Custody—Relocation—Best Interest of the Child Standard.Plaintiff (“Mother”) and Defendant (“Father”) have one child together, N.S. (“Child”),

who was born in 2009. Mother commenced this action on September 16, 2013, by filing a Complaint for Custody and Petition for Relocation with Minor Child. In applying the statu-tory factors outlined in 23 Pa. C.S.A. §5328(a), the Court concluded that it was in Child’s best interests to be in the primary physical custody of Father. The Court found that Father is better able to provide stability for Child because his home offers continuity in education, family life, and physical environment. Father’s parents live next door to Father and have been an integral part of Child’s life since her birth. The Court also took into account the fact that Mother seemingly intended to relocate to Virginia whether or not she was granted primary physical custody of Child.

In applying the factors outlined in 23 Pa. C.S.A. §5337(h), relating to relocation, the Court concluded that it was in Child’s best interest not to relocate to Virginia with Mother. The Court found that Child has developed closer bonds with Father’s family in Pennsylvania than she has with Mother’s family in Virginia. Child has also graduated from preschool in Pennsylvania and has friends who will be continuing in Father’s intended elementary school. If Child relocated to Virginia, Father’s custodial time with Child would be dramatically reduced, thus impairing the strong relationship Father and Child have developed. Lastly, the Court found that Child would not benefit from relocation, where she would be economically depen-dent on an individual who is not her biological father.

This matter is before the Court on Plaintiff’s Complaint for Custody, filed on September 16, 2013, and Plaintiff’s “Petition for Relocation with Minor Child,” also filed on September 16, 2013. Testimony was taken on July 30 and 31, 2014, and the matters are ready for disposition.

FINDINGS OF FACT

1. Plaintiff is M.P. (“Mother”), who currently resides at 900 Maple-hurst Court, Virginia Beach, Virginia (“Mother’s Proposed Residence”). (N.T., 7/30/2014, at 141:10-12.)

2. Defendant is J.S. (“Father”), who currently resides at 54 Quiet Valley Road, Mount Bethel, Pennsylvania (“Father’s Residence”). (N.T., 7/31/2014, at 4:3-5.)

3. Mother and Father are the parents of N.S. (“Child”), who was born in Hackettstown, New Jersey on July 21, 2009. (N.T., 7/30/2014, at 29:9-11; N.T., 7/31/2014, at 206:8-9.)

20:17-24.)7. Mother was born in Norfolk, Virginia on April 9, 1984, and is

thirty years old. (Id. at 4:14-21.)8. Father was born in Pennsylvania on June 12, 1982, and is thirty-

two years old. (Id. at 19:8-10; N.T., 7/31/2014, at 4:8-13.)9. The parties’ current custodial arrangement is governed by an in-

terim agreement that was adopted as an Order of Court by the Honorable Edward G. Smith on November 13, 2013, and was filed on November 20, 2013 (“Interim Order”).

10. The Interim Order grants Mother and Father joint legal and physical custody of Child, with the parties having alternating three-week periods of physical custody.

11. Shortly after the Interim Order was entered, Mother relocated from Father’s Residence to Chesapeake, Virginia. (N.T., 7/30/2014, at 84:25-85:5.)

12. From the date of the Interim Order to present, the parties have performed under the three-week shared custody arrangement. (N.T., 7/31/2014, at 190:4-9.)

13. Father currently pays for the car Mother uses as her primary vehicle and for her phone bill. (N.T., 7/30/2014, at 49:7-20, 137:2-4.)

14. In addition, Father pays $76.00 per month to Mother in child support. (Pl.’s Ex. 17.)

15. Mother’s biological father, D.P., is deceased. (N.T., 7/30/2014, at 5:22-6:1.)

16. Mother never had a good relationship with her father. (Id. at 6:10-14.)

17. Mother’s biological mother, L.P. (“Maternal Grandmother”), is fifty-two years old and currently resides at 2603 Bainbridge Boulevard, Chesapeake, Virginia. (Id. at 188:19-189:2.)

18. For the last three years, Maternal Grandmother has been sepa-rated from her husband of twenty-three years. (Id. at 190:2-7.)

19. Mother attended Kempsville High School in Virginia for three years and graduated from Salem High School, also located in Virginia. (Id. at 11:10-12, 124:2-16.)

20. After high school, Mother attended Virginia Commonwealth University, where she studied Fine Arts from 2006 to 2008. (Id. at 11:16-12:22.)

21. When Mother became pregnant with Child in 2008, she discon-tinued her studies. (Id. at 12:2-9.)

22. Mother is currently employed as a server at The Green Turtle, a sports bar in Chesapeake, Virginia, where she has worked since January of 2014. (Id. at 14:3-20.)

23. Mother’s current work hours are Friday, Saturday, and Sunday from 4:00 p.m. until 12:00 a.m. (Id. at 14:24-15:10.)

24. Mother sometimes picks up additional shifts during the week when she does not have physical custody of Child. (Id. at 15:1-3.)

25. Mother currently earns $2.83 per hour, plus tips, averaging ap-proximately $300.00 per weekend. (Id. at 25:3-12, 136:5-8.)

26. In mid-2014, Mother inherited $33,000.00 from a trust established by her grandfather, of which approximately $18,000.00 remains. (Id. at 98:13-100:4.)

27. When Mother relocated to Virginia, she initially lived with Ma-ternal Grandmother in Chesapeake. (Id. at 84:25-85:8.)

28. Maternal Grandmother’s residence is a three-bedroom apartment within a larger building. (Id. at 85:9-24.)

29. Mother has been co-leasing Mother’s Proposed Residence with her current boyfriend, M.S., since July 1, 2014. (Id. at 21:3-8, 22:17-19-23:4.)

30. Their current lease calls for rent of $1,150.00 per month through July 1, 2015. (Id. at 89:15-18, 97:12-16.)

31. Mother’s Proposed Residence is a townhouse with three bedrooms, two bathrooms, a dining room, a backyard, and a side yard. (Id. at 22:23-23:13.)

32. Mother submitted photographs of Mother’s Proposed Residence which depicted, aside from Child’s furnished bedroom, the interior of the townhouse in the unfinished state it was in at the time the parties moved in on July 1, 2014. (Pl.’s Exs. 16a-k; N.T., 7/30/2014, at 154:6-155:22.)

