35:15-47-19 [AMENDED]SUMMARY:

The proposed rule changes are based off new epidemiologyreports detailing the viability of the CWD prion in cervidsand in the natural environment. The proposed change inrule 35:15-47-6 requires accredited veterinarians to includethe origin of all herd additions on annual verifications ofherd inventories. In rules 35:15-47-12, 35:15-47-13, and35:15-47-14 the Department is increasing the time periodsused to define trace-forward and trace-back herds, as wellas increasing the quarantine times of these herds. In rule35:15-47-18 the amendment would restrict importation ofcervids from states that have ever had CWD in any free-rangingcervids. The proposed change in rule 35:15-47-19 allows theState Veterinarian the ability to alter the conditions requiredfor disposition of cervids unlawfully imported into the state.These changes are necessary to protect the cervid industry andthe wild cervid population in the state.AUTHORITY:

In rules 35:30-17-22.2 and 35:30-17-24the Department is adding omitted words and phrases. In rule35:30-17-35 the amendment corrects an error in the descriptionof Restricted Area A of Harmon County for the applicationof hormone type pesticides. The rule should refer to the townof Hollis, Oklahoma, which is in Harmon County rather thanthe town of Arnett, which is in Ellis County. PROPOSED RULES:Chapter 45. Oklahoma's Water Quality Standards

[AMENDED]SUMMARY:

The staff of the Oklahoma Water Resources Board("OWRB") is proposing to amend, or is considering amending,various provisions of Oklahoma's Water Quality Standards("OWQS") in Chapter 45 of Title 785 of the OklahomaAdministrative Code ("OAC") as follows:

OAC 785:45-3-2 is proposed to be amended to deletelanguage relating to thermal discharges. Existing languagein OAC 785:45-5-12(f)(2) adequately protects water qualityfrom thermal discharges. The circumstance which createdthe need for the proposed amendment is that the languagein 785:45-3-2(e) has become unnecessary and is potentiallycounterproductive. The intended effect of this amendment isto delete the unnecessary language in 785:45-3-2(e) and leavethe language in 785:45-5-12(f)(2) standing alone to addressthermal discharges.

A new Section is proposed to be added at OAC 785:45-5-9which will provide in one Section the various narrative criteriamoved from numerous other Sections in OAC 785:45. Thestatements of narrative criteria for: minerals currently in785:45-5-13(e), nutrients currently in 785:45-5-19(c)(2)(A),solids currently in 785:45-5-19(c)(3), and taste and odorcurrently in 785:45-5-19(c)(4), will all be deleted and relocatedto the new Section 785:45-5-9 (or elsewhere as may be requiredby the Secretary of State's Office of Administrative Rules).The circumstances which created the need for these changesare that these narrative criteria are to be applied for protectionof multiple beneficial uses; however, because these criteriaare currently located in Sections dealing with "Agriculture"(785:45-5-13) and "Aesthetics" (785:45-5-19), some personshave wondered whether the criteria apply for purposes of onlythose respective beneficial uses. The intended effect of theproposed amendments is to make it clear that these narrativecriteria are to be applied across the spectrum of all beneficialuses.

OAC 785:45-5-16 is proposed to be amended to addlanguage to address the presence of multiple indicatorsof bacteria. The circumstance which created the need forthis amendment is the possibility of an interpretation thata discharger may choose to test for all three of the listedindicators (coliform, E. coli, and enterococci) and then reportonly the result that passed rather than a result that failed. Theintended effect of this amendment is to make clear that noexceedances are allowed for any indicator group.

