3. No cash alternative will be offered in the scenario where an upgrade cannot be fulfilled due to lack of availability

4. Employees, staff and shareholders of Meliá or any associated or group companies, their respective families, agencies and suppliers and anyone connected with this prize draw are not permitted to enter this promotion.

5. Upgrade requests will be accepted via posts made on facebook and twitter. Requests must include the following information: the hashtag #upgradeME, the booking surname (the surname used to make the hotel booking), the arrival date, the hotel name (ie. ME Mallorca). Requests must be made between 00.00 (CET) on 1.04.2015 and 23.59 (CET) on 15.05.2015 (for ME Ibiza) and 31.04.2015 (for ME Mallorca). Requests received outside of this time period, or which do not include the hashtag, surname, arrival date and hotel will not be considered. Entry is free. Internet access and a valid account on Facebook and Twitter are required. Only one valid request per

social media account will be considered. Meliá reserves the right to exclude from the promotion those requests that it suspected to be dubious or fraudulent.

6. Meliá accepts no responsibility and will not be liable for the content (including any imagery or video) of any entry post/status/tweet. Meliá reserves the right to immediately remove any unsuitable, obscene or otherwise offensive comments, posts, imagery or videos using the hashtag #upgradeME or posted on ME by Meliá’s Facebook pages. Anyone posting such materials will automatically be disqualified from the promotion and may be blocked from Meliá’s social media pages at Meliá’s discretion.

7. Meliá will not be liable for any losses which result from the guest’s, negligence during the enjoyment of their upgrade.

8. By requesting an upgrade, the guests agree to participate in publicity relating to the prize draw for free on Meliá’s reasonable request. Such publicity is likely to include the guest names, images and comments being used in interviews and articles on social media and in media publications but this is not an exhaustive list. Guests agree that Meliá can use their names, any images taken of them and any comments made by the guest for the purpose of publicising the promotion without paying any fee to the guest (and the guest confirms that it has the right to allow Meliá to use these in this way).

9. Upgrades are subject to availability and in the scenario where a request cannot be fulfilled no correspondence will be entered into. Meliá reserves the right to cancel or amend the promotion or these terms and conditions at any time without prior written notice if circumstances beyond Meliá’s control make this necessary.

10. Meliá will not be responsible for any incomplete, lost or delayed requests or any requests that have not been validly submitted due to computer error or any reason which is beyond Meliá’s control. Proof of entry is not proof of receipt.

11. The only personal data that Meliá will process about each request entrant for the purpose of the promotion is their social media profile name and any imagery/videos uploaded in the request post. Meliá is not responsible for any losses resulting from inaccurate or incomplete personal data provided. Meliá will process all personal data fairly and lawfully in accordance with the principles of European data protection laws and only for the purposes set out in these terms and conditions. Guests should be mindful that the internet and their IT systems may cause loss of personal data and Meliá shall not be liable for any losses caused by IT errors or issues outside of Meliá’s control. Guests can retract their consent to Meliá processing their personal data by contacting Meliá via our below address or via email to [email protected]. Please note however, that Meliá will be unable to consider any requests any guest who retract their consent to processing.

12. By entering into this promotion, guests are deemed to accept these terms and conditions.

13. If any term in these terms and conditions is found by a court of law or other competent authority to be invalid, unlawful or unenforceable then this shall not affect the validity, lawfulness or enforceability of the remaining terms.

14. The promotion is governed by Spanish law and is subject to the exclusive jurisdiction of the courts of Palma de Mallorca (Spain).

15. The promoter is ME by Meliá, as part of Meliá Hotels International S.A (“Meliá”), Calle Gremio Toneleros 24, Palma de Mallorca, Spain. Spanish tax number: A-78304516.
