LEGAL BASIS

What is UTPRAS? UTPRAS is a two-stage process of quality
assurance namely:
1. Mandatory registration of TVET programs / courses
2. Voluntary accreditation of institutions (currently this is with the Asia Pacific Accreditation and Certification Commission)
PROGRAM REGISTRATION Registration of all Technical-Vocational
Education and Training programs offered by both public and private TVIs under TESDA
(Mandated under Section 8 of R.A. 7796 and TESDA Board Resolution 98-03 as reiterated by TESDA Circular No. 45 series of 2007)
GENERAL PRINCIPLES
Institutionalization of the registration process
Registration of programs either “With Training Regulations” (WTR) or “No Training Regulations” (NTR)
Registration of program by qualification or by cluster of competencies
Adherence to the nominal duration prescribed in TR

NTR PROGRAMS REGISTRATION Requirements for the NTR programs registration:
1. Must lead toward employment opportunities; 2. Must satisfy any of the following conditions: i. The manpower requirement of critical emerging industry or specific area requirements ii. The industry with high employment potentials iii. The employment commitment from enterprises iv. The regulatory and licensing requirements for the practice of an occupation/profession

6. Assesses curriculum against competency-based training (CBT) definition
7. Focal person recommends to the PO/DO the conduct of ocular inspection if the documents are in order
8. Review of application document shall be conducted not more than 15 working days.

b. Conduct Site Inspection
1. PO/DO UTPRAS focal person schedules team inspection, prepares checklist for inspection and coordinates with the institution regarding the inspection;
2. Inspection team conducts inspection;
3. Site inspection shall be conducted for 1 day

c. Prepares Result of Site Inspection
1. PO/DO UTPRAS focal person sends official notice to TVI duly signed by the PO/DO Director for compliance of deficiencies if any, schedules and conducts re-inspection if required;
2. PO/DO UTPRAS focal person prepares final inspection report/recommendation and submits to PO/DO Director
3. PO/DO Director submits recommendation to the RD for issuance of Letter of Denial or CoPR
4. Compliance with registration requirement deficiencies shall be done by the TVI not more than 30 days.

d. Issue Certificate of Program Registration / Letter of Denial1. RO UTPRAS Focal conducts final review of documents, returns documents if there are deficiencies;2. PO/DO UTPRAS focal returns documents to institution and outlines the corrective actions needed;3. Institution comply with the deficiencies within one (1) week;4. PO/DO prepares memorandum to RO based on the corrective actions taken then recommends issuance of CoPR or Letter of Denial;5. RO prepares CoPR or Letter of Denial6. Regional Director signs CoPR or Letter of Denial7. RO releases CoPR or Letter of Denial to PO/DO, then PO/DO releases CoPR or Letter of Denial to the TVI8. Release of CoPR shall be done within one (1) week after receipt of recommendation from PO/DO

COMPLIANCE AUDIT Compliance Audit is a tool for the independent
examination of whether a TVET institution is continuously complying with TESDA’s requirements for registered TVET program in all regional, provincial and district offices.
Newly registered land-based programs are subjected to compliance audit a year after the issuance of CoPR. Thereafter, the programs are subjected to compliance audit once every (2) two years.
COMPLIANCE AUDIT The RO submits to TSDO the list of programs
to be audited every first quarter of the year The sea-based program are subjected to
compliance audit every first quarter of the year Unscheduled compliance audit may be
conducted due to:
1. customer complaints and
2. recurring quality problems
SANCTIONS AND PENALTIESa. Grounds for imposing sanctions and
penalties: Unauthorized offering of an unregistered
TVET programs; Advertisement of an unregistered programs Discovery of fraud or deceit in connection
with the application for program registration
SANCTIONS AND PENALTIES
b. Sanction/Penalties to be imposed:
Criminal liability A fine of not less than P 2,000.00 no more than P
10,000.00 or Imprisonment for a maximum of 2 years or both at the
discretion of the court (if the corporation commits the act, the school head together with the person/s responsible for the offense shall equally be liable.
Sanctions against the school shall be without prejudice to the right of the aggrieved students, teachers and employees to after the erring officials and TVIs.
GROUNDS FOR PROGRAM CLOSURE AND REVOCATION OF CoPR Failure of the TVI to comply with the non-
compliance/deficiencies within a prescribed period as found in the compliance audit.
Failure of the TVI to re-register/migrate program within a prescribed period
Employment rates of the graduates of an NTR program is lower than the national average for 3 consecutive batches.
Mismanagement or gross inefficiency of the school personnel in the operation of the school and its program offering;
Fraud, falsification, misrepresentation, or any similar acts of the TVI.