Appendix A, Designated Beneficial Uses for SurfaceWaters, is proposed to be revoked and reenacted with numerouschanges. The first category of changes includes new oradditional use designations for several streams which includeBoley Creek in Okfuskee County (it is proposed to changethe current Warm Water Aquatic Community, Primary BodyContact Recreation, Agriculture, Aesthetics, and Industrialand Municipal Process and Cooling Water designationsto Habitat Limited Aquatic Community, Secondary BodyContact Recreation, and Aesthetics); an unnamed tributaryof Caddo Creek in Carter County (it is proposed to changethe current Warm Water Aquatic Community and PrimaryBody Contact Recreation designations to Habitat LimitedAquatic Community and Secondary Body Contact Recreation,respectively, and delete the current designations of Industrialand Municipal Process and Cooling Water and Agriculture); anunnamed tributary of Garrison Creek in Sequoyah County (itis proposed to change the current designations of Warm WaterAquatic Community and Primary Body Contact Recreationto Habitat Limited Aquatic Community and Secondary BodyContact Recreation, respectively, and delete the currentdesignations of Industrial and Municipal Process and CoolingWater and Agriculture); Garrison Creek in Sequoyah County (itis proposed to delete the current designation of Industrial andMunicipal Process and Cooling Water, and affirm the currentdesignations of Warm Water Aquatic Community, PrimaryBody Contact Recreation, Agriculture and Aesthetics); anunnamed tributary of Mayhew Creek in Choctaw County (it isproposed to change the current designations of Warm WaterAquatic Community and Primary Body Contact Recreationto Habitat Limited Aquatic Community and Secondary BodyContact Recreation, respectively, and delete the currentdesignations of Industrial and Municipal Process and CoolingWater and Agriculture); and Snake Creek in Mayes County(it is proposed to change the current Warm Water AquaticCommunity, Agriculture, Aesthtics, and Industrial andMunicipal Process and Cooling Water designations to CoolWater Aquatic Community, Primary Body Contact Recreationand Aesthetics, and to add the designation of High QualityWaters). The circumstances which created the need for thesechanges are that Use Attainability Analyses ("UAAs") havebeen completed for these streams. The UAA for each streamindicated that certain uses should be designated for that stream.In some cases the UAA indicated that limitations for additionalprotection should be designated for a stream. The intendedeffect of the amendments is to designate the particular usesand limitations indicated by the UAAs as required by U.S.Environmental Protection Agency ("EPA") regulations underthe federal Clean Water Act. A second category of changesis to add approximately twenty-three (23) streams whichdo not receive effluent from point source discharges, anddesignate their uses. The circumstances which created theneed for these amendments are that these streams, which arelocated in various ecoregions around the state, were recentlysubjected to biological collections and physical assessments.These collections and assessments have demonstrated the

following: all of these streams should have the designateduses of Primary Body Contact Recreation and Aesthetics;approximately one-half of the streams should have the WarmWater Aquatic Community designation and the other halfshould have the Cool Water Aquatic Community designation;three of the streams should have the Public and Private WaterSupply designation; and two of the streams should have theAgriculture designation. The intended effect of the proposedamendments is to satisfy the federal Clean Water Act byassigning appropriate uses for protection of these waters of thestate.

The OWRB is considering adoption of another change inAppendix A. This revision would add the limitation of "HQW"(denoting High Quality Waters) for the Upper Illinois Riverfrom Tenkiller Dam, including Tenkiller Reservoir upstream toBarren Fork confluence. This revision has been suggested bythe Department of Environmental Quality. The circumstanceswhich created the need for this amendment are that the portionsof the Illinois River above this segment are designated foradditional protection as Outstanding Resource Waters anda Scenic River, while the portion of the Illinois River belowthis segment is designated for additional protection as HighQuality Waters. However, the segment of the Illinois Riverupstream from Tenkiller Dam to the confluence with BarrenFork Creek currently is not designated for any such additionalprotection. The intended effect of this amendment would beto add protection for this segment of the Illinois River as HighQuality Waters as provided in OAC 785:45-5-25.

The OWRB is also considering adoption of amendmentsto OAC 785:45-5-25 and Appendix A to delete languageproviding for designation of "Culturally Significant Waters".This revision has been suggested by three interestedpersons. The circumstances which created the need for theseamendments are that this designation has never been made forany waters, and the current language has caused confusion anduncertainty among interested persons. The intended effect ofthese amendments would be to eliminate this confusion andavoid the possibility that the current language could lead tounforeseen and unintended consequences.

Appendix B, Areas with Waters of Recreational and/orEcological Significance, is proposed to be revoked andreenacted with changes in the description of East Fork andWest Fork Creek in Table 2. The circumstances which createdthe need for these amendments are that it has come to theattention of the OWRB staff that this description containserrors which should be corrected. The intended effect of theseamendments is to correct the errors by identifying the correctcounty (McCurtain), changing the language "north-northwest"to "north-northeast", and adding a Section, Township andRange legal description.

