A Cabinet report released on Friday November 21st, 2014 stated that the Dr. Rufus Ewing administration has agreed in principle to the increase and will invite views on the proposal to be submitted to the email address tciminimumwagereview2014@ gov.tc by December 31, 2014. When contacted by the SUN, Minister of Finance Hon. Washington Misick said that government was hoping to have a consumer price index established prior to the increase, but because there was a delay its establishment, decided that the wage raise could not wait. “By now we thought we would have had a consumer price index on which to peg the minimum wage. We still haven’t been able to produce the consumer price index. But we don’t want that to hold us back in increasing minimum wage, because we believe that it is the right thing to do,” Misick said. He added: “And so, what we will be attempting to do, once the CPI (consumer price index) is ready, is to have another look at what it (minimum wage) should be, but we have not had a minimum wage increased in a while, so the intention is to increase the minimum wage by 25 percent.” The minister could not say at the time of the interview as to when he believed a consumer price index would be established, but from all indications, a rise in the minimum wage will come before consumer price index is set up. “I don’t know if the CPI will be ready for April (2015), but we believe that the consumer price index will probably indicate that possibly the minimum wage should be more than 25 percent - what we are suggesting now. – business places – are paying above what is the current minimum wage, so I don’t think most businesses are going to be impacted by that. I think who is going to be impacted, as I said when I was going around with the payroll tax debate, my concern was that single mothers and other people who may have to hire domestic workers. I think it is going to impact them more than anybody else unfortunately, because it is probably in those areas that the minimum wage is probably paid,”

the minister said. The minister added: “I don’t know of any resort property on this island that is paying minimum wage. I am not saying that some of them aren’t, but I am not aware of anyone who is paying minimum wage.” For her part, Opposition Leader Hon. Sharlene Cartwright Robinson, said that the wage increase is good news for the country, but she questions its timing, saying she believes that the announced increase is a mere election ploy. “We welcome it. We have been fighting

for that for the last two years. We were told there is a working committee. In the last House of Assembly meeting we asked about it, and we were told that the committee hadn’t met. So whatever decisions they take inside or outside of a committee’s decision, we welcome it,” she said. She added: “We trust that it is done as quickly as possible, because with the number of taxes that the government has thrown on the people it certainly makes the cost of living much higher, and I am sure that those persons who

are earning minimum wage will be very pleased with it.” The People’s Democratic Movement (PDM) Leader said that the opposition was expecting such a move, since election was on the horizon. “We are sure that this was coming now that election is in view, and we are concerned, though we welcome the decision that the government has taken. These are the issues that the opposition has been championing for, and we want the people to be mindful of the motives behind it,” she said.

She said that a number of measures that the government is seeking to push through now, proved difficult for them at the beginning of their tenure, as they cited constitutional hurdles as their excuse. However, she said no constitutional changes have been in place to establish these measures, yet government is now finding ways to implement them. “It is election time, and a lot of things that we have been fighting for, we expect the government to roll them out. And what the people of

the country need to be thinking; there is no constitutional amendment, there is no amendment to the Financial Regulations. And all of the things that we have been asking them for that they are now doing are happening outside of these changes. “For two years we have heard the government saying they can’t do this and they can’t do that because of the Constitution. The Constitution is still the same, and they are doing a lot of what we championed,” Cartwright-Robinson said.

In London the Governor will have an audience with Her Majesty the Queen, and take part in the annual Joint Ministerial Council of Overseas Territories. He will also be taking some leave. Provisional liquidator appointed for insurance company BAFS

The first hurdle in the Financial Services Commission’s (FSC) attempt to liquidate the financially hemorrhaging British Atlantic Financial Services (BAFS) has been cleared after Chief Justice Her Ladyship Margaret Ramsay-Hale appointed auditor Joseph Connolly of PriceWaterhouse as provisional liquidator, in the Supreme Court on Thursday (November 20, 2014). The ruling was made despite vociferous argument from attorney Richard Savory, who reasoned on behalf of a group of policy holders. Savory beseeched the court to defer a decision on the matter until sometime in January 2015, when he would be better able to present a more compelling argument, seeing that he was called into the ring belatedly and did not have time to prepare. Chief Justice Ramsay-Hale ruled that the company has until January 9, 2014, to secure a rescue package, and if one is not locked in by then, could order a winding up of the entity. Jonathan Katan of Miller Simons law firm, who represented the FSC, said that if the provisional liquidator believes that he needs sufficient time to secure a rescue package, he could always return to the court and apply for an extension. Katan, during the hearing, argued that BAFS was in serious financial problems with no clear sign of

it ever climbing from the financial hole any time soon. He said that a report from Wilbur Caley, former managing director of BAFS to the FSC, in May, 2013, painted a depressing picture of the company finances. He said however, that the FSC gave the company time to recover, which it never did, as every month its finances continued to plummet, and with no further capital injection being made. Katan said that according to Caley’s report, the asset of the company was $3.2 million, while the liability was $10.8 million, which amounts to a shortfall of $6.2 million. He said that BAFS has been racking up losses after losses, and the bleeding needed to stop. He said that Connolly, who was appointed as administrator for BAFS since March, 2014, has made the determination that the enterprise should wind up based on its insolvency problem, also emphasizing that such a decision was not taken by the FSC. Katan further argued that if a full winding up of the company was not granted, then a provisional liquidation should be arranged, since the provisional liquidator could begin to determine what possible route it could take to stem the financially bloodletting entity. He argued that since the FSC would be the first to be blamed in the event that a policy-holder were to make a claim and was told that there was no money to fulfill such request, a decision by the regulatory body to call for a managed winding up was

legitimate. Savory, who told the court that policy holders had been making request of him to represent their interest up to the night before the liquidation petition. And so, a delay in the matter until sometime in could allow him to properly prepare. He said up to Wednesday (November 19, 2014) approximately 35 policy-holders requested him to represent them. He argued that a delay in the matter would have no adverse bearing on the public since the entity is a private company with private policy holders. He said, too, that seeing that government was interested in saving the failing entity was all the more reason that a deferment would be necessary. He said policy-holders believe that they would suffer tremendous loss if the company were to go under at this stage, since many of them have been longstanding investors. He begged the judge for time to allow him the latitude of conducting more research on the matter, pointing to numerous reports of public outrage on the FSC lobbying for liquidation at this stage.He argued further that so far the company’s insolvency was only on paper and thereby should not be the determining factor for liquidation. Savory warned that a winding up could send the wrong signal to the outside world on the country’s financial image, since the BAFS liquidation happens almost on the heels of the TCI Bank liquidation. He told the court that at this stage the cost to keep the company running was minimal. Savory, said further that it was a bad idea when administrator took the decision to stop collecting from the clients, since a number of them were still willing to pay, seeing that they want to see the company staying afloat and their investments saved. He said that BAFS could have continued for another few months, arguing that if a full hearing was done, an actuary could be called to give expert assessment as to what options would be available to the company. He said that BAFS was not as far gone as it was made out to be, since it had the ability to make small debt payouts. Meanwhile, Katan argued that the administrator’s decision to stop collecting from clients was based on his assessment that their funds could become unrecoverable. He said that it was difficult to see how the company’s fortunes could change in the next three months, when it was not able to do so in almost a year.He said a delay could sound the death knell for the policy holders, some of whom already have no chance of redeeming their investments. BAFS has approximately 2,500 policy holders of varying kinds. It is unclear how many shareholders it has. Under a liquidation process, the policy holders would get a fraction of their payment, depending on the policy. In some cases they stand to lose everything. The shareholders, though, will not get anything back.

Premier says Government took economy from ruins to growth

Premier Hon. Dr. Rufus Ewing said that his administration met ruins and a broken people when it came to office is late 2012, but as times went on his government has made significant changes to the point where the TCI is now reaping rick rewards. Making his ministerial contribution in the House of Assembly on Monday (November 17, 2014), Premier his government inherited a country that he said was broken in a variety of ways, including in spirit, financially and in hope for the future. He said that even before his party won the election, his team knew that its task to restore stretched far beyond economics. “We realized that our mandate was not merely the restoration of things measurable and tangible, but the restoration of national pride, the cultivation of the spirit of hope for our people for this generation and future generation. And as we set out compass towards progress with our future and destiny being nationhood,” he said. The premier reminded that he is mindful that no country has embarked

on the nationhood journey without sacrifice, noting that history has shown that those in leadership seeking independence for their nations face challenges of sacrifice and the Turks and Caicos will be no different. “Those in leadership, who are ultimately successful in the quest for self government, have had to face the challenge of difficult decisions. Like these other nations, during these times, we, too, are faced with such decisions, which may at times seem contrary to purpose, such as the payroll tax. Imagine what could have been if we had it. But with our eyes ever focused on our ultimate goals, we must remain steadfast and committed,” the premier noted. The premier said that while the era when blood was shed and lives lost for the sake of nationhood has seemingly past, his government remains resolute that it would use the tools available in today’s civil society to achieve that goal. “As we remember that no victory has never been won without a struggle, and no success achieved without a measure of discomfort, let us give

thanks that we did not live in those times past or in an environment where freedom and independence require the sacrifice of life and blood. “Be assured that this purpose, and the vision that I and my fellow elected members in government held before us, remain strong in our hearts today as it was two years ago when we came to office,” he said. The premier pointed out that government has made tremendous strides especially on the economic home front where it has taken from country from a state of bleeding to condition of healing. He said that before his government took office, investors were running to the hills, while the civil service was at its knees. But said his government has turned the situation around and has been making great improvements. “When my government took office, the economy of this country was in shambles. Austerity measures were the order of the day. The tools to rebuilding were lacking in a weakened civil service, and the rules for the conduct of business on a national level were stringent, giving rise to attrition

in investor confidence. “My government, the first order of business was the restoration of a state of positive economic growth and generation of sufficient government revenue to meet our numerous social and debt obligations, and I assure that after hearing the presentation from the minister of finance, you would say mission accomplished,” the premier said. The premier added: “As part of our commitment, we halted the implementation of Value Added Tax, with the assistance of our colleagues opposite, which, in our analysis, would have a detrimental impact on the economic growth in the short term and the long term of these islands. We instead implemented a number of short term taxation measures to bridge the fiscal gap. “A combination of this taxation strategy, a rebound in the global economy and in our efforts in tourism, has resulted in unprecedented growth in government revenue with real surpluses, especially during the course of this financial year, as communicated by the minister of finance earlier.”

Acting Deputy Commissioner of Police Rodney Adams who was found not guilty of corruption after being placed on administrative leave, says he wants to be back on the job. “Now that this matter has run its course and has been resolved by the court, I will be officially advising HE the Governor’s Office and the Commissioner of Police that I am available to continue my duties as a police officer. I do so out of a sense of commitment and duty to my country and to the many young officers of the Police Service who seek a role model to aspire to. I want them to know that in spite of difficulty they too can overcome challenges and achieve the rank of Acting Deputy Commissioner or higher in an organization like the RT&CIPF,” Adams said in a press release dated November 17, 2014, Adams said. The veteran police officer said he never once doubted his innocence. He added: “I was vindicated when a jury returned a verdict of “not guilty” on the one count that they were given directions on by the Chief Justice of the Turks & Caicos Islands. This was the last remaining count that I faced after being charged with five counts of corruption charges by the Integrity Commission alleging interference in a high profile murder investigation on Providenciales in April 2013. It is noteworthy that three of the counts never made it to tri al and of the two that did, the Chief Justice instructed the jury to return a not guilty verdict

on one count before sending them off to deliberate on the one remaining count. While I was always confident of my innocence in the entire matter, given the delicate situation involving a shocking murder in our otherwise peaceful country, I can understand why reasonable persons would be concern. In light of these circumstances, I deliberately refrained from speaking out about my charges as I always wanted the legal process to run its course and at the end of the day the results would be there for all to see. I never doubted my innocence and I had every expectation that once the court heard the evidence that it would conclude that I likewise was innocent of the charges filed against me.” Adams said he dedicated his entire professional career to policing since joining the RTCIPF on 5th March, 1984. He said he decided to make policing a career because of “love for my country and wanted to do my part in ensuring the safety and security of its citizens and those who come to visit and live among us”. Adams stated: “In all my dealings I endeavored to respect the laws of our country and uphold the decency and integrity of the Police Service. I would like to thank my entire family and the many persons in the community who believed in my innocence and supported me throughout this very difficult and challenging ordeal over the last year. Thanks to all for your prayers and words of encouragement. I equally would like to thank my legal team, the court (including the jury) and the prosecution for conducting this trial with a high degree of professionalism.”

