◦ In the Southeast, “Five Civilized Tribes”: Cherokee, Creek, Seminole, Chickasaw, Choctaw Relocate – force people to leave land
◦ Indian Removal Act – federal government allowed to pay the Native Americans to leave Indian Territory – Congress created land in present-day
Oklahoma◦ The Cherokees refused to leave
Worcester vs. Georgia – Cherokee argued that the state government could not force them to move (Marshall agreed and said only the federal government could)
◦ General Winfield Scott – forcefully led the Cherokee to the new land