33. M.S. has a bachelor’s degree in Culinary Arts and Business Man-agement from the Art Institute of Virginia. (N.T., 7/30/2014, at 143:13-18.)

34. He was formerly a Coast Guard cook and is currently employed by No Forks restaurant in Virginia Beach, where he is a sous chef. (Id. at 143:7-10, 143:22-144:8.)

35. M.S. works from 10:00 a.m. to 5:30 p.m., Monday through Friday, and earns approximately $38,000.00. (Id. at 144:12-22, 147:18-22.)

36. He occasionally earns additional income from catering jobs and cake decorating. (Id. at 147:23-148:22.)

37. M.S. has a ten-year-old daughter, J.S., and has primary physical custody of her. (Id. at 144:23-144:1, 144:14-15.)

38. M.S. is divorced from J.S.’s biological mother, whom J.S. sees approximately once per month. (Id. at 145:2-10, 145:19-24.)

39. Child and J.S. have a good relationship and call each other “sis-ters.” (Id. at 147:10-17.)

42. He has known Child since she was born and has a loving relation-ship with her. (Id. at 150:4-151:5.)

43. Mother, Child, and M.S. often engage in recreational activities, including concerts, beach outings, and dinners. (Id.)

44. Mother’s relationship with M.S. became romantic in January of 2014. (Id. at 149:16-24.)

45. M.S.’s mother resides in Virginia Beach. (Id. at 170:11-17.)46. Maternal Grandmother has a sister, D.D., and a brother, A.L.,

both of whom reside within twenty minutes of her. (Id. at 190:8-191:5.)47. Maternal Grandmother has a brainstem tumor, which was diag-

nosed in July of 2013. (Id. at 193:6-19, 194:12-16.)48. She testified that her doctors initially estimated her life expec-

tancy to be between two and eight months. (Id. at 193:6-9.)49. Her current prognosis is uncertain. (Id. at 223:1-10.)50. Maternal Grandmother has signed a contract to commence teach-

ing third grade in August 2014. (Id. at 196:10-19.)51. Her work hours will be Monday through Friday, from 8:00 a.m.

to 3:30 p.m. (Id. at 197:1-8.)52. Maternal Grandmother has a loving relationship with Child. (Id.

at 199:3-200:2.)53. When Mother has custody of Child in Virginia, Child often sleeps

at Maternal Grandmother’s home and accompanies her on recreational outings. (Id. at 198:1-8, 199:3-200:2.)

54. While Mother was living with Maternal Grandmother following her relocation, Maternal Grandmother provided financial support to Mother. (Id. at 198:11-16.)

55. Maternal Grandmother testified that if Mother needed a place to live in the future, she would be willing to provide such support again. (Id. at 210:18-23.)

56. Maternal Grandmother has provided childcare for Mother by having Child sleep over when Mother works until midnight. (Id. at 226:20-230:22.)

57. Mother’s older brother, M.M.P., resides on the same street that Mother and M.S.’s apartment is located on. (Id. at 173:12-14, 175:13-15.)

58. He resides there with his wife, his one-year-old daughter, Quinn, and his thirteen-year-old stepson, Connor. (Id. at 173:12-174:4.)

59. M.M.P. is employed by Verizon as an analyst. (Id. at 174:5-8.)60. He works in Newport News, which is approximately forty-five

minutes from his home. (Id. at 174:12-17.)53

61. His hours are variable, but he generally works nine-hour shifts, Tuesday through Saturday, beginning at 10:00 a.m., 11:00 a.m., or 12:00 p.m. (Id. at 174:18-175:12.)

62. M.M.P. has frequent contact with Mother and Child, including daily visits in the morning before work. (Id. at 175:18-23.)

63. He acts as a babysitter for Child less than one time per month. (Id. at 184:2-9.)

64. Mother’s younger brother, M.P., resides on the same street that Maternal Grandmother’s apartment is located on. (Id. at 9:19-10:3.)

65. Mother sees M.P. often, and the two have a close relationship, seeing each other almost daily. (Id. at 10:14-21.)

66. M.P. resides with his one-year-old son. (Id. at 10:10-13.)67. Mother also has family residing in Buffalo, New York that she

visits often and which includes Maternal Grandmother’s other brothers and sisters. (Id. at 122:22-123:12.)

68. Father resides with Child and his current girlfriend, J.O., at Fa-ther’s Residence. (N.T., 7/31/2014 at 4:6-7.)

69. Father’s Residence previously belonged to Father’s grandparents, and the property passed to Father’s parents, S.S. and Mg.S. (“Paternal Grandparents”), upon their death. (Id. at 10:25-11:19.)

70. Father’s Residence is located next door to the home of Paternal Grandparents. (Id. at 165:13-20.)

71. Father currently pays rent to Paternal Grandparents and has the option to purchase Father’s Residence for $210,000.00. (Def.’s Ex. 2.)

72. Father’s father (“Paternal Grandfather”) is employed by Lehigh Heavy Forge as a machine operator and works Monday through Friday, from 7:00 a.m. to 4:00 p.m. (N.T., 7/31/2014 at 90:16-91:1.)

73. Father’s mother (“Paternal Grandmother”) is employed as a legal secretary and works Monday through Friday, from 9:00 a.m. to 5:00 p.m. (Id. at 178:14-24.)

74. Child has close relationships with both Paternal Grandmother and Paternal Grandfather. (Id. at 171:21-172:8.)

75. Paternal Grandmother has been taking Child to Trinity United Church of Christ every Sunday for church and Sunday school since Child was two years old. (Id. at 188:7-189:1.)

76. Father’s girlfriend, J.O., has been employed by Coordinated Health Systems as a physician extender for the past four years. (Id. at 118:6-13.)

77. In 2013, she earned $35,602.00 in this position and currently earns $20.00 per hour. (Id. at 119:20-120:1.)

78. J.O. has a master’s degree in Sports Medicine and Athletic Train-ing from the California University of Pennsylvania. (Id. at 117:19-118:5.)

79. Father first met J.O. in November 2012 at a mutual friend’s birth-day party. (Id. at 120:10-16.)

80. From that date until May 2013, Father and J.O. encountered each other three times at social gatherings. (Id. at 121:6-124:16.)

81. Their relationship became romantic near the end of May 2013. (Id. at 124:16-126:22.)

82. While Mother suggested that Father and J.O.’s relationship began while Mother and Father were still together, the Court found no credible evidence to support this suggestion.