DPP comments on Adams not guilty verdict

The decision by the seven-member mixed jury to find Acting Commissioner of Police Rodney Adams not guilty of corruption charges will be the barometer of what the public will come to expect in future jury trials, hinted Director of Public Prosecution, Jo-Anne Meloche, who spoke to the media shortly after Adams’ exoneration on Monday (November 17, 2014). Visibly disappointed, but accommodating to the media, Meloche pointed out that she would be drawn in

giving her personal feelings on the matter, but did not hide the fact that based on evidence presented, should not have been a case from which the prosecution did not get a favourable outcome. “That’s the decision of the jury, which reflects the public’s view of what is required of the police officer. And so I believe that the jury has spoken on that, and that would be the standard that would be expected following the verdict,” Meloche said. She hinted that Commissioner Colin Farquhar’s second in command was

acting in the course of his duty when he met with eyewitness Dorelll Williams

–an eyewitness to the April 13, 2013 shooting death of Kaziah Burke at the Uncle Dough Bar on Airport in Providenciales, but was not reflected in the jury’s decision.

“We are questioning that the jury came back with which respect to whether or not the meeting with the witness in the course of, or what does it mean in his performance of his (Adams’) duties. And the crown’s position throughout the case was that Deputy Commissioner Adams was in the course of his duties. “A police officer doesn’t take off his hat and put his hat back on. And so, the Crown’s argument was that he was asked by the commissioner of police to stay away from the investigation involving his son. And that, by virtue of meeting with the witness that he knew to be a witness in the case was actually not staying away from the case,” Meloche told the media.

“She added: “He was instructed in the performance of his duties, not to interfere with the case and to meet with the witness. So therefore, the crown’s position all along is that he was in the position of his duties, and that a police officer, under the police force ordinance is always a police officer, and cannot choose when not to be a police officer.”She said that Adams assured the

public at a news conference after the murder, that he would not be involved in the case.

“In fact the Crown’s case is that that is not what happened. And bearing the evidence, the Crown was able to bring, including the tape recording that was presented to the commissioner of police some months after it was taken. That, in fact, would have met the criteria of the charge as far as the crown’s position was concerned,” Meloche said. She said that the outcome of the case has put to chance the proper administration of justice and the setting of a standard for the public and the police.

“My personal feelings are not relevant to the process. My personal feelings is not what’s at stake; what’s at stake is the proper administration of justice and to set a standard for the public and for police officers, and that appears to be the standard that is acceptable to the public insofar as the verdict of the jury is. So that is really what is relevant for the Turks and Caicos Islands,” she said. She said that since the crown does not have the right of appeal, it would not be able to question any of the legal findings and legal rulings, including what was direction to the jury.

“So this decision is a final decision,” Meloche said.

Government crafts bill to bring back TC Invest

In its quest to promote the creation of more local businesses in the Turks and Caicos Islands, government intends to take two bills to parliament which it hopes to get passed while seeking to establish a policy to undergird the development of such enterprises. Premier Hon. Dr. Rufus Ewing, while giving a wide-ranging interview to talk show host Dr. Conrad Howell, earlier this week on the Radio Turks and Caicos’ Expressions, said that his government aims to establish an enterprise support similar to that of the now defunct TC Invest. He said unlike TC Invest, this business agency would not carry a banking arm. “This will be a TC Invest-like agency that does not have the banking arm, but the one that really market, promote investment and developing both domestic and foreign investment in Turks and Caicos as well as to support small businesses development in the Turks and Caicos. “The funding has already been made available for the reestablishment of that agency. It will be supported by the MSME policy. This policy will provide the framework as to how we go about encouraging and promoting the developing of small business in Turks and Caicos,” he said, highlighting that a public/private partnership framework has already being crafted. “A lot of consultancy work has been done on that already involving

the government and private entities, including that Banking Association etcetera, that would form a kind of a bureau under the MSME policy that would try to seek funding, that we can later move on to the phase of getting capital support for small and medium size businesses, without going through the robust procedures like we had with the TCI Invest banking division that created lots of problems,” the premier said. He said that the MSME Policy, currently being developed, is being aligned with the manufacturing policy, which the premier said is another critical policy being articulated to promote small businesses, which he said also falls in the manufacturing sector, that the country need to encourage and develop. He said government is also looking to develop an agriculture policy, which he said can serve as another area for agro tourism as well as processing. “A lot of persons can get into agriculture as part of the Small and

Medium Size business Enterprise,” he said. The premier also heighted his government’s creating more than 90 reserved business categories up from 19, when his administration took office. For the longest while we had a situation where he had a reserved category of business. There were 19 reserve categories. We had a situation whereby even in the water sports industry and tourism-related services

-because tourism-related services were so broa d and every lumped into one group - we decided that we are going dissect and stratify the business licensing categories and create new categories of businesses especially those that Turks and Caicos Islanders can capitalize on. In doing, we increase the number of reserved category of business licenses from 19 to over 90-odd, including the restricted categories that we have created. He added; “So I would say that we have not only been talking, but we have been putting our money and our actions where our mouth is, which regards to creating the policies that would safeguard Turks and Caicos Islanders, and we are now creating the framework upon which they can capitalize (especially) on those reserved categories by providing the MSME Programme, and later on receive funding to help them get into business in those areas. So I think you should give credit where credit is due.”

Without Jury Bill on November 17th, 2014“Indeed, in a free Government, almost all other rights would become utterly worthless, if the Government

possessed an uncontrollable power over the private fortune of every citizen”.JUSTICE JOSEPH STORY

Mr. Speaker, to be accused by the crown, charged by the crown, tried by the crown and judged by the crown is a gross representation of

“uncontrollable power.” Mr. Speaker, even in the courts of the United Kingdom and Wales, the use of a trial without jury was first approved in 2009 and prescribed for three main uses in extreme situations where there is “real and present danger” to jurors and suspected jury tampering. That, despite Police protection there is suspected likelihood of interference and that is the only recourse in the interest of justice. The other use, Mr. Speaker, is in cases of domestic violence following the trial of the accused on sample counts in a jury case. The final instance, Mr. Speaker, is when the accused pleads guilty autrefois.

Mr. Speaker, in the prescribed instances mentioned, these followed either failed attempts or successful trials by jury. To deny citizens the right to a trial by jury is an infringement of their very rights and one that I cannot support. A jury trial is a legal proceeding in which members of the public are invited to listen and assist with the decision making or outcome of a trial. Jury trials date back to the 12th Century when Henry 2nd took a major step in developing the Jury Trial. Trial by Jury also became a fairly explicit right from as far back as 1215 as outlined in the magna carte signed by King John. By its very appearance, the presence of a jury gives the accused, as well as the community a sense of fairness and impartiality. To have a group drawn from your peers, one is more able to accept the verdict as these persons are drawn from the community in which one lives. A community, a country, a nation is made up of individuals: They come from all walks of life, they are all shapes and sizes, they come with different backgrounds and different experiences speaking a common language. They are representatives of the community and symbolize each and every one of us. They are not lawmakers, not professionals or experts in the field of law. They are common men who are expected to use a common sense approach to arrive at a just verdict. They are sworn to listen, to bring their collective wisdom and common sense to bear on the matter and they are charged to weigh the evidence and the facts and render a verdict. They are answerable to each other, to their conscience and they have to live in the community in which they have made that decision. The public has confidence in, and a willingness to trust, a jury trial as such a trial brings the power and expression of an entire citizenry to bear upon the administration of justice. To suggest that in some instances trials by jury cannot bring a fair judgement is to suggest that the citizens of the Turks and Caicos Islands are without integrity, void of the ability to absorb and comprehend details specific to that case with

impartiality. This Mr. Speaker, in my mind, bears insult to my people, to me, even, Mr. Speaker, to this Honourable House.But even if this were to be the case Mr. Speaker, in my mind’s wonderings, for a jury of many to have less integrity than a sole person in the role of a judge is unimaginable to me. I ask this honourable House to weigh that probability. To take away the opportunity for an individual to be heard and judged by a panel of their peers is to take away the rights, freedom and opportunities that should be available to all men in all democracies. This is injustice: undiluted; pure and simple! Trial without jury bears high degrees of prejudice and a higher likelihood of injustice with no opportunity of reasoning of the facts. A trial without jury, Mr. Speaker, was meant to be as recourse for failed jury trials, not as a punishing stick for those select few that the crown has prejudged to be guilty before having their day in court. Trial without jury Mr. Speaker, was brought into the laws of the Turks and Caicos Islands for a specific purpose, after the actions of individuals were brought into question, after the crown deemed they had reason to suspect those individuals, after, after, after, Mr. Speaker, and this tells me, that by this very fact, that the crafters and drafters of trial without jury, at least within the Turks and Caicos Islands, have motives that bear questioning, which lack the very integrity, impartiality and justice that they claim to be protecting. Mr. Speaker, members of this Honourable House, we have a duty to protect the rights and freedom of our citizens and to ensuring that we have a fair judicial system that provides fair opportunity for all tried within its laws. We have a duty to remove from our systems any instrument that does not promote the wellbeing of our people. Mr. Speaker as a citizen of these beautiful islands, as a leader and representative of my people, I must stand for integrity, I must stand for impartiality. I must stand for justice. I must stand, Mr. Speaker, for the repeal of the Trial without Jury Legislation.

Turks & Caicos Islands Government, Deputy Governor’s Office is pleased to announce the appointment of Ms. Keisha Bonita Taylor to the post of Human Resource Manager within the Human Resource

Management Directorate. Ms. Taylor who holds a Bachelor’s of Science Degree in Finance with a minor concentration in Human Resource Management, has been a civil servant for over 14 years.

