1. The Sustainable Rural Infrastructure Development Project in Northern Mountainous Provinces is funded by the Asian Development Bank (ADB), of which the Subproject (SP52) “Improvement of Domestic Water Supply in Pa Tan Commune, Sin HoDistrict” is one of the proposed subprojects. The subproject area will cover Pa Tan commune, Sin Ho district, Lai Chau Province. The subproject entails the improving and construction of 3 gravity water supply systems. When the Subproject is completed, sufficient potable water supply is expected to be distributed to about 3,400 persons in Pa Tan commune of Sin Ho district.
2. Pa Tan is the boundary commune of Sin Ho districtwhich has a large area with people living in scattered locations. The commune has 14 villages consisting of 816 household with 3,759 persons and four ethnic groups: namely the Kinh accounted 146 HHs with 447 persons, 28 Mang households with 127 persons; 259Monghouseholds with 1,522 persons; and 361 Thai households with 1,579 persons.
3. Boundary of the project area are as follows:
- Eastern border: Hong Thu commune; - Western border: Nam Ban commune and China; - Southern border:Hong Thu and Nam Ban communes of Sin Ho district; and - Northern border: Huoi Luong commune of Phong Tho district

4. The subproject willimprove one existing and construct 2 new gravity water supply system. The schemes include1 new unit for 6 villages of An Tan, Pa Tan 1, 2,3,4 and centre village; 1 new unit for Pho 1village and one existing system for Pho 2village.
a. Work item 1: Water supply system for the 6 villages of An Tan, Pa Tan 1, 2,3,4 and
centre village.
- Main works include: construction of intake structure, raw water pipeline, first settling tank, raw filter tank , filtration stations, pressure filter tank, anddistribution pipelines. Design capacity: 513.49 m
3 / day.
b. Work item2: Water supply system for Pho 2 village
- The main works include: Construction of 2 new water intakes; raw water filtration, raw water pipelines, distribution water pipelines, pressure cut tanks. Design capacity: 24m
3/day.
c. Work item3: Water supply system for Pho 1 village - Repair and installation of new facilities for the existing water supply systemwhich
includes a coarse filter tank and reservoir tank (2m3capacity) for 3 households.

C. Social Issues:
1. The LIC social safeguards specialists with support of CPMU, Lai Chau PPMU, and communes’ PC of Pa Tan has conducted a social impact assessment in the proposed commune to identify social impact issues and scope of land acquisition in the subproject commune.
2. There are some main social issues of the subprojects found from social impact
assessmentconducted by the LIC specialists: (i) Inadequate potable water supply for Pa Tan commune of Sin Ho district; (ii) Existing water source for domestic use (limited coverage within subproject area)
includewater from slot, rain and water source of neighbouring communes; and (iii) The non-potable water consumed by local residents is believed to have be the cause of
water-borne diseasessuffered by local people such a trachoma, diarrhoea, dysentery cholera, dermatological diseases, and others. In the survey conducted, community leaders and local people expressed their aspirations to have their current poor water supply facility upgraded and expanded to adjacent villages, to ensure the healthand sanitation of local people, as well asimprovetheir living conditions.

3. According to the social impact assessment, all subproject facilities (i.e. water tank, water treatment station and pipelines) are to be sited in government lands (CPC’s land), while the pipelines are to be buried at the side of the existing roads well within the Right of Way (ROW). There is a 500m
2 of forest land belonging to the government (under CPC administration) but
under lease (no rental) by theLai ChauRubber company No 2 that will be acquired as site for the new water treatment plant.
4. The CPC and Rubber Company agreed to hand over the affected landsto the subproject for use in building the potable water system.
5. There are no tree, crop or any assets on the affected land. The area that used to be planted with Acacia Mangium trees, have its timber harvested by clear cutting method. Now the land lays barren with no vegetation of commercial value growing there.

6. Therefore, negative impacts resulting from land acquisition, including temporarily impacts on local people have not been identified in the subproject area. It is predicted that there is no potential land acquisition impact on the local people during subproject implementation.

7. All the pipelines are to be buried at the side of the existing roads well within the Right of Way (ROW). Therefore, negative impacts resulting from land acquisition, including temporarily impacts on local people have not been identified in the subproject area. It is predicted that there is no potential land acquisition impact on the local people during subproject implementation.
8. Resettlement Category: The subproject could be categorized C for Involuntary Resettlement
and Indigenous People due to no land acquisition and negative impact on the local people.
Following ADB SPS 2009 (para 17, Appendix 2) and Project Resettlement Framework (para
26, Item A, Chapter IV), there is no need for the preparation of RP and IP.In case land
acquisition of the local people occurs during subproject implementation due to changes in
technical design, a RP will be prepared and submitted to ADB for endorsement. Payment for
affected land and non-land assets must be paid at replacement costs and before commencing
construction.

