    3.0 About This Document

    3.1 This document sets down the parking and MTC kerbside management and enforcement

    protocols in the City of Westminster. Parking is covered in section 2 of the document, moving traffic in section 3 and engine idling in section 4 It is primarily intended for use by WCC’s Marshals, a term which also includes camera operators (see section 10.0), but has been made readily available via WCC’s website for the public’s information.

    3.2 Through this document WCC seeks to:

    Deliver a high quality parking service to all road users in a fair and consistent manner, in line with our Fair Parking Policy;

    Ensure there is clarity of the kerbside policies and enforcement requirements for all, and

    Be a single point in which kerbside and enforcement policy is documented and can be updated.

    3.3 Document Format

    Each main area of kerbside use and enforcement is covered by a separate section. An amendment history is included to track changes to the previous version of this document.

    3.4 Temporary or trial changes will not be listed in this document and it generally omits specific or

    ad hoc instructions referring to individual streets or locations. These will continue to be communicated to the kerbside management provider via formal instruction.

    3.5 Illustrations and Photographs in this Document

    The illustrations and photographs included in this document are examples used for illustrative purposes only, intended to promote ease of use of this document, and may not reflect the actual signage or restrictions in place on-street. In the case of moving traffic contraventions, the contraventions are not limited to the signs illustrated in this document.

    3.6 Operational Manual

    The information within this document should be used in conjunction with the Operational Manual. The KMECOP document specifies the kerbside and enforcement protocols Marshals should employ when enforcing parking, moving traffic and engine idling contraventions on behalf of WCC whereas the Operational Manual outlines operational procedure and best practice.

    5.2 Ownership

    This document is owned by City of Westminster Parking Services. 5.3 Updates

    Ad hoc changes will be communicated to WCC’s kerbside management provider via formal instruction. The instruction will refer to the section of the document that is being changed. The full document will be reissued only when deemed necessary or appropriate by Parking Services.

    5.4 Approval Authority

    All re-issues must be authorised by the WCC Executive Director for City Management and Communities. This copy replaces all previous versions which are now obsolete.

    6.0 Definitions

    6.1 Marshals, Camera Operators and CEOs

    Marshals are fully qualified CEOs as defined in section 76 of the TMA 2004, being persons authorised by or on behalf of WCC to enforce road traffic contraventions. The term ‘Marshal’ is used to reflect their additional ambassadorial role. However, as they are still fundamentally CEOs they are still referred to as such on statutory documents. Camera operators are also fully qualified CEOs.

    6.2 Waiting, Parking and Stopping

    Parking contraventions are contraventions of the relevant TMOs. As described in the Road Traffic Regulation Act 1984; parking and waiting are synonymous. Waiting consists of stopping a vehicle where restrictions apply and can be described as occurring where the vehicle has been permitted to remain at rest.

    6.3 Where drivers are not present, Marshals are not required to locate the driver. Finding and

    advising a driver to move the vehicle is not practical and is in no way necessary prior to the issue of a PCN. 6.4 Loading/Unloading

    This activity needs to be visible and the process (i.e. the delivery/collection and the obtaining of any necessary signature etc) needs to be continuous in order to satisfy the concessions for loading and unloading. This document details where loading/unloading is and is not permitted and if so, for how long.

    6.5 Private vehicles are only afforded loading/unloading concessions when goods are being

    loaded/unloaded that are too heavy or bulky to be carried from a legal parking place. The vehicle must therefore be parked at the particular location as a matter of necessity rather than mere convenience. This stipulation does not apply to commercial vehicles.

    6.6 Picking Up/Dropping Off of Passengers

    The definition of picking up/setting down is stopping at the kerbside in order to allow a passenger/passengers to board or alight the vehicle and to load/unload their luggage. In such cases the vehicle should generally not be left unattended. This document details where picking up/setting down is and is not permitted and if so, for how long.

    6.7 Light and Heavy Goods Vehicles (LGVs/HGVs’)

    HGVs are vehicles over 3.5 tonnes in weight. They may have chevrons at the rear although if present these only indicate vehicles that are over 7.5 tonnes. A commercial vehicle of 3.5 Tonnes or less is classified as an LGV.