She joined the HR team in April 2010 and worked in the Training Unit for some time as a Human Resource Officer attached to the Training & Development Division before leaving the service for a short while in 2012 during the Voluntary Severance Exercise. She returned in April 2013 through the VS Reengagement Program and has earnestly worked to assist the department in its HR efforts, most especially the Ministry of Education, Youth, Sports and Culture which is the largest employment sector in government. Commenting on the appointment Deputy Governor Anya Williams said; “I am pleased to announce the appointment of Ms. Taylor to her new post within the Human Resource Management Directorate. Carnival Cruise lines threatening to pull out of Grand Turk

Carnival Cruise Line is threatening to pull out of Grand Turk if drugs and alcohol peddlers do not desist from such action, warns Minister of Finance Hon. Washington Misick. Misick, who was making his ministerial address in the House of Assembly on Monday (November 17, 2014), hinted that the alternative to the Grand Turk Cruise Center for Carnival would be the soon-to-be-open US$65 million cruise center in Puerto Plata, Dominican Republic. “Competition is real and there are some real threats to what has been a significant growth subsector in our tourism product – cruise tourism. There are some potential threats because of new entrants to the south of us. I understand that the Dominican Republic is getting ready to open its new port and someone said you can literally eat bread off the street. And Carnival has made it very clear that

unless the Turks and Caicos pulls up its socks, we face the real threat of them pulling out,” the premier warned. He added: “So I want to make every citizen aware, particularly the people of Grand Turk, who largely depend on cruise activities here in the island to be aware of this threat that we are facing.” The finance minister told the House that a meeting was held with the citizens of Grand Turk last week to sensitize, especially those making their living from tourism-related activities, the dangers that loom. “They should be very careful on how they interfere or how they interact with the business. We made it very clear that those persons who are undermining the livelihood of others by deviant behavior such as selling drugs and alcohol on the beach in front of the carnival property (that) they should desist from doing so. Grand Turk, it is very important that we be reasonable,” he entreated. The finance minister was quick to point out that government was in no way encouraging that the beach area that the Carnival guests normally bask be declare a no man’s land for local vendors, but was in fact warning against threatening the industry by harassing the tourists with drugs and alcohol. “This is not an attempt to prevent anybody from using the beaches; this is

about livelihood and is about protecting the ability to put bread on the table. And it is everybody’s business to ensure that the few bad apples don’t spoil it for everyone else,” he emphasized. He said that government is committed to stamp out any illegal activity that stands to threaten the tourism sector, and as such is beseeching all to play their part. “I will do everything within my power to assist, but as the slogan goes, ‘its (tourism) everybody’s business’, to ensure that this subsector survives and prosper and government is taking serous action to do just that,” he said. In the meantime, Misick said that government would be drawing down on the Carnival Infrastructure Funds before Christmas, in order affect major infrastructural improvements to the aesthetics of Grand Turk, including the rebuilding of the North Ridge Road going to the lighthouse. Meanwhile, Misick said that the tourism sector continues to grow at a rapid rate both in cruise and land base. “Tourist arrivals in the Turks and Caicos Islands increased by 21 percent during the first six months of the fiscal year, when compared with the same period last year. To put that number in context, we are talking about April to the end of September. When we take it from January 1st to the end of September, we increase close to 39 percent. Cruise ship arrival from April

to September increased by 26.9 percent over the same period over last year. “ He said also that the Strategic Policy Planning Department (STPPD) has indicated that the real GDP projection of 4.6 percent for 2014 is still on target for the Turks and Caicos economy this fiscal year. He said that the growth rate is in line with emerging markets growth rates such China and India. “The economy of Turks and Caicos is stable, and future projection shows signs of continuous and positive growth and to a large extent, the people of these islands have adjusted and are continuing to adjust to the new normal in economic conditions, not only in Turks and Caicos but in the world,” he said. He said though that in order for the TCI to grow even further, there has to be a reallocation of scarce resource, lowering of the unemployment rate and emerging of new industries. He noted however that actual growth will depend on the strength of US economic recovery and the commitment of the Turks and Caicos Islands government to find ways to further diversify the economy, making it less reliant on the tourism sector. “We are not a commodity exporting country such as Guyana, Trinidad & Tobago and so on. Kazz Forbes quits local Miss Universe Pageant

When the Miss Turk and Caicos Islands Universe Pageant is held next year there will be a new production franchise team as fashion designer Kazz Forbes who managed the event for the past two years have thrown in the towel. In his letter, Forbes advised local franchise holders – the Tourist Board

– that he had decided some time ago to quit managing the pageant but did not want of his decision eclipse the local participating in the January 25, 2015 Miss Universe Pageant. “Please be advised that I have no interest in renewing the MOU (Memorandum of Understanding) with the Tourist Board. This decision was made months ago but I did not want this news to overshadow our participation in the upcoming Miss Universe Pageant,” the sketchy letter said in part. The MOU is a two-year agreement which ends in 2015. When contacted, Ralph Higgs, Director for the Tourist Board thank Forbes for his involvement in the event for the past two years, saying that he believed Forbes did a marvelous job with the local franchise. “The MOU ended the early part of next year, and he decides that he did not want to reengage in it. We fully accept that decision, we wish him

well in his future endeavors. We asked him to honour his commitment to the MOU for the remaining time left on it, so I think that there is an amicable ending to the relationship, and I think he has done his best to elevate the whole Turks and Caicos Miss Universe brand,” Higgs said. Higgs explained that The Tourist Board, which owns the local franchise for the Miss Universe Pageant for the past three years, enter into MOUs with a locally-based entity to produce the show, covering certain terms and conditions, among them is that the Miss Turks and Caicos Universe winner is well rehearsed and ready for participation in the Miss Universe Pageant. Higgs said that the timeline of the notice given by Forbes is reasonable

since it would give the Board time to wind up its phase with him and to find a new production team for the staging of subsequent events. “I thought not withstanding a very tough economy and the ability to raise funds from the private sector for sponsorship; I thought we achieved some good benchmarks. It is the first time that the Tourist Board has held the franchise, and now we are able to say what the production team should look like; we can lean on the producers to bring standards to the competition,” Higgs said. Higgs said that the Tourist Board secured the franchise in a bid to raise the standard of the local pageant. “We pay a franchise fee to the Miss Universe Pageant every year. We took the decision some three years ago to rescue and hold the franchise, and for the first time, in many, many years that the country has been participating in the Miss Universe Pageant, we can now hold the producers of it to account,” he said. In the meantime, Higgs said that based on the expressions of interest already been shown by individuals and groups in the community, to take over the production of the event, the Tourist Board will have no problem signing a suitable candidate or set of candidates to move forward with the event next year.

“I am absolutely sure we will have no difficulty finding a person or a group of persons to be the producers of the pageant. And I think we have the right formula to attract capable persons to do so. “The country holds the franchise, we can set the standard, because, after all, Miss Turks and Caicos is an ambassador for the Turks and Caicos brand, and we want to make sure that we have the best system in place to select a Miss Turks and Caicos. “And then we want to be sure that once one is chosen that the whole system is in place to ensure that she is prepared to represent the country overseas. I think the standard has been raised. We have attracted some beautiful and beautiful Turks and Caicos Islanders and propelled them into the spotlight,” he said.

TCI Hospital partners with TCI Community College

The Turks and Caicos Islands Hospital and the Turks and Caicos Islands Community College (TCICC) have signed an affiliation agreement November 12th, 2014, aimed at creating synergistic opportunities for Turks and Caicos Islanders, through the development of instructional programs to support a variety of health care careers for local students. The affiliation agreement, which outlines the collaborative relationship between the two organizations, will provide TCICC students with hands-on clinical and practical experience outside the classroom. It will also strengthen respective research efforts, provide the opportunity for the establishment of international accreditation, and support one another’s efforts to achieve and maintain excellence. The agreement, the first of its kind for TCI Hospital, will also garner opportunities for students in fields of study such as business and engineering, in addition to programs in nursing and medical sciences.

This is a win-win situation, says TCI Hospital CEO, Jill Magri.

“Hospital staff will have the opportunity to impress upon young, bright minds that TCI Hospital is a great place to practice, while the Country will benefit from having more Turks and Caicos Islanders employed at both of our facilities.” She added, “ These programs will also develop nursing candidates that can support the Ministry of Health’s clinics, in addition to private community provider clinics. TCI delegation visits Haiti HE The Governor Peter Beckingham, Permanent Secretary Ministry of Border Control and Labour Clara Gardiner, and Deputy Commander (Marine Division) Inspector Warrican visited Port au Prince on 13 and 14 November at the invitation of the Haitian Ministry of Foreign Affairs. The working visit was to finalise a Memorandum of Understanding (MOU) between Haiti and the Turks and Caicos Islands and to discuss with the Haitian Government and other representatives in Port au Prince issues of common interest. “I am pleased to say that the Haitian

Government have agreed the final text of an MOU,” commented the Governor.

“This will be signed by representatives of the two Governments, after which we will release the text, and it will cover economic ties as well as illegal migration and people-to-people links.”

“The MOU will not suddenly change the relationship nor immediately reduce illegal migration,” the Governor continued,

“but it is an indication of the seriousness with which both Governments view the growing relationship.”

As well as talks with the Haitian Government, including the Foreign Minister and the Minister of the Haitian Diaspora, the TCI delegation also held meetings with the EU, Bahamian, US and Canadian Ambassadors, the heads of the UN

mission in Haiti and the International Organization for Migration (IOM.) “There are a number of other possible initiatives arising from our visit, including registration of Haitians in TCI, which I am sure will assist our country to

work more closely and effectively with Haiti and the key regional players. Everyone we met recognizes the importance of TCI, despite our small population, in the nexus of opportunities and issues in the relationship with Haiti.”

TCIG ADVISES THE PUBLIC TO BEGIN PREPARING FOR SCHOLARSHIPS SEASON 2015

The Ministry of Education, Youth, Sport and Library Services is once again inviting candidates to submit applications for its annual scholarship Program for studies beginning September 2015. Although the deadline for submission is April 30th 2015, the Secretariat is asking that interested applicants begin to consider their applications from very early and be guided by the information below. The Ministry advises that the National Scholarship Program is a government scholarship program aimed primarily at meeting the development needs of the Turks and Caicos Islands. As such the government has listed a number of priority areas for which it aims to address and for which consideration for scholarships will be aimed in the first instance. A list of priority areas along with the policy document and applications forms will be uploaded on www.gov.tc. All interested applicants are asked to visit this site for these relevant documents. Applicants are also advised that government can announce or reserve a block of funds for a particular area in any given year as it did with the area of Education for 2014. This is an indication of areas of importance for the country’s needs.

INTERESTED APPLICANTS ARE TO BE GUIDED AS FOLLOWS:

•Consideration will be given to applicants who have applied to schools in the United Kingdom and the Caribbean in particular the University of the West Indies. It is in these areas we are able to gain maximum economic efficiencies and ensure value for money. •Applicants wishing to study medicine: Our preferred school is the University of the West Indies. Our recent country contributing status will allow TCI’s students to qualify for fee discounts and so make it possible for more students to access tertiary level education. •Support for study for medicine in the US and other private instructions will not be considered. UWI and UK based schools are the institutions of choice. •Scholarships will not fund foundation programs, all applicants must have matriculated to the degree level. •All awards are up to Bachelors’ level. In some instances other levels may be considered but they are not awarded automatically. A separate application is needed for each level of study. •Applicants are asked to ensure that their University/College is either on the recommended list or are fully accredited schools. The list published is in no way an exhausted list. The Secretariat will conduct research to determine if your school is a fully accredited school. •There are a limited number of scholarships that will be awarded. The board is limited in the amount of scholarships and so will weigh each criterion and compare the quality of the applications to determine the successful candidate. •The National Secretariat Officers will commence their round of meetings for this year within the month of November to all High School and the Community College. The Prosecution Did Not Prove its Case Against Rodney Adams

There were in the beginning, at least five charges of corruption being brought against Acting Deputy Commissioner Rodney Adams stemming from the incident of his making a tape recording of a person of interest in two shooting incidents. One of the incidents led to the shooting death of Kaziah Burke. The charges were brought using section 44 of the Integrity Commission Ordinance. After a number of legal maneuverings, only two of those charges were argued before a judge and a Jury of Mr. Adams’ peers. The Jury comprised five women and two men and the Foreperson ended up being a lady.

COUNT ONE:

ACT OF CORRUPTION: Contrary to Section 44(d) of the Integrity Commission Ordinance, Cap 109, namely, recklessly allowed his private interest to improperly influence his conduct in the performance of his duties as a public official.

PARTICULARS OF OFFENCE

That you Rodney Adams, on or about 22nd May 2013 in Providenciales, recklessly allowed your private interest in relation to your son Roderick Adams to improperly influence your conduct in the performance of your duties as the Acting Deputy Commissioner of Police in the Royal Turks and Caicos Police Force, by meeting with and recording a conversation with Dorrell Williams, a witness to the murder of Kaziah Burke on 13th April 2013.