83. J.O. first met Child in July 2013 at a company function held at Dorney Park by J.O.’s employer. (Id. at 131:1-132:4.)

84. After that, J.O. interacted with Child several more times before moving into Father’s Residence in January 2014. (Id. at 132:9-22.)

85. J.O. currently has a loving relationship with Child and intends to remain in her relationship with Father and to marry him in the future. (Id. at 134:1-24.)

86. Father has been employed by Brown Daub Kia as a car salesman since March 10, 2010. (Id. at 12:3-17.)

87. In this position, Father earns approximately $60,000.00 per year. (Id. at 13:18-21.)

88. In his most recent year of employment, Father earned $62,716.00. (Id. at 15:7-10; Def.’s Ex. 3.)

89. Father’s current work schedule is Monday from 9:00 a.m. to 5:00 p.m., Wednesday from 9:00 a.m. to 5:00 p.m., Thursday from 9:00 a.m. to 9:00 p.m., Friday from 9:00 a.m. to 6:00 p.m., and three Saturdays per month from 9:00 a.m. to 5:00 p.m. (N.T., 7/31/2014 at 16:13-24.)

90. Through his employment, Father receives health insurance that also covers Child. (Id. at 19:14-20:11.)

91. Father has abused alcohol in the past. (Id. at 5:7-9.)92. Father was arrested for DUI in Pennsylvania in 2004 and in Vir-

ginia in 2007. (Id. at 5:10-25.)93. The 2004 DUI resulted in ARD and the 2007 DUI required Father

to complete drug and alcohol counseling and community service, which he has completed. (Id. at 6:4-15.)

94. After these arrests, Father continued to abuse alcohol. (Id. at 85:21-86:1.)

95. As a result, Father entered rehabilitation for seven days in 2008, shortly after meeting Mother. (Id. at 85:21-86:6.)

96. Afterwards, Father continued to drink a mix of beer and mixed drinks five to six nights per week in 2008, three nights per week in 2009, and two to three nights per week in 2010. (Id. at 86:15-88:2.)

97. Father currently consumes one to two beers, two to three nights per week. (Id. at 6:20-7:1.)

98. While Mother complained about Father’s drinking habits, she also drank with Father when they were together. (Id. at 86:19-87:4.)

99. Father’s Residence is located on five and one-half acres, has three bedrooms, contains 1,650 square feet, and is located on hilly terrain with a large yard. (Id. at 60:4-61:21, 64:9-65:15, Def.’s Exs. 5B-D, G-L.)

100. On Father’s property, Father and Child engage in outdoor ac-tivities such as sleigh-riding, tractor-riding, and picnics. (N.T., 7/31/2014, at 60:22-61:3.)

101. Paternal Grandparents’ residence is located three hundred feet from Father’s Residence, within walking distance. (Id. at 61:24-62:7.)

102. Paternal Grandparents’ residence has a pool that Child often uses and enjoys. (Id. at 59:9-25, 63:15-64:8, Def.’s Exs. 5A, F.)

103. Aside from Paternal Grandparents, various other members of Father’s family reside in the Lehigh Valley area, including: Sa.S., who is Child’s paternal aunt; Sa.S.’s daughter, Me.S, who is Child’s cousin; E.C., who is Father’s aunt; J.C., who is Child’s cousin; J.C.’s children, Simon (age 4) and Nathan (age 11); S.C., who is Child’s cousin; S.C.’s son, R.C. (age 5); and J.M., who is Father’s aunt. (Def.’s Ex. 6.)

104. On Sundays, members of Father’s family gather at Paternal Grandparents’ residence. On these occasions, Child interacts with Simon, Nathan, and R.C. Child has a particularly close relationship with R.C. These Sunday gatherings include activities such as cookouts, swimming, birthday celebrations, and watching football. While Mother resided with Father in Pennsylvania, she accompanied Father and Child during these gatherings. (N.T., 7/31/2014, at 68:9-69:18, 152:12-155:3, 187:23-188:6.)

105. Father graduated from Bangor Area High School in 2000 and attended East Stroudsburg University until 2003, when he withdrew and moved to Virginia Beach. (Id. at 8:19-9:6.)

106. Father met Mother in Virginia Beach in 2008. (Id. at 20:20-21, 81:6.)

107. At the time, Father and Mother worked at the same restaurant, Father as a cook and Mother as a waitress. (Id. at 20:22-21:4.)

108. They started dating three months before Mother became pregnant with Child. (Id. at 21:9-11.)

109. After Mother became pregnant, Mother and Father decided to move to the Lehigh Valley and live with Paternal Grandparents. (Id. at 21:12-23:7; N.T., 7/30/2014, at 133:2-6.)

110. They lived with Paternal Grandparents until Child reached the age of one. (N.T., 7/30/2014, at 133:4-9.)

111. Mother and Father then moved into an apartment, in which they resided from June 2010 to October 2011. (Id. at 133:15-25.)

112. After that, Mother and Father moved into Father’s Residence, where they resided until their separation. (Id. at 134:1-9.)

113. While living with Father in Pennsylvania, Mother and Child often visited Mother’s family in Virginia. (Id. at 41:7-18.)

114. These visits occurred approximately every eight to ten weeks and lasted about a week. (Id.)

115. In April 2013, Father and Mother ended their relationship after growing apart. (Id. at 134:10-20, N.T., 7/31/2014, at 30:3-33:7.)

116. They continued to live together until June 2013, when Mother asked Father to leave the home. (N.T., 7/30/2014, at 134:14-18.)

117. Father complied and from June 2013 to the end of July 2013 stayed with a combination of his parents, his friend, and his boss. (N.T., 7/31/2014, at 31:12-32:10.)

118. At the end of July 2013, Father moved back in with Mother and Child. (Id. at 32:8-13.)

119. From July 2013 until Mother’s relocation in November 2013, Mother and Father lived together with Child at Father’s Residence. (Id. at 32:8-33:7.)

120. During these months, Mother worked as a waitress and stayed home with Child when Father was working at Brown Daub Kia. (Id. at 33:7-24.)

121. Child was enrolled in Wee Love and Care preschool in 2011. (N.T., 7/30/2014, at 106:6-25.)

122. Child continued at Wee Love and Care through 2012. (Id. at 107:1-2.)

123. From September 2013 until the date of the Interim Order in November 2013, Child did not attend Wee Love and Care. (Id. at 107:3-110:5.)

