Sub :Feasibility of implementation ofrecommendations accepted by GOIcontained in paras 10.1.67 & 10.1.68 of7CPC report.

In connection with feasibility of implementationof recommendation contained in para 10.1.67 of7CPC report relating to pre-2016 pensioners, theundersigned, on behalf of Bharat PensionersSamaj (Federation) a conglomerate of over 628pensioners Associations, submits as follows:

i). Your kind attention is invited to 5th CPCrecommendation contained in Para 137.14 of thereport together with GOI’s decision there on whichreads as under:

The pension of all pre -1986 retirees may beupdated by notional fixation of their pay as on1.1.1986 by adopting the same formula as for theserving employees. Thereafter, all the pastpensioners who have been brought on the FourthCPC pay scales by notional fixation of their payand those who have retired on or after 1.1.1986can be treated alike regarding consolidation oftheir pension as on 1.1.1996 by allowing the samefitment weightage as may be allowed to the servingemployees. However, the consolidated revisedpay of the post held by the pensioner at the timeof retirement. (137.14)

Govt Decision:

Accepted to the extent that pension of pre1.1.96 retirees including pre-86 retirees shall beconsolidated as on 1.1.1996 as recommendedbut the consolidated pension shall be brought onto the level of 50% of the minimum of the revisedpay of the post held by the pensioner at the timeof retirement. Nos. 45/86/97-P&PW(A) Part-II dt.27.10.1999 & 45/1098-P&PW(A) dt 17.12.98 refer.

ii). Similarly 6th CPC recommendation on thesubject of revision of pre-2006 pensioners werepossible as per GOI orders contained in F.No.38/37/08-P&PW(A) dated 01.09.2008 andamendments issued by DOP & PW thru F.No.38/37/08-P&PW(A) dated 28-01-2013 wherein para

4.2 reads “ That is, the fixation of pension will besubject to the provision that the revised pension,in no case shall be lower than 50% of the minimumof the pay in the pay band plus grade paycorresponding to the pre revised pay scale fromwhich the pensioner had retired. In case of HAG+and above scales, this will be 50% of the minimumof the revised pay scale.”

iii). Pension record is of permanent nature andif it is to be destroyed, proper permission from thecompetent authority is to be obtained. In any case,these record can always be reconstructed takingthe details from various sources available in thedepartment and the material collected from thePensioner. In this regard attention is also drawnto recent CAT Bombay Nagpur Bench judgementdated 09.03.2015 in case of Smt. Saija vs. GeneralManager, Central Railway O.A.No. 2131 of2011(CAT Bombay Bench at Nagpur) & F.No. CIC/DS/A/2013/000901-YA. Date of Decision :03.07.2014. It is also pointed out that never everany department in any of the Court cases broughtout the issue of non-availability of records.

2. It was possible to implement the aboverecommendations of pay panels and issue revisePPOs as records were traced out, probably due tosome incentive given to the staff concerned forrevising the PPOs of pre-1986 retirees involvingnotional fixation. Railway administration for certaingave incentive to the staff concerned forimplementing 5th CPC recommendations.It isreliably learnt that as no incentive for additionalwork involved in revision of PPOs after 6thCPCwas offered. Rly Admn did face some difficultiesin implementing recommendations of 6th CPCand consequential issue of revised PPOs to pre-2006 retirees, still as per Rly Board 100% PPOscould be revised. Govt records can speak of theposition of incentive offered by variousdepartments concerned. It is one of thesuggestions to consider incentive to staff to easethe problem of locating old records/informationrequired, since in 90% cases records areavailable and remaining can be recasted.

3. 7th CPC considered the long standingdemand of pensioners retired in earlier CPCsregimes to grant them parity in fixation of pension

with those retiring subsequently afterimplementation of its report. Accordingly, 7th CPChas recommended granting benefit of incrementsearned by the pensioner in the Pay Band andGrade Pay/Scale of Pay for 01.01.2006Pensioners while determining their notional payas on 01-01-2016 at a level in the pay matrix givenby the 7th CPC. Pension would be fixed at 50% ofthe notional pay so arrived.

4. Apprehension of non-feasibil ity ofrecommendation, discussed in para 3 , due tonon-availability of records is further narrowed &not zeroed. PPOs issued at the time of retirementand revised afterwards do reflect changesprescribed by the Govt. in the pay scales on therecommendations of different Pay Commissions,record the stage of pay in the Pay Scale/Pay Bandof a person retired.

5. The recommendation of 7thCPC vide theirpara10.1.67(option1) for Parity of Pension isbased on legal & Constitutional grounds and assuch to maintain sanctity it needs to beimplemented in toto.

6. It is a history that pensioners retired earlierwere always at a discount in the matter of revisedpensions. 7th CPC has tried to give some reliefto pre-2016 retirees. For the purpose ofdetermining pension under para 10.1.67 of 7thCPC in cases where all attempts to tracerecords or to recast missing ones fail, it issuggested that such of the pensioners may begiven option to get their notional pay determinedon the basis of stage of pay i.e. LPD in the gradeindicated in the PPOs this information isinvariably available in all PPOs. If in some PPOsif LPD is not indicated it can be determined fromfamily pension which is 30 % of LPD.

7. Fixation of notional pay of pre 2016pensioners on the basis of the stagecorresponding to the grade of pay in which apensioner had retired would offer a fair & equitableoption in all cases where records cannot betraced in spite of best efforts.

8 . However to meet the ends of justice, Bharatpensioners Samaj request that a personalhearing be granted to its delegation.

Sub : Grant of full pension for less than 33 yearsof service – Extension of the provisionsof Govt. of India, Ministry of Personnel,Public Grievances and Pensions,Department of Pension and Pensioners’Welfare, OM No.38/37/08-P&PW (A) dated6th April, 2016 to Pre-2006 Coffee BoardPensioners.

We would like to invite your kind attention tothe OM cited above, a copy of which is enclosedherewith for ready reference, under which all pre -2006 Central Govt. Pensioners who had retiredwith less than 33 years of service have been madeeligible for full pension i.e. at 50 % of the sum ofthe minimum of the pay in Pay Band and GradePay thereon introduced w.e.f.1-1-2006,corresponding to the pre revised pay scale fromwhich they had retired, in terms of para 4.2 of OMdated 1-9-2008 of the Department of Pension andPensioners’ Welfare.