COUNT TWO:

ACT OF CORRUPTION: Contrary to Section 44(h) of the Integrity Commission Ordinance, Cap 109, namely, interfered with

the performance of a duty of a public official with a view to recording a conversation with Dorrell Williams, a witness to the said murder, before he gave his statement to the Investigating Officers. The officers whose duties you interfered with were Inspector Grantley Williams and/or Acting Inspector David Wilson: The intended benefit for Roderick Adams was a recording of a statement from Dorrell Williams indicating that he, Roderick Adams, was not involved in the murder of Kaziah Burke, before the Investigating Officers interviewed Dorrell Williams. In our criminal justice system, two main things must happen to ensure a conviction: the prosecution must prove its case, and must do so beyond a reasonable doubt. The evidence presented must be sufficient persuasive that the Jury is sure of the guilt of the person charged. If there is any doubt whatsoever, then the benefit of such doubt must redound to the benefit of the accused person. The Constitution and the law allowed Mr. Adams to be represented at all times, but at the end of the prosecution’s case, he need not testify on his own behalf, or call any witness to help with his side of the events. For me, the tide turned in Mr. Adams’ favour, when the Commissioner of Police, the first witness called, testified that the charges were instanced by a disagreement between himself and Mr. Adams as to the contents of a recording and he did not stop to fully hear Mr. Adams’ side. Further, Mr. Adams at no time received information from the Police and did not instruct any Officer in the conduct of the investigations. After the prosecution closed its case against Mr. Adams based on the charges before the Supreme Court, Mr. Ariel Misick, Q C on behalf of Mr. Adams, made what is known as “a no case submission” on behalf of his client. That was just another brilliant piece

of work by Mr. Misick, and confirmed once again for me, that if I have to, God forbid, go before the Court on a criminal matter, my legal representative, must be Mr. Misick. He took almost two hours dealing with the facts and they law, showing to the Chief Justice, Her Ladyship Margaret Ramsay-Hale, that the prosecution had not discharged it obligation, therefore Mr. Adams had no case to answer. The prosecution had to respond to the submission. Even to this day, the man’s name escapes me, but what I can say is that he is a QC from Canada, brought in by the DPP who is also Canadian and that the Commissioner of Police who instigated the matter, is Canadian. Now as to the prosecution’s response, I can say in no uncertain terms, that that was the worst response I have ever heard to the defense’s no case submission that I have ever heard in my entire life. Trust me, I have heard quite a few, at home as well as abroad. Initially, the Chief Justice ruled that Mr. Adams had a case to answer on the two counts, so Mr. Misick began

and completed his closing arguments to the jury. At the end of his summing up, the Chief Justice announced that she had made an error, in that the prosecution did not prove a particular ingredient to substantiate its charge with respect to count two and therefore, she had to direct the Jury to return a not guilty verdict on that count. The prosecution was livid and went as far as to question the Chief Justice as to the signal that would be sending to the Commissioner of Police. I could see Her Lady turning as red in the face as the dirt from St. Elizabeth and had to constrain herself from issuing a contempt citation! Eventually, the prosecution addressed the Jury and to be truthful, I did not see the necessity of employing outside counsel for this case, save and except that it was another joy ride by foreign elements at our expense. A first year law student could have conducted the case. There were no particular points of law that needed to be expounded on that created the necessity to bring in such a person. It certainly begs the question as to why Ms JoAnn Meloche was hired in the first place, as the Director of Public Prosecutions in the face of opposition from both the Premier and Leader of the Opposition, as well as the Bar Council. The Chief Justice summed up to the jury the important ingredients of the both the prosecution’ and defense’s case and reminded the Jury that no matter what counsel on both sides said, the law belonged to her and the facts belonged to them. They went away properly instructed. They came back and asked for clarification on a particular point and then retired to continue their deliberations. Eventually, they came back with a unanimous verdict of not guilty! This episode should be a serious wake up call for Mr. Adams and many other Turks and Caicos Islanders, in that if the “green is being burnt, what about the dry?”

Anti-government protest in Haiti turns violent

Thousands of Haitians marched in the capital Port-au-Prince in protest at a delay in the country’s legislative and municipal elections. The polls are already years overdue and were scheduled for last Sunday. They were postponed because of an ongoing stalemate between the government and a group of opposition senators over an electoral law. The march began peacefully when a crowd grew to a few thousand people in slums that are opposition strongholds. But as demonstrators walked by an intersection in Delmas 32, the critics of President Michel Martelly’s administration and pro-government residents began shouting and throwing rocks at each other. As the melee quickly escalated, Associated Press journalists witnessed three people apparently getting hit by bullets. One was hit in the neck and appeared gravely wounded. The two others sustained wounds to limbs. As a panic ensued in the densely-packed area of cinderblock houses, officers with the Haitian National Police fired tear gas and most demonstrators dispersed. Police spokesman Frantz Lerebours and other authorities made no immediate comment about

the violence or any arrests. Even after the violence, nearly 1,000 protesters continued their Tuesday march demanding Martelly’s resignation and a chance to vote in long-delayed legislative and municipal elections. The president was supposed to call elections in 2011 for a majority of Senate seats, the entire Chamber of Deputies and local offices. But he hasn’t done so because the Senate has yet to approve an electoral law authorizing the vote. The Chamber of Deputies has approved the legislation, but it is being held up in the Senate by six senators who have blocked a vote, arguing it is unconstitutional and favors the government. Martelly administration officials blame the standoff on the six senators, insisting that the government wants to hold the elections but can’t because the lawmakers are blocking the vote by preventing a quorum. Haiti is the poorest country in the region and is still struggling to recover from a 2010 earthquake.Protesters lit piles of wood in the central neighbourhood of Bel Aire before marching to a wealthy hillside neighbourhood, where riot police guarded hotels, shops and Haiti’s elections office.

Some demanded President Michel Martelly’s resignation for his “inability to organise elections in the country”.Two opposition activists who had organised the protest were arrested by police for “public unrest and inciting violence”. Mid-term senate elections in Haiti had been due in May 2012, while the municipal poll is three years behind schedule as Haiti slowly emerges from the earthquake which left much of the country devastated in 2010. In June, President Michel Martelly decreed that the elections be held on 26 October. The date was set after lengthy talks mediated by the president of Haiti’s Bishops’ Conference, Cardinal Chibly Langlois, intended to overcome the political deadlock between the opposition and the government. But after the National Assembly failed to pass an electoral law in time, the office of Mr Martelly announced another postponement on Sunday. No new date has been set, but the statement said that “President Michel Martelly, in his constant concern to guarantee political stability, promises to pursue consultations with the different sectors of national life in order to hold the elections as soon as possible”. Opposition politicians accuse President Martelly of wanting to rule by decree - a likely scenario if no elections are held before the lower chamber’s term runs out in January. The government argues that opposition politicians are also dragging their feet in the hope of extending their time in office without elections.

Bob Marley family launches global marijuana brand

The family of Jamaican-born reggae star Bob Marley launched a first-of-its-kind global cannabis brand on Tuesday. Called Marley Natural, it will hit the market in late 2015 – and is aimed at both medical and adult-recreational use (21 and over). It is a venture of Bob Marley’s widow, Rita, who is also a reggae musician, and his children and grandchildren, in partnership with Seattle-based Privateer Holdings, a leading cannabis focused private-equity firm. Bob Marley’s name and legacy – attached to a mass-marketed global marijuana brand – could be a killer app in this booming industry. Legal marijuana sales are expected to grow from $2.4 billion in 2014 to $10 billion by 2018, according to the cannabis investment group ArcView. The meteoric growth in revenue is predicated on an expected transition of marijuana buying habits, from buying it on the illegal black market to purchasing it in state-regulated and taxed retail stores and dispensaries. However, marijuana is still illegal under federal law, and there are many obstacles to success for investors and brands. It is currently extremely difficult for cannabis-related businesses to obtain banking services, and many business expenses can’t be deducted under federal tax law. Production, processing and distribution can generally be done only within the state where the marijuana is sold. Interstate and international shipping of marijuana is not permitted.

Marley Natural products will include heirloom Jamaican cannabis strains in smokable and vaporizable form, Privateer CEO Brendan Kennedy said last week in an interview at a major trade show for pot – the Marijuana Business Conference and Expo – in Las Vegas. The brand also features therapeutic cannabis and hemp-infused lotions; pot paraphernalia, such as smoking implements; carrying cases and other accessories. The Jamaican marijuana strains offered will be similar to those Bob Marley favored during his life, such as Lamb’s Bread and Pineapple Skunk, Kennedy said. Marley Natural will only be

available for sale in local, state, and national jurisdictions where marijuana use is legal, according to Privateer. A total of 23 states and the District of Columbia now permit marijuana use for medical purposes; four states plus the District of Columbia have legalized recreational adult-use, including Colorado, Washington, Oregon and Alaska (the latter two by voter initiative in November 2014, with implementation pending under state law). Legalization advocates predict California, Nevada, Arizona, Missouri, Massachusetts, Maryland, Delaware, Maine, New Hampshire, Vermont and Hawaii could pass similar initiatives by 2017 (see map below). Several

European countries and Uruguay also permit some legal use of marijuana. A new online ad for Marley Natural begins with sweeping aerial views of a tropical jungle and a voiceover that says: “In Bob Marley’s vision for a better world, one united by love, respect and social justice, he advocates for the positive power of the herb,” as reggae music swells in the background. The brand’s logo appears in the video. It includes an image of the Lion of Judah, a powerful spiritual symbol for the Jamaican Rastafari movement, which reveres cannabis. “In many ways our father helped start this movement at least 50 years ago,” Cedella Marley, Bob Marley’s daughter, said in an interview before the launch. “He said it himself: ‘When you smoke the herb, it reveals you to yourself.’ So it feels very natural to us to use his voice on a global scale, getting the message across of the many benefits of cannabis.” Members of the Marley family insist their new brand is aimed at legal adult users 21-and-over, and not the young. They promise that both the labeling and the marketing will be clear on this point. “Children like music,” said Rohan Marley, Bob Marley’s son. “But just like with other adult products – tobacco, consumption of alcohol, going to a nightclub – people have to be responsible. Our label will always gear toward adults and steer away from children. We want people to have a responsible mind, to have full knowledge, to understand the benefits of cannabis. It’s not a toy.”

Police investigating social media use of plane crash pictures

SENIOR Assistant Commissioner of Police Emrick Seymour has expressed dismay over the unconscionable circulation on social media of gruesome pictures of the victims in the plane crash in Grand Bahama last week. “It is a despicable act and we are pursuing an investigation into it,” Mr Seymour said yesterday, ten days after the fatal crash that claimed the lives of Dr Myles Munroe, his wife Ruth, and seven others on board the Learjet 36. Immediately following the incident, photographs were taken of the victims at the crash site and circulated on social media. ACP Seymour said the release of such photographs is disrespectful to the victims and their families. “It is so distasteful for people to really take advantage of these unfortunate situations by sending out all these photographs all over the worldwide web for everyone to see, without regard for the victims’ family,” he said. “I want to ask them to cease. We are pursuing the investigation and wherever we find there is a breach we will take appropriate action against them. Not only this particular matter, but we are looking at all

such incidents to see how we can get to the bottom of it.” ACP Seymour is appealing to Bahamians to exercise sensitivity in such situations.