Appendix E, Requirements for Development of SiteSpecific Criteria for Metals, is proposed to be revoked andreenacted to add new site specific criteria for copper relating tothe City of Heavener and OK Foods, Inc. discharge to MorrisCreek. The circumstances which created the need for these

amendments are that this discharger has completed a studywhich indicates that criteria more appropriate and site specificthan otherwise provided in OAC 785:45 can and should beapplied in its respective circumstances. The intended effectof these amendments is to provide for increased specificity inthe criteria and standards which apply to this receiving stream,while maintaining water quality, as permitted by EPA andfederal law.

Appendix F, Statistical Values of the Historical Data forMineral Constituents of Water Quality (Beginning October1976 Ending September 1983, Except as Indicated) is proposedto be revoked and reenacted to add data for the parameters ofsodium, chloride and sulfate in certain additional streamsegments. The circumstances which created the need forthese amendments are that it has come to the attention of theOWRB staff that the vast majority of the Appendix F valueswere derived for main stem rivers and frequently did notaccurately reflect conditions in the tributaries to those rivers.The intended effect of these amendments is to refine AppendixF and provide more accurate and complete values for theidentified stream segments.

Appendix G, Numerical Criteria to Protect BeneficialUses, is proposed to be revoked and reenacted with certaincorrections. The circumstances which created the need forthese amendments are that it has come to the attention of theOWRB staff that the provisions for "butylbenzyl" shouldbe corrected to reflect the parameter name of "butylbenzylphthalate" and to add the Chemical Abstract Societynumber for this parameter. In addition, the term "lindane",a commercial name, should be replaced with the moregeneric name "gamma BHC". The intended effect of theseamendments is to correct and improve the descriptions forthese parameters.

Several provisions throughout OAC 785:45 are proposedto be amended to correct grammatical and other errors and toupdate citations. The circumstances which created the need forthese amendments are that several rules contain grammaticaland other errors. Additionally, citations have evolved and needto be updated wherever they are referenced. The intendedeffect of these amendments is to make the rules reflect theappropriate grammar and citations and otherwise to state theirtext accurately.

In addition to the proposed amendments and new rulesdescribed herein, it is possible that interested persons may,during the comment period, comment or request that otherprovisions of Chapter 45 be amended. While the OWRBstaff is not at this time proposing any other amendments, allinterested persons should be on notice that it is possible thatstaff may propose additional amendments or new rules foradoption by the OWRB if public comment indicates that suchproposals are appropriate and justified.AUTHORITY:

The circumstances which created the needfor this amendment are that in recent years, various sourcesincluding the Code of Federal Regulations and the applicableU.S. Environmental Protection Agency ("EPA") guidancedocument have employed the terms "water quality limitedsegments", "not attained", and "impaired" interchangeablywith the language "not supported" and "partially supported".The intended effect of this amendment is to employ all of theseterms in context and describe how they are interchangeable.

OAC 785:46-15-5 is proposed to be amended to providespecial rules for determining beneficial use support in wadablestreams in the Central Oklahoma - Texas Plains ecoregion. Thecircumstance which created the need for these amendmentsis the inability to measure directly the support for aquatic lifebeneficial uses in these streams. The intended effect of theseamendments is to create an ability to measure aquatic life usesupport in the specified streams.

OAC 785:46-15-5 is also proposed to be amended to addlanguage (a) addressing naturally occurring conditions inthe context of dissolved oxygen, (b) expanding the citationto the criteria for toxic substances, and (c) for assessingimpacts from oil and grease, regarding the beneficial use ofFish and Wildlife Propagation. The circumstances whichcreated the need for the first set of these amendments arethat OAC 785:45 excuses naturally occurring conditions asa source for exceedance of the criteria for dissolved oxygen.However, the use support assessment protocol ("USAP")rules in OAC 785:46 currently do not recognize this excuse.There are some waterbodies identified in the State's 2002Integrated Report (formerly the "305(b) Report" and the"303(d) List") where it may have been appropriate to applysuch exemptions. The intended effect of these amendments isto help prevent determinations of non-support in waterbodieswhere the dissolved oxygen exceedances are not attributableto pollutants. The circumstances which created the need forthe second set of these amendments are that the current USAPrule does not address toxic material not specifically listed