9. The Public Consultation meeting was held on 11 November 2014 in the subproject commune.
Participants include major stakeholders (i.e. PPMU, CPC officials, Local residents, academe,
CPMU, Safeguard Consultants). The CPC Chairperson welcomed the visitors and encouraged
his constituents to actively participate in the discussions. PPMU Director explained the rationale
of the subproject, while Safeguard consultants informed the body of the environment and social
impact of the subproject implementation.The participants have raised a number of issues which
include: a) they have long waited for this subproject to be implemented; b) there is inadequate
potable water supply in their area; c) Encourage more active and meaningful participation of
women and EMs into the process of land recovery implementation, management and
monitoring; d)The women highly agreed with action plans on gender of the subproject; d)
Incidence of waterborne diseases is confirmed especially for residents using shallow wells with
polluted ground water; d) time is wasted fetching clean water from neighbouring areas; and e) It
is thought that the environmental impacts of the subproject during construction are limited, but
these effects can be overcome with the mitigation measures as proposed in the meeting. (See
minutes of the Public Consultation Meeting in Appendix 5)

10. The Ministry of Agriculture and Rural Development (MARD) is the Executing Agency for the Sustainable Rural Infrastructure Development Project in Northern Mountainous Provinces. CPMU under MARD has responsibility for project management. Lai Châu PPMU is responsible for the subproject implementation.

the Safeguard report for SP52 that needs to be
prepared and submitted by the Safeguard consultants
for review and consideration of ADB/MARD/PPMU

Description
PPMU Safeguard Staff Mr.Hung presented the rationale
and general description of the proposed subproject
SP52to the body. Representative of the PPMU Design
consultants provided further details of the proposed
scheme.
3 Clarification of
subproject
details
• Clarificatory questions were raised on the Subproject
description presentation.
• It was mentioned that the subproject main
components are: a) intake tank;, b) water treatment
station; and installing pipelines.
• The subproject will install some facilities. Therefore it
will acquire some land.
• The subproject will attach to the main water pipeline
of the existing water supply facility along the road.
• All the major subproject components will be
constructed within CPC (government) lands and small
part of private land. The pipelines will be installed
along the existing road well within its ROW.
• Three CPCs and Rubber company (leasee of land)
agree to donate land and asset for the subproject
without any payment or assistance. Then there is no
compensation for resettlement items.

4 Initial conclusion • Pending confirmation of the resettlement impact

Category C, there is no need for preparation of RP
following Project Resettlement Framework and ADB
SPS 2009. However, a scoping report will be needed
to support the proposed Categorization along with

water supply subproject can create adverse
environmental impacts during the construction phase
that need to be mitigated. Following the Project
Environmental Assessment and Review Framework,
the subproject can still be classified as Environment
Category B, which will require the preparation of an
IEE following the report format prescribed in the
Project Administrative Manual (PAM).

Lai Chau PPMU of SRIDPNMP now are preparing for the subproject “Improvement of domestic water

Safeguard consultants as following:
Based on the design, the construction of 2water treatment stations, the management house and
water tanks will require the recoveryof land on which the structures will be built. There is 30m2 of
idle land of Pa Tan commune, Sin Ho district; and 500m2 of forest land of Lai Chau Rubber company
No 2 will be acquired for constructing subproject.Pa Tan CPC and Lai Chau Rubber company No 2
agreed to hand over their affected land and assets on land,for the constructionof the water supply
system. All the impacts on land and assets that may be caused by pipeline layingare temporary.The
local people absolutely approve and agree with this water supply undertaking. The subproject will
have no involuntary resettlement impact because noadverse impact is expected on local people’s
assets and livelihood.