124. Mother testified that she thought it was in Child’s interest to stay home with her while custody proceedings were ongoing. (Id.)

125. Once the Interim Order was entered, Child reentered Wee Love and Care in January 2013 and graduated at the conclusion of the Spring 2013 semester. (Id. at 109:22-110:5.)

126. If Child relocated to Virginia, she would attend Kempsville Meadows Elementary School, which is five minutes from Mother’s Proposed Residence. (Id. at 80:18-25.)

127. If Child does not relocate to Virginia, she would attend Five Points Elementary School, which is five miles from Father’s Residence. (N.T., 7/31/2014, at 44:25-45:2, 46:8-10.)

128. Statistics for Kempsville Meadows Elementary School include the following: ranked better than 66.8% of Virginia schools; student/teacher ratio of 19.1; reading proficiency of 80% in 2013; history and social science proficiency of 93% in 2012; math proficiency of 77% in 2013; and science proficiency of 83% in 2013. (Def.’s Ex. 1; Pl.’s Ex. 11.)

129. Statistics for Five Points Elementary School include the follow-ing: ranked better than 52.3% of Pennsylvania schools; student/teacher ratio of 15.4; reading proficiency of 76.50%; and math proficiency of 81%. (Def.’s Ex. 1.)

DISCUSSION

Mother commenced this action on September 16, 2013, by filing the Complaint for Custody and Petition for Relocation with a Minor Child presently before the Court. In her Petition for Relocation, Mother seeks permission to relocate to Virginia with Child. On September 26, 2013, Father filed a Counter-Affidavit Regarding Relocation in which he ob-jected to Mother’s proposed relocation. On October 11, 2013, Father filed a Reply to Mother’s Petition for Relocation. On that same date, the parties appeared before a Custody Conference Officer for a custody conference. Pending the trial, the parties agreed to share physical and legal custody of Child, and an Order encompassing that agreement was entered on October 11, 2013, and was filed on October 22, 2013. On October 15, 2013, Presi-dent Judge Stephen G. Baratta entered an Order assigning the case to the Honorable Edward G. Smith for disposition. On October 22, 2013, Judge Smith entered an Order scheduling a hearing for November 13, 2013. On November 13, 2013, the parties entered into the interim agreement that resulted in the parties sharing physical custody for alternating three-week periods. After Judge Smith was appointed to the federal bench, the case was reassigned to the undersigned, and testimony was taken on July 30 and 31, 2014.

It is well established that, “[w]ith any child custody case, the para-mount concern is the best interests of the child. This standard requires a case-by-case assessment of all the factors that may legitimately affect the physical, intellectual, moral and spiritual well-being of the child.” J.R.M. v. J.E.A., 33 A.3d 647, 650 (Pa. Super. 2011) (quoting Durning v. Balent/Kurdilla, 19 A.3d 1125, 1128 (Pa. Super. 2011)). “In ordering any form of custody, the court shall determine the best interest of the child by consider-ing all relevant factors, giving weighted consideration to those factors which affect the safety of the child ... .” 23 Pa. C.S.A. §5328(a). After considering all such relevant factors, the Court may make an award of shared, primary, partial, sole, or supervised physical custody and shared or sole legal cus-tody, provided such award is in the best interest of the child. Id. §5323(a).

In evaluating the best-interest standard, the Court must examine sixteen factors. Id. §5328(a). First, the Court must consider “[w]hich party is more likely to encourage and permit frequent and continuing contact between the child and another party.” Id. §5328(a)(1). In this case, the evidence presented at trial indicates that each party will likely encourage and permit frequent and continuing contact between Child and the other party. Each party testified to being satisfied with the other’s parenting skills. Mother testified that she would be willing to move back to Pennsylvania to be with Child if Child remained in Pennsylvania.1 In response, Father ———

testified that he believes the parties could resume the co-parenting routine that was used while both parents lived in Pennsylvania with Child. In con-templating a situation involving Mother returning to Pennsylvania, Father testified as follows:

[MR. MARGLE:] What would you like to see happen as far as the custodial arrangement?

[FATHER:] I would love if M.P. would live here.Q. You’d prefer she lived here?A. Yeah. It’s the best thing for both of us to be around

N.S. as much as possible.Q. Would you agree to equal time with mom?A. Yes.

(N.T., 7/31/2014 at 72:23-73:7.) In contemplating a situation involving Mother remaining in Virginia Beach, Father testified as follows:

[MR. MARGLE:] Have you given some thought to what type of custodial arrangement you think would promote a continuing relationship between N.S. and her Mother, even though she lives in Virginia Beach?

[FATHER:] Well, yeah. The most that she could see her, any long weekends that I can, you know, make available, holidays, summertime. ...

Q. It would only be fair to give her the majority of the summer, wouldn’t it?

A. Exactly.....Q. Would you be willing still to do the shared transporta-

tion that you’re doing right now?A. Yes.

(Id. at 73:19-74:15.) Mother testified similarly with regard to her intentions to permit continuing contact between Father and Child:

[MR. GOUGH:] If the Court were to grant your request to relocate to Virginia with N.S., what would you be willing to do or what arrangements would you make to allow the bio-logical father to spend time with the child?

[MOTHER:] Um, we could agree on holidays, long weekends, summer. I would be willing to meet him halfway. I would be willing to drive most of the time if need be. He can come and stay with us. He can come to Virginia Beach. That’s fine. I have no problem helping him visit her.

(N.T., 7/30/2014 at 60:15-25.) When questioned regarding her intentions as to custody should she move back to Pennsylvania, Mother gave the only hint of possible disagreement between the parties:

[MR. MARGLE:] The logistics aside and the possibilities aside, do you share that interest in co-parenting equally with J.S.?

[MOTHER:] No.....A. I would still want primary custody.

(Id. at 93:24-94:9.) Despite Mother’s contention that she would seek pri-mary physical custody of Child upon a possible return to Pennsylvania, there is no indication that Mother would deny Father a chance to continue having frequent and continuing contact with Child. Nor has Father indi-cated that he would do anything to stop Mother from having frequent and continuing contact with Child, whether in Virginia or Pennsylvania. Further, each party has been cooperative in facilitating alternating three-week pe-riods of custody of Child since November 2013. As a result, the Court will not weigh this factor in favor of either party.