2.With delinking of 33 years of service foreligibility to full pension, all pre -2006 Pensionerswith a qualifying service of 10 years and abovehave become eligible for full pension w.e.f 1-1-2006 without any pro rata reduction in pension forless than 33 years of service. Admissibility of fullpension for 10 years of service has also beenconfirmed by the Ministry of Finance, Departmentof Expenditure, Central Pension Accounting Office(CPAO), New Delhi ,vide their OM No.CPAO/IT&Tech/Revision(Pre-2006)/2016-17/8 Vol-VI/58dated 13th June 2016 ,a copy of which is alsoenclosed for reference.

3.We have been informed by the Coffee BoardPensioners’ Association, Bengaluru, an AffiliateAssociation of the Coordination Committee ofCentral Government Pensioners’ Associations,Karnataka (R), that the orders contained in theDepartment of Pension OM dated 6-4-2016 statedabove, have not yet been extended to Coffee BoardPensioners, who are also governed by CentralCivil Services (Pension) Rules and whosepension has already been revised under 6th CPCrecommendations, implemented Vide DoP&PWOM dated 1-9-2008. We have also been informed

by this Association that the Coffee Board hasrequested Ministry of Commerce for release ofadditional funds required for payment of arrearsto its pensioners as per this OM and who, in turn,has requested your Department for sanction ofadditional funds required. We understand thatmany of the other Statutory Bodies/AutonomousBodies have already implemented the orderscontained in this OM and it is only the pre-2006pensioners of Coffee Board have not got thisbenefit so far. We are really not able to understandwhy this kind of step-motherly treatment is beingmeted out to few sections of pensioners.

5.We are, therefore, constrained to approachyour kind self with an earnest request to causeimmediate implementation of the provisions ofDoP&PW OM dated 6-4-2016 cited above inrespect of pre-2006 Coffee Board Pensioners whohad retired with less than 33 years of service, soas to ensure grant of full pension to suchPensioners from 1-1-2006 on par with otherCentral Civil Pensioners, by releasing additionalfunds requested by the Ministry of Commerce sothat the consequential benefits, that have accruedto these pensioners as per DoP&PW OM dated4.8.2016 issued in implementation ofGovernment’s decisions on the recommendationsof 7th Pay Commission – revision of pension ofpre - 2016 pensioners/family pensioners etc.,- maybe granted based on this revision.

We would like to invite your kind attention tothe OM cited above, a copy of which is enclosedherewith for ready reference, under which theGovernment has revised pension of pre-2016pensioners/family pensioners w.e.f. 1.1.2016based on the 7th Pay Commissionrecommendations.

apply to all pensioners/family pensioners whowere drawing pension/family pension before1.1.2016 under Central Civil Services (Pension)Rules, 1972. Further, the Government has alsoordered that the revised pension and the arrearsdue to the pensioners, as per this OM is paid tothe pensioners or credited to their account by 31st

August 2016. In accordance with this O M, all thepensioners of Central Government will be gettingrevised pension/arrears w.e.f. August 2016.

3. The pensioners/family pensioners of theStatutory Bodies/Autonomous Bodies viz. CoffeeBoard, Rubber Board, Spices Board, Central SilkBoard, Kendriya Vidyalaya Sanghathan, NationalCouncil of Science Museum, etc. are all governedby Central Civil Services (Pension) Rules and theirpension/family pension are being revised as perthe Government orders based on Central PayCommission Recommendations, issued fromtime to time. As the orders contained in the e OMcited above apply to all pensioners/familypensioners, who were drawing pension/familypension before 1.1.2016 under Central CivilServices (Pension) Rules 1972, pensioners ofthe organisations indicated in para 3 above areentitled to get their pension revised as per the OMdated 4.8.2016.

3.We may also recall your press briefing on19.11.2015, made immediately after 7th PayCommission recommendations were submittedto the Government, when your good self informedthe Media that 7th Pay CommissionRecommendations, as and when accepted by theGovernment, will benefit staff of autonomousbodies, universities and public sectorundertakings.

4. Under the above circumstances, we requestyou kindly to cause issuance of necessaryinstructions to Administrative Ministries concernedto implement the orders contained in the OMdated 4.8.2016 in respect of the pensioners/familypensioners of Statutory Bodies/AutonomousBodies, immediately, and to ensure that theirrevised pension/family pension are paid fromAugust 2016, for which we will be grateful to you.If this is done, this will ensure equity amongstpensioners/family pensioners of CentralGovernment and Statutory/Autonomous Bodies ofCentral Government.

BPS is also thankful for your ardent supportfor implementation of option1 for revision ofpension (Para10.1.67) I am writing following fewlines with the intention that the informationhereunder may further strengthen the stand infavour of pre 2016 pensioners :

a) The PPOs invariably contain the last pay drawn,pay scale and the designation of pensioner. Itis not difficult to glean the requisite informationfrom this;

b) Pension related documents are a permanentand protected record which cannot bedestroyed without the sanction of competentauthority and certainly not during the life timeof pensioner/family pensioner;

c) It was possible to implement therecommendations of earlier pay panels (like5th CPC) and issue revised PPOs as recordswere traced out after giving some incentive inRailways to the staff concerned for revisingthe PPO of pre 1986 retirees involving notionalfixation. Hence the incentive scheme on thesame lines can be considered to motivatethe concerned staff to ease the problem oflocating the old records/information asneeded since most of the record is alreadyavailable and the remaining, if required, canbe recast;

d) More over the General Financial Rules (GFR)2005 issued by MOF (DOE) in Chapter 12 VIII(2) lays down the retention periodregarding Destruction of Records connectedwith Accounts. In item 8 (Page 109) in Annexure

to Appendix 13, it is mentioned that undervarious types of pensions, Retention Periodis till one year after the last beneficiary ofthe family pension ceases to be entitled toreceive or 5 years whichever is later;

e) Much longer period is prescribed in the Ministryof Railways. Under item 136 of Appendix ix(Para 121) of IR ACCOUNTS CODE (IRCA),THE PERIOD FOR WHICH THE RECORDSIN ACCOUNT OFFICES ARE TO BEMAINTAINED in respect of PENSION PAPERSis five years after the date on which thePENSION becomes inoperative; and

f) In very few and exceptional cases, the recordmay have to be recast taking the details fromvarious sources and the material collectedfrom pensioners.

