Recording Procedure – Jurist Working Remotely• When the jurist is working remotely (e.g. conducting hearings from his/her home), the recording procedure is as follows:– Jurist logs into Zoom and hosts the meeting at the designated time

– In the courtroom, the clerk logs into Zoom through the Polycom

– The clerk is the only person in the courtroom.  She is only there to operate the recording equipment.

– Once all parties are present in the Zoom meeting, the jurist indicates to the clerk that she should begin recording.

– The hearing is recorded to the courtroom recording equipment through the Polycom.

Recording Procedure – Jurist in the Courtroom• When the jurist is in the courtroom, the recording procedure is as follows:– The jurist and the recorder are both present in the courtroom.  They observe social distancing by sitting at least six feet apart (in Allegan, this means that the jurist will sit at counsel table or at the witness stand)

– Jurist logs into Zoom through his/her laptop and hosts the meeting at the designated time

– The jurist will ensure that the laptop is close enough to a courtroom microphone that the clerk can hear what is being said.

– Once all parties are present in the Zoom meeting, the jurist indicates to the court recorder that she should begin recording.

– The hearing is then recorded to the recording equipment through the courtroom microphones.

Hearing Procedure• Breakout rooms:– To allow attorneys to speak with their clients prior to the start of the hearing.

– To utilize breakout rooms, everyone must be present in the Zoom meeting prior to opening the breakout rooms.  We have had technical trouble in adding and assigning breakout rooms if they are opened prior to everyone joining.

– Once everyone is present:

– Click the “Breakout Rooms” function on the bottom of your Zoom screen

– Add the appropriate number of rooms to accommodate each attorney and his/her client.

– Assign the attorney and the client to their own breakout room.

– Click “Open Rooms” to send participants to their private breakout rooms.

– After a designated period of time, click “Close All Rooms” to allow participants to return to the main session.

– Once everyone is back in the main session, you may begin the hearing.

Hearing Procedure• Waiting rooms– To prevent participants from entering a hearing early or to control the participants in a particular hearing

– To utilize waiting rooms, you can either set up an automatic waiting room, which requires the host to admit them to the hearing OR you can place unwanted participants in a waiting room while until the previous hearing is finished.

– To set up an automatic waiting room, you would turn on the “Waiting Room” function in the “My Settings” location of your Zoom account

Hearing Procedure (cont.)• Generating Orders:– If jurist is present in the courthouse, the order is printed and signed as it normally would be.

– If jurist is working remotely, the order can be signed physically or electronically.

– Physically signed – the clerk would print the order from the courtroom and attach it to the file with a note that the order needs to be signed.  The order is then placed in a “dirty room” or a common space for jurists to access orders for signature.  Each jurist has his/her own pen and this area is separate from the courtroom and the clerk’s office space.

– Electronically signed – the order is emailed to the jurist, who then exports the order to his/her smart phone as a PDF file.  The order is opened on the smart phone using the Adobe Reader app.  The jurist then utilizes the “Fill and Sign” feature in Adobe to sign the order.  The order is then emailed back to the clerk for printing and processing.

Hearing Procedure (cont.)• Zoom Notices:– For all hearings, the clerk generates and gives notice pursuant to MCR 3.920.

– The notice of hearing or Summons indicates that the hearing will occur via Zoom.

–Zoom instructions are included with the notice of hearing or Summons.

– If the court can obtain email or phone information, then the clerk also sends an email to the parties with Zoom information.

Public Access to the Court• To ensure that the public continues to have access to court proceedings:– Allegan County Courthouse remains open to the public (with safety screening procedures put in place).

– Courtrooms remain unlocked and accessible to the public.

– Zoom information is provided to any member of the public who wants to participate or watch a hearing.

– NOTE: Due to the procedures outlined above, the Family Division is not livestreaming NA/DL matters to YouTube.  However, our District and Circuit Courts and FOC are utilizing this feature.

General Thoughts and Observations• We have had better participation by litigants using Zoom than in‐person hearings.

• By utilizing breakout rooms and Zoom notices, hearings have been proceeding smoothly and efficiently.

• Hearings are running about the same length, but they are more timely given the instant access.

• Access to justice by litigants and the public seems to have improved using remote hearings.

• Some proceedings (e.g. a bench trial) require some creativity, but overall, our docket is almost back to full capacity.
