1. Introduction - Overview of Licenses

Indonesia government has set out procedures of licensing for certain goods of international trade before customs declaration in addition to technical requirements of SPS and TBT. There are various types of Trade Measures, including registration, monitoring and dontrolling measures known as API (Importer Registry Number), IP (Importer Producer) or IT (Registered Importer), Import Permit and Recommendations. These trade measures are hereafter referred to as “licenses.” The number of licenses amounts to 74 and the stipulating regulations amounts to 72. In order to apply for these licenses, it is necessaryfor importers to identify administrative requirements by the Ministry of Trade. The table will give you overall view of requirements and help you to prepare for licenses.

Note: There are several regulations which state both IP and IT of the same goods, and some regulations stipulate both import and export of the same goods. These regulations are counted once and carefully avoided double count.

The first thing the importer should do to prepare is to check whether the goods are required for licenses. There are several ways to get information for the licensing procedures including application requirements. Because import and export are controlled by the ministry of Trade, licenses are all issued by the Ministry of Trade. Therefore, except for some special cases, it is important to check the information from the Ministry of Trade regarding controlled goods by visiting the ministry, or reading the regulations issued by ministry of Trade or accessing to the official web-site. The Administrative Requirements Table is a result of collecting information by using all of these means. First, information was collected from website, then checked and verified with ministerial regulations, and finally consulted with officers of the Ministry of Trade at DG

Import or DG Trade Facilitation for confirmation and clarification.

Requirements are indicated in the website of the Ministry of Trade, named INATRADE. The site is very well organized and very informative. Importers are encouraged to register and collect information necessary to apply for trade licenses. Because it is an official site, the requirements indicated in the website are considered to be authorized. Ministerial regulations are issued in order to authorize the licensing procedures, and stipulate requirements for application. In relation to licensing procedures of goods, related regulations are reviewed to verify the requirements. Most of the requirements are verified and indicated both in the website and regulations, but there are some inconsistencies. These inconsistencies are checked and consulted with officers, and found out that in order to eliminate these inconsistencies regulations are now under review to be amended.

2. Composition of Administrative Requirements Table

There are largely two components in the licensing procedure of international trade, namely license (IP or IT) and import permit (SPI). The left side of the table consists of requirements for licenses, and the right side is requirements for import permits (SPI). If there is no requirement indicated, it means there is no import permit, as are seen in most cases of IP licenses. Generally IT licenses are coupled with SPI’s. Each license and SPI has its own validity period separately. If there are indications of requirements, the goods need SPI. In addition, pre-shipment survey or survey upon arrival is often required and the survey report is listed as one of the requirements. Unloading ports are also restricted for some goods because of availability of facilities.

Requirements for licenses consist of three types of documented information. The first type of requirements consists of administrative certificates such as TDP, NPWP, SIUP or IUI. These are certificates to verify eligibilities of importers. The second is specific requirements regarding the import of the particular goods such as production plan, import plan and statement letters. The third type is recommendation letter from the goods controlling ministries Ministry of Industry (abbreviated as IND) or Ministry of Agriculture (abbreviated as Agri). It may take some time to prepare for the application, and this type of documents should be prepared first in the series of procedures.

3. Import License Requirements

3.1 General Provisions, API and NPIK

API is the basid importer registration and requirements consist of administrative general certificates of company and specific requirements such as cetificate of location (domicile Letter)

3.2 Requirements for IP License (Importer Producer)

Import procedure of Producers can be exhibited in the following flow diagram that for each licenses there are several requirements. Producers will obtain API-P as importer registration to Ministry of Trade first. Then application should be prepared for recommendation from Technical Ministry related to goods to be imported.

In the mean time, administrative documents which are the same with those used in the process of API will be prepared again. Some additional documents are required as specific requirements such as import plan and statement letter. With all these three types of documents, application of IP is submitted. Usually the processing time of issueing the license is 5 to 7 working days when the documents are complete and satisfactory. After getting IP license, importer will check the requirement of Specific technical inspection before the shipment. Sanitary and Phytosanitary inspection (SPS) or other Techinical Barriers to Trade (TBT) and restriction of unloading port may be stipulated in the regulation. With these requirements in mind, importers are expected to prepare the import plan.

3.3 Requirements for IT License (Registered Importer)

General Importers inluding traders are expected to obtain API-U first, and then check requirements of IT of goods to be imported. If the goods are listed in the list of IT, check the requirements inluding Administrative documents, Specific requirements, and recommendations from technical ministries. Recommendations are issued in response to applications.