It is, therefore, clear from the above that withthe availability of all the pension documents incompliance with codal provisions for retention ofrecord and some incentive to the concerned staff,there should not be any difficulty in implementingthe long awaited parity of past pensioners asenvisaged under option 1. The Govt. with its bonafide intention and vast resources at theircommand can always implement Option 1 ofrevising pension of past pensioners as acceptedby the Cabinet. IS NOT REQUIRED."THAT,in fact, all thepermanently Blind persons if they are nototherwise crippled, are capable of earning, ifopportunity is available to them.On this groundno family pension can be sanctioned to a blindchild & under this condition, the provision of grantof family pension to a blind child becomesinoperative.That, in reality there a gulf of differencebetween the "Capacity to Earn" and "actualearning". That, as far as "Capacity to earn" for ablind person is concerned, he can earn hislivelihood by begging also. Should we desire thesame for the children of Rly Pensioners? That asper extent rules, family pension is sanctioned tothe children of Pensioners whose maximum limitof earning is Rs2550/- or below. The saidprovision is reasonably applicable to the blindchild also. That, the spirit of the content of the Bd'circular as referred to above is to grant familypension to a permanently blind child and not todeprive him/her of the same on the ground that,"he is able to earn from job where vision is notrequired ", without defining the amount he canearn under the same condition. Under thecircumstances, I would request you to pleaseclarify the stand of the Rlys and on the above issueso that a genuinely deserving blind child of adeceased Rly Pensioner in not deprived of hislegitimate claim.That, in the light of above, GM(E)/W Rly may please be directed to grant familypension to Sh. Ramakanth L Rajpurkar, who isperfectly eligible for the same.

After protractedcorrespondence, the bank has released familypension to Mrs Surajwati commencing f/pensionfrom the month of July, 2016 with assurance thatarrears of family pension from 21-09-2006onwards will also be disbursed in couple ofmonths. This case again strengthens the needfor arranging workshops both for serving as wellas dependents of the deceased pensioners toensure that the entitled benefits are made knownto all .

Instructions wereissued vide this Department OM of even numberdated 30th September, 2010 for extension ofbenefits of modified parity to past pensioners forrevision of disability pension/family pensioncovered under CCS(EOP) Rules.

2. Subsequently, orders were issued vide thisDepartment’s OM NO.38/37/2008- P&PW(A) dated28. 01. 2013 and 30.7.2015 for further steppingup of normal pension/family pension to 50%/30%of the sum of minimum pay in the pay band andgrade pay corresponding to the pre-revised payscales from which the pensioner had retired, asarrived at with reference to the fitment tableannexed to the Ministry of Finance, Department ofExpenditure OM NO.1/1/2008-IC dated so” August2008 with effect from 01.01.2006. These benefitswere also extended to pre-2006 disabili typensioner/family pensioner covered under theCentral Civil Services (Extraordinary Pension)Rules vide this Department’s OM of even numberdated 20.11.2014 and 29” April 2016 respectively.As per para 111(a),IV(a) and para V(a) of thisDepartment’s OM of even number dated 20thNovember 2014, the service element of disabilitypension of pre-2000 disability pensioners waslinked to qualifying service for earning full pension.

3. In the case of pre-2006 pensioners receivingpension under CCS(Pension)Rules, 1972, ordershave been issued vide this Department’s OM NO.38/37/2008-P&PW(A) dated 6.4.2016 that therevised consolidated pension of pre- 2006pensioners shall not be lower than 50% of theminimum of the pay in the Pay Band and the grade

pay (wherever applicable) corresponding to thepre-revised pay scale as per the fitment tablewithout pro-rata reduction of pension even if theyhad qualifying service of less than 33 years at thetime of retirement.

4. This provision would be equally applicablefor computing service element of revised disabilitypension being drawn by the pre-2006 disabilitypensioners. Accordingly, the provision linking theservice element of disability pension under paraIII(a),IV(a) and V(a) of this Department’s OM ofeven number dated 20th November 2014 standsdeleted. The arrears of revised disability pensionwould be payable with effect from 1.1.2006.

5. All Ministries/Departments are requestedto bring the contents of these orders to the noticeof Controller of Accounts/Pay and AccountsOfficers and Attached and Subordinate Officesunder them for revising the pension of all thosepre-2006 disability pensioners who had renderedless than 33 years of qualifying service at the timeof retirement/boarding out in the manner asindicated above on top priority. Revised PensionPayment Orders (PPOs) in all these cases mayalso be issued immediately.

6. All other terms and conditions in the O.M.No.45/22/97-P&PW(F) dated 3.2. 2000 and O.M.No.45/3/2008-P&PW (F) dated 30.09.2010,20.11.2014 and 29.4.2016 shall remainunchanged.

1. Quick & satisfactory disposal of pensioners’grievances has been on top priority of CPAO. Forthis purpose, a Grievance Cell is alreadyfunctioning in CPAO and grievances receivedthrough different modes are settled by it. So far,grievances not pertaining to CPAO directly butinvolving other agencies for final disposal werebeing forwarded to the concerned agency i.e. Bank,PAO for necessary action through email/letter.However, no tracking/monitoring of disposal ofsuch grievances was available either with theMinistries or with CPAO.

2. In order to fill this gap, CPAO has developedGrievance Redressal and Monitoring System inits website www.cpao.nic.in under the ’WebResponsive Pensioners Service’. Through thisfacility, pensioners’ grievances can be transferredonline on the login of the concerned PAO from theCPAO website for early disposal and updatethereon for pensioner’s information. For thegrievances which need to be resolved byconcerned HOO/DDO; PAO has been given facilityto mark such grievances to the concerned DDOsfor their response. Here, it may be noted thatmarking of grievances to the DDOs is only forreporting/tracking purpose. After marking thegrievances through system, FAQ will require tosend the same to the concerned 0005 throughavailable modes i.e. letters/emails as DDOs arenot connected through this system. Similarly,response from the 0005 taken through samemodes will be updated by FAQs in the systemthrough their login IDs. For the time bounddisposal of grievances (within 30 days from thedate of receipt at CPAO), monitoring is required.Therefore, facility of monitoring of disposal ofgrievances marked to PAOs has been providedin the CPAO website under the existing CCAslogins along with Dashboards and meaningfulMIS reports.

3. It is further pertinent to mention that largenumbers of grievances pertain to delay in start ofpension for which late submission of pensionpapers from HOO to PAD is mainly responsible.For monitoring the timely submission of pensionpapers, facility to upload quarterly lists of theemployees retiring in next 12/15 months has beenprovided to FAQ in CPAO website to facilitate theimplementation of Rule 56 of CCS (Pension)

Rules which provides “that every Head ofDepartment shall have a list prepared every threemonths each year, of all Government servant whoare due to retire within the next twelve/ fifteenmonths and a copy of each such list shall besupplied to the Accounts Ofiicer concerned” .Under this facility, Pay and Accounts Officers willupload such quarterly lists on CPAO website byusing their existing logins after collecting the samefrom concerned HOOs/DDOs. Facility to monitortimely uploading of quarterly lists and submissionof pension papers thereof by the HOOs/DDOs isalso provided in the logins of CCA along withDashboard and required MIS reports.