    7.0 Exemptions to this KMECOP

    7.1 Exemptions and observations listed in this document do not apply:

    If it appears to the Marshal that the vehicle is not being used in accordance with the exemption or concession which is being relied upon. For example, an observation period should not be given to a commercial vehicle parked on a yellow line if it is evident that the crew are having lunch in a nearby café etc.

    Where vehicles are known to use the maximum observation times under these protocols and then move the vehicle, only to immediately re-park in contravention. Instant PCNs may be issued upon the vehicle parking in contravention for the second time.

    7.2 If a Marshal feels a particular concession or exemption is being abused, they may override or

    disregard the protocols detailed in this document when enforcing parking or moving traffic regulations on behalf of WCC. If doing so however, full notes and an explanation must be recorded.

    7.3 Problem Areas – Arrangements to Lift KMECOP Requirements

    Where vehicles are known to park in contravention at a given location or locations on a regular or continuous basis, that location and the appropriate VRM(s) will be briefed to Marshals and may be subject to immediate enforcement without observation.

    7.4 Bases will be requested to provide details over a 2 week period where documented evidence

    (e.g. other PCNs, Marshal notes) shows that continuous non-compliance is taking place. The notes and evidence provided will then be produced in the case of challenge or appeal against the PCNs subsequently issued.

    7.5 Note, 7.1 to 7.4 above do not apply to the statutory 10 minutes grace period introduced by the

    Deregulation Act 2015. This must be granted wherever appropriate. 7.6 Extension to Controlled Hours

    Warning Notices should be issued for 2 weeks during the extension period. Normal enforcement should be carried out during previous core controlled hours. Note, this does not apply to locations converted from SYL to DYLs.

    7.7 Introduction of New Restrictions

    Where brand new restrictions are introduced, Warning Notices only should be issued for the first 2 weeks of controls. This may not occur however where existing restrictions are merely being enforced by new or different enforcement methods.

    7.8 Moving On and ‘Appropriate Action’

    Attended vehicles parked in contravention should only be moved on or be subjected to ‘soft’ enforcement if this is considered to be the appropriate action. However, a Marshal is under no obligation to ask a motorist to move on before beginning PCN issue.

    8.0 PCN Types

    8.1 Four different types of PCN are issued by WCC:

    Regulation 9 on-street PCNs which are either fixed to the vehicle or handed to the person appearing to be in charge of it by a Marshal;

    Regulation 10 Vehicle Drive Away PCNs which are issued where a motorist drives away whilst the Marshal is in the process of issuing the PCN;

    Regulation 10 CCTV parking PCNs where a parking contravention is observed remotely by a CCTV camera operator. From 1 April 2015, this PCN type can only be issued in very limited circumstances; and

    MTC PCNs, where a vehicle is observed remotely by a CCTV camera operator contravening a moving traffic regulation.

    8.2 Regulation 10 and MTC PCNs are issued by post. Regulation 9 and 10 PCNs are issued under

    the TMA 2004. MTC PCNS are issued under the London Local Authorities and Transport for London Act 2003.

    8.3 Engine idling is enforced by FPN under environmental legislation, and issued to the driver.

    9.0 Marshals

    9.1 As per paragraph 6.1 above, Marshals are fundamentally CEOs with an enhanced

    ambassadorial role, the main objective of which is to establish positive working relationships with motorists and businesses. The Marshal’s role therefore is to provide guidance to motorists, advising where they can legally park and service. However Marshals can still issue a PCN/FPN and therefore follow the protocols outlined in this document.

    10.0 Parking Enforcement by CCTV

    10.1 From 1 April 2015, parking restrictions can only be enforced by CCTV in very limited

    circumstances as prescribed by the Deregulation Act 2015. These are school clear markings, bus stop/stand clearways, bus lanes and red routes.