IT licenses are followed by SPI ( Import Permit) which requires administrative and Specific documents. Unlike IT, SPI is more specific to import. The requirements for SPI is more detail and

the validity of SPI is shorter then IT or by shipment. It is important to check the requirements of pre-shipment inspections and port restrictions. Technical inspection such as SPS are the same with the case of IP licensing.

Following these procedures, Requirements Table is laid out. Readers of the table will be able to get the overall idea of requirements and necessary points of preparations..

It should be reminded that this table deals with international trade and not domestic trade such as distribution permit or industrial standard. . There are several regulations to stipulate the control measures of domestic distribution. For information please consult with the related Ministries and Agencies.

3.4 Explanation of the Requirements Table IP and IT

TDP, NPWP, SIUP or IUI are listed as most common requirements. When these documents are required for the first time in the application of API, it is marked “O”. When these are required for the second time, as seen in the requirements of IP or IT, these requirements are marked “▼”. Grey background indicates these requirements are certificates issued by government agencies.

The Requirements Table indicates all the licenses in relation to goods to be imported and exported. Necessary documents are indicated in key words with maximum amont of information. There are colored cells which indicate inconsistencies as follows.

Yellow colored cell indicates that the requirement is indicated in the regulations but not in the website.

Blue colored cell in dicates that the requirement is in the website but not in the regulation

Requirements for each license are indicated in each row. Category of company whether the applicant should be producer or trader is indicated. This is related to the category of API-P for producer and API-U for trader. in the case of IP license, API-P holder is eligible as applicant. Next group of columns are administrative general requirements including API, TDP, NPWP and IUI for IP application. These are documents to certify the importer.

Then the next group of columns is specific requirements for goods to be imported. For Example, IP -Horticulture requires certificates of the storage and transportation means owned by the importer. In other IP, one year import plan or production plan are required. Statement letters and agreement documents are specific to goods, and these are explained in a separate chapter. (Chapter 5)

In many cases, recommendation from technical ministry is required in relation to policies of

goods to be controlled. Issuing ministries of recommendations are indicated in the columns in the right side. If the ministry is certain the cell is shaded, whereas the ministry is either of the two or three, the cell is left white. The required ministry is related to the purpose of the goods to be used.

3.5 Import Permit

In the case of IT license, SPI (.Import Permit) is required before actual import. Requirements for SPI are indicated in the table similar to the requirements of IP IT licenses. There are administrative requirements, other specific requirements and recommendations from related ministries.

Validity of SPI is indicated in the right side column. If the validity is not indicated and there is no name of ministry in the recommendation columns, there is no SPI required. Most of IP so not require SPI. (Please refer to the flow hart of IP Licensing Procedure. Figure 3 )

3.6 Requirements for Recommendation

Recommendations are issued in the form of letters and required often for IP, IT and SPI as indicated in the columns of recommendation. In order to apply for recommendation, there are requirements in addition to application form. There are two categories of requirements, namely general administrative requirements and specific requirements. The first category includes almost the same items with IP and IT. The second category of specific requirements includes items similar to some degree, such as Production plan, import plan and Statement letter.

Some requirements unique to the recommendation from Ministry of Industry are “production process report” and “import control card”. Production process reports are required for recommendations of Nitro-Cellulose, Hazardous material and Non B3 waste goods. Production process using imported goods should be explained with flow charts. Import control card is a record of import realization with total amount allowed. It is a confirmation of import plan and realization.

In the case that two recommendations are required, one ministry such as Ministry of Environment will issue a recommendation first, then the importer zattached this recommendation as a part of application to the Ministry of Industry for the second recommendation. This type of requirements is indicated in the far right column of the table.

There are available information documents in the ministerial regulations, DG decrees and website information. Collected Information is laid out in the table in the similar format of IP and IT. But unlike trade related licenses, recommendations are issued depending on the policy of ministries. Therefore it is advised that applicant should contact with issuing ministries so that requirements are confirmed. Transparency in Administration in Indonesia is still on the way.

4. Export Requirements

4.1 Export Licenses ET (General Exporter)

There are general provisions of export by 13/M-DAG/PER/3/2012, in which export of goods are grouped as follows:

(1) Exportable Goods

There are goods prohibited to export. Those goods are stipulated by regulations.

Among these procedures, business entity will generally take the procedure to obtain ET and export if goods are stipulated to obtain ET (Registered Exporter). In most cases ET requires SPE at times of actual export. The procedures are the same with the next section.