The second factor requires the Court to consider “[t]he present and past abuse committed by a party or member of the party’s household, whether there is a continued risk of harm to the child or an abused party and which party can better provide adequate physical safeguards and su-pervision of the child.” Supra §5328(a)(2).2 There is no evidence in this case of abuse committed by either party or a member of their household. Therefore, this factor is not relevant.

The third factor requires the Court to consider “[t]he parental duties performed by each party on behalf of the child.” Id. §5328(a)(3). As stated above, each party testified that the other has performed admirably in the role of parent. When the parties lived together, Father was the primary wage earner, and Mother was the primary caretaker. During this time, Father performed parental duties including cooking, bathing, shopping, and putting Child to bed. Mother’s primary duties included laundry, changing, and caring for Child while Father was working. Mother and Father attended early doctor visits together, with Mother performing this duty thereafter. Mother and Father were also both highly involved in making arrangements for Child’s schooling.

At the current time, Father assumes the role of disciplinarian of Child while he has custody. While in custody of Child in Virginia, Mother is es-sentially a stay-at-home mom and, in addition to caring for Child, often provides her with entertainment by visiting local attractions. The evidence established that each parent is and has been fully capable of performing parental duties. However, as Mother has provided more parental care than Father, the Court will weigh this factor slightly in favor of Mother.

The fourth factor requires the Court to consider “[t]he need for stabil-ity and continuity in the child’s education, family life and community life.” ———

Id. §5328(a)(4). With regard to education, Child has attended and gradu-ated from preschool in Pennsylvania. The evidence indicates that she has excelled there and made friends who will be continuing with elementary school in the same district. Child has not attended any school in Virginia.

Regarding continuity in community life, at the young age of six, Child has not had the chance to extend her relationships beyond her family to other members of the community, aside from her school friends in Penn-sylvania.

As for family life, “the court must consider the importance of conti-nuity in the child’s life and the desirability of development of a stable re-lationship with established parental figures and known physical environ-ment.” Wiseman v. Wall, 718 A.2d 844, 850 (Pa. Super. 1998) (citation omitted). “Parental figures” may include individuals living in the households of a child’s parents. See id. In this case, Child has direct and extended fam-ily living in both Virginia and Pennsylvania. The evidence established that Child has a loving relationship with her extended family members in both Virginia and Pennsylvania. However, from birth until November 2013, Child lived exclusively in Pennsylvania, and the only real home she has known up to that time has been Father’s Residence and/or the home of Paternal Grandparents, which are next door to each other. During this time, Child has spent a significant amount of time with Paternal Grandparents and at their home, living with them for part of that time period. While liv-ing in Pennsylvania, Child has spent Sunday mornings going to church with Paternal Grandmother and has spent Sunday afternoons and evenings with Father’s family and extended family at Paternal Grandparents’ home. In essence, Father and/or Paternal Grandparents’ homes are, for the most part, the only real homes Child has known.

Regarding other members of parents’ household, M.S. and J.O. oc-cupy similar spaces in Child’s life. M.S., however, has been part of Child’s life, albeit intermittently, since birth. J.O., on the other hand, entered Child’s life in July 2013. Nevertheless, as to both individuals, the evidence showed that Child is not confused as to the identity of her parents.

Because the evidence regarding continuity in education, family life, and physical environment points strongly to Pennsylvania, the Court will weigh this factor, as a whole, in favor of Father.

The fifth factor requires the Court to consider “[t]he availability of extended family.” 23 Pa. C.S.A. §5328(a)(5). Child has Maternal Grand-mother, two maternal uncles, two one-year-old cousins, one great aunt, and one great uncle within close proximity of Virginia Beach. Child has Pater-nal Grandparents, an aunt, three cousins, two great aunts, and three second cousins, ages four, five, and eleven, in close proximity of Mount Bethel. Paternal Grandparents reside within 300 feet of Father, thereby making them the most available extended family members. In fact, they have been the most involved in Child’s life since birth. The evidence established that

the majority of Child’s extended family in Virginia resides within a twenty-minute radius. Although numerous members of Child’s extended family reside in both Virginia and Pennsylvania and all appear to have a loving relationship with Child, the Court will weigh this factor slightly in favor of Father, as Paternal Grandparents live next door to Father and have been intimately involved in Child’s life since birth.

In evaluating the best-interest standard, the Court must next con-sider “[t]he child’s sibling relationships.” Id. §5328(a)(6). Here, Child has no biological siblings. While the evidence established that Child and J.S. have a relationship which often resembles sisterhood, this is not relevant to the statutory analysis. Therefore, this factor will not be considered.

The seventh factor requires the Court to consider “[t]he well-reasoned preference of the child, based on the child’s maturity and judgment.” 23 Pa. C.S.A. §5328(a)(7). Neither party asked the Court to interview Child in this case. Thus, this factor is not relevant.

The eighth factor requires the Court to consider “[t]he attempts of a parent to turn the child against the other parent, except in cases of domes-tic violence where reasonable safety measures are necessary to protect the child from harm.” 23 Pa. C.S.A. §5328(a)(8). There was no evidence presented concerning this factor, and it is therefore not relevant to the Court’s decision.

The ninth factor requires the Court to consider “[w]hich party is more likely to maintain a loving, stable, consistent and nurturing relationship with the child adequate for the child’s emotional needs.” Id. §5328(a)(9). The Court believes that both Mother and Father are equally capable of maintaining a loving, stable, consistent, and nurturing relationship with Child. Accordingly, the Court will not weigh this factor in favor of either party.

The tenth factor requires the Court to consider “[w]hich party is more likely to attend to the daily physical, emotional, developmental, educa-tional and special needs of the child.” Id. §5328(a)(10). The evidence es-tablished that each party has been heavily invested in Child’s everyday needs. Child has no identifiable special needs regarding education or emotional care. As Father works full-time and Mother does not, Mother is in a position to more readily attend to Child’s daily physical and develop-mental needs. Because Mother will have more free time at home with Child, the Court will weigh this factor slightly in favor of Mother.

The eleventh factor requires the Court to consider “[t]he proximity of the residences of the parties.” Id. §5328(a)(11). Currently, Mother’s Proposed Residence and Father’s Residence are between six and seven hours apart. Since November 2013, the parties have been exchanging cus-tody of Child at a midway point in Delaware. Mother stated that this ar-rangement could continue regardless of where Child was located. Accord-ingly, the Court will not weigh this factor in favor of either party but will discuss it further in its analysis of the relocation factors.