4. In view of above, all the Pr. CCAs/CCAs/CAs/ AGs/Administrators of UTs/Delhi Admin arerequested to use this online monitoring facility onregular basis and keep track of the disposal ofgrievances to ensure that all grievances receivedfrom CPAO are settled on priority and maximumwithin 30 days and status is updated on CPAOwebsite by their FAQs. The period wise pendencyinformation is available on their dashboards. It isalso requested to ensure timely uploading of listsof retiring employees and submission of pensionpapers arising out of such lists. You are alsorequested to instruct your PAOs to use theseonline CPAO facilities as they are the nodal pointsfor CPAO in respect of disposal of grievances anduploading of quarterly lists.

been decided that Anomaly Committees should

be set up, consisting of representatives of the

Officials Side and the Staff Side to settle the

anomalies arising out of the implementation of

the 7th Pay Commission’s recommendations,

subject to the following conditions, namely:

(1) Definition of Anomaly

Anomaly will include the following cases:

(a) where the Official Side and the Staff Side are

of the opinion that any recommendation is in

contravention of the principle or the policy

enunciated by the Seventh Central Pay

Commission itself without the Commission

assigning any reason; and

(b) where the maximum of the Level in the Pay

Matrix corresponding to the applicable Grade

Pay in the Pay Band under the pre-revised

structure, as notified vide CCS (RP) Rules

2016, is less than the amount an employee is

entitled to be fixed at, as per the formula for

fixation of pay contained in the said Rules”.

(2) Composition : There will be two levels of

Anomaly Committees, National and

Departmental, consisting of representatives

of the Official Side and the Staff Side of the

National Council and the Departmental

Council respectively.

(3) The Departmental Anomaly Committee may

be chaired by the Additional Secretary (Admn.)

or the Joint Secretary (Admn.), if there is no

post of Additional Secretary (Admn.). Financial

Adviser of the Ministry / Department shall be

one of the Member of the Departmental

Anomaly Committee.

(4) The National Anomaly Committee will deal with

anomalies common to two or more

Departments and in respect of common

categories of employees. The Departmental

Anomaly Committee will deal with anomalies

pertaining exclusively to the Department

concerned and having no repercussions on

the employees of another Ministry /

Department in the opinion of the Financial

Adviser.

(5) The Anomaly Committee shall receive

anomalies through Secretary, Staff Side of

respective Council upto six months from the

date of its constitution and it will finally dispose

of all the anomalies within a period of one

year from the date of its constitution. Any

recommendations of the Anomaly Committee

to resolve the anomaly shall be subject to the

approval of the Government.

(6) Cases where there is a dispute about the

definition of “anomaly” and those where there

is a disagreement between the Staff Side and

the Official Side on the anomaly will be referred

to and “Arbitrator” to be appointed out of a panel

of names proposed by the two sides. However,

this arbitration will not be a part of the JCM

Scheme.

(7) The Arbitrator so appointed shall consider the

disputed cases arising in the Anomaly

Committees at the National as well as

Department level.

(8) Orders regarding appointment of the Arbitrator

and constitution of Anomaly Committee at

National Level will be issued separately. All

Ministries / Departments are accordingly

requested to take urgent action to set up the

Anomaly Committees for settlement of

anomalies arising out of implementation of the

7th Pay Commission’s recommendations, as

stipulated above.

Now, DP&PW vide their OM No.4/38/2008-P&PW (D) dated 04.08.2016 (notpublished) has clarified that the notional fullpension of absorbee pensioners would also berevised in accordance with the instructionscontained in aforesaid OM dated 06.04.2016 w.e.f.01.01.2006 and dearness relief and additionalpension for old pensioners would be admissibleon such notional revised full pension. There willhowever be no change in the actual 1/3rd restoredpension determined in accordance with the OMdated-15.09.2008 read with OM dated-11.07.2013.

All Pr. CCAs/CCAs/ CAs/AGs andAdministrators of UTs are requested to instruct theirFAQs for sending revisions for such cases as perabove instructions. They are also advised to instructtheir PAOs to verify the list of PPO numbers forrevision provided by CPAO in FAQs login, from theirrecords as to whether these PPO numbers arecovered by DP&PW OM dated-06.04.2016. Theother cases which are not available in the listprovided by CPAO but covered under the OM dated-06.04.2016 are also to be revised.

Present orders areapplicable to the pensioners/family pensionersin whose respect Pension Payment Order (PPO)have been issued by CDA (Pensions)/Chief CDA(Pensions)/ Pr. CDA (Pensions) from time to timein respect of Defence Civilians/Civilians underMinistry of Defence (MoD).

3.2 As stated in Para 2.2 of the enclosed OM,nothing contained in the enclosed OM applies toCommissioned Officers and Personnel BelowOfficer Rank (PBOR) of Armed Forces. Separateorders will be issued for them by Ministry ofDefence.

3.3 Consolidation of pension in respect ofcategories mentioned in para-3.1 above is to be

done only in r/o Civilians/their families who retired/died before 1.1.2016. In other words, cases ofretirement/death in service on or after 1.1.2016are not covered by these orders.

REVISION OF PENSION

4.1 For existing pensioners, who have retiredbefore 01.01.2016, the revised pension/familypension with effect from 01.01.2016 shall bedetermined by multiplying the pension/familypension, as had been fixed at the time ofimplementation of 6th Central Pay Commission(CPC) recommendations, by a factor of 2.57. Theamount of revised pension/family pension soarrived at shall be rounded off to next higher rupee.

4.2 For calculation of revised pension, theexisting pension/family pension will be the basicpension/family pension only without the elementof additional pension available to the oldpensioners/family pensioners of the age of 80years and above. The additional Pensions/FamilyPension payable to old pensioners/familypensioners will be worked out in accordance withpara 4.5 of the OM.

4.3 Since the consolidated pension will beinclusive of commuted portion of pension, if any,the commuted portion will be deducted from thesaid amount while making monthlydisbursements.

4.4 MINIMUM / MAXIMUM PENSION/FAMILYPENSION : The minimum pension w.e.f.01.01.2016 wil l be Rs. 9000/- Per month(excluding the element of additional pension toold pensioners). The upper ceiling on pension/family pension will be 50% and 30% respectivelyof the highest pay in the Government (The highestpay in the Government is Rs. 2,50,000 w.e.f.01.01.2016).