“It is sad that Bahamians would try to take advantage of the misfortune of others by parading people’s picture over the social media for others to see for the fun of it. I get irate when I see things like that happening. I am asking persons to respect the sanctity of the victims and their families, if you have any bit of humanness in you,” he said. ACP Seymour said there is a law and people have been prosecuted under it on two different incidents. “We will pursue the matter and whoever we find culpable we will take action against them,” he warned. Dr Munroe, founder and president of Bahamas Faith Ministries International (BFMI), his wife, Ruth, Dr Richard Pinder, vice president of BFMI, newly ordained youth pastors Lavard and Radel Parks and their young son Johanan, pilot Stanley Thurston, co-pilot Frankhan Cooper and American Diego DeSantiago were on board and on their way to attend the Global Leadership Forum in Freeport. The Learjet was completely

destroyed on impact and all nine persons were killed instantly. The plane went down around 5pm in bad weather after hitting a crane at the shipyard. The pilot was making an approach to land at the airport. Investigations are underway into the cause of the crash. Meantime, Transport and Aviation Minister Glenys Hanna Martin said it could take several months before the investigations into the Learjet 36 crash in Grand Bahama, which claimed the lives of prominent pastor Dr Myles Munroe, his wife, and seven others, is completed. She urged family members and the public to be patient while awaiting a response. Speaking during yesterday’s House of Assembly session, Mrs Hanna Martin confirmed that a team, including the Bahamas Department of Civil Aviation, will meet in Washington DC at the headquarters of the National Transportation Safety Board next month “to further process the investigation and to commence a formal analysis of the data achieved from the” recently obtained cockpit voice recorder and digital electronic engine monitors.

Cayman Islands schools under the microscope

Government is spending almost $300,000 on a pair of reviews that will look at the quality of teaching and leadership in all Cayman Islands schools and evaluate the overall standard of the education system. According to the Cayman Compass, a team of six inspectors will visit all 16 government schools as part of a comprehensive “baseline inspection” already under way. That process will take place in tandem with a more general review of the governance of education in the Cayman Islands, which will also evaluate alternative models, including the possibility of putting some schools under private sector management. Mary Bowerman, a former chief inspector of schools in the Cayman Islands, has been contracted to lead the “baseline inspections,” which will focus on student achievement and quality of teaching and leadership, with a specific focus on mathematics and English. The inspectors will produce individual reports on each school, as well as an overarching review, to be tabled in the Legislative Assembly at the end of the school year. It is the first time such a comprehensive review, involving every government school, has been conducted. A team of consultants from U.K.-based Independent Schools Inspectorate, which is sanctioned by the British government to inspect independent schools, has been hired to work with Ms. Bowerman on the $230,000 review. Government’s own internal inspection unit has been effectively disbanded after staff numbers dwindled to zero. No full school inspections have been conducted since 2008. Education Minister Tara Rivers said the unit would ultimately be revived, with possible policy or legal changes introduced to ensure its independence from the Ministry of Education.

Cable and Wireless could be in breach of the licences

The Eastern Caribbean Telecommunications Authority (ECTEL) has warned that both Cable and Wireless (CWC) and Columbus Communications could be in breach of their licenses if they engage in activities, which can unfairly prevent, restrict, or distort competition. The ECTEL statement Wednesday was in response to the proposed purchase of Columbus by CWC announced earlier this month. It said that in reviewing the preliminary information available on the planned purchase, under the current regulatory regime, telecommunications license holders including CWC and Columbus maybe in breach of their licenses. “The decision to combine business by the two companies can have a negative impact on the telecoms sector

and this has provided further impetus for the revision of existing legislation and rules governing competition in the sector, including the proposed new Electronic Communications Bill,” ECTEL statement read in part. ECTEL cautioned that this development could potentially result in a negative impact on competition, and reduce choice by consumers of both services and service providers. “Since the advent of liberalisation, the prices of all telecommunications and ICT services have been significantly reduced due to competition in the region. “ECTEL is mindful that over the past 15 years there has been major development in the telecommunications sector under the guidance of independent regulators in the Eastern Caribbean.

“Increased monopolisation therefore can erode the gains made by the liberalisation and create challenges for the entrance of new service providers,” ECTEL noted. ECTEL said both itself and the National Telecommunications Regulations Commission in the member states will intensify collaboration with other regulators in the Caribbean region to seek further information in order to advise member governments on the issue. The sub-regional body claims that it urged the OECS Commission to move with some haste to establish the OECS Competition Commission. In its latest comment on the alliance Wednesday Digicel called on all regulatory bodies across the Caribbean “to see through the smokescreen put up by CWC/

Columbus and subject the proposed transaction to the fullest regulatory scrutiny.” The company was responding to CWC’s recent comments in the media about the money it was spending on the acquisition and its assertion that Digicel was suffering from “sour grapes.” “Digicel can confirm that it looked at Columbus Communications several months ago and that it was Digicel’s assessment that the value of Columbus Communications was no more than US$2 billion. The assertion by the UK listed CWC that Digicel is suffering from “sour grapes” couldn’t be further from the truth as the reality is Digicel was not prepared to overpay for the business–unlike CWC,” Digicel said in the statement.

Congressman wants US to address “sparse diplomatic presence” in the Caribbean WASHINGTON D.C., United States - A senior Congressman is calling for the United States to have a greater presence in the Caribbean. Eliot L. Engel, the senior Democrat on the US House of Representatives’

Foreign Affairs Committee, who represents New York, said that Caribbean countries are “of profound importance to the United States and particularly to the millions of Caribbean-American citizens in our country.

“Unfortunately, our sparse diplomatic presence in the Caribbean significantly impedes our ability to engage more deeply with our partners,” he wrote in an opinion piece in the Miami Herald. “That is why I

recently introduced the United States Caribbean Partnership Act of 2014 in the House of Representatives,” he said, noting that the bill would establish US embassies in the five countries in the Caribbean with which the US has diplomatic

relations but no permanent diplomatic presence. He identified them as Antigua and Barbuda, Dominica, St. Kitts and Nevis, St. Lucia and St. Vincent and the Grenadines. Engel said passage of his legislation

would deepen the relationship between the United States and the Caribbean and build on the Obama administration’s efforts to enhance economic, energy and security cooperation with the region.

five million immigrants WASHINGTON — President Obama took a historic, legacy-defining step Thursday night when he announced a plan to protect 5 million undocumented immigrants from deportation, infuriating Republicans but satisfying immigrants who have fought for years for such relief. The president’s plan will allows u n d o c u m e n t e d immigrants who are parents of U.S. citizens and legal permanent residents, known as green card holders, to legally live and work in the country for a period of three years. He also expanded the pool of undocumented immigrants brought to the country as children who are eligible for protected status. The plan also makes it easier for foreign workers trained in high-tech fields to enter, and stay in, the country. And it refocuses the nation’s entire immigration

enforcement apparatus on a much smaller pool of immigrants — those with criminal records , ties to terrorist organizations or gangs and people who crossed the border in the past year. “Mass amnesty would be unfair. Mass deportation would be both impossible and contrary to our character. What I’m describing is accountability — a commonsense, middle ground approach,” Obama said from the East Room of the White House. “If you meet the criteria, you can come out of the shadows and get right with the law. If you’re a criminal, you’ll be deported. If you plan to enter the U.S. illegally, your chances of getting caught and sent back just went up.” Republicans in Congress promised to do everything in their power to block the president’s actions. Some have called for impeachment. Some want to sue the president in federal

court. And with Washington in the middle of debating next year’s budget, some want to use Congress’ power of the purse to defund his move. “Make no mistake,” Republican Leader Sen. Mitch McConnell, R-Ky., said on the Senate floor Thursday.

“When the newly elected representatives of the people take their seats, they will act.” Obama said he was forced to act because of Congress’ inability to pass a bill to overhaul the nation’s broken

immigration system. The Senate passed such a bill last year that would have allowed 8 million undocumented immigrants to become U.S. citizens and dedicated $38 billion to increase border security. But that bill was rejected by House Speaker Rep. John Boehner, R-Ohio, and the chamber failed to consider any plan of its own. There is also serious disagreement over the legality of Obama’s move.The White House pointed to the actions of previous presidents,

including Republicans Ronald Reagan and George H.W. Bush, who issued executive orders granting legal status to migrants. Officials said the White House counsel’s office has vetted the plan, and they are confident the orders can withstand legal scrutiny. “The actions I’m taking are not only lawful, they’re the kinds of actions taken by every single Republican President and every Democratic President for the past half century,” Obama said. The Republican position: Reagan and Bush did executive orders as adjustments to a congressional immigration bill passed in 1986, while Obama is going around Congress. Some described the new executive orders as a political power grab designed to appeal to Hispanic voters. The president’s plan will focus first on granting protections to

nearly half of the nation’s 11 million undocumented immigrants. Obama created a program in 2012, known Deferred Action for Childhood Arrivals, or DACA, that allowed undocumented immigrants brought to the country as children to register with the federal government, pass a criminal background test and pay a fee in exchange for temporary legal status and a work permit. The new plan expands that program to include undocumented immigrants who are parents of U.S. citizens and green-card holders. None of the beneficiaries of Obama’s plan would be eligible for U.S. citizenship or green cards, but they will receive work permits, Social Security numbers and have the guarantee that, unless they commit a serious criminal offense, they will not be deported.

Senate blocks NSA phone records measure

WASHINGTON - The Senate blocked a bill to end bulk collection of Americans’ phone records by the National Security Agency, dealing a blow to President Barack Obama’s primary proposal to rein in domestic surveillance. The 58-42 vote was two short of the 60 needed to proceed with debate under Senate procedural rules. Voting was largely along party lines, with most Democrats supporting the bill and most Republicans voting against it. The Republican-controlled House had previously passed its own NSA bill. The legislation would have ended the NSA’s collection of domestic calling records, instead requiring the agency to obtain a court order each time it wanted to analyze the records in terrorism cases, and query records held by the telephone companies. In many cases the companies store the records for 18 months. The revelation that the spying agency had been collecting and storing domestic phone records since shortly after the terrorist attacks of Sept. 11, 2001, was among the most significant by Edward Snowden, a former agency network administrator who turned over secret NSA documents to journalists. The agency collects only so-called metadata - numbers called, not names - and not the content of conversations. But the specter of the intelligence agency holding domestic calling records was deeply disquieting to many Americans. The bill had drawn support from technology companies and civil liberties activists. Its failure means there has been little in the way of policy changes as a result of Snowden’s disclosures. Pressured to act, Obama in January proposed curbing the NSA’s authority and the House in May passed a bill to do so. While the measure was pending, the NSA continued to collect American landline calling records, though the program does not cover most mobile phone records. The law authorizing the bulk collection, a provision of the post-9/11 USA Patriot Act, will expire in June 2015. That means Congress would have to pass legislation re-authorizing the program for it to continue.

Florida State shooter suspected Government

TALLAHASSEE, Fla. — A Florida State University alumnus and attorney who shot three people at the school’s library early Thursday believed the government was targeting him for persecution, detailing his thoughts in a journal and in videos detectives obtained, authorities said. Officers fatally shot Myron May, 31, during an exchange outside the library about 12:30 a.m. May reloaded at least once and tried to enter the library, where about 450 students were studying for midterm exams, but was blocked by lobby security barriers that

permit only students and staff inside, Tallahassee Police Chief Michael DeLeo said. “Based on our initial review of the documents and his videos and his postings, it’s clear that Mr. May’s sense of being and place in our community was not what most people would refer to as a normal,” DeLeo said. “He had a sense of crisis and he was searching for something.” The shooting sent students scrambling for cover in the book aisles and barricading themselves in with desks amid screams from classmates. “I ran for my life,” said Allison Kope, a freshman from Cocoa Beach, who was on the

library’s first floor. “I ran right out the backdoor. My laptop and everything is still in there. It was shock. It was just instinct. Miss Honduras Body Recovered, Nation Mourns

Tears and anger poured out for the dark-haired beauty who was to have flown to London on Wednesday to represent Honduras at the Miss World pageant, only to be found shot to death with her sister on a remote river bank. After the bodies of the reigning Miss Honduras, 19-year-old Maria Jose Alvarado, and her sister Sofia, 23, were discovered early in the day, police announced that the sister’s boyfriend had confessed to killing them last week in a fit of jealousy over his girlfriend dancing with another man. Dozens of relatives and friends of the beauty queen gathered for a candlelight vigil at the college she attended, remembering a down-to-earth young woman who aspired to be a diplomat, went out without makeup and worked as a model to help support a humble family. “She was simple, humble, a total innocent smiling and without malice,” said Ludin Reyes, a fellow student at the Technical University of Honduras. The Center for Women’s Rights, based in the Honduran capital of Tegucigalpa, issued a statement condemning the sisters’ killing and noted 328 women have been slain in this Central American nation so far in 2014.