The twelfth factor requires the Court to consider “[e]ach party’s availability to care for the child or ability to make appropriate child-care [sic] arrangements.” Id. §5328(a)(12). The Court notes that “[a] parent’s work schedule may not deprive that parent of custody if suitable arrange-ments are made for the child’s care in his or her absence.” Gerber v. Gerber, 337 Pa. Super. 580, 586, 487 A.2d 413, 416 (1985). Father testified that if Child remains in Pennsylvania, she will be enrolled in Five Points Elemen-tary School. This would be a full-day program starting at 8:30 a.m. and ending at 2:50 p.m. As Father does not begin work until 9:00 a.m., he would be able to drive Child to school in the morning. At the end of school days on which Father works, a bus would be available to transport Child one mile to Wee Love and Care, where she would remain until 4:30 p.m. Pa-ternal Grandmother would then pick Child up and care for Child until Father returned home from work, at either 5:30 p.m. or 9:30 p.m., depend-ing on the day. Paternal Grandmother testified that she has a flexible work schedule which would allow her to pick Child up at 4:30 p.m. Father testi-fied that he would be available to care for Child when not working.

Mother testified that if Child relocates to Virginia, she would begin half-day elementary school concluding at 11:30 a.m. Child would be trans-ported to and from school by a school bus which stops in front of Mother’s Proposed Residence. During the week, Mother does not work and could thus care for Child after school. On the weekend, when Mother works from 4:00 p.m. to 12:00 a.m., Mother would leave Child in the care of Maternal Grandmother until 12:00 a.m. At that time, several things could occur. First, M.S. or M.M.P. could pick up Child after either has completed work for the day. In the event they are unavailable, Mother could pick up Child at 12:00 a.m. after work. Alternatively, Child could sleep at Maternal Grand-mother’s home for the night, which has been a regular occurrence in the past. When testifying regarding these plans, Mother was reluctant to admit that contingencies could arise with regard to M.M.P.’s or M.S.’ ability to provide care for Child. Nevertheless, as Mother is more available, in gen-eral, to care for Child, the Court will weigh this factor slightly in favor of Mother.

The thirteenth factor requires the Court to consider “[t]he level of conflict between the parties and the willingness and ability of the parties to cooperate with one another. A party’s effort to protect a child from abuse by another party is not evidence of unwillingness or inability to cooperate with that party.” 23 Pa. C.S.A. §5328(a)(13). The evidence presented in this case established that the parties have cooperated when it comes to Child’s best interest. They have been able to successfully navigate the system of partial custody in place since November 2013. Though there was conflict between the parties concerning the breakdown of their relationship, neither party has demonstrated an unwillingness to cooperate in pursuing Child’s best interest. Therefore, the Court will weigh this factor equally.

The fourteenth relevant factor is “[t]he history of drug or alcohol abuse of a party or member of a party’s household.” Id. §5328(a)(14). Father has a history of alcohol abuse. He was arrested twice for DUI and completed a rehabilitation program. Testimony from Father and Paternal Grandmother indicated that Father, while he abused alcohol in the past, has limited his current alcohol use and has never abused alcohol during Child’s lifetime. Due to Father’s admitted history of alcohol abuse and need for rehabilitation, the Court will weigh this factor in favor of Mother.

The fifteenth factor requires the Court to consider “[t]he mental and physical condition of a party or member of a party’s household.” Id. §5328(a)(15). Neither Father, Mother, M.S., nor J.O. has any mental or physical condition which could impact Child’s care or safety. Thus, the Court will not weigh this factor in favor of either party.

Finally, in evaluating the best-interest standard, the Court may con-sider “[a]ny other relevant factor.” Id. §5328(a)(16). In this case, the Court required each party to submit two proposed orders for consideration, one in which the Court allowed relocation and one in which the Court denied relocation. In the order Mother proposes should her Petition for Relocation be denied, she recommends that Father be granted primary physical cus-tody, indicating that, despite her testimony to the contrary, she will remain in Virginia, even if the Court denies her Petition to Relocate. The fact that Mother will be remaining in Virginia, regardless of the outcome of her Petition for Relocation, has been taken into consideration by the Court.

Turning to Mother’s Petition to Relocate, the Court notes that “[t]he party proposing [a] relocation has the burden of establishing that the relo-cation will serve the best interest of the child as shown under” the factors enumerated in Section 5337(h) of the Domestic Relations Code. Id. §5337(i)(1). In addition, “[e]ach party has the burden of establishing the integrity of that party’s motives in either seeking the relocation or seeking to prevent the relocation.” Id. §5337(i)(2). In disposing of a relocation petition, the Do-mestic Relations Code requires the Court to consider ten factors, “giving weighted consideration to those factors which affect the safety of the child.” Id. §5337(h). First, the Court must consider “[t]he nature, quality, extent of involvement and duration of the child’s relationship with the party pro-posing to relocate and with the nonrelocating party, siblings and other significant persons in the child’s life.” Id. §5337(h)(1). Child has spent roughly equal time with Mother and Father throughout her life. Since the parties have lived apart, Child has split time between Mother’s residence and Father’s residence. While the parties lived together in Pennsylvania, Child interacted with Mother’s family in Virginia during Mother’s visits to Virginia. However, Child lived with Paternal Grandparents for a period of time, and has interacted regularly with Father’s family in Pennsylvania during family gatherings and routine childcare from the time she was born, resulting in her developing closer bonds with Father’s family in Pennsyl-vania. For these reasons, the Court will weigh this factor against relocation.

Next, the Court must consider “[t]he age, developmental stage, needs of the child and the likely impact the relocation will have on the child’s physical, educational and emotional development, taking into consideration any special needs of the child.” Id. §5337(h)(2). As stated above, Child does not have any discernible special needs that would be impacted by relocation. Her basic educational needs, however, would be impacted by relocation. Child has attended preschool in Pennsylvania when she has been present in Pennsylvania. In doing so, Child has successfully reached her preschool graduation and has made friends who will be continuing in the same elementary school district. Thus, relocation would remove Child from a school system to which she has become accustomed. It would require Child to enter an unfamiliar school system and make new school friends. In addition, testimony from Mother gave some indication that relocation could be confusing for Child:

[MR. GOUGH:] What, if anything, have you noticed about her now, as opposed to when you were living in Penn-sylvania?