    10.2 CCTV Enforcement and CCTV Cars

    For those few parking contraventions still enforced by camera, the same exemptions and observations apply as to enforcement by on-street Marshal unless stated. The requirement to move vehicles on where the driver is present does not apply to CCTV or CCTV car enforcement. Section 2 of this document highlights which parts apply to both Marshal and camera enforcement and which parts refer to Marshal enforcement only.

    10.3 In most instances camera operators are instructed to observe footage for 121 seconds before

    issuing a PCN. This is to give parking enforcement by camera uniformity with on-street enforcement as the process of a Marshal issuing a PCN obviously takes a certain amount of time.

    10.4 CCTV COP

    The information within this document should be used in conjunction with WCC’s Corporate CCTV COP and SOP. The KMECOP document specifies the kerbside management and enforcement protocols Marshals should employ when enforcing parking and MTCs by CCTV whereas the CCTV COP outlines best practice and the CCTV SOP outlines operational procedures.

    11.0 Marshal Activities

    11.1 As well as carrying out parking enforcement, Marshals carry out the following supplementary

    activities:

    Aiding, directing and marshalling motorists;

    Identification and reporting of incorrect, missing, contradictory, vandalised and unauthorised street furniture. This includes signs, lines and faulty machines;

    Checking of parking suspensions;

    Identification and reporting of unauthorised suspensions;

    Identification and reporting of unlicensed skips;

    Identification and reporting of untaxed vehicles;

    Identification and reporting of abandoned vehicles;

    Identification and reporting of technology failure (for example Marshal’s inability to access the Pay-to-Park system);

    Identification and reporting of suspected permit or badge fraud and abuse;

    Reporting of negative interaction with a member of the public resulting in assistance from supervision and/or the Police;

    Reporting of an event and/or incident which has the potential to bring the WCC into disrepute or negatively impacts the public’s perception of WCC;

    Identification and reporting of problematic locations or hotspots within the City;

    Low-level highways reporting;

    Collation of reports requested by other service partners (e.g. Metropolitan Police Service).

    Kerbside management and enforcement of engine idling.

    Instant code 01 PCN unless exemption below applies.

    Exemptions

    1. Any vehicle - do not issue for the first and last 3 mins of controlled hours on SYLs. 2. Notification has been received from Parking Services that special permission has been given to load/unload

    for as long as necessary at a particular location.

    3. Vehicle is displaying a valid and correctly completed PIB issued by WCC or a London HAUC board issued by a utility company as long as the vehicle is not affecting free flow of traffic and is parked in compliance with the board’s conditions of use. .

    4. Vehicle is identified as having a valid WCC-issued SYL/DYL dispensation.

    5. Vehicle is in the Whitehall Security Zone.

    6. Domestic and office removal vehicles for as long as necessary whilst actively loading/ unloading.

    7. Vehicles used in connection with building operations or highway maintenance in or adjacent to street where the presence of the vehicle at the location is essential and the activity could not satisfactorily be carried out if the vehicle was parked elsewhere. This includes building, demolition and excavation; street

    maintenance, improvement, reconstruction, cleansing or lighting; installation, alteration, cleaning or repair of sewers; installation or repair of gas, water or electricity mains, pipes or apparatus or telecommunications systems; placing, maintenance or removal of signage or traffic lights and scaffolding lorries and glaziers carrying out work.

    8. Gate or barrier to premises which the vehicle needs access to is being opened or closed and there is no

    other practical place for vehicle to wait. This applies equally to vehicles waiting to enter a loading bay or other off-street area.

    9. Visible signs of unavoidable vehicle breakdown or if a recovery service vehicle in attendance.

    10. Vehicle being used for Fire Brigade, Ambulance or Police purposes.

    11. London Fire Brigade Vehicle displaying Identifier Board.

    12. The main funeral or wedding vehicle, as well as 2 other family vehicles in the funeral or wedding cortege. All

    other vehicles must park legally.

