P rocedure of obtaining trademark

1. Apply for registration of a trademark to the Indian Trademark

Registry at Mumbai. Form TM-1 is to be filled along with application

fee of Rs. 2500/-. The air vehicle manufacturing belongs to the Class 12

of International Classification of Goods and Services for trademark

application.

2. Publication of the trademark application in the Indian Trade Marks

Journal for acceptance.

3. Any party can raise objection to the application within three months

(can be extended up to a month further) with a notice of opposition to

register.

4. Without any objection or after clearing the suit, the company gets the

trademark to be used commercially.

± A pply to the concerned RoC for availability of name in eForm 1A. Fee of

Rs. 500/- has to be paid.

If proposed name is not available, the user has to apply for a fresh name on

the same application. ± On approval, the applicant to apply for registration of the new company (

Form 1, 18 and 32) within 60 days of name approval

Notice of situation of registered office of the company - Form-18.

Particulars of the Director's, Manager or Secretary - Form-32.

Nomination of Merchant banker as Lead Book runner.

20 % price band is offered by the issuer within which investors are

allowed to bid.

10 % advance payment is required to be made by the QIBs, Other

categories of investors have to pay 100 % advance.

50 % of shares offered are reserved for QIBS, 35 % for small investors

and the balance for all other investors.

Opening of escrow account for all transactions.

The Issuer also appoints syndicate members with whom orders are to

be placed by the investors.

The syndicate members input the orders into an 'electronic book'. This

process is called 'bidding' and is similar to open auction.

The book normally remains open for a period of five days and

not more than 10 working days.

Bids can be revised by the bidders before the book closes.

Book runners evaluate bids for demand at various price levels and

decide the final price.

Generally, the number of shares are fixed, the issue size gets frozen

based on the final price per share.

Allocation of securities is made to the successful bidders. The rest get

refund orders.