4.5 ADDITIONAL PENSION : The quantum ofpension/family pension available to the oldpensioners/family pensioners shall continue tobe as follows:-

The amount of additional pension will beshown distinctly in the pension payment order.

For example, in cases where a pensioner is more

than 80 years of age and his/her revised pension

in terms Para 4.1 above is Rs. 10,000 pm, the

pension will be shown as (i) Basic Pension= Rs.

10,000 and (ii) Additional pension = Rs. 2,000

pm. The pension on his/ her attaining the age of

85 years will be shown as (i) Basic Pension =

10,000 and (ii) additional pension = Rs. 3000 pm.

Dearness relief will be admissible on additional

pension available to the old pensioners also.

4.6 In cases, where the Govt. Servants have

drawn one time lump-sum terminal benefits

equal to 100% of their pensions and have become

entitled to the restoration of one third commuted

portion of pension, their cases will not be covered

by these orders. Orders for regulating pension of

such pensioners will be issued separately.

4.7 The revised pension/family pension arrived

at as per paragraph 4.1 includes dearness relief

sanctioned from 1.1.2016.

5. Where the revised pension/family pension

in terms of paragraph 4.1 above works out to an

amount less than Rs. 9000/-, the same shall be

stepped up to Rs. 9000/-. This will be regarded

as pension / family pension w.e.f 01.01.16.

6 PENSIONER EMPLOYED/RE-EMPLOYED:

The existing instructions regarding regulation of

dearness relief to employed/re-employed

pensioners / family pensioners, as contained in

Department of Pension & Pensioners Welfare

O.M. No. 45/73/97-P&PW (G) dated 02.07.1999,

as amended from time to time, shall continue to

apply.

7. CONSTANT ATTENDANT ALLOWANCE:

The matter regarding CAA admissible to existing

pensioners shall be examined by the Committee

constituted by the GoI. For this purpose, till a final

decision is taken based on the recommendation

of the Committee, Constant Attendant Allowance

shall be paid at the existing rates.

8. DEARNESS RELIEF: The pension/family

pension as worked out in accordance with

provision of Para 4.1 above shall be treated as

‘Basic Pension’ with effect from 01.01.2016. The

revised pension/family pension includes

dearness relief sanctioned from 1.1.2016 and

shall qualify for grant of Dearness Relief

sanctioned there after.

9. ARREARS OF PENSION:- The arrears of

Pension/Family Pension, as a result of

consolidation of Pension, will be worked out by

PDAs and will be paid to pensioner or credited to

their accounts by 31st August 2016 positively.

10. If any overpayment is in the process of

recovery, the amount still due for recovery

should be adjusted in lump- sum against the

arrears payable.

11. PROCEDURE:- The Govt. has authorised

the Pension Disbursing Authorities including

Public Sector Banks to pay the consolidated

Pension/ Family Pension without further

authorization from this office at the revised rates

in terms of Para 4.1 and 5 above. Wherever the

age of pensioner/family pensioner is available in

the PPO, the additional pension/family pension

in terms of Para 4.5 above may also be paid by

the PDAs without any further authorization from

this office. The following points may specially be

kept in view while authorizing disbursement under

the captioned order:

(a) A suitable entry regarding the revised

pension shall be recorded by the Pension

Disbursing Authorities on face of Pension

Payment Orders.

(b) A suitable entry regarding revised

consolidated pension/ Family Pension w.e.f. 1-1-

2016 should also be recorded in the check

register/Payment Register/ Pension Payment

scroll.

(c) In every case, where revision is done by

PDA’s, intimation to this office in the form given

as Annexure-I to this circular will be prepared in

triplicate. Two copies thereof will be sent to this

office in covers bearing the following address in

convenient batch(s):- SAO, O/IC Audit Section, O/

o the Pr. C.D.A. (P.) , Allahabad- 211014. A

consolidated soft copy of all such payment in CSV

format may be sent in a CD to this office and also

be mailed to us in the format attached in Annexure-

(d) All cases where such revision is carried

out will ‘change’ entitlements and other data which

must be reflected as such in the Pension Payment

revised pension for pensioners in receipt of more

than one pension, the cases with full details of

3. In these orders :

a. ‘Existing pensioner’ or ‘Existing Familypensioner’ means a pensioner/familypensioner to whom these orders areapplicable in terms of para 2.1 above.

draw pension separately from the Government,

the pension of such absorbees will be updated in

terms of these orders. In cases where the

Government servants have drawn one time lump

sum terminal benefits equal to 100% of their

pensions and have become entitled to the

restoration of one-third commuted portion of

pension as per the instructions issued by this

Department from time to time, their cases will not

be covered by these orders. Orders for regulating

pension of such pensioners will be issued

separately.

(b) FAMILY PENSION

In cases where, on permanent absorption in

public sector undertakings/autonomous bodies,

the terms of absorption and/or the rules permit

grant of family pension under the CCS (Pension)

Rules, 1972 or the corresponding rules,

applicable to Railway employees/members of All

India Services, the family pensicn being drawn by

family pensioners will be updated in accordance

with these orders

8. The matter regarding Constant Attendant

Allowance admissible to the existing pensioners

shall be examinted by a Committee comprising

Finance Secretary and Secretary (Expenditure) as

Chairman and Secretaries of Home Affairs,

Defence, Posts, Health & Family Welfare,

Personnel & Training and Chairman, Railway

Board as Members. Till a final decision is taken

based on the recommendations of the

Committee, Constant Attendant Allowance shall

be paid at existing rates.

9. All Pension Disbursing Authorities including

Public Sector Banks handling disbursement of

pension to the Central Government pensioners

are hereby authorised to pay pension/family

pension to existing pensioners/family pensioners

at the revised rates in terms of para 4.1 and 5

above without any further authorisation from the

concerned Accounts Officers/Head of Office etc.

Wherever the age of pensioner/family pensioner

is available on the pension payment order, the

additional pension/ family pension in terms of para

4.4. above may also be paid by the pension

disbursing authorities immediately without any

further authorisation from the concerned Accounts

Officer/ Head of Office, etc. A suitable entry

regarding the revised pension shall be recorded

by the pension Disbursing Authorities in both

halves of the Pension Payment Order.

10 The pension/family pension as worked out

in accordance with provisions of Para 4.1. and 5

above shall be treated as ‘Basic Pension’ with

effect from 01.01.2016. The revised pension/

family pension includes dearness relief

sanctioned from 1.1.2016 and shall qualify for

grant of Dearness Relief sanctioned thereafter.

