From the ABA Journal Daily Newsletter : [1] “An [individual] petitioned for a judg-ment of sex change may be referred to as ‘nonbinary,’ an Oregon judge ruled Friday. Judge Amy Holmes Hehn of Multnomah County allowed . . . [the individual] to choose the ‘nonbinary’ description, the Oregonian and CNN report . . . [The] petition was filed under an Oregon law that allows a court to change the legal sex of a person who has undergone treatment for a gender transition. [The individual] began transitioning in 2013. ‘I was assigned male at birth due to biology, [the individual] told the Oregonian. ‘I’m stuck with that for life. My gender identity is definitely feminine. My gender iden-tity has never been male, but I feel like I have to own up to my male biology. Being nonbinary allows me to do that. I’m a mixture of both. I consider myself as a third sex.’ Llona Turner, legal director of the Trangender Law Center, said the decision may be first of its kind in the United States”; [2] “A University of Virginia Law School graduate, whose degree and job with a Washington, D.C., law firm were delayed be-cause of a sexual misconduct investigation of him by the University, has sued the U.S. Department of Education, claiming it improperly changed the standard of proof in such matters, the Washington Post reports. The suit filed by ‘John Doe’ in the U.S. District Court for the District of Columbia alleges that the Department’s Office for Civil Rights [OCR] should have gone through a formal rulemaking process, with notice for public comment, before providing guidance in a 2011 letter that colleges and universities re-ceiving federal funds should use a ‘preponderance of the evidence’ standard of proof during campus sexual misconduct disciplinary proceedings . . . The ‘Dear Colleague’ letter was sent by the OCR to educational institutions as part of the Obama Administra-tion’s response to increases of allegations of rape and sexual assaults on campuses. It warned that failure to use the preponderance of evidence standard would be a violation of Title IX of the Education Amendments of 1972. Prior to the letter, the University of Virginia used a ‘clear and convincing evidence’ standard of proof . . . The suit is spon-sored by the Foundation for Individual Rights in Education, which battles so-called speech codes on campus and what it believes are breaches of students’ and teachers’ civil rights – in this case, due process. The OCR ‘needs to do what federal law requires – tell the American people what it wants to accomplish, ask them for their feedback and only then make a decision, Justin Dillon, who represents Doe, told the Post. The lawsuit also alleges that by publicizing the list of schools under investigation for violating stu-dents’ Title IX rights, the OCR was putting pressure on those institutions to violate the rights of accused students. There were 55 schools on the list when it became public in the spring of 2014. Now there are 192. Doe is seeking to have the court issue a declara-tory judgement against the OCR for violating the Administrative Procedures Act be-cause the ‘Dear Colleagues’ letter was not submitted for public comment and over-stepped the body’s authority. He is also seeking an order enjoining the OCR ‘from re-quiring schools to abide by any of the mandatory requirements’ in the 2011 letter, in-cluding the use of the preponderance of evidence standard. He asks also for reimburse-ment of his attorney fees and expenses.” (Article by Terry Carter ); [3] “The U.S.

Supreme Court on Monday declined to hear a challenge to a Connecticut law that bans assault weapons. The New York-based Second U.S. Circuit Court of Appeals ruled in October that the law didn’t violate the Second Amendment and was not void for vague-ness. The law was passed after the 2012 shootings at Sandy Hook Elementary School in Newtown, Connecticut. The law had banned popular weapons such as AR-15s and AK-47s, the Washington Post reports. The case is Shew v. Malloy.” (Article by Debra Cassens Weiss) [Ed. note: In another case, a similar New York statute was also up-held.] ; [4] “Lawyers in Wisconsin will be able to designate a successor to continue their law practice after their death or disability as a result of vote by the state bar’s board of governors on Wednesday. The board of governors approved a succession planning registry that will be developed by staffers with the State Bar of Wisconsin, according to WisBar News. The board also approved a recommendation that the bar pay for professional liability insurance coverage for successor counsel for a reasonable period of time. Lawyers wouldn’t be required to participate in the registry. But a state bar working group that recommended its creation has suggested the board may want to consider a mandatory registry in the future, according to the WisBar News article.

The Pennsylvania Lawyers Fund for Client Security reimburses clients who have been victimized by a dishonest lawyer. The Fund is financed entirely by Pennsylvania licensed attorneys.
