P578 PIlgrims 02/24/2014 04C0 Poultry Good DE8150802 Open MDI On February 20 2014 at approximately 12:25 PM as was conducting a Good7 Pride 5 Commercial 424G Commercial Practices task observed a bird in a cage that had been put back on a

Corporati Practices truck. Upon closer inspection noted that the reason it had been left in the cage

on was that its wing was caught on a couple of broken wires on the side of the cage.show the bird The birds wing was freed from the

wires and removed from the cage. The wire had punctured the wing and the birdwas bleeding. During a Good Commercial Practices audit conducted

on 2/19/14 it was noted that therewere a number of cages that were in need of repair. By continuing t o u se these

cages with broken wires this has caused injury to a bird USDA expects birds to be

protected from harm and transported in acceptable cages that will not cause Injuryto the birds. It also should have been noticed by plant personnel working in that

area and riot been put back on the truck. Cages should be sorted so that birds do

not suffer injuries by broken cage wires. A copy of this MDI will be forwarded to theDVMS in the Dallas District

At approximately 1715 hours USDA was informed that a truck hauling live birds had flipped on its side on the back dock. USDA continually monitored the

cleaning up of the wreckage throughout the night. At approximately 1845 hours wa s alerted by that the establi ent was not

sorting out dead birds from the wrecked cages discussed this with an d stated that P2 sually removes

dead birds from cages outside on the back dock prior to placing the cages on the conveyor belt to decrease the number of DOA enter live hang.

stated that it was not efficient to sort the dead birds from the live birds by hand so he would run c a ge f ro m the wreck roximately every 15 minutes while

incorporating the bird cages from the wreck with cages from another truck stepped back and wa the process for approximately 5 minutes.

She observed the forklift driver place a cage from the wreck onto the conveyor and then immediatel r, place another cage from the wreck onto the same

conveyor belt. brought this to the attention and he informed the for river to slow down with placing the cages from the wreck

to the conveyor belt and to incorporate them at a slower rate such as approximate every 15 minutes or every 5-6 cages stepped back and

observ e process for approximately another S minutes. She observed the ift driver slowly incorporating the cages from the wreck. After observing theprocess outside he back dock, she entered live hang to observe t process at approximately 1915 hours There were 3 piles of dead birds on the floor,

approximately 2D birds ch pi le . There were no live birds e p il e o f dead birds. The hangers were slowly hanging birds to determine if the birds were

dead or al ive and were careful to throw dead b in the piles. observed 3 establishment employees working on the floor in live hang to

remove the pile of dead birds as quickly a le. spoke with the to emphasize the importance of keeping the live birds

separated from the dead birds and emphasiz e importance of staying in communication with the establishment employees on the back dock loading

cages on the conveyor bel nsure their process remain ontrol. At approximately 1935, on my way to the paw room to observe

operational sanita observed that the light was on in live hang. n opened the door to live hang observed three piles of mixed live and dead birds on

the floor, piles were approximately 3 feet high and covered and area ap imately 4 feet in diameter. There wa s dead bird along the West wall that wa s

a ximately five feet in length and three to four feet high. At thetime of my obse on there was no one sorting the live birds from the dead birds that

were in the pile on the floor. was notified and shown area. took Regulatory control at approximately 1939 hours

with USDA Retain tag U 6389D79D1, too stop the line a n d g iv e the establishment ample time to clean rea and return to sanitary condition and control

their process. Regulatory control wa s reliquished at approimately 1953 hour after the area wa s back in sanita ndition and they had control of their

    process.

P5787 Pilgrims Pride C or p ora ti on 12 2 3 2 13 On December 23, 2D13 at approximately OD PM, was performinga Good Commercial Practices check in live receiving when observed live bird in the Dead

on Arrival DOA cart in the live hang area for the line. This bird wa s still breathing a nd w as underneath a dead bird. It had its head up and blinked its

eyes. This bird was in danger of being buried and smothered in the DDA cart got the attention of and showed him

the bird. He removed the bird and concurred that the bird was still alive. emphasized that live birds should not be in the DOA cart. USDA expects that no live

birds are to be present in containers meant for DOA birds since they are in danger of being smothered dying by means other than slaughter . Itis expected

that birds will be treated humanely at all times and in accord with good commercial practices. USDA expects effective measures to be taken that will ensure

this does not occur again. Copies of this Memorandum of Interview will be entered into PHIS, USDA inspection file, distributed to the establishment and the

DistrictVeterinary Medical Specialist per F5l5 Directive 61DD.3.

In addition, the establishmentreported 4,125 DOAs on FSl5 form 9061-2, Poultry Condemnation Certificate.Further investigation revealed that most of these birds died in the afternoon hours.A review of the area temperatures at the time revealed a Heat Advisory, withtemperatures at 1040 F and a heat index of 1190 F Therefore, it is reasonable toconclude that poultry presented for slaughter died by means other than byslaughter and more would have perished if not for USDA intervention.

observed and were notified of the noncompliance.

observed the plants corrective actions of increased personnel hosing down birds incages and the immediate dumping of a trailer of highly stressed birds under USDAinstruction. Th e establishment has the responsibility to ensure that birds aremaintained with minimal stress and do not die other than by slaughter. Theestablishment failed to conform with good commercial practices and the regulatoryrequirements of 9 CFR 381.65 b). A similar noncompliance was documented on NR0104-2010, dated 08/03/2010. A written response could not be obtained from theestablishment as of this date, but provided a verbal further plannedaction on 8/05/10 of re laying the incidence to Live Haul and

and placing additional fans during catching. In addition, the welfare ofbirds during extreme heat conditions including overcrowding, was addressed tothe establishment in weekly meetings dated 8/05/10, 7/15/10, 7/08/10, 7/01/10,6/24/10, and 6/17/10. Th e preventive measure stated ma y not have beenimplemented or maintained as described.