“The case of Mary Jose and Sofia show clearly the situation of generalized violence against women and the nonexistent response of the Honduran government to prevent, investigate or punish it,” the statement said. The bodies believed to be the sisters were found buried near the spa where they disappeared a week earlier while celebrating the birthday of the sister’s boyfriend, Plutarco Ruiz. At some point during the night of Nov. 13, a heated argument broke out over the sister dancing with another man and Ruiz pulled a gun, firing first at his girlfriend and then at Alvarado as she tried to flee, said the National Police director, Gen. Ramon Sabillon. Alvarado was hit twice in the back. Claudio Cecilio Munoz, an uncle of the sisters, said Ruiz came to the family’s modest house on a dirt road the day after the young women disappeared to invite them to lunch, and returned several days to help with the search. He described Ruiz not as a boyfriend, but as someone who was courting his niece. “We didn’t file a complaint right away because we were waiting for a telephone call asking for ransom,” Munoz said. “On Saturday their mother and I went to put in a complaint and the killer was with us.” Ruiz led investigators to the gravesite where he and an alleged accomplice buried them in Santa Barbara, about 240 miles (400 kilometers) west of Tegucigalpa. Alvarado’s body, wrapped in brown plastic, was loaded into the back of a pickup truck just hours before she was to have boarded a flight to London to compete in the Miss World pageant. The killing of the sisters highlights what experts call an alarming trend of violence against women in Central America, fueled by poverty, male chauvinism, domestic violence, street gangs and drug trafficking. Charles Manson gets marriage license CORCORAN, Calif. — Mass murderer Charles Manson plans to marry a 26-year-old woman who left her Midwestern home and spent the past nine years trying to help exonerate him. Afton Elaine Burton, the raven-haired bride-to-be, said she loves the man convicted in the notorious murders of seven people, including pregnant actress Sharon Tate. No date has been set, but a wedding coordinator has been assigned by the prison to handle the nuptials, and the couple has until early February to get married before they would have to reapply. The Kings County marriage license, viewed Monday by The

Associated Press, was issued Nov. 7 for the 80-year-old Manson and Burton, who lives in Corcoran — the site of the prison — and maintains several websites advocating his innocence. Pronounced dead, 91-year-old Polish woman awakens WARSAW, Poland - A Polish doctor says she has been in “deep shock” since learning that a 91-year-old woman she pronounced dead woke up in a morgue several hours later. The doctor - identified in the media as Wieslawa C. - said on TVN24

television Friday that she was sure the patient was dead after finding

“no basic life functions” during a morning house call on Nov. 6. She said she checked for a pulse on a forearm and neck arteries, listened for a heartbeat and the sound of

breathing, and checked the pupils for reaction to light, but found none.

“If I had had doubts, I would have called the ambulance, done an electrocardiogram, but I was sure that the patient is dead,” the doctor said. The doctor examined the elderly woman,

identified by the media as Janina Kolkiewicz, in the eastern town of Ostrow Lubelski after relatives noticed she was not breathing. Some two hours after she was pronounced dead the woman was taken to the morgue. Shortly before midnight,

an undertaker who brought in another body noticed that Kolkiewicz was moving inside a bag she had been placed in. Once it was opened, she complained of being cold and asked for hot tea, the media said. She was then taken home. A spokeswoman

for the local prosecutors, Beata Syk-Jankowska, told The Associated Press that she had never heard of such a case before, and that prosecutors are investigating whether the patient’s life and health were endangered by the inaccurate death diagnosis.

Allegations tarnish Cosby’s fatherly image

The allegations about Bill Cosby keep coming. For decades, Cosby was thought of in glowing terms as a perceptive comedian, upbeat pitchman and genial father figure. His public personality made him more than rich -- it made him a role model, admired for his support of education and his no-nonsense talks on parenting and achievement. In recent weeks, that persona has been paired with another, much darker image. On Tuesday, the famed comedian and TV star was accused of rape by Janice Dickinson, a former model. In an interview on

“Entertainment Tonight,” Dickinson claimed Cosby assaulted her in 1982 after the two had dinner in Lake Tahoe. Cosby attorney Marty Singer was blunt in his response. “Janice Dickinson’s story accusing Bill

Cosby of rape is a lie,” he told CNN in a statement.

“There is a glaring contradiction between what she is claiming now for the first time and what she wrote in her own book and what she told the media back in 2002. Ms. Dickinson did an interview with the New York Observer in September 2002 entitled ‘Interview With a Vamp’ completely contradicting her new story about Mr. Cosby. “That interview a dozen years ago said ‘she didn’t want to go to bed with him and he blew her off.’ Her publisher HarperCollins can confirm that no attorney representing Mr. Cosby tried to kill the alleged rape story (since there was no such story) or tried to prevent her from saying whatever she wanted about Bill Cosby in her book.” He added,

“Documentary proof and Ms. Dickinson’s own words show that her new story about

something she now claims happened back in 1982 is a fabricated lie.” Dickinson’s allegations come on the heels of other rape accusations. Cosby has repeatedly said the allegations are untrue. He has never been prosecuted. Over the weekend, Cosby was asked about

“serious allegations raised about you” by NPR’s Scott Simon.

“Do you have any response to those

charges?” Simon asked. In response, Cosby shook his head in silence.On Sunday, Cosby attorney John P. Schmitt released a written statement.

“Over the last several weeks, decade-old, discredited allegations against Mr. Cosby have resurfaced,” Schmitt said. “The fact that they are being repeated does not make them true. Mr. Cosby does not intend to dignify these allegations with any comment.”

The accusations have received wide publicity in recent weeks, spurred in particular by two events: a viral video of comedian Hannibal Buress in which he called Cosby a “rapist,” and an attempt to create a Cosby meme sponsored by Cosby’s Twitter account. The latter led to many images of Cosby with the rape accusations emblazoned over his picture. The allegations have taken a toll on Cosby’s family-friendly, fatherly image. On Tuesday, Netflix announced that a Cosby special, set to debut November 28, would be postponed. Then, on Wednesday, his old network, NBC, announced that a Cosby show in the works has been scuttled. The events detailed by Cosby’s accusers took place over many decades. Five women have gone on record in describing

them. Another woman, Andrea Constand, approached Montgomery County, Pennsylvania, authorities in 2005, but prosecutors decided they had “insufficient credible and admissible evidence.” “The desire on our part to move forward was pretty strong,” Bruce Castor, then the Montgomery County district attorney, told CNN’s “New Day” on Wednesday. “The problem with the case was she waited a year until she told police about it.” At the time, Cosby lawyer Walter M. Phillips Jr. told CNN the allegations were

“utterly preposterous” and “plainly bizarre.” Constand later filed a civil suit. Her lawyers said they found 13 Jane Doe witnesses with similar stories. However, Constand’s suit was settled in November 2006, and the witnesses were never called. Terms have not been disclosed.

The three laughed and grinned as they appeared in court for the first time charged with an attack that was said to be imminent. Nadir Ali Sayed, 21, from Hounslow, west London, Yousaf Shah Syed, 19, from High Wycombe, and Haseeb Hamayoon, 27, from Hayes, west London, were arrested on November 6. They were detained by the Metropolitan Police for a fortnight — the limit under the Terrorism Act — before being charged yesterday with “the intention of committing acts of terrorism, jointly engaged in conduct in preparation for giving effect to their intention”. The three men, who all had beards and wore long grey tops, arrived at Westminster Magistrates’ Court under heavy police guard. They travelled in two armoured prison vans which were flanked by three unmarked police cars with flashing blue lights and sirens. The three spoke only to confirm their name and address during the 15-minute hearing. The Sayeds, who are cousins, twice refused a direction by District Judge Michael Snow to sit down. They smiled throughout the proceedings. Mr Hamayoon sat down and nodded to associates in the public gallery. All three were remanded in custody to appear at the Old Bailey on December 4. A fourth man, who was arrested in Uxbridge, west London, in the original raids was released on November 15 with no further action.

The site takes advantage of the fact that camera users receive default passwords to get devices working - such as “1234.” Many manufacturers also put default passwords online, Britain’s Information Commissioner’s Office said Thursday. “The ability to access footage remotely is both an internet camera’s biggest selling point and, if not set up correctly, potentially its biggest security weakness,” Simon Rice, the ICO group manager for technology, said in a statement. “Remember, if you can access your video footage over the internet, then what is stopping someone else from doing the same?” The ICO is joining with its counterparts in the United States, China, Australia and Canada in warning consumers about the Russian site, which offers live streams together with the coordinates of where the cameras are located. Benjy, a Charlerois bull, failed this year to impregnate any heifers at a County Mayo farm in western Ireland. Veterinarians determined he was fertile, but was more attracted to the bull that replaced him. After the farmer announced he planned to send Benjy to an abattoir, activists last week launched a social media campaign seeking 5,000 pounds ($7,825) to send the bull to the Hillside Animal Sanctuary in Norfolk, England, which is home for about 2,000 unwanted farm animals and horses. About 300 donors contributed 4,000 British pounds ($6,200) to an ongoing fundraising drive organized by the British online magazine TheGayUK. Simon, who funds a Malibu dog shelter and many other animal rights projects, said he heard about Benjy’s case through friends at the People for the Ethical Treatment of Animals pressure group. The family of the only patient to die of Ebola in the US has received an undisclosed sum from the hospital that treated him, their lawyer has said.Officials at Texas Health Presbyterian have admitted their mistake when they sent Thomas Eric Duncan home despite his symptoms and travel history.Lawyer Les Weisbrod said the sum was a “very good deal” and would provide

CBS News correspondent Allen Pizzey says there are dire warnings that what Israel calls a “wave of terrorism” is taking on the overtones of a religious war, and political leaders on both sides accuse the other of fanning the flames. But not in the ultra-Orthodox neighborhood where the four slain

rabbis lived and worshiped. At the funeral outside the synagogue where the attack occurred, a rabbi merely noted that there are now four widows and 24 orphans on one street. Three of the four rabbis were dual U.S.-Israeli nationals, and one was a British-Israeli. An Israeli police officer was also killed in the attack. “Our future in this world is dependent on God,” worshiper Gavriel Cohen said Wednesday morning. “A man can never know what will happen to him.” But Israeli Prime Minister

Benyamin Netanyahu vowed to “respond harshly” for what he termed “despicable murders.” As an example of what he has in mind, overnight, Israeli security forces destroyed the home of a Palestinian man who rammed his car into a commuter train stop last month. That attack left a young woman and a baby dead. The homes of the two Palestinians who attacked the synagogue will also be knocked down. The practice of destroying militants’ homes was largely abandoned in 2005, with

officials deciding it didn’t serve as an effective deterrent. They resumed the demolitions recently. What particular grievance inspired the two Palestinian cousins to attack worshipers at the synagogue with meat cleavers, knives and a handgun is still unclear, but a relative was quoted as saying he was sure they acted alone, not as part of an organized plot by any group. Both men were killed by police at the scene. Israeli security officials say such

“lone wolf” attacks are the hardest to predict, or prevent.