11. Further orders in regard to revision of

pension based on the recommendations of the

Committee to be constituted in terms of the

Government’s decision on Item No. 11 of this

Department’s Resolution No. 38/37/2016-P&PW

(A) dated 4tn August, 2016, will be issued in due

course.

12. After a decision as in para 11 above is

taken by the Government and orders are issued

in this regard, the Head of the Department of the

Ministry, Department, Office, etc. from which the

government servant had retired or where he was

working prior to his demise will revise the

pension/family pension of all pensioners/family

pensioners with effect from 1st January 2016 in

accordance with those orders and issue revised

Pension Payment Order (PPOs) accordingly.

13. It is considered desirable that the benefit

of these orders should reach the pensioners as

expeditiously as possible. To achieve this

objective it is desired that all Pension Disbursing

Authorities should ensure that the revised pension

and the arrears due to the pensioners in terms of

para 4.1. and para 5 above is paid to the

pensioners or credited to their account by 31st

August, 2016 or before positive.

14. In their application to the persons

belonging to Indian Audit and Accounts

Department, these orders issue in consultation

with the Comptroller and Auditor General of India.

I am directed to say that in pursuance ofGovernment’s decision on the recommendationsof the Seventh Central Pay Commission, theDepartment of Pension & Pensioners’ Welfare byits OM No. 38/37/2016- P&PW (A)(i),(ii) andResolution dated 4th August 2016 (copiesenclosed) has issued the necessary detailedorder for implementation of Government’sdecision on the recommendation of the SeventhCentral Pay Commission- Revision of provisionsregulating pension/gratuity/commutation ofpension/family pension/disability pension/ex-gratia lump-sum-compensation etc. under theCCS (Pension) Rules, 1972 and Commutation ofPension under CCS (Commutation of Pension)Rules 1981,CCS( Extraordinary Pension) Rules1939 etc.

2. The applicability of the provisions ofaforesaid Office Memorandums of theDepartment of Pension & Pensioners Welfare tothe members of All India Services has beenconsidered. It has been decided that theprovisions contained in the aforesaid OfficeMemorandum issued by the Department ofPension & Pensioners shall be equally applicable

Mutatis-Mutandis to members of All India Servicegoverned by the AIS(DCRB) Rules, 1958.

Sub: Minutes of the meeting held on 22.08.2016under the Chairmanship of Addl.CGA withall the Heads of CPPCs/GovernmentBusiness Divisions of Authorised Banks toreview the status of implementation of 7thCPC pension revision and other issues.

A meeting with all the Heads of CPPCs/Govt.Business Divisions to review the status ofimplementation of 7th CPC revision and other issueswas held on 22.08.2016 at PFMS Conference Hall,4th Floor, Shivaji Stadium Annexe, New Delhi underthe Chairmanship of Addl.CGA. A list of participantsis enclosed at Annexure-I.

Following agenda items were discussed.

I) Status of implementation of 7th CPC PensionRevision

1) Readiness of the banks for timely andcorrect revision of pension and payment of arrearsby 31th Aug 2016:- As per DPPW OM dated 4thAugust, 2016 all the pension disbursing banks haveto complete the task related with 7th CPC pensionrevisions and payments of arrears by 31st August,2016. Banks were also instructed vide OM No. CPAO/IT & Tech/Revision (7th CPC)/ 19.Vol-IlI/2015-16/109 dated 1 1th August 2016 from CPAO instructingthem to complete the task by 31St August 2016 andreport the revision through e-scrolls. In the meeting,instructions were reiterated to ensure payment ofrevised pension alongwith arrears to all pre-2016pensioners by 31.08.2016. All banks expressed theircommitment for payment of revised pensionalongwith arrears to pensioners by 31.08.2016.However, the State Bank of India mentioned that itwas targeting the date of 8 September, 2016 tocomplete the process on which both the Addl. CGAand CC (P) instructed SBI that the target date of31.08.2016 is non- negotiable and SBI should useall their resources to complete the payment ofrevised pension alongwith arrears by 31.08.2016.

GOI ORDERS15. Ministry of Agriculture etc. are requested to

bring the contents of these Orders to the notice of

Controller of Accounts/Pay and Accounts Officers

and Attached and subordinate Offices under them

on a top priority basis. All pension disbursing

offices are also advised to prominently display

these orders on their notice boards for the benefit

of pensioners.

Since payment of pension presently being drawn bythe Pensioners/Family Pensioners under 6th CPCwill provide basis for revision under 7th CPC,correctness of pension under 7th CPC revisionswould depend upon the accuracy of the revisionseffected by the Banks under 6th CPC. lntemal Auditof CPAO has pointed out in many casesmismatches between the pension authorized by theCPAO and the pension paid by the Banks vide letterdated 22nd July 2016 to banks. In these cases,banks were either making overpayments orunderpayments to the pensioners. If not corrected,these discrepancies in the payment would percolateto the 7lh CPC revisions also which may lead to thepensioners’ grievances and court cases. Therefore,banks were advised to comply with the auditobservations while revising such cases as per 7thCPC without breaching the deadline of 31st August,2016.

2) Strategy of banks to deal with pending casesof revision under 6th CPC: - It was discussed thatthere were possibilities where Revision Authoritieshad been sent by the CPAO but banks had not yetacted upon these authorities pertaining to thepension revisions under DP&PW O.M. dated30.07.2015 & 06.04.2016. Further, other revisionsunder 6th CPC pending with Departments may alsobe received by the banks later after effecting revisionsunder 7th CPC by them based on the existingpension. To deal with these pending cases under6th CPC, banks were advised to make suitablestrategy and provision in their software to revisethese cases under 6th CPC at a later date too andprovisions for further required adjustments for 7thCPC revisions may also be made.

3) Monitoring of implementation of 7th CPC byCPPCs/GBDs: As banks have to effect 7th CPCrevisions along with payment of arrears by 31stAugust, 2016, close monitoring of implementationof the same was required. For this purpose, bankswere advised to constitute a group of officials whomay keep a close watch on the status ofimplementation on daily basis. This group may dealwith the issues related with manpower, software,infrastructure and availability of records to ensurethat correct revisions are done and arrear paymentsare made by 31st August, 2016. Banks were alsoadvised to strengthen their Internal Monitoring andControl System for timely and correct payment ofpension and revisions.

