The meeting of Permanent Trade Facilitation Committee (PTFC) was held

on 12.01.2021 at 03:30 PM through Video Conferencing in the chamber of Principal

Commissioner, Noida Customs Commissionerate. The meeting was presided over by

Smt. V. Usha, Principal Commissioner, Noida Customs Commissionerate. The

At the outset the Chairperson of the Committee, welcomed all the members

present in the meeting and invited the representatives of the Trade/CHA to put forth their grievances/points for discussion in the meeting.

3. Points sponsored by Trade and Customs Broker Association:

Shri R.K. Mehrotra, Noida Customs Broker Association raised the issue of

factory stuffing for merchant exporters. These exporters use the premises of

the manufacturing unit with the stuffing permission at their addresss. The

Pr. Commissioner clarified that we are allowing such requests for factory

stuffing permission to merchant exporter on case to case basis.

ii. Shri Rajeev Sharma, representative of Delhi Customs Broker Association and

Shri Bharat Malik, (CB), raised the issue that at Startrack/APM Terminals,

customs officers are insisting to submit hard Copy with original documents

for OOC, whether it is RMS or Examination Bill of Entry. Shri Gautam

Thapliyal, Deputy Commissioner (Shed) informed that there is no such practice and if that is the case, he would ensure it is not repeated. Such

cases may be directly brought to his notice. He also said that importers

should ensure that fully completed documents such as Form 6 and Form 9

which are mandatory, may be uploaded on e-sanchit.

iii. Shri R.K. Mehrotra, Noida Customs Broker Association and shri Rajeev

Sharma, DCBA, raised the issue of Customs Out of Charge not getting online

of RMS Bill of Entry, also port facilitation for giving online job order and gate

pass. The Pr. Commissioner clarified that this matter should be taken up

with the Custodian for out of charge and that as per the Custodian no such

issue exists.

Shri Rajeev Sharma, DCBA raised the issue of delayed permission of seal

cutting of containers. Shri Sharma informed that inspector in charge does not

give seal cutting permission without prior approval of DC (Shed) resulting in

delayed examination of the Import Cargo. Shri Gautam Thapliyal, DC Shed

replied that no such instance has come to his notice and assured that there

shall be no delay in seal cutting permission by the Customs officers.

Shri Rajeev Sharma, DCBA raised the issue of Spectro testing at Loni for V.

each and every export consignment even in the cases when the exporter is

regularly exporting the same commodity for the last 4 to 6 months. The

Additional Commissioner while replying to the query stated that spectro test

is being conducted only in the case of precious metals and in other cases no

spectro test has been ordered so far. He assured that the AC (Loni) would be

directed to resolve this.

Shri Rajeev Sharma, DCBA raised the issue of export examination by SIIB

officers in all cases where the RMS instruction states "if required the

examination may be conducted by SIIB". The Additional Commissioner (SIIB) replied that during the process of registration of shipping bills, in some cases, Systems gives an alert regarding the examination to be conducted by SIIB. Export shed officers put up the matter to AC Export who directs the SlIB to conduct examination in case of new exporters only. No SIIB examination is done in case of regular exporter. Further, it was brought to notice of the forum that during last two three months no alert has been received for SIIB

Shri Rajeev Sharma, DCBA suggested that AD Code registration should be

centralized so that it is done at one port should be applicable at other ports of

the same commissionerate. The Additional Commissioner informed that there

is a facility of online feeding of AD Code. As port codes are different, AD

Codes should be feeded for different ports separately. [Action: DC (Export)]

Shri Rajeev Sharma, DCBA raised the issue of submission of KYC documents

at different ports separately. The Chairperson informed that KYc documents

are verified at ICD Dadri for all ports export Loni & Moradabad and assured

that KYC for all ports under Noida Customs done through SIIB would be

verified to all ports.

Shri Rajeev Sharma, DCBA raised the issue of issue of renewal ofH Card and iX. for marking the file to SIIB for seeking their NOC. The Joint Commissioner

replied that G Card/ H Card are being issued by this Office as per Public

Notice No. 11/policy/2017 dated 08.06.2017. He also requested the trade

representative to contact him if they face any delay in issuance of G Card/H

Shri Rajeev Sharma, DCBA raised the issue of various CFS under separate

port codes at ICD Dadri and requested that all CFS should be given only one

port code. He informed that different port codes result in delay in filing B/Es

and assessment of B/Es because assessing officer has to change over to

different ports which create delay in assessment/

are identified by their codes. She appreciated the suggestion and assured that

the issue will be discussed with Systems.

xi. Shri Rajeev Sharma, DCBA informed that EGMs are not being updated in

Systems. Shri Gautam Thapliyal, DC informed that all EGMs have been

updated up to O6.01.2021.

[Action: All Custodians] Shri Manan Goenka, Board Member, M/s IICA informed that no queries are

being raised by assessing officers specially in FAG (Gr.4) prior to loading of

value and that the value is being loaded as per internal guidelines. Importers

are unwilling to give consent for the same and they must not be harassed, in

case they seek assessment order. The Chairperson as well as additional

Commissioner replied that before value addition the ground of rejection of

declared value are required to be communicated to the importers. In case the

importers do not agree with the value addition, a Speaking Order is required

to be issued. Necessary directions/Instructions have been issued to assessing

officer group 4 for following the Valuation Rules, 2007.

Shri Manan Goenka, Board Member, M/s ICA requested that in case of non-

agreement of Importers for value enhancement, duty payment under protesst

may be allowed. The chairperson assured that the duty payment under

protest is allowed and Speaking Orders shall be issued in all cases where the

Shri Manan Goenka, Board Member, M/s IICA informed that in one case of

in-discriminate value loading, the appeal by the importer was remanded backk

to ICD Dadri for issuing a Speaking Order. This remand is yet to be decided

He urged Customs to ensure that all such cases of remand by Commissioner

(Appeal), are decided on time. The Chairperson assured that the issue has

been noted for compliance and the remand orders shall be issued on priority.

She also sought a list of all such remand cases where the remand orders have

Shri Manan Goenka, Board Member, M/s IICA raised the issue of recurring

loading of values even after issuance of various order by various appellate

authorities including the Apex Court. It was informed that even after the

landmark judgments on the issue, the same are being ignored. A mechanism

must be evolved wherein Commissionerate can give due respect to recurring

orders and should not be forced to go into the process of paying duty under

protest, filing of appeals and wait for refunds. The Chairperson assured to

xvi. Shri Tarun Kalra, representative of M/s MSC Shipping Agency Pvt Ltd. raised

the issue on auction of unclaimed/uncleared goods. He informed that many

containers pending for auction at Dadri are still without any action by

Disposal Branch. The Chairperson informed that a Special Drive for disposal of long standing containers is going on since August, 2020 without any

bias/discrimination against any custodian/CFS under the Noida Customs Commissionerate. All pending disposable cases shall be disposed of by March, 2021.

Xvii. Shri Tarun Kalra, representative of M/s MSC Shipping Agency Pvt Ltd. raised

issue that local EGM are being delayed, causing Gateway EGM to fall under

Error. The Joint Commissioner replied that the EGM are being filed on time

but these are not being uploaded successfully, unless the train carrying the

goods moves out from the ICDs. [Action: Dc (Export)}; All Custodians)]

The Meeting ended with a vote of thanks to all participants. It was requested

by the Chairperson that all stakeholders should work together for the best

outcome of trade facilitation as envisaged under the concept of ease of doing

business.