They clocked up an average of 15.1Mbps (megabits per second) while 3G averaged 6.1Mbps, it suggested. The report looked at the speed and coverage of mobile networks in five major UK cities - London, Birmingham, Manchester, Glasgow and Edinburgh. It indicated that London had the fastest 4G web browsing speeds but the slowest 3G browsing speeds. While it took just 0.72 seconds to load a standard web page on the 4G network in London, it took 1.2 seconds via 3G. Getting a web page to load on the 4G network took the longest in Glasgow (0.82 seconds)

while Manchester had the best 3G browsing speeds (1.01 seconds), according to the report. Edinburgh recorded the highest download speeds for both 4G and 3G with London having the lowest for both. It is an indication that the situation regarding the performance of both 4G and 3G is complex and patchy around the country but it does make a good case for the overall performance of 4G, said Ofcom chief executive Ed Richards. “Today’s research shows 4G is providing a significantly enhanced mobile broadband experience to customers, which we expect to be available to 98% of the UK population by 2017 at the latest.” The findings help make the case for consumers who may be considering an

upgrade to 4G, thinks Ovum analyst Matthew Howett. “I expect some consumers might have held off upgrading in the belief that the network performance wouldn’t be that much different, or because of a bad 3G experience, but this report clearly highlights the difference, so for operators this is probably a welcome piece of work,” he said. Others pointed out that the report may not be an accurate portrait of 4G across the whole UK. “Ofcom’s latest report shows that 4G speeds are undoubtedly improving, but with the chosen test locations in key urban centres, it’s not a real representation of the UK as a whole,” said Ernest Doku, telecoms expert at uSwitch. “The true picture for

those based outside of major towns and cities - where it is often needed most - is still uncertain.”The report indicated that speeds varied from operator to operator. EE and Vodafone delivered the fastest average 3G download speeds at 6.8Mbps and 6.7Mbps respectively, according to the report. This compared with 3G speeds of 5.6Mbps for O2 and 5.2Mbps for Three. The 4G speed winner was EE with an average of 18.4Mbps, followed by O2 at 15.6Mbps. Vodafone’s average 4G speed was 14.3Mbps and Three’s 10.7Mbps, the report found. Each of the operators attempted to put their own spin on the findings.Three said it was pleased that “in the areas that matter” - web browsing speeds and latency - it

had done well. Meanwhile Vodafone questioned the results. “These results were undertaken over six months ago and don’t give consumers a full picture as there were only a small number of tests undertaken, in a small number of cities and only taken in places where the majority of operators had coverage,” the firm said in a statement.

Coverage promises

The report also looked at how the operators are performing when it comes to coverage. 4G coverage has increased rapidly and Ofcom reports that it is currently available from at least one operator in around 70% of UK premises. Mobile operators have suggested that they

intend to match O2’s 98% indoor coverage obligation for 4G mobile services by 2015. This is likely to extend coverage into areas underserved by 3G. One notable omission from the report is data about Three’s 4G coverage. Ofcom cites differences between its data and that of Three’s as the reason it was left out. The research measured the performance of 4G and 3G on smartphones, both indoors and outdoors across the five cities between March and June 2014. It looked at upload and download speeds, web browsing speeds and latency - the time it takes data to travel to a third-party server, important to reduce delays when making video calls, for example.

Google Paying $4m to Rent World’s Biggest Billboard in

The biggest advertising billboard in Times Square history, longer that a football field and eight stories high, will light up for the first time on Tuesday. The world’s largest high-definition video display will turn on its nearly 24 million LED pixels at 7:30 p.m. EST (0030 GMT) and make its debut with an exhibition of digital art by Universal Everything Studio. Next week Google will become the billboard’s first advertising client, said Clear Channel Outdoor, the firm selling the gargantuan ad space. The billboard, hovering over the Marriott Marquis Hotel, was commissioned by the Vornado Realty Trust, which would not reveal its cost. “When it comes to making an impact in Times Square size does matter,” said David Grabert, a Clear Channel spokesman. Google has signed a deal for an undisclosed amount for an ad campaign that runs through the New Year, Clear

Channel said. The rate for a four-week advertising blitz is $2.5 million, according to the New York Times. The new billboard is located in the heart of Times Square and faces the intersection passed every day by an average of 300,000 pedestrians and 115,000 drivers and passengers, according to the Times Square Alliance.Vornado said in 2012 it was building the sign as part of a $140 million project to expand and redevelop the Marriott Marquis’ retail space. Times Square Alliance President Tim Tompkins said the high-tech screen would enhance the appeal of New York’s most renowned intersection as a tourist destination. “This is the one place on the planet where people seek out, take pictures of and then transmit advertisement,” Tompkins said. “The phenomenon that happens in Times Square is that the whole is greater than the sum of the parts.”

NEW YORK - Japan has slipped back into a recession for the second time in two years. That could mean more trouble for a range of U.S companies and industries that count on the country for sales. Best known as an exporter of cars, gadgets and comic books, Japan is also a key consumer of U.S. goods and services from name-brand companies. Japanese customers take a shine to diamonds from Tiffany, strap on handbags from Coach, and ride choppers from Harley-Davidson. “If the Japanese economy continues to shrink, it has a big impact on other countries,” says Sheila Smith, senior fellow for Japan studies at the Council on Foreign Relations.

“It’s not like some isolated economy. Having a strong and vibrant Japan is important for everybody.” On Tuesday, Prime Minister Shinzo Abe announced steps aimed at keeping the downturn from getting worse. Abe postponed another hike in the national sales tax and called for national elections next month. An increase in that sales tax earlier this year has been widely blamed for the most recent slump. Here’s a brief look at the economic ties between the U.S. and Japan, the world’s third-largest economy, as well as the American businesses that could be hardest hit by the recession. SIZE: Japan ranked as the fourth-largest trading partner for the U.S. last year, with $204 billion in goods passing between the two countries, according to the U.S. Trade Representative’s office. PARIS - Hair salons do it, dry cleaners do it, and so do department stores selling health and beauty products. Now France wants to know why, for some goods and services, women seem to be paying more than men. The question was first taken up by a group of French activists inspired by a study that found American women overpay hundreds of dollars a year for the same products. The activists persuaded the Economy Ministry this month to launch an in-depth study to determine what price differences exist in Fra nce, the reasons behind them and which sectors are most affected. Findings are expected early next year. A quick look by The Associated Press at haircut prices and store aisles in Paris found some disparities. Haircut: women 43 euros, men 26. Roll-on deodorant: women 2.04 euros, men 1.96. Shaving gel: 2.87 euros in a pink canister, 2.39 in a blue one. “Honestly, like many women I had noticed it and then I moved on to other things,” Pascale Boistard, France’s minister for women’s rights, told The Associated Press in an interview. “It is a fact that this happens in everyday life and with products that are commonly used. These disparities mean that by the end of the year, the sum is not negligible.” New York City and California have outlawed the practice of charging differently for products or services according to gender, and in California companies face fines up to $4,000 if they’re caught breaking the law. In New York city, periodic sweeps have found nail salons go in a different direction, charging men more for manicures, pedicures and waxing. The EU requires member countries to have legislation ensuring men and women are treated equally but does not specify how. In France, activist group Georgette Sand - named tongue-in-cheek after French author George Sand, who used a male pseudonym to be taken more seriously as a writer - is encouraging contributions to a photo blog of products priced differently according to gender. The group took its cue from a California state government study that found American women on average pay $1,300 more than men every year for identical products. Consumer Reports found similar disparities in 2010. “It’s a first victory if people are asking themselves the question when they walk into a store and compare prices,” said Gaelle Couraud of Georgette Sand. “What we’re asking

for is the end of gendered marketing, that prices be determined not by the sex of the purchaser but by the function of the product or the service rendered.” Monoprix, one of the French chains targeted by the campaign, responded by explaining that the price differences had nothing to do with the sex of the customer. “The differences in price between products referenced for women and men can be explained by their intrinsic characteristics and their sales volumes,” the company said in response to a petition signed by 40,000 consumers. The CEO of L’Oreal, speaking at a press conference on the day the government announced its study, questioned the premise entirely, saying he thought people were “inventing something.” And Fabien Provost, artistic director of the Franck Provost group of hair salons, said it makes no sense to charge women and men the same amount for what is essentially a different service. That view got some legal backing elsewhere in Europe: This month, a Danish appeals court threw out a 2012 ruling that barred different haircut prices for men and women, saying a women’s cut is “so technically more demanding that it is the reason for the price difference.” In the United States, the California and New York City laws remain outliers. The issue went up to the Supreme Court, where lawyers argued unsuccessfully for the abolition of different tariffs for clothing for men and women. “We don’t want to create a unisex world. It’s boring and it’s not accurate,” said Michael Cone, one of the lawyers in the tariff case. “It has to be that the gender discrimination is wrong.” Helene Masse-Dessen, a French lawyer who worked on a 2010 study on how European Union countries implement gender equality requirements, said the price differences could be bridged under current anti-discrimination legislation in France. She noted that a court has already ruled that auto insurance rates, for example, cannot be different for men and women. “There are legal means to combat it,” she said. “It’s not easy, but they’re there.” Boistard said she hoped the government would be able to put a response in place early in 2015. “Men are afraid that we’ll raise their prices to match those of women, but what we’re hoping to do is bring more justice and normality to this,” she said. “Women are consumers and citizens, and businesses have an interest in getting rid of injustices that affect them. There are things that can be settled without the law, without forcing it.”

Nokia plots comeback with Android tablet

Just months after selling its ailing handsets business to Microsoft, the Finnish company is planning to go back into the consumer market with a new tablet. The former top mobile phone maker, which has a history of reinventing itself since it began as a paper maker in the 19th century, said Tuesday it will launch a 7.9-inch device early next year in China, the world’s biggest market, before selling it elsewhere. The device will be manufactured by Taiwan-based Foxconn, which makes Apple’s handsets. And it will operate Android instead of the Windows software Nokia used on its cellphones when it began a partnership with Microsoft in 2011. That partnership ended unsuccessfully

- in April Nokia sold its cellphones unit to Microsoft for $7.2 billion. Sebastian Nystrom, head of at Nokia’s technologies unit, described the N1 tablet as “a new beginning for Nokia.” He noted that about 80 percent of the world’s mobile consumers use Android, compared with just 2.5 percent using Windows mobile devices. The aluminum-cased tablet uses Google’s Android Lollipop operating system, and will retail for some $250. For sure, it won’t be an easy shift for Nokia after years of focusing on cellphones and a troubled networks operation that only recently has shown signs of improvement. “It’s pointing in the right direction, but there are some real challenges,” said Neil Mawston from Strategy Analytics, near London. “It doesn’t have the distribution channels that

others like Samsung and Apple enjoy, and nobody is making any profits in Android tablets at the moment.” But Nokia, established in 1865, has demonstrated an ability to transform itself. Named after the small southern Finland town where it was based, it evolved its paper making business into a rubber boots and cable maker before becoming an electronics company. Then it hit on mobile telephony that made it almost synonymous with wireless high-tech, reaching a peak of 40 percent market share in mobile phone sales worldwide in 2008. But, after holding the No.1 spot in cellphones for 14 years, it wasn’t able to meet the challenge when Apple in 2007 introduced the iPhone, and also began to lose the competition to cheaper Asian manufacturers. After completing the sale of its mobile phone unit to Microsoft, Nokia has focused on its three, much more profitable operations: networks, HERE mapping services and software. It is one of the few computerized roadmap providers in the world and the only one with a long history of working with automotive companies. HERE has an 80 percent market share for embedded automotive maps. Nokia’s brand was wiped out of the handset market last week, when Microsoft unveiled its first Lumia smartphone under its own brand name. “We are pleased to bring the Nokia brand back into consumers’ hands,” said Nystrom, who announced the launch of the tablet in Helsinki at Slush, one of Europe’s largest startup and investor events with some 10,000 participants expected over two days.