4) Reporting of revised cases to CPAO bybanks: The objective of government is to ensuretimely and correct revision of pension under 7th CPC.It becomes necessary for CPAO to monitor the same.Therefore, after paying the revised pension andarrears, banks were advised to flag the revisedcases in the Format -A of the e-scrolls to besubmitted to CPAO so that revised cases may beidentified at CPAO. To enable the banks for flaggingof such cases, necessary modifications have beenmade in the Format-A of e-Scroll by changing theheading of column 18 to "Applicable PayCommission'. Under this column, banks have to fill"7" for the cases which have been revised under 7thCPC by them. Further banks were advised toincorporate in the column 27 of the Format in e-scroll titled “Pay Commission”, 7th CPC and send italongwith Format-A. Banks sought certainclarifications on the 7th CPC revisions and theclarifications of CPAO have been put on CPAOwebsite on 24th August 2016. A copy of the same isat Annexure-II.

II) Other Issues

a) Furnishing the details/records of pendingrevision of Pre-2006 pension cases: Despite allefforts of PAOs and CPAO, still 4,857 (1.13%) casesas on 22th August 2016 pertaining to Civil Ministries/Departments were pending for revision as per 6thCPC recommendations. In these cases, details ofpensioners required for revision are neither availablewith CPAO nor with PAO/Ministry/ Department. Sincebanks are paying pension to these pensioners, theywere advised to forward the details of suchpensioners/family pensioners to CPAO forimmediate revision of pension. In those caseswhere banks are not having requisite details of thesepensioners, they were supposed to contact thepensioners on the contact details available with themunder KYC norms and get the details.

b) Delay in commencement of family pensionto spouse on death of pensioners: - It has beenreported by the pensioners and pensionersassociations that there is inordinate delay in start ofpension in favour of spouse after the death ofpensioners. Ideally there should not be any delay inthe start of family pension in favour of the spouse ofdeceased pensioners because family pension infavour of spouse is co-authorized in the original PPOof pensioners itself through joint bank accounts. Thefamily pension must be started immediately after

submission of death certificate of the pensioners. Itis essential for CPAO to monitor such types of cases;however, it becomes difficult because the date ofdeath of pensioner is not known to CPAO. Though,provision of reporting of date of death of Pensionersis available in the Format ‘F’ of the e-scroll. However,banks are not providing this information to CPAO.Therefore, banks were advised to take necessarysteps in this regard to ensure timely payment offamily pension in the event of death of pensionersand report the same to the CPAO through Format / Fof e-Scroll.

c) Automatic Restoration of Commutation ofpension and payment of Additional Pension: Thecommuted portion of pension must be restored after15 years from the date of payment of commutationautomatically. Similarly, on attaining the age of 80years, additional pension to the pensioners shouldalso be paid automatically. It was mentioned to thebanks that it has been noticed that in many casestimely restoration of CVP and payment of additionalpension are not done by the banks resulting intosufferings to the pensioners. These issues arereported by the pensioners and pensionersassociations to the government time and again. Inthe recent SCOVA meeting also these issues wereraised on which Secretary (P&PW) expressed hisdeep concern and desired that CPAO should takemonthly report on it from the banks. To ensure timelyrestoration of CVP and payment of additional pensionon attaining the age of 80 years, banks were advisedto make necessary provisions in their software forflagging of such cases and regular monitoringthereof so that pensioner may not feel harassed onthese grounds.

d) Use of CPAO website to respond on theaction taken on pensioners’ grievances: Bankswere informed that CPAO has developed webresponsive pensioner’s service on its websitewww.cpao.nic.in for the registration and tracking ofgrievances registered by the pensioners. Facility toforward bank related grievances and taking onlineresponse thereof has been developed. For thispurpose login IDs have been created for every headof CPPC and necessary instructions (along withlogin id and password) have already been circulatedby CPAO for the use of this service by the banks. Tomonitor the disposal of grievances by the banks,separate login IDs have also been created for theofficers of Government Accounting/Business

Divisions. However, it is noticed that banks have notstarted using this facility for taking action on thegrievances of pensioners forwarded online throughthis system. They were advised to use this facilityimmediately. Further, banks were also advised tohave separate website for CPPCs which should beable to redress pensioners grievances too as perpara 9.2 of CPPC guidelines issued by CPAO.

e) Readiness of SFT P for implementation ofdigitally signed pension revision authorities: Afterthe implementation of paperless movement ofdigitally signed revision authorities for SBI, PNB,Canara Bank and Bank of Baroda, other 25 bankswere instructed through CPAO OM dated 28/01/2016to get ready with their SFTP server so that w.e.f.16.02.2016 this project might be implemented in allthe banks. Accordingly, all the banks were requestedto provide Server fingerprint for SFTP, Usemame ofSFTP and Password for the SF TP to the CPAO.However, 7 Banks i.e. Bank of India, Central Bank ofIndia, Indian Overseas Bank, Oriental Bank ofCommerce, State Bank of Travancore, UnitedCommercial Bank and Syndicate Bank were still toprovide these details. Consequently, this projectwas yet to be implemented with these banks. These7 Banks were advised to complete all formalities inthis regard without further delay so that the digitallysigned pension revision authorities may beimplemented with them also.

f) Status of Aadhaar Seeding: CC (P)appreciated the overall seeding of Aadhaar by thebanks which was more than 75% of the total civilpensioners. Further, quoting the reference ofDP&PW letter dated-10.08.2016 addressed toCMDs of all Pension Disbursing Banks, he advisedthe banks to complete the Aadhaar seeding forremaining pensioners also while revising thepension under 7th CPC.

g) Delay in receipt of Scrolls from Banks:Though Banks are required to send e-scrolls toCPAO either on the same day or by next day, butdelay ranging from 1 days to 68 days has beenobserved. Banks were advised to ensure that e-scrolls are timely sent to CPAO.

h) Timely credit of revisions of pensioneffected consequent to OMs dated-30th July, 2015and 6th April 2016 respectively of DP & PW :Instances have been reported where the revision ofpension already sent by CPAO consequent to OMs

dated-30th July, 2015 and 6th April 2016 respectivelyof DP&PW have not been effected by banks for longor with too much delay. Banks were instructed tohave their internal timelines to effect revisions andkeep a close watch to avoid delays.

This writ petition has been filed, under Article226 of the Constitution of India, praying to call forthe records relating to the impugned orderpassed in O.A.No.436 of 2010, dated 31.10.2011,by the Central Administrative Tribunal, MadrasBench and quash the same.