    13. WCC formal instruction to disregard. Observations

    1. There is evidence of loading/unloading bulky or heavy items. For private loading activity, the goods must be

    too heavy or bulky to be carried from a legal parking place. Take logging then give a minimum of 20 mins casual observation. 08:30-11:00 - If loading still taking place after 20 mins, give further 20 mins casual observation. If no

    loading observed after 20 mins, give 5 mins constant observation before issuing PCN if loading is not observed during this period. If loading is seen, repeat procedure. 11:00-18:30 - If vehicle still in situ after 20 mins, issue PCN. Multi-drops that may take longer than 20 mins

    are permitted as long as the vehicle is moved in the process. A fresh 20 minute casual observation should be given if vehicle moved.

    Note, the TMO allows continuous loading activity for as long as necessary before 11:00, but 20 mins max from 11:00 to 18:30.

    2. Evidence of picking up/setting down passengers and their luggage observed. Sufficient time must be

    allowed for this activity (for as long as necessary). Driver should be with vehicle.

    3. Vehicle displaying valid HEB should be kept under casual observation for 60 mins before PCN issued.

    4. Vehicle is displaying an exemption board, which allows vehicles to wait for 10 mins outside a named hotel,

    as agreed by WCC, while picking up/setting down passengers.

    5. Give 5 mins constant observation to vehicles displaying a valid disabled badge to ascertain whether picking up/setting down is occurring. Issue instant PCN after this period if none seen. If activity observed, allow as long as necessary.

    6. Vehicles displaying a valid resident permit for the same zone (or interim permit or URN) to be given 5 mins

    constant observation on a SYL. If no loading/unloading activity observed after this time, PCN should be issued. If concession blatantly being abused, PCN can be issued without 5 mins observation but full notes must be made.

    7. Vehicle displaying hospital car service identifier whilst parked in close proximity to hospital/clinic, give 20

    mins casual observation to allow for picking up/setting down passenger(s) and/or patient(s). If no activity seen after 20 mins, issue instant PCN. Record hospital/clinic name.

    SYLs – All vehicles

    SYLs not active therefore no enforcement unless timeplate extends hours, in which case enforcement is identical to DYLs below for the duration of the extended period. However, no PCNs to be issued for the first and last 3 mins of extended period. DYLs –18:30-08:30

    Where there is evidence of loading/unloading bulky or heavy items, take logging then give 20 mins casual observation. If loading still taking place after 20 mins, give further 20 mins casual observation. If no loading observed after 20 mins, give 5 mins constant observation and if loading still not observed during this period issue code 01

    PCN. If loading is seen, repeat procedure. Loading/unloading is permitted for as long as necessary. For private loading activity, the goods must be too heavy or bulky to be carried from a legal parking place. Exemptions and observations as per pages 9-10.

    If loading/unloading activity is being carried out, the driver should be asked to move to the kerbside where this is available and appropriate. Note, for double parking to be occurring the vehicle must be parked more than 50cm away from both/all kerbs/edges of carriageway. Exemptions

    1. Wide streets in C zone. Do not enforce outside CPZ hours unless vehicle is preventing free flow of traffic. Full notes and photograph required.

    2. Vehicle being used for Fire Brigade, Ambulance or Police purposes.

    3. WCC formal instruction to disregard.

    Observations

    1. If evidence of loading/unloading heavy bulky items seen and no other kerbside parking place available for vehicle nearby –

    08:30-11:00 - give 20 mins casual observation. If loading still taking place after 20 mins, give further 20

    mins casual observation. If no loading observed after first 20 mins, give 5 mins constant observation before issuing PCN if no further loading observed.

    11:00-18.30 - same applies but if vehicle still in situ after first 20 mins, issue PCN.

    2. If evidence of picking up/setting down passengers seen, allow as long as is necessary. If no evidence seen,

    issue instant PCN. 3. Give 5 mins constant observation to vehicles displaying a valid disabled badge to ascertain whether picking

    up/setting down is occurring. Issue instant PCN after this period if none seen. If activity observed, allow as long as necessary.

If no loading observed after 20 mins, give 5 mins constant observation before issuing PCN if loading not observed during this period. If loading is seen, repeat procedure. As long as necessary should be given during permitted times.