Microsoft has patched a critical bug in its software that had existed for 19 years.IBM researchers discovered the flaw, which affects Windows and Office products, in May this year - but worked with Microsoft to fix the problem before going public.The bug had been present in every version of Windows since 95, IBM said.Attackers could exploit the bug to remotely control a PC, and so users are being urged to download updates.Microsoft has addressed the problem in its monthly security update, along with more than a dozen patches to fix other security issues, with a further two to be rolled out soon.In a blog post explaining the vulnerability in depth, IBM researcher Robert Freeman wrote: “The bug can

be used by an attacker for drive-by attacks to reliably run code remotely and take over the user’s machine.”In computer security, a drive-by attack typically means making users download malicious software.The bug had been “sitting in plain sight”, IBM said.The vulnerability - dubbed WinShock by some - has been graded as 9.3 out of a possible 10 on the Common Vulnerability Scoring System (CVSS), a measure of severity in computer security.One of the other bugs affects Microsoft’s Windows Server platforms

ST JOHN’S, Antigua – Any remaining speculation over the tour of South Africa was removed Tuesday when 14 of the 15 players selected for the Test series signed the controversial match/tour contacts. In selecting the squad last week, the West Indies Cricket Board had given players a deadline of 5 pm on Tuesday, and the board confirmed they had received all but one of the signatures.

“The WICB thanks the players for their timely and positive responses and looks forward to a successful tour of South Africa,” the WICB said in a statement.In a surprise move, however, left-hander Darren Bravo will take no part in the tour after pulling out of the squad for “personal reasons”.The 25-year-old, the younger brother of one-day captain Dwayne Bravo, also played no role in Trinidad and Tobago

Red Force’s first round match in the WICB Professional Cricket League last weekend against Barbados Pride. In fact, he was left out of the squad named for the first two rounds, with selectors claiming the player had made himself unavailable since his returned from the troubled tour of India. Bravo was a member of the West Indies one-day squad which took the controversial decision to quit the tour

of India over a contracts row with their union, WIPA. In recent years, Bravo has become a fixture in the Windies top order, and averages 43 from 32 Tests where he has compiled 2311 runs. However, only last year, he also abruptly left the tour of New Zealand also for “personal reasons”. The board said it looked forward to his return. “Darren Bravo wrote to Chairman of Selectors Clive Lloyd and requested not to be considered for the Test series due to personal reasons,” the WICB statement said. “The WICB extends its best wishes to Bravo as he seeks to address his personal matters and looks forward to his return to the game.” A replacement player is expected to be named soon. Meanwhile, the players move to sign match tour contracts is a major development, which will now see the three-Test tour of South Africa proceed as planned next month. The contracts were at the centre of the controversial abandoned tour last month, with players contending the new terms would have resulted in a significant reduction in their earnings.Following a series of meetings between the WICB, WIPA and the players, it was decided the contract would go to arbitration. West Indies will face South Africa in the first Test at SuperSport Park in Gauteng on December 17th.

Bermuda to host 2017 America’s Cup DIEGO — The tax haven of Bermuda has been picked over San Diego to host the 2017 America’s Cup, a person with knowledge of the situation told The Associated Press on Thursday. The person spoke on condition of anonymity because defending champion Oracle Team USA, based in San Francisco, hasn’t made the decision public. The person said software billionaire Larry Ellison of Oracle Corp. made the decision after consulting with the CEO of his sailing team, Russell Coutts, a New Zealander who also is director of the America’s Cup Event Authority. Reached in New Zealand, Coutts declined to confirm the decision, saying he was under a non-disclosure agreement. Members of San Diego’s bid effort, as well as officials with the Port of San Diego, also declined comment, saying they were under a non-disclosure agreement. Mayor Kevin Faulconer wouldn’t comment, his spokesman said, declining to give a reason. The spokesman wouldn’t say if the mayor’s office was also bound by an NDA. Officials in Bermuda didn’t return an email seeking comment. America’s Cup officials have scheduled a news conference in New York on Dec. 2 to announce

the venue selection. The choice of the British territory is intriguing, from its location at the northern tip of the Bermuda Triangle to the financial incentives that include tax-free status for regatta participants. It’s also sure to be unpopular with traditionalists and could mean the end of powerhouse Emirates Team New Zealand and perhaps other challengers. This will be the first time a U.S. defender holds the America’s Cup outside the United States. It’ll also be the first time in the regatta’s 163-year history that a defender sails the races in foreign waters by choice rather than necessity. In 2007 and 2010, Alinghi of Switzerland held the America’s Cup in Valencia, Spain, because it wasn’t practical to race on Lake Geneva. Before he won the America’s Cup in 2010, Ellison, one of the world’s richest men with a fortune

estimated at $52 billion, spoke of how he wanted to return the silver trophy to the United States after a 15-year absence. Now he’s taking it offshore after just one cycle in America. San Diego hosted the America’s Cup in 1988, 1992 and 1995. In 1995, Coutts skippered Team New Zealand to a five-race sweep of Dennis Conner, the first of Coutts’ five America’s Cup victories, for three different countries. A few weeks ago, a “for rent” signed popped up in the yard of Coutts’ home in Coronado, across the bay from downtown San Diego.Sailors and other members of America’s Cup syndicates are expected to benefit from tax breaks offered by Bermuda. Some America’s Cup sailors earn six-figure salaries. Others in the sport, such as Coutts, are paid millions of dollars a year. Bonuses are a big part of their pay packages.

Picking Bermuda is the culmination of a nearly year-long process in which Coutts considered venues from coast to coast, including Chicago.

corruption report GENEVA - FIFA will further review the 2018 and 2022 World Cup corruption investigation, putting the status of hosts Russia and Qatar back in question. The head of FIFA’s auditing committee will examine the full 430-page confidential report by American prosecutor Michael Garcia into impropriety during the bid process, reviving a probe which seemed closed one week ago. Domenico Scala, a Swiss businessman who serves as the soccer body’s audit panel chairman, will then decide whether to turn over any evidence to FIFA’s executive committee. The decision to hand over the documents to Scala came a week after FIFA ethics judge Joachim Eckert ruled that the case against Russia and Qatar was closed. Within hours of the German judge’s decision being published, Garcia appealed to FIFA, objecting to

“numerous materially incomplete and erroneous representations” of his work.That led to a meeting in Zurich on Thursday between Eckert and Garcia, whose appeal appears to still be active. The pair “agreed that it is of major importance that the FIFA Executive

Committee has the information necessary to evaluate which steps are required based on the work done by the FIFA Ethics Committee,” they said in the statement. “The chairmen also offered to answer any questions the chairman of the Audit and Compliance Committee and the Executive Committee might have.” The FIFA executive committee will next meet Dec. 18-19 in Marrakech, Morocco, with 12 of its 25 elected members having voted in the scandal-plagued December 2010 hosting elections. Some of those 12 have been formally charged by Garcia with wrongdoing linked to campaigns dogged by allegations of bribery, favor-seeking and collusion, and an investigation hampered by uncooperative witnesses. “The investigatory chamber has already opened a number of formal cases against individuals,” the joint statement from Garcia and Eckert said, without identifying names or detailed allegations. The suspects could include staffers from the nine bid candidates. In Morocco, the board chaired by FIFA President Sepp Blatter could discuss relaxing secrecy rules and

the strength of evidence presented by Garcia. Last Thursday, Eckert’s summary of the investigative report judged that any corrupt acts did not justify re-opening the bidding process for the 2018 and 2022 tournaments. FIFA at first welcomed a “degree of closure” in Eckert’s ruling that corruption across the 11 bidding nations was “of very limited scope.” However, FIFA stepped up scrutiny of the case Tuesday by filing a criminal complaint with Switzerland’s attorney general against possible law-breaking by unnamed individuals.

Swiss federal prosecutors are now studying Garcia’s investigation report, which remains sealed by FIFA’s code of ethics. Garcia’s own prosecutions of FIFA voters and officials will not be affected by parallel work being done by the Swiss federal agency, nor by Scala, according to Thursday’s statement. Scala will step into the heart of the corruption case after more than two years monitoring FIFA’s billion-dollar annual revenue. He has evaluated deals with FIFA commercial partners, blocked grants to FIFA member federations and stopped bonuses to executive committee members, while also doubling their annual stipend to a reported $200,000. Scala and Garcia worked together in June when deciding that FIFA board members should not be allowed to accept luxury Swiss watches offered by a World Cup sponsor. Previously, Scala has said the World Cup corruption investigation should have the power to remove a host if compelling evidence was found. The Russian and Qatari bid committees have always denied wrongdoing and have pledged to continue their World Cup hosting plans, costing tens of billions of dollars.

Kidd booed in return to Brooklyn as Bucks coach NEW YORK — Jason Kidd revealed a distrust of the Nets’ front office and a desire to get past his messy departure from the franchise when he returned to Brooklyn on Wednesday as coach of the Milwaukee Bucks. It was Kidd’s first game against the team he led to two NBA Finals as a player and coached to the second round of the playoffs in 2013-14. He was loudly booed when he came onto the court and again when he was announced during pregame introductions, with a chant of “Kidd’s a traitor!” breaking out in the first quarter. It was a reception that would have been impossible to imagine last season, when the team retired the No. 5 jersey Kidd wore during the greatest career for a Nets player since the franchise joined the NBA. “My teammates, coaches, we did a lot for this franchise,” Kidd said before the game. “But it’s what-have-you-done-for-us-lately motto. I understand everybody has their opinion. It’s business and I work for the Milwaukee Bucks.”

He sought that job during the summer after first seeking additional power within the Nets organization. The Nets declined and eventually let him out of his contract by acquiring a couple of second-round draft picks from Milwaukee. Kidd denied trying to get himself positioned above general manager Billy King but also said they didn’t have much of a relationship. He believes the Nets wanted to fire him in December, when they were en route to a 10-21 start. “I think it really helped me to see what I was dealing with, what type of people I was dealing with, you know?” Kidd said. The Nets rebounded to finish 44-38 and reach the second round of the playoffs, still far below expectations that were created when they acquired Paul Pierce and Kevin Garnett in assembling the highest payroll in NBA history. “The veteran guys I coached last year, I had a great time with,” Kidd said. “We maybe didn’t fulfill our expectations of winning a championship, but we did come a long ways. We won a Game 7 on the road,

we did a lot of good things and it was a fun journey. I respect everyone in that locker room.” He has barely spoken about the terms of his departure and wasn’t comfortable having to do it Wednesday. He said he had spoken to some Nets players since he left and was asked about last month’s comments from owner Mikhail Prokhorov, who said the team made the trade with the Bucks because: “There is a nice proverb in English: Don’t let the door hit you where the good Lord has split you.” “I thought it was a great quote. I’ve heard it before, so was it something new? No,” Kidd said.Kidd was warmly welcomed back the first time he returned to face the Nets as a player following his trade to Dallas in 2008. He didn’t know, or seem to care, what the response would be Wednesday. “As a player, you get traded, and as a coach you have the opportunity to get traded, so that’s what happens, we move on,” Kidd said. “Unfortunately one side hasn’t, but eventually both sides will move on.”

There have been rumors that Bryant’s early-season gunning was a result of him chasing MJ on that list, and wanting to make sure he passes him while healthy enough to do so. Los Angeles: Asked if he has heard chatter that he’s gunning for Jordan’s spot on the list, Bryant said: “There’s always something. Especially with me. First it’s, I can’t come back and play. Now I’m playing and now it’s, well, I’m not playing well enough. Well, you just said that I’d be in a wheelchair and I wouldn’t be able to play at all. So there’s always something. I don’t even waste my time trying to shut people up.”

Dan Redmond takes TCI Sprint Triathlon

The TCI Sprint Triathlon took place on Sunday (November 16, 2014) at the Bight Park in Providenciales. Dozens of persons took part in the event, including His Excellency Governor Peter Beckingham, who competed with a team. Governor Beckingham competed in the last leg, which was the road race. The TCI Triathlon comprised swimming, pedal cycle race and road race. The overall winner was Dan Redmond, who competed as a one man team, was the first to complete all his events.