with the numerical criteria in OAC 785:45-5-12(f)(6)(G). Theintended effect of these amendments is to allow determinationof use support with respect to toxicants listed elsewhere in785:45-5-12(f)(6) if they are identified in the waterbody. Thecircumstances which created the need for the third set of theseamendments are that the current USAP rules do not providea protocol for determining Fish and Wildlife Propagation usesupport with respect to oil and grease. The intended effectof these amendments is to allow determination of Fish andWildlife Propagation use support with respect to oil and grease.

OAC 785:46-15-6 is proposed to be amended to addlanguage to address the presence of multiple indicatorsof bacteria. The circumstance which created the need forthis amendment is the possibility of an interpretation thata discharger may choose to test for all three of the listedindicators (coliform, E. coli, and enterococci) and then reportonly the result that passed rather than a result that failed. Theintended effect of this amendment is to make clear that usesupport shall be determined using all applicable tests.

OAC 785:46-15-7 is proposed to be amended to addlanguage for assessing impacts from oil and grease regardingthe beneficial use of Public and Private Water Supply. Thecircumstances which created the need for these amendmentsare that are that the current USAP rules do not provide aprotocol for determining Public and Private Water Supply usesupport with respect to oil and grease. The intended effectof these amendments is to allow determination of Public andPrivate Water Supply use support with respect to oil and grease.

New Sections 785:46-15-11, 785:46-15-12 and785:46-15-13 are proposed to be added to provide USAP rulesfor the beneficial uses of Hydroelectric Power Generation,Industrial and Municipal Process and Cooling Water, andNavigation. The circumstances which created the need forthese rules are that these beneficial uses are not addressed inthe current USAP rules, yet water quality reporting and usesupport determinations must be done anyway. The intendedeffect of these new rules is to provide straightforward rulesdeeming these uses fully supported for purposes of waterquality reporting.

Several provisions throughout OAC 785:46 are proposedto be amended to correct grammatical and other errors and toupdate citations. The circumstances which created the need forthese amendments are that several rules contain grammaticaland other errors. Additionally, citations have evolved and needto be updated wherever they are referenced. The intendedeffect of these amendments is to make the rules reflect theappropriate grammar and citations and otherwise to state theirtext accurately.

The OWRB is considering amending OAC 785:46-15-3,pertaining to data collection and analysis for the purposeof determining use support, in response to a request from aninterested person to delete language allowing "widely-acceptedand peer-reviewed methods" other than the testing proceduresprovided in 785:45-1-4. This or some other amendment ofthis Section may be needed, and the intended effect would

be, to clarify what if any additional testing procedures arepermissible for purposes of determining use support.

In addition to the proposed amendments and new rulesdescribed herein, it is possible that interested persons may,during the comment period, comment or request that otherprovisions of Chapter 46 be amended. While the OWRBstaff is not at this time proposing any other amendments, allinterested persons should be on notice that it is possible thatstaff may propose additional amendments or new rules foradoption by the OWRB if public comment indicates that suchproposals are appropriate and justified.AUTHORITY:

Emergency AdoptionsAn agency may adopt new rules, or amendments to or revocations of existing rules, on an emergency basis if the agency

determines that "an imminent peril exists to the preservation of the public health, safety, or welfare, or that a compelling public interestrequires an emergency rule[s] . . . . [A]n agency may promulgate, at any time, any such [emergency] rule[s], provided the Governorfirst approves such rule[s]" [75 O.S., Section 253(A)].

An emergency action is effective immediately upon approval by the Governor or on a later date specified by the agency in thepreamble of the emergency rule document. An emergency rule expires on July 15 after the next regular legislative session followingpromulgation, or on an earlier date specified by the agency, if not already superseded by a permanent rule or terminated throughlegislative action as described in 75 O.S., Section 253(H)(2).