6. Lai Chau province. Lai Chau is a province in Northwestern Vietnam, about 450 km away from Hanoi towards the North-West. Lai Chau province is divided into 7 subdivisions, including Lai Chautownship and districts (Tam Duong, MuongTe, Sin Ho, PhongTho, Than Uyen and Tan Uyen) with 103 communes, wards and towns.
7. According to the 2011 statistics, total landarea of this province is 906,879 ha. Of which, agricultural land accounts for approximately 56.13% (509,021 ha). Non-agricultural land only constitutes about 3.84%. Of 509,021 ha of agricultural land, only 17.6% are productive land, while the remaining is forest.
8. Average population of Lai Chau province in 2011 is estimated to be about 393,752 people. Of which, the male accounts for 51.14% and the female makes up 48.86%; the urban population accounts for 14.31% and the rural constitutes 85.69%. Natural growth rate is estimated to be 23.61%. This rate slightly decreases in comparison with in recent years, for instance, 2010 (24.74%) and in 2009 (24.93%). Average population density is about 43.42 people/km
2. Highest density (413.97
people/km2) occurs in Lai Chau township, while lowest one (14.86 people/km
2) is estimated in
MuongTe district.
9. Sin Ho district. Sin Ho is one of seven districts and townships of Lai Chau province, 60 km away from Lai Chau township towards the West. This district is divided into 1 town (Sin Ho town) and 23 communes (Le Loi, Pu Dao, Chan Nua, Pa Tan, Phin Ho, Hong Thu, Nam Ban, Phang So Lin, Ma Quai, Ta Phin, Sa De Phin, Nam Tam, Ta Ngao, Pu Sam Cap, Nam Cha, Lang Mo, NoongHeo, Nam Ma, Can Co, Tua Sin Chai, Nam Cuoi and Nam Han). This is a mountainous district with complex topography of isolated high mountains and difficult transportation access. Total landarea of the district is 192,485 ha and population at the end of 2011 is about 82,344 people (14,768 households); of which, the male and the female account for 50.7% and 49.3%, respectively. Sin Ho is one of the poorest districtsof Lai Chau province, and is one of 61 poorest districts of Vietnam which are adjusted by the Program 30a of the Government with poverty rate at the end of 2011 of up to 48.03%. There are 13 ethnic minority groups living in the district, including Kinh, Thai, Mong, Dao, Kho Mu, Giay, Lu, Mang, Tay, Muong, Hoa, Ha Nhi and Hung. There are 7 main minority groups, including Thai, Mong, Dao, Kinh, Lu, Kho Mu and Mang and the groups’ total population are distributed as 32.51%, 31.62%, 20.89%, 5.67%, 4.01%, 1.07% and 1.49%, respectively.
10. Sin Ho district covers a landarea of 192,485 ha, being the second largest district of Lai Chau province. Of which, agricultural land accounts for 56.25% (108,281 ha), non-agricultural land constitutes 4.79% (9,227 ha) and unused land makes up 38.95% (74,977 ha). Of 108,281 ha of agricultural land, only 30.97% is agriculture production land, while forest land accounts for 68.97%.
11. As of 2011, the district had a population of 81,399 people (population at the end of 2011 is about 82,344 people or 14,768 households). Of which, the urban and the rural population account for 5.5% and 94.0% respectively; the male and female respectively account for 50.7% and 49.3%. Average household size is 5.58 persons/household.
12. Total laborers working in economic sectors is estimated to be 42,327 persons, accounting for 52% of total population. Of which, themajority works in the agriculture, forestry and aquaculture sector (36,029 laborers, accounting for 85%). This implies that this is the main sector of the district.
13. Sin Ho is one of the poorest districtsof Lai Chau province and is one of 61 poorest districts of Vietnam belonging to Program 30a of the Government. Poverty rate at the end of 2011 is very high, 48.03%, even though this rate had significantly decreases in comparison with the figure atthe end of 2010 (54.30%). The poorest commune is Pu Dao with a poverty rate of 66.12% and the lowest poverty rate is encountered in Le Loi commune. There are 14 of 23 communes where poverty rate is more than 50%, including two subproject communes, Nam Cuoi (57.37%) and Nam Han (56.44%). This high poverty rate is a result of many factors,foremost of which is due to low education attainment of local people, lack of working experience, lack of productive land, lack of labor force, and many dependents.

15. Pa Tan commune; Pa Tan 's total land area is 115.06 km2 and the population is 3,759 persons
with the density of 32.69 persons/km2. Pa Tan comprises 14 villages: Pa Tan 1, 2, 3, 4, Pho 1, 2,
Mong 1, 2, An Tan, Cau Tien, Nam Tien 1, 2 and Tan Xa.
16. According to 2013 CPCs' socioeconomic report of the commune, average annual percapital income of Pa Tan is 12.8 mil VDN per person/year. The poverty rate in the commune is lower than the average of Sin Ho district (21.2% in Pa Tan commune).
17. There are 3 ethnic minority groups living in the Pa Tan commune that includes the Kinh, Thai, Mong and Mang. The percentageof EM in Pa Tan is85.87%respectively. Table 4 contains the Socioeconomic features of the subproject commune.

The non-potable water consumed by local residents is believed to have been the cause of reported water-borne and related diseases of local people such as cancer, trachoma, diarrhea, dysentery cholera, dermatological diseases, and others. In the survey conducted, community leaders and local people, expressed their aspirations to have their current poor water supply facility upgraded and expanded to ensure the healthand sanitation of local people, as well asimprove their living conditions.