[MOTHER:] Maybe a change in attitude.Q. What do you mean by that?A. Um, I would say she is adjusting well but has ques-

tions.(N.T., 7/30/2014 at 79:23-80:3.) While it is clear that Child enjoys her time in Virginia and maintains a loving relationship with her family in Virginia, the fact that Child has only attended school in and has only lived perma-nently in Pennsylvania suggests that relocation would require a greater adjustment for Child than would remaining in Pennsylvania. As a result, the Court will weigh this factor against relocation.

Next, the Court must consider “[t]he feasibility of preserving the relationship between the nonrelocating party and the child through suitable custody arrangements, considering the logistics and financial circum-stances of the parties.” Id. §5337(h)(3). “An aspect of this determination is the degree to which the court can be confident that the custodial [parent] will comply cooperatively with alternate visitation arrangements which the move may necessitate.” Gruber v. Gruber, 400 Pa. Super. 174, 185, 583 A.2d 434, 439 (1990). “A court’s determination is not whether the alterna-tive schedule would maintain the current level of the non-custodial parent’s interaction with the children, but rather whether the substitute arrangements ‘will foster adequately an ongoing relationship’ between the non-custodial parent and the children.” Hogrelius v. Martin, 950 A.2d 345, 352 (Pa. Super. 2008) (quoting White v. White, 437 Pa. Super. 446, 650 A.2d 110, 113 (1994)). “Thus, although an alternative custody schedule necessarily re-duces the frequency of a parent’s interaction with a child because of the distance involved, relocation should not be denied for that reason alone.” Id.

The parties testified that they would each be willing to cooperate in achieving a workable system of partial custody should relocation be granted. During periods of three-week custody, both Father and Mother have had adequate opportunity for telephone contact with Child. The evi-dence established that each party would allow the other to continue a lov-ing relationship with Child. Despite this, the parties currently reside more than six hours apart. Were Child to relocate to Virginia, the feasibility of Father maintaining his current relationship with Child would be signifi-cantly diminished because Child would no longer live with Father. Further, under Mother’s proposed custody schedule, Father would have custody of Child for eight weeks of Child’s summer break, one week of Child’s spring break, ten days of Child’s winter break, and any of Child’s three-day week-ends. This totals not more than eleven weeks of total custody of Child. The distance between the residences and Father’s full-time work schedule make it such that it would not be feasible for Father to easily visit Child outside of these proposed custodial periods. Moreover, Mother does not have the financial means to send Child to Pennsylvania by way of airplane. Since the parties’ separation, Father has had shared physical custody, which, when extended to a full year, totals twenty-six weeks. Such a decrease in time spent together suggests that the current relationship built up between Father and Child will suffer significantly in the event of relocation. As a result, the Court will weigh this factor against relocation.3

The next factor requires the Court to consider “[t]he child’s prefer-ence, taking into consideration the age and maturity of the child.” 23 Pa. C.S.A. §5337(h)(4). As stated above, Child has not been asked to state a preference in this case. Therefore, this factor is not relevant.

Next, the Court must consider “[w]hether there is an established pat-tern of conduct of either party to promote or thwart the relationship of the child and the other party.” Id. §5337(h)(5). There is no evidence of such conduct in this case. Therefore, this factor is likewise not relevant.

Next, the Court must consider, “[w]hether the relocation will enhance the general quality of life for the party seeking the relocation [and for the child], including, but not limited to, financial or emotional benefit or edu-cational opportunity.” Id. §5337(h)(6)-(7). A party desiring to relocate may “seek an improved physical environment in which to live and raise children.” Gruber, supra. Mother testified that she was not happy when she lived in Mount Bethel. She stated that the area made her feel isolated and alone, causing her to miss her family. This was corroborated by Maternal Grand-mother and by Mother’s brother. This was contradicted, however, by Father and Father’s mother, both of whom testified that Mother expressed feelings of longing to return “home” to Pennsylvania after visits with her family in Virginia. In weighing both sides, the Court has no doubt that Mother would ———

be happier in Virginia where her family and M.S. reside. Thus, the Court finds that Mother would emotionally benefit from relocating with Child to Virginia. The same cannot be said, however, of Child, who appears to be emotionally content in Pennsylvania. Further, though the evidence estab-lished the presence of greater recreational opportunities in the Virginia Beach area, there was no evidence which casted doubt on the Lehigh Val-ley area as a suitable area for the parties or for Child. Thus, the Court does not find either location to be an “improved physical environment in which to live and raise children.” Id. As the statute permits the Court to take into account the emotional state of the relocating party in analyzing this factor, the Court will weigh this factor slightly in favor of relocation with regard to Mother but against relocation with regard to Child.

The next factor requires the Court to consider, “[t]he reasons and motivation of each party for seeking or opposing the relocation.” 23 Pa. C.S.A. §5337(h)(8). “The court must assure itself that the move is not motivated simply by a desire to frustrate the visitation rights of the non-custodial parent or to impede the development of a healthy, loving relation-ship between the child and the non-custodial parent.” Gruber, supra. The Court does not believe that the proposed relocation is motivated by Mother’s desire to frustrate the custodial rights of Father or to impede the growth of a healthy and loving relationship between Father and Child. Rather, Mother seeks to relocate because she wants to be close to M.S. and to her family in Virginia and because she believes that Child would benefit from relocation. Likewise, there is no evidence that Father objects to the proposed relocation out of spite, jealousy, or ill will directed at Mother. Rather, the record indicates that Father objects to the move because he loves his daughter and wants her to continue to live near him so that he can be intimately involved in her upbringing.

Turning to the reasons behind relocation, Mother has not offered any evidence that Child’s well-being is not properly served in Mount Bethel. Instead, much of the evidence concerned Mother’s well-being in Virginia as opposed to Pennsylvania. For this reason, the Court has cause to believe that Mother’s relocation is driven more by her interest than by reasons which impact on Child’s interests or welfare. Though it is clear Mother’s motivations are not to spite Father, it is not clear they arise from a concern specifically for Child’s interest. Thus, the Court will weigh this factor slightly against relocation.

Finally, the Court must consider “[a]ny other factor affecting the best interest of the child.” Id. §5337(h)(10). The Court finds the parties’ eco-nomic situations to be relevant in this case. Were Mother to relocate with Child to Virginia, Child would be economically dependent on an individ-ual who is not her biological father, M.S., as it is clear that Mother cannot afford Mother’s Proposed Residence by herself. In Pennsylvania, Child is economically dependent on her biological father. The Court is concerned

that, in the event M.S. no longer resides with or financially supports Mother, Mother’s income from waitressing and Father’s child support pay-ments would not be sufficient to support her and Child’s expenses. There-fore, the Court will weigh this factor against relocation.