FINDING OF EMERGENCY:Emergency is found to exist in order for the Board to properly determine

the financial impact of the exclusion of the employee benefit allowance fromconsideration for retirement for Justices and Judges, as well as to equitablydetermine any curative provisions for past contributions and calculations.ANALYSIS:

The existing emergency rule, 590:15-1-15 defines the term "salary" inaccordance with the URSJJ plan provisions. 20 O.S. § 1103 and 1104 limitcontributions and benefits to "salary." Salary for all judges and justices areset by statute. The rule specifically excluded all other forms of compensationincluding the benefit allowance and longevity payments for retirementpurposes. Although the rule correctly cited Oklahoma law concerning the term"salary", the Board was concerned about the benefits accrued and contributionspreviously paid, which were "grandfathered" under the rule. (1) Justices of the Oklahoma Supreme Court shall usesalary as set by 20 O.S. Section 3.1;(2) Judges of the Court of Criminal Appeals shall usesalary as set by 20 O.S. Section 31.2;(3) Judges of the Court of Civil Appeals shall use salaryas set by 20 O.S. Section 30.2A;(4) Judges of the District Courts, including associatedistrict judges and special judges, shall use salary as setby 20 O.S. Section 92.1A;(5) Judges of the Workers' Compensation Court shalluse salary as set by 85 O.S. Section 1.2;(6) The Administrative Director of the Courts shall usethe salary as set by the Oklahoma Supreme Court.

(b) Subject to the limitations contained elsewhere in the re-tirement act or in these rules, salary shall include amounts de-ducted from the employee's paycheck for retirement and de-ferred compensation contributions and pre-tax cafeteria pur-chases which are not funded by the employer or the employee'sbenefit allowance.(c) Any payments or amounts made available to an em-ployee for insurance benefits or benefits allowances includingany amounts paid directly to the employee and/or longevitypayments are not salary for retirement purposes.(d) The provisions of this rule shall be effective for all mem-bers on or after August 1, 2003. It shall be the responsibility ofthe employer to ensure that the appropriate retirement contri-butions are deducted or paid correctly and in accordance withthis rule.

(e) The salary of each justice or judge as set forth above shallbe used for calculating the monthly retirement compensationfor each retiring member. Provided, however, the calculationshall include the compensation prior to August 1, 2003, forwhich retirement contributions were withheld in determiningthe average monthly salary, if applicable, for the last three (3)years of active service.

The Commission has determined that an imminent peril to the preservationof the public health, safety, welfare or other compelling extraordinarycircumstance exists which necessitates the promulgation of emergency rules,due to the passage of HB 1319 and the current issue of mold as relates to realproperty.

Since the Commission felt that the existence of prior manufacturing ofmethamphetamine was more encompassing than simply knowing of residuefrom methamphetamine manufacturing, question number 27 of the ResidentialProperty Condition Disclosure Form was amended and question number 28was added.

Since the Commission felt that the seller is unclear on how to answer thepresent question on mold due to their lack of knowledge of the types of moldthat cause health issues; the Commission is adding two (2) questions whichare specific to mold, which the seller can answer concisely compared to theexisting mold question.ANALYSIS:

The amendment in Subchapter 15 provides clarification to licenseapplicants, licensees, real estate school entities and instructors, and membersof the general public that effective November 1, 2003, the Residential PropertyCondition Disclaimer Statement form is amended and all disclosure formsexecuted prior to November 1, 2003 will remain in force and valid untilexpiration of the 180 days from the date noted thereon.

In 2003, House Bill 1319 added an additional disclosure statementrequirement for a seller of property located in this state to include a statementof whether or not the seller is aware of existence of prior manufacturing ofmethamphetamine. Existing language in Title 60 requires the disclosurestatement form to be amended by rule as necessary and appropriate.

Section 16 of House Bill 1356 was enacted into law by the 49th Legislature,1st Regular Session, and become effective on August 29, 2003. The billprovided for a new category of sales tax permit to be obtained by "specialevents" promoters or organizers, which necessitated emergency adoptionof Commission policy for the timely implementation of those permits. Inits Order adopting this rule through emergency rulemaking procedures, theCommission made a finding that the need to provide timely guidance withrespect to the new permit constituted a compelling public interest.ANALYSIS:

Definitions for terms used in the enabling statute have been repeated forthe benefit of the public, as well as additional terms defined, to clarify someambiguity. The entities to which the new permit requirement will apply havebeen described, as well as examples of some "special events". Procedures forthe permit application are included, and the collection and reporting dutiesimposed on participants and promoters is discussed in some detail.CONTACT PERSON:

