    On A p r i l 24, 2012, the Board of Supervisors h e l d a p u b l i c hearing a n d received p u b l i ccomment egarding a a i r of ordinances r e l a t e d t o r e g u l a t i o n of Medical Marijuana C u l t i v a t i o n .At the conclusion of the hearing, Board members rovided i n p u t o n the proposed ordinances,a n d requested that we b r i n g r e v i s e d ordinances t o the Board o n May 8 t " f o r f u r t h e rconsideration. S ince the May t " Board meeting, we h a v e continued t o receive n u m e r o u scomments a n d suggestions from the p u b l i c , a n d o n F r i d a y , May t" , had a very p r o d u c t i v emeeting w i t h our focus group .B a s e d o n the c o m m u n i t y feedback we h a v e continued t o receive a nd ou r own a d d i t i o n a lresearch, we a v e continued t o r e v i s e a n d u pdate the proposed ordinances. Revised d r a f t s ofthe proposed ordinances were released o n Friday afternoon. The rimary change s t o the A p r i l24t" versions are a s o l l o w s :

    a. The ordinances now allow f o r u p t o 100 s q u a r e feet of indoor c u l t i v a t i o n area o n a l lr e s i d e n t i a l a n d r u r a l p a r c e l s , regardless of the size or l o c a t i o n of the p a r c e l . To ddressp o t e n t i a l nuisance issues associated w i t h indoor grows, a d d i t i o n a l p r o v i s i o n s werea d d e d t o (a) e q u i r e t h a t a l l e l e c t r i c a l a n d plumbing work b e d o n e pursuant t o a v a l i d

Th e ordinances no w p r o v i d e t h a t a l l setbacks i l l be measured from the c u l t i v a t i o n areat o any l e g a l residence or "outdoor l i v i n g area" on an adjacent p a r c e l , and a newd e f i n i t i o n o f "outdoor l i v i n g area" has been added. I n a d d i t i o n , t h e requirement f o r asetback between the c u l t i v a t i o n area and a p r o p e r t y boundary has been removed.These changes are i n t e n d e d t o p r o v i d e a d d i t i o n a l d i s t a n c e between c u l t i v a t i o n areasand adjac ent residences and outdoor l i v i n g spaces, which i n t u r n f u r t h e r reduces t h ep o t e n t i a l f o r odor, s e c u r i t y , a e s t h e t i c and o t h e r nuisance impacts on the s u r r o u n d i n gneighbors.

    c . M o d i f i e s th e requirements o r r e s i d e n t i a l p a r c e l s as o l l o w s :For p a r c e l s t h a t are 2 acres o r l e s s , o n l y i n d o o r c u l t i v a t i o n i s a l l o w e d .This change r e f l e c t s a c o n t i n u i n g concern t h a t the l i v i n g spaces on s m a l l e rp a r c e l s ar e o f t e n i n close p r o x i m i t y t o each o t h e r and, h e r e f o r e , t h e r e i s ag r e a t e r l i k e l i h o o d t h a t surrounding neighbors w i l l be impacted by o d o r ,n o i s e , t r a f f i c , mold, e c u r i t y r i s k s and o t h e r p o t e n t i a l nuisances a s s o c i a t e dw i t h outdoor c u l t i v a t i o n . Keeping c u l t i v a t i o n i n d o o r s s i g n i f i c a n t l y reducesthe p o t e n t i a l f o r some o f these nuisances i n r e s i d e n t i a l neighborhoodsw i t h smaller l o t s .