4.3 Specific Requirements - Related documents & Statement Letter

There are various types of Statement letters required in the process of licensing procedure. these letters are different in relation to the nature of importing goods and purposes. Here are brief introductions of statement letters including agreement letters, appointment letters. All of these are used as certificates for import.

4.3.1 Import related Statement letters and other documents

Statement Letter (Sugar) = Surat Keterangan Bukti Perolehan Tebu dari Asosiasi Petani Tebu Rakyat, Statement Letter about acquisition of sugarcane from Sugarcane Farmers Association

Statement letter (API-U) = A sealed letter from owner that stated having a special relationship with the company abroad

Evidence of Special Relationship is a document validated by Indonesian Embassy in foreign countries

Special Relationship with a company abroad, in the case of Producer Importer, is certified by either of the following documents validated by Indonesia Embassy (Trade Attaché) in the exporting country. The documents are contractual agreement to share control over an economic activity, Company share ownership, Company Charter, agency/distributor agreement, loan agreement, or supplier agreement. (59/M-DAG/PER/9/2012, Article 10)

Statement letter (PI)= Statement from API-P owner to do re-export, if certain industrial goods are imported not match with specified of goods in the Importer Producer

Temporary Permit = Izin Prinsip, Temporary Investment Registry Number

Statement Letter (IP-Salt Consumption) = A letter legalized by Industry District Agency that stated 50% production capacity procure from domestic salt producer.

Agreement Letter (IP-Salt Consumption) = Copy of cooperation agreement letter between domestic salt producer and importer, legalized by Industry District Agency.

Sales Contract (IT-Horticulture) = Evidence of horticulture products sales contract with at least with 3 (three) distributor for at least 1 (one) year;

Horticulture Distributor (IT-Horticulture) = Proof of experience as horticulture distributor at least 1 year.

Statement Letter (IT-Horticulture)= Sealed statement letter that stated the Horticulture Products will not sell directly to consumers or retailers.

Statement Letter (IT-White Plantation Sugar)= Statement letter from Sugar Association that stated 75% of sugar cane procure from the domestic farmers.

IT-Salt Industry use = Sales contract with industrial company that stated the salt use for supporting material in the production process.

Distribution License (IT-Multifunction color printer/ copier) = A letter from foreign principal of color multifunction machine, color photocopying machine, and color printing machine certified by Embassy of Indonesia and competent Notary Public.

Product Specification = Brochure, leaflet or other information about product specification.

Appointment Letter of Alcohol (Surat Penunjukan) = Letter from 20 (twenty) brand holder or factory to assign the importer to distribute their products. This letter should be validated by a Public Notary and Indonesian Trade Attaché or Consulate in the country of origin.

Statement Letter of Alcohol = A written statement from the manufacturer of goods or representatives of the brand holder that assigns the importer to be the distributor in Indonesia.

This letter should be legalized by Indonesian Trade Attaché or Indonesian Embassy in the country of origin.

Agreement Letter = Agreement of cooperation with Sub Distributor, Direct Seller or Retailer of Alcoholic Drink for minimum of 6 (six) provinces

Domicile Letter (Surat Keterangan Domisili) = A document to show the location of business entity by ownership of the location or lease agreement.

Pesticide Registration (Registrasi Pesitisida) = Approval of pesticide from the Ministry of Agriculture in the form of trial recommendation, temporary registration or permanent registration.

Import Realization Report= Laporan Realisasi Impor, reported quantity of goods that has been imported by importer as stated in the import permit or import license

Import Control Card = Kartu Kendali Import, A form of import monitoring sheet that consist of import data such as Import Declaration Number (PIB), Amount of commodity import, and remaining amount of commodity allowed to be imported. This form will be valid if its legalized by Customs and Excise officer at the entry port.

Business License (Surat Izin Usaha Angkutan Udara atau Laut) Business license related to the air or sea transportation

4.3.2 Export-Related specific documents requirements

Inspection Report = Berita Acara pemeriksaan oleh Tim Verifikasi dan Monitoring Kebijakan Ekspor Sarang Burung Walet, Inspection Report by the Export Verification and Monitoring Team of Swallow Nest

Quota Certificate = sertifikat yang memuat keterangan mengenai identitas eksportir dan importir, pos tarif, jumlah pisang atau nanas yang diekspor, Certificate consists of Exporter Identity, HS.Code, Amount

Export Contract = Kontrak Ekspor, Export Contract for Banana and Pineapple with Japan

Statement Letter (for Urea Fertilizer) = A letter from exporter to state that the exported urea fertilizer is not subsidized by government.