SUBCHAPTER 9. PERMITS

710:65-9-8. Special event permits and reporting(a) Definitions. The following words and terms, when usedin this Section, shall have the following meaning, unless thecontext clearly indicates otherwise:

(1) "An event held on an irregular basis", for pur-poses of this Section, means any event that does not occuron a continuous and ongoing basis, even if there is somefrequency or pattern of occurrences. Events held on "anirregular basis" may include, but are not limited to, events

held once a week or only certain weeks, events that areheld every weekend or only on particular weekends, eventsheld once a month or for only certain months, and otherevents that are held on a periodic basis, as well as thosewhich occur more sporadically.(2) "Person" means any individual, company, partner-ship, joint venture, joint agreement, association, mutual orotherwise, limited liability company, corporation, estate,trust, business trust, receiver or trustee appointed by anystate or federal court or otherwise, syndicate, this state,any county, city, municipality, school district, any otherpolitical subdivision of the state, or any group or combi-nation acting as a unit, in the plural or singular number.[68 O.S. § 1352(12)](3) "Promoter" or "organizer" means any personwho organizes or promotes a special event which resultsin the rental, occupation or use of any structure, lot, tractof land, sample or display case, table or any other similaritems for the exhibition and sale of tangible personalproperty or services taxable under Section 1350 et seq.of Title 68 of the Oklahoma Statutes by special eventvendors. [68 O.S.Supp.2003 § 1364.2](4) "Special event" means an entertainment, amuse-ment, recreation, or marketing event that occurs at a sin-gle location on an irregular basis and at which tangi-ble personal property is sold. "Special event" shall in-clude, but not be limited to gun shows, knife shows, craftshows, antique shows, flea markets, carnivals, bazaars,art shows, and other merchandise displays or exhibits."Special event" shall not include any county, district orstate fair or public or private school-sponsored event. [68O.S.Supp.2003 § 1364.2](5) "Special event vendor" means a person makingsales of tangible personal property or services taxableunder Section 1350 et seq. of Title 68 of the OklahomaStatutes at a special event within this state and who is notpermitted under Section 1364 of Title 68 of the OklahomaStatutes. [68 O.S.Supp.2003 § 1364.2]

(b) Application for special event permit. Every promoteror organizer of a special event shall file an application for a spe-cial event permit with the Taxpayer Assistance Division, Ok-lahoma Tax Commission, 2501 N. Lincoln Blvd., OklahomaCity OK 73194, at least 20 days before the beginning of thespecial event. If more than one special event is to be held atthe same location during a single calendar year, all may be in-cluded in one application, and a separate permit will be issuedfor each event. Each permit will include the dates of the eventto be held, and must be prominently displayed at the site of theevent for its duration. If an applicant wishes to have permitsissued for additional events after an application has been pre-viously submitted, another supplemental application must befiled for the additional events.(c) Fee. There is a fee of fifty dollars ($50.00) for each ap-plication filed, which must be remitted with the application.(d) Promoter or organizer to distribute vendors' report-ing forms. Special event promoters and organizations are re-quired to provide Special Event Vendors Reporting Forms to

the non-permitted vendors that will be selling tangible personalproperty and taxable services at the event.(e) Promoter or organizer to collect reports and tax fromspecial event vendors. Special event promoters are requiredto collect the Special Event Vendors Reporting Forms daily,along with the sales tax due from each special event vendor.(f) Promoter or organizer to report and remit sales tax.Promoters and organizers are required to file a sales tax reportwithin fifteen days following the last day of a special event.The sales tax report is to be accompanied by the Special EventVendors Reporting Forms. Payment of the total tax due is re-quired at the time the sales tax report is filed.

(g) Reporting and remitting tax when event lasts 30 daysor longer. When the special event will last thirty (30) days orlonger, a sales tax report is required to be filed for each calendarmonth by the 15th day of the following month.(h) Remuneration. Provided that the required sales tax re-ports are timely filed and the tax due remitted, promoters andorganizers to whom special event permits have been issuedmay deduct the applicable remuneration allowed by 68 O.S.§ 1367.1.