WHEREFORE, having considered all relevant factors, giving weighted consideration to those factors which affect the safety of Child, the Court enters the following:

ORDER

AND NOW, this 9th day of September, 2014, Plaintiff’s “Petition for Relocation with Minor Child,” filed on September 16, 2013, is hereby DENIED. Upon consideration of Plaintiff’s Complaint for Custody, filed on September 16, 2013, it is hereby ORDERED, as follows:

1. Legal Custody. Plaintiff (“Mother”) and Defendant (“Father”) shall have shared legal custody of N.S. (“Child”), born on July 21, 2009. “Legal Custody” shall be defined as the right to make major decisions affecting the best interests of Child, including, but not limited to, medical, religious, and educational decisions. Thus, major decisions concerning Child, includ-ing, but not necessarily limited to, Child’s health, welfare, education, and religious training and upbringing, shall be made by the parties jointly, after discussion and consultation with each other, with the goal of developing and adhering to a harmonious policy in Child’s best interests. Each party shall keep the other party informed of Child’s development. Each party shall not interfere with the other party’s physical custody of Child. The parties shall give support to one another in their role as parents and shall take into account the views of the other parent regarding the physical and emotional well-being of Child. Each party shall notify the other party of any activity that could reasonably be expected to be of significant concern to the other. Day-to-day decisions shall be the responsibility of the parent then having physical custody.

Each party shall have the right to receive, directly from Child’s school, copies of Child’s report cards, test results, notices of parent-teacher confer-ences and school programs, and any other information normally released to a custodial parent.

Each parent shall further have the right to receive, directly from the provider, any medical, psychological, psychiatric, prescription drug, dental, or daycare records or reports normally released to a custodial parent.

2. Primary Physical Custody. Father shall have primary physical custody of Child.

3. Partial Physical Custody. Unless the parties agree otherwise, Mother shall have partial physical custody of Child, as follows:

a. School Year. During the school year, Mother shall have physical custody of Child during any “long weekend,” from after school on Friday until Monday evening, at a time to be

determined by the parties or, if they cannot agree, no later than 6:00 p.m. A “long weekend” shall be defined as a weekend on which there is a school or legal holiday on the Monday follow-ing the weekend;

b. Summer. During the summer, Mother shall have physical custody of Child for a period of six (6) weeks to be allocated in two (2) three-week installments. Mother’s first block of three (3) weeks shall begin on the first Friday follow-ing the conclusion of Child’s school year, and Mother’s second block of three (3) weeks shall be the three (3) weeks immedi-ately preceding the commencement of the school year, with Child being returned to Father’s physical custody no later than one (1) week prior to the beginning of the school year; and

c. By Agreement. Mother shall have physical custody of Child at any other time mutually agreed to by the parties, and the parties are encouraged to allow Mother to exercise liberal periods of physical custody of Child in addition to the periods outlined above and below.4. Holidays. Holidays shall be shared as the parties may agree. If the

parties cannot agree, then the parties shall have the following periods of physical custody, which shall supersede the parties’ school year and summer custody schedules:

a. Christmas/Winter Recess. Mother shall have physical custody of Child during the majority of Child’s Christmas break from school, on those dates and times to be mutually agreed upon by the parties; and

b. Easter/Spring Recess. Mother shall have physical custody of Child from 4:00 p.m. on Child’s last day of school until 6:00 p.m. on the day before Child’s school resumes.5. Physical Custody/Partial Custody Without Prejudice. The above

physical custody/partial physical custody award shall be implemented so long as Mother remains a resident of Virginia. Should Mother relocate to Northampton County, Pennsylvania, within the Bangor Area School District, the parties shall share physical custody in alternating weeks, with custody exchanges to take place at 7:00 p.m. on Friday evenings, and the parties shall share holidays equally, as mutually agreed.

6. Transportation. The parties shall equally share transportation of Child. Exchanges shall take place at the agreed upon location in Milford, Delaware, unless the parties agree otherwise. The parties shall be cordial to each other at exchanges.

7. Telephone Access. The non-custodial parent shall be entitled to call or videoconference with Child on a reasonable, ongoing basis. If Child is not available to speak to the non-custodial parent, the custodial parent shall ensure that phone calls are returned as promptly as possible. Child

shall be entitled to call the non-custodial parent as desired, and the custo-dial parent shall not interfere with Child’s reasonable requests in this regard.

8. Activities. Each party shall advise the other, on a reasonable, ongo-ing basis, of the schedule of curricular and extracurricular activities and events involving Child. Both parties shall have the right to attend such activities and events and to participate in them, if applicable. Neither party shall schedule an activity that interferes with the other party’s periods of physical custody without that party’s consent.

9. Medical/Dental Appointments. The parties shall consult with each other before scheduling medical/dental appointments. Both parties shall have the right to attend such appointments.

10. Modification. The parties may agree to modify the schedule set forth above and shall accommodate reasonable requests for modification that are in Child’s best interests.

11. Contact Information. Each party shall keep the other party advised of a current address, e-mail address, telephone number, and cellular tele-phone number.

12. Injuries and Health. Each party shall promptly advise the other party of any injuries sustained by Child, any illness suffered by Child, and any need for non-routine medical care.

13. Non-Alienation. The parties shall encourage Child to love and respect Mother, Father, and their respective family members, and they are prohibited from doing or saying anything to alienate Child from Mother, Father, and their respective family members, either directly or indirectly, by any pretense or ploy whatsoever. The parties shall not make, or permit anyone else to make, derogatory or negative comments about Mother, Father, and their respective family members in the presence or hearing of Child. The parties shall not talk to Child about this custody case/order.

14. Corporal Punishment. Neither party shall employ, nor allow any other individual to employ, any form of corporal punishment whatsoever as a means to discipline Child.

15. Arguments. The parties shall not engage in arguments or heated conversations in the presence or hearing of Child. All contact between the parties, and their respective family members, shall be polite, civil, and respectful.

16. Headings. The paragraph headings in this Order are for ease of reading only and shall not be legally binding.

17. Previous Orders. This Order shall supersede all prior custody Orders in this case.