    2. During times when access is permitted and no loading ban is in place, give 20 mins casual observation to commercial vehicles then additional 5 mins constant observation. If loading/unloading is observed, repeat

    process up until end of permitted access time. If no evidence of loading/unloading after 25 mins a PCN may be issued. As long as is necessary should be given during permitted times.     When instructed to take enforcement action as a result of a resident permit being altered, the vehicle can be issued with an instant code 12r PCN. Details of this action must be confirmed with WCC’s permit investigation contractor at

    the earliest opportunity.

    1. Vehicle is displaying any of the following valid permits –

    Resident permit for the appropriate zone (note, a motorcycle resident permit will be a ‘virtual’/electronic permit) ;

    WCC white disabled badge (note, in a Car Club vehicle the VRM on the badge will not match that of the vehicle).

    Official All Zones permit (‘ALL’ or ‘Z’).

    Resident, visitors’ (Brent) or business permit or white disabled badge equivalent (RBKC Purple, Camden Green or substitute badge, City of London Red) for a neighbouring borough on a reciprocal street where agreement applies and as denoted on the sign. This does not apply in Queen’s Gate.

    2. All vehicles – do not issue for the first 10 and last 3 mins of controls. This does not apply to resident bays

    that are enforced at all times. For non-24 hour controls, this means -

    For private loading activity, the goods must be too heavy or bulky to be carried from a legal parking place. If no evidence of loading activity seen, instant PCN.

    Note, maximum time for loading in designated bay under the TMO is 20 mins, regardless of whether vehicle is commercial or private. If max time exceeded, issue code 12r PCN.

    5. If vehicle is displaying valid HEB badge then 60 minute casual observation should be given before PCN

    issued.

    6. Give 5 mins constant observation to vehicles displaying a valid blue disabled badge (any issuing authority) to ascertain whether picking up/setting down is occurring. Issue instant PCN after this period if none seen. If activity observed, allow as long as necessary.

    7. Cash collection vehicles actively involved in the delivery/collection of cash to be given 40 mins casual observation. As long as necessary should be given up to 11:00, with 40 mins max thereafter.

    Shared-use bays enable resident permit holders and visitors to use the same parking bay. Resident permit holders displaying a valid permit for that zone can park in these bays at any time, whereas visitors must pay to park during the hours controls apply. Some shared-use bays are only available to visitors at certain times during the day as indicated by the signage (e.g. 10am-4pm). Marshals will need to check for various payment methods at shared-use bays – resident permits, Pay-to-Park, P&D and Parking Card payments are all valid. If no resident permit is on display, prior to issue give 5 mins constant observation and confirm on the Pay-to-Park system that no further payment has been made. This 5 mins observation period is to enable the motorist to make payment upon parking. Record location number where vehicle is parked in Notes field on HHD. When confirming whether a vehicle has paid to park, Marshals must check by both location number and VRM. When entering the VRM, Marshals should take care with the number 0 and the letter O and the number 1 and the letter I. If in doubt, both should be checked. Where drivers have paid to park, it is acceptable for them to move to another shared-use or paid-for parking bay within the same zone using the same payment until it expires, but not to another zone, even if the tariff is identical.

    Instant code 19 PCN If vehicle displaying an invalid resident permit: wrong zone (code 19w); incorrect VRM (code 19x) or expired permit (code 19z), unless exemption below applies.

    If note left by motorist indicating P&D not working or their credit/debit card not registering, Marshal should report possible fault, check for payment by other method and if none issue instant code 12s PCN. Full notes to be recorded.

    When instructed to take enforcement action as a result of a resident permit being altered, the vehicle can be issued with an instant code 12s PCN. Details of this action must be confirmed with WCC’s permit investigation contractor at

    the earliest opportunity. Exemptions

    1. All vehicles – do not issue for the first and last 10 mins of controlled hours. This means -

    Business or Teachers’ permit in sub-zone C2.

    Resident, visitors’ (Brent) or business permit or white disabled badge equivalent (RBKC purple, Camden green, City of London red) for a neighbouring borough on a reciprocal street where agreement applies and as denoted on the sign. This does not apply in Queen’s Gate.