The petitioner herein, as applicant, has filedOriginal Application No.436 of 2010, on the file ofthe Central Administrative Tribunal, MadrasBench, wherein the present first respondent hasbeen arrayed as respondent. In the application itis averred that the petitioner/applicant has servedas Train Examiner in Indian Railways and he hasbeen permitted to retire on 31.3.1991. At the timeof his retirement he has drawn monthly salary onthe basis of scale of pay of Rs.1,400/- - Rs.2,300/-. the applicant at Rs.4,500/- - Rs.7000/- and thesame has been challenged in the present originalapplication.

3. The Central Administrative Tribunal, afterconsidering the contentions raised on either side,has dismissed the Original Application No.436 of2010, by way of passing the impugned order andthe same is being challenged in the present writpetition.

The learned counsel appearing for thepetitioner has contended to the effect that the writpetitioner/applicant has been permitted to retireon 31.3.1991 as Train Examiner and on the dateof his retirement, his scale of pay is Rs.1,400/- -Rs.2,300/-. On 01.01.1996, the 5th PayCommission has come into effect and as per therevised scale of pay, his pension should be fixedon the basis of Rs.5000/- - Rs.8000/-. But, the firstrespondent has erroneously fixed the pension onthe basis of Rs.4,500/- - Rs.7000/- and further,after 1.1.1996, there is no post of Train Examinerand the said post has“ been re-designated asJunior Engineer Grade-II and as per the revisedscale of pay, Junior Engineer Grade-II is entitledto get Rs.5000/- Rs.8000/- and on that basis, thewrit petitioner is entitled to get his pension. Underthe said circumstances, Original ApplicationNo.436 of 2010 has been filed on the file of theCentral Administrative Tribunal, Madras Bench, butthe same has been erroneously dismissed andtherefore, the order passed by the CentralAdministrative Tribunal, is liable to be quashed.

Per contra, the learned counsel appearingfor the first respondent has contended that sincethe petitioner has been retired on 31.3.1991 andthe 5th Pay Commission has come into effect on01.01.1996, he is not entitled to get benefits onthe basis of revised scale of pay. Under the saidcircumstances, the order passed by the CentralAdministrative Tribunal, Madras Bench, is perfectlycorrect and the same does not call for anyinterference.

6. It is seen from the records that after 1.1.1996,the post of Train Examiner has been re-designatedas Junior Engineer Grade-II. As per 5th PayCommission, Junior Engineer Grade-II is entitledto get pay scale of Rs.5000/- - Rs.8000/-.

7. The claim of the petitioner is very limited. As

adverted to earlier, after 1.1.1996, the post of TrainExaminer has been redesignated as JuniorEngineer Grade-II and the revised scale of pay isRs.5000/- - Rs.8000/- and the same is applicableto the petitioner.

Even in the letter given by the Railway Board,on 15.1.1999, it has been clarified to the effectthat pension of all pensioners, irrespective of theirdate of retirement, shall not be less than 50% ofminimum pay in the revised scale of pay with effectfrom 1.1.1996. Even a cursory look of theclarification made by Railway Board, it is madeclear that the petitioner is entitled to get 50% ofthe revised scale of pay by way of pension.

9. As mentioned supra, the only contentionput forth on the side of the petitioner is as towhether he is entitled to get revised scale of payof Rs.5000/- - Rs.8000/- or Rs.4,500/- - Rs.7000/-.

Considering the fact that the post of TrainExaminer has been re-designated as JuniorEngineer Grade-II and also considering the factthat from 1.1.1996, Junior Engineer Grade-II isentitled to get“ revised scale of pay of Rs.5000/- -Rs.8000/-, the same yardstick can also beextended/applied to the petitioner. Under the saidcircumstances, the claim of the petitioner can beaccepted.

11. The Central Administrative Tribunal,without considering the aforesaid factual aspectand also the clarification made by the RailwayBoard, has erroneously dismissed O.A.No.436of 2010 and therefore, the order passed by theCentral Administrative Tribunal is liable to bequashed. In fine, this writ petition is allowedwithout cost. The order passed in O.A.No.436 of2010 by the Central Administrative Tribunal isquashed and O.A.No.436 of 2011 is allowedwithout cost. The revised fixation of pension doneby the first respondent on 30.10.2009 is set asideand directed to re-fix the pension of the petitioneron the basis of revised scale of pay of Rs.5000/-- Rs.8000/-. The first respondent is directed to re-fix the pension of the petitioner within two monthsfrom the date of receipt of a copy of this order.

Orgn honoured Saxena jee withshawl & coconut who in turn donated Rs 29,285/- to the Orgn for its good work. 1. The reason given by the Pay Commission for not recommending the revision of FMA was quite unjust

because the basic issue to be considered was the quantum of FMA and not as to when it was last

revised.

2. It is regretted that the 7th CPC had not even gone into the merits of the reasons advanced for the revision

of FMA. Such summary rejection of the issue was most arbitrary and unjust.

3. FMA of Rs.100 was fixed in 1999 was itself very low and did not take into consideration the actual

requirement for day-to-day treatment especially in case of the Pensioners & their spouse who were all

senior citizens requiring regular medication, consultation and at times minor procedures (not requiring

hospitalisation).

4. A large proportion of Pensioners were residing in remote areas or villages having no excess to CGHS

Dispensaries & Railway Hospitals and as such, are wholly dependent on the paltry amount of FMA for

day-to-day treatment of self & spouse.

5. The Pensioners residing in non-CGHS areas and far away from CGHS Dispensaries / Wellness Centres

and Railway Hospitals were not even covered under CGHS / RELHS and had to bear all the expenses

even for the hospitalization, medicines and the related procedures for their treatment.

6. The cost had exorbitantly increased for the Medicines, Consultation Fee and cost of Pathological Tests

required for day-to-day medical treatment since 1999 (when the FMA was initially granted) and this had

risen at a much steeper rate than the General Price Index.

7. Average monthly expenditure per pensioner/per Patient on OPD in CGHS Hospitals has increased

manifold and is at present over Rs.3000/- per patient. This reflects the exorbitant increase in the cost of

Medicines, Consultation Fee and cost of Pathological Tests etc. required for day-to-day medical treatment.

The FMA of Rs.500 per month is thus a pittance of the actual expenditure on day-to-day Medical Treatment

by the Pensioners who are residing in non-CGHS /RELHS areas and have thus opted out of the same.,

8. It is, therefore, requested that the FMA may please be revised to at least Rs.3000 p.m. or at par with the

average expenditure on OPD Treatment per month per Pensioner / Patient in the CGHS Hospitals /

wellness Centres.
