    I run enclosing herewith an authenticated photostatic copy of the subject' 6 paSGport applicat.ion made to the American ConsuJ.ate General at Tokyo, Japan, on September S, 1941. The Department of'St9.te has advised me that they do not have a record of Mrs. 1)' Aquino having fUed an application for evacuation at ·the SWiss Oonsu1.B..te in Tokyo on. March 30. 1942. It appears, howElver, from a. telegram of Septell\ber 4, 1942, from the Aruerican Legation in Bernt Sldtzerland, that Mrs. 0' Aquino informed th$J apanese authori tis5 that sh$ voluntarily renounced repatriatinn to the United States.

    In briefing Special. Agent .be" \ '1 c,. prior to 'hiB departure for Japan, I believe you should stress the possibUity that there are still in existence recordings of the Zero flour, made by the Japanese in Japan. We have proceeded thus far on the theory that all Zero Hour broadca.sts '«ere live. You rlll recall that the Japanese witnesses 80 iruonned you in San Francisco. However, Mr. Green, in his search for recordings in . t.1is and other ca.ses, is yerystronglyof the opinion that some recordinss wetre. made wi. th or .vi thout the knoJtledge of the broadcasting • personnel of R 0 Tokyo who appeared as witnesses at the grand jury.

    Reference is made to your letter of September 22, 1952, concerning the request of \::J(P~ '1 ~ who testified as a Gov-ernment wi.. tness at the treason trial of Iva Toguri D'Aquino, that you write a letter on his behalf to the Immigration and Naturalization Service for his use in applying for an immigration visa under Public Law 4l4, 1{hich becomes effective in December.

    The Department has no objection to your writing such a letter for bc.. , '1C-- since you have stated that you feel he is worthy of some consideration and since, through your contact with him in the D I Aquino case, you are the· person in the Department best qualified to make this determination. However, in this con-nection you will recall that many German witnesses who were brought to this country to testify in the Chandler, Best, Burgman, Monti and Gillars cases requested similar letters from the Depart-ment in their efforts to regularize their status here. In each instance the Department furnished a letter setting forth a state-ment of the cases in which the witness testified, the contribution which his testimony made to the success of the prosecution, the extent of his cooperation with the Government, and his general

    demeanor, but refrained from making any reconunendation as to the desirability or advisability of granting a visa to the witness.

    Iva Toguri D'Aquino was convicted of one overt act o£ treason on September 29, 1949, and on October 6, 1949, was senteneed to ten years' imprisonment.

    Section 4161 of Title 18, United stateQ Code, provides in par.t as follows:

In this connection it may be o£ interest to you that the statute under which Mrs. DIAquino was convicted pro\ '\Ies a nrl.Dimuro. punishment of five years and a max:i.nmm punishment o:f dea'~h, and the severity of the sentence imposed within those limits is in the sole discretion o:f the court ..

    Section 41.6l o£ Title 18, United states Code, provides in part as follows:-

    Reference is made to your letter of March 20, 1952, in which you advi3ed that your agenoy had received a request from

    _bG I "1 e..- _ - for re-recordings of broadcasts made by Iva Toguri D' Aquino ("Tokyo Rose") which are on deposit with the National Archives. ·You re-quested to be advised wether the Department of Justice has any objection to your complying with this request.

    The treason conviction of Iva Toguri D' Aquino was affirmed by the Court of Appeals for the Ninth Cirouit on October lO, 1951, and a petition for certiorari to the Supreme Court of the United states was filed on her behalf on January lh, 1952. In view of the pendency of this case before the Supreme Court, it is felt that this Department must adher.e to the opinion expressed in my letter of August 11, 1950, to Mr. Dallas D. Irvine of the Audio-Visual Records Branch that it would not be proper for the Depart-ment of Justice to sanction the release or re-recording of ariy broadoasts of Iva D'Aquino prior to the final disposition of her case. I shall be glad to advise you when such final. disposition has been made.

    However, this Department has no objection to your utiliz-ing in such manner as you deem appropriate any recordings of the broadcasts of b«;. I , L ..