    3. If vehicle is displaying an expired annual resident permit for zone, take following action -

    Permit expired by 1-14 days – Warning Notice

    Permit expired by 15 days-1 month – Instant code 19s PCN

    Permit expired by 1 month plus - Instant code 12s PCN

    This assumes no white disabled badge is on display or payment to park is evident.

    4. The resident parking permit or white disabled badge is obscured in which case a Warning Notice only should be issued if a HHD check confirms the permit/badge as valid.

    5. If vehicle is displaying expired white badge, take following action:

    Badge expired by 1 day-1 month – Warning Notice

    Badge expired by 1 month plus – Instant code 12s PCN

    6. A P&D ticket purchased from the same zone is acceptable. In Lincoln’s Inn Fields only this includes tickets purchased from Camden. In Queens Gate and Exhibition Road this includes tickets purchased from RBKC.

    7. If P&D machine shows Marshal’s “Out of Order” notice, vehicle exempt for max stay calculated from the time

    the machine is returned to service. Vehicle must be moved unless other valid method of payment used or can rely on an exemption. Code 08 (“Parked at an out of order meter during controlled hours”) is not to be used on shared-use bays. Unless the above applies, motorists should either use an alternative payment method or move the vehicle. This is explained at the bay.

    8. Notification has been received from Parking Services that special permission has been given to load/unload

    at particular location.

    9. Vehicle displaying valid Trades Permit. Note, a Trades permit issued by a neighbouring borough is acceptable on a reciprocal street.

    10. Vehicle is displaying valid and correctly completed PIB issued by WCC or a London HAUC board issued by

    a utility company, as long as the vehicle is not affecting free flow of traffic and is parked in compliance with the board’s conditions of use.

    11. Cleansing and refuse vehicles collecting rubbish from the side of the road. Note, this applies to WCC and

    commercial refuse company vehicles.

    12. Domestic and office removal vehicles for as long as necessary whilst actively loading/unloading.

    13. Vehicles used in connection with building operations or highway maintenance in or adjacent to street where the presence of the vehicle at the location is essential and the activity could not satisfactorily be carried out if the vehicle was parked elsewhere. This includes building, demolition and excavation; street

    maintenance, improvement, reconstruction, cleansing or lighting; installation, alteration, cleaning or repair of sewers; installation or repair of gas, water or electricity mains, pipes or apparatus or telecommunications systems; placing, maintenance or removal of signage or traffic lights and scaffolding lorries and glaziers carrying out work.

Motorcycles are permitted to move freely from one motorcycle bay to another in any zone as long as a valid payment to park for that day has been made.     bay during the hours the bay is controlled for motorcycle use only (at all times in zones A, B, C, D and H, and 07:00-19:00 Mon-Sat in zones E, F and G). Vehicle to be authorised for relocation. Relocation can occur from 30 minutes after the issue of the PCN. Note, loading/unloading by non-motorcycle vehicles is not permitted.

    of controls when bays are controlled for motorcycles only (i.e. no PCN until 07:10 or from 18:57). Other zones are for motorcycles only at all times so this exemption will not apply.

    07:00 – 07:09 – do not issue 07:10 – 18:56 – valid PCN 18:57, 18:58, 18:59 – do not issue 19:00 onwards – controls have ended

    4. Electric and plug-in hybrid motorcycles may park for free at all times. Marshals should ascertain vehicle status via vehicle make and model type. If the motorcycle cannot be identified as an electric or plug-in hybrid vehicle, issue a code 11g PCN after 5 mins observation and make comprehensive notes.

    5. Motorcycle displaying valid WCC white disabled badge.

    6. Motorcycles with a valid resident permit are entitled to park in any motorcycle bay city-wide. Note, resident

    permits for motorcycles are ‘virtual’ electronic permits. Nothing physical will be on display.

    7. Vehicle (any) is displaying a valid and correctly completed PIB issued by WCC or a London HAUC board issued by a utility company, as long as the vehicle is not affecting the flow of traffic and is parked in compliance with the board’s conditions of use.
