

the law and contract. No payment by the GSECL for supervision shall be admissible.

(43) Staff Discipline:

It is the responsibility of the contractor to ensure that his employees maintain strict

discipline as regards security, methods of safe working etc., and not to cause any

hindrance to smooth running of power station or in execution of duties by staff. Any

lapse in this regard will be viewed seriously and contract is liable to be terminated. If

any of his staff is found unsuitable or not behaving properly, the contractor shall have to

remove him from the work-site on demand by GSECL. The contractor shall have to

strictly observe the rules and conditions specified in the enclosed works contract booklet

of the GSECL, which are not modified hereunder. To keep harmonious Industrial

Relations amongst contract labours is the sole responsibility of the contractor. Any

breach of the same will be viewed seriously.

(44) Arbitration:

If at any time any question, dispute, differences, shall arise between the GSECL or the

Engineer-In-Charge and the contractor or any person claiming through him upon or in

relation to or in connection with the matter herein before stipulated and specified to be

referred to arbitration, either party may forthwith give to the other month’s notice in

writing of the existence of such question, dispute or differences whatsoever, which may

at any time arise between the parties to this agreement, touching the agreement or

subject matter thereof, arising out or in relation thereto and whether as to construction

or otherwise, shall be referred to the decision of the sole Arbitrator appointed by the

Chairman of for the purpose, who shall be a retired High Court Judge or a retired District

and Sessions Judge, and upon the parties reference to the Arbitration Act, 1940 as

amended from time to time and the rules therein. The Arbitration proceedings shall be

conducted at GSECL’s head office, Baroda, or at such places as the sole arbitrator may

determine. The award of the sole arbitrator (or umpire) shall be final and binding upon

the parties upon every or any such reference the costs of and incidental to the reference

and award respectively, shall be at the discretion of the arbitrator or umpire who may

determine the amount thereof or direct the same to be taxed as between party, and the

party shall direct by whom and in what manner the same shall be borne and paid,

provided, however, that either party to the dispute shall in respect of any monetary

claim, be entitled to receive from the other party by way of cost any time exceeding the

percentage set out below, irrespective of the actual fees and expenses incurred by him.

Work under contract shall continue during the arbitration proceedings and no payment,

other than for matters in dispute due or payable by the purchaser, shall be withheld on

account of such proceedings. The percentage above referred to in this clause is five

percent on any such monetary award, which does not exceed Rs. 10,000/-; three

percent on the next or any part thereof; two percent on the next Rs. 50,000/-, or any

party thereof, and one percent on Rs.40, 000/- or in case it exceeds Rs. 1, 00,000/-

(45) The GSECL reserves the right to terminate this contract at any time during its

currency without giving notice of termination or any reason thereof.

(46) Time Limit:

The time limit for completion of this contract works, if awarded, is 11 months. The

GSECL can extend contract for further period of six months after expiry of time limit, if

desired by the GSECL, and quantity will be enhanced proportionately.

(47) The contract will remain in effect for the period of 11 months from the date of

commencement of contract. GSECL at any time during the tenure of the contract may

terminate the same at its sole discretion without assigning any reason, if it is observed

that obligations under this contract are not performed up to the satisfaction of GSECL.

The contractor will, however, not be entitled for any compensation for such premature

termination of contract.

(48) In case of default, the work will be got done through other agency / agencies at

the risk and cost of the original contractor, and the GSECL shall be entitled to recover

such expenses from defaulting contractor by such methods as deemed fit. The contractor

shall not, however, be entitled to terminate the contract or stop works undertaken by

him before expiry of the contract period / extended period due to any reason

whatsoever.

(49) Under the contract, the contractor should either himself be present at the site or

should nominate persons in writing, who must be available at site and who should be

authorized to take decisions about the works and receive the instructions from Site in

Charge of the work at any time. In absence of any responsible man of contractor at the

time of any emergency, adhoc decision of Site In charge will be binding on the

contractor.

(50) The contractor is bound to execute the work for any item as per the instruction of

the Site In charge. On refusal to do so, the work will be carried out at the risk and cost

of contractor by using the contractor’s tools and tackles, for which no compensation,

whatsoever, shall be payable to the contractor.

(51) If any immovable articles/tools/equipment will be found stolen from the working

place, the contractor would be held responsible and cost will be recovered from his bill.

(52) For any conflict and ambiguity, the decision of the Chief Engineer shall be final and

binding on the contractor.

(53) Before starting the work, the contractor should contract Industrial Relation Officer/

Labour Welfare Officer for all formalities and obtaining the gate passes of his labours and

for other formalities.

(54) Office correspondence will be carried out in English language, and if at any time to

facilitate the contractor, Gujarati translation may be furnished, if deemed fit. The English

version will be the correct one and the same only will held good for legal matters.

(55) The contractor should intimate to the office the name and address of authorized

and responsible representatives, so that our field officers can contact them when

required in connection with the execution of the said works.

(56) The Contractor shall deposit 15 days salary at the rate of last drawn salary for

every completed one year of services for each worker for the liability of gratuity.

(57) For emergency works, contractor shall have arrangements for making manpower

available immediately on intimation from EIC.

(58) The general rules and regulation of GSECL for tender the contract for work shall be

applicable the contractor’s is deemed to have gone through it and considered to be fully

aware of this condition mentioned in it. All terms & conditions of work contract booklet

of GSECL shall be applicable to the contractor in general.

(59) The quantity/Job mentioned in schedule-B is approximate which may vary also.

However total amount will not exceed ordered estimated value.

(60)The contractor shall have to execute Agreement on stamp paper of Rs.100/- &

Indemnity bond on stamp paper of Rs.100/- in the prescribed form before

commencement of the work. The cost of the stamp papers shall be borne by contractor.

(61)All kind of transportation is under the scope of contractor.

(62)Accommodation facility will be provided by M/s GSECL on chargeable basis.if

available.

(63)Contractor should provided safety PPE(i.e safety helmet, safety shoes etc) to his

unskilled labour as per safety norms.
